HomeMy WebLinkAbout940607.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #1612 - ADAMS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #1612, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #1612 was submitted by Wilma J. Adams, 19334 State Highway 392, Lucerne, Colorado 80646, for property which is described as Lot A and Lot B of Recorded Exemption #250, located in the NWI of Section 20, Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be 1.00 acre and approximately 74.873 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1612 submitted by Wilma J. Adams be, and hereby is, approved conditional upon the following: 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 2. Prior to recording the plat: a. The applicant shall submit evidence that an ISDS evaluation has been completed by the Weld County Health Department on all existing septic systems. b. The applicant shall grant or dedicate on the plat a 30-foot access and utility easement across Lot B for the benefit of Lot A. The applicant shall correct the illegal land split on Lot B of RE-0803-20-2-RE-250, which occurred on September 15, 1993, by Personal Representatives Deed recorded in Book 1401, Reception Number 02350459, by a corrected personal representative deed to indicate that Wilma J. Adams has one-half undivided interest in Lot B of RE #250. 3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. Adams RE-1612 An illegal land split has occurred on Lot B of RE-250. The split occurred on September 15, 1993, by Personal Representative's Deed, Book 1401, Reception Number 02350459, in which a part of Lot B containing 27.725 acres, more or less was granted to Wilma J. Adams and the remaining belongs to Donald Adams and the heirs of Robert C. Adams. To correct the illegal land split on above stated property a new recorded exemption application must be submitted, reviewed, approved, and all conditions met or a corrected personal representative deed to indicate that Wilma J. Adams has 1/2 undivided interest in Lot B of RE-250. Dear Commissioners: This request for a recorded exemption is submitted by Wilma J. Adams. The parcel of land on which this proposal is being made is described as Lot "A" of Recorded Exemption Number 250, located in the NW4 of Section 20, T6N, R65W of the 6th P.M. , Weld County, Colorado. The property is located within the Urban Growth Boundary areas of the City of Greeley and the Town of Eaton. The request before you is not the total contiguous land holdings of the applicant. This request is to divide a parcel into two lots, one of which is one acre, and the other 22.115 acres, more or less. The applicant stated in the application materials that the purpose for the proposed division is to provide an additional residential lot for a family member. The proposed 22. 115 acre parcel has an existing home which is served by North Weld County Water District and a septic system. Water is proposed to the one acre lot from North Weld County Water District, and sewage disposal would be provided by a septic system. The Department of Planning Services' staff recommends denial of this request based on the lack of efficient and orderly development. In 1977, the lot was created by RE-250 to divide 1/3 interest from the estate to make improvements on the property. This request, if approved, would allow for the addition of a dwelling on Lot A of RE-250, further intensifying the density of the uses on the property. The staff also has concerns about the creation of a land-locked parcel. An access easement would be required to serve the proposed one acre parcel if created. 940607 RECOMMENDATION, RE-1612 Wilma J. Adams Page 2 The applicant has not demonstrated that the proposal is in compliance with the future development plans, projected by the City of Greeley. The City of Greeley does not support approval of this request. The reason that was given for this decision is the concern that the overall gross density exceeds one dwelling unit per 20 acres in the area outside of the 2010 growth ring or long-range expected growth area. If the staff determines that the application does not meet the approval criteria, you will be notified and asked to appear before the Board of County Commissioners at a public hearing. You will be informed of the hearing date prior to the hearing. The Board of County Commissioners will then consider your application and make a final decision on the recorded exemption. Adams Dear Todd: As you requested on Friday, this letter is a follow-up to the May 2 letter the City of Greeley Planning Staff originally sent . It is my understanding from our conversations that the second house shown on the site plan is on a separate lot and not on either proposed lot . While we do understand that the application as now proposed shows only one house on the property, that fact will not change our recommendation based on Resolution 7, 1985 . Resolution 7, 1985 gave administrative review authority to the Greeley Planning Staff for review of recorded exemptions . I included a copy of the resolution with my May 2 letter for your information. The resolution provides that we can not recommend approval on any application where the overall gross density exceeds one dwelling unit per 20 acres in the area outside of the 2010 Growth Ring or Long Range Expected Growth Area. Since approval of this application would allow two homes on 23 . 115 acres located outside of our Long Range Expected Growth Area, we can not recommend approval of the request . Adams Recorded Exemption, and offer the following comments : RIGHT-OF-WAY The proposal does not address the existing right-of-way width along SH 392 . Projected traffic in that area indicates the need for a total of 150 feet of ROW, 75 feet each side of the highway centerline . Additional width to meet that projected need should be protected by reservation, or preferably, dedication as permitted by County regulations . ACCESS The proposal to add a single family residence at the site would increase traffic through the access to the main house. It appears that the access serves the two existing residences and the farm yard and agricultural uses . It is probable that the addition of a third residence would increase the traffic at the access by at least 20% . The access to the state highway is governed by the State Highway Access Code. The Code provides the Department an opportunity to re-evaluate access to the property upon an increase of traffic of at least 20% . As that appears to be the case, further explanation regarding possible requirements of changes is appropriate . This site borders a Category 3 portion of highway, which means that a single access point to the highway is appropriate if that property is not bordered by the general street system. The proposal indicates that two accesses currently exist for the Adams property. As it would be proper for only a single access to be allowed, the addition of a third residence may require the closure of one of the existing accesses . If this submittal does not indicate all of the contiguous Adams property or all of the Adams property accesses, that information should be provided for our review.
