I --", i. -'. ._▪ -4.-___ - __':13S§ :lEEo 3.q4._ . :. ~ tii"54 ,`�.�1� I _ . .. -I _.L.....,. -ice_ _ .. ., €-. _. ._.....-----1---I- :'iNJ 11) RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION N0. 1373 - TRAVELERS INSURANCE/WILLIAM AND SHARON MEHL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1373, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption No. 1373 was submitted by Travelers Insurance and William and Sharon Mehl for property which is located in part of the Ez of Section 14, Township 4 North, Range 68 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 3.09 acres and 185.06 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1. A Weld County septic permit is required for the proposed home and its septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 2. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. The parcel of land is described as Lot B of Amended Recorded Exemption #341 located in the E2 of Section 14, T4N, R68W of the 6th P.M. , Weld County, Colorado. The property is located south of Weld County Road 78 and approximately 3/4 mile east of Interstate 25. This is the total contiguous land holdings of the applicant. The applicant proposes to use Little Thompson Water District as a water source. Individual septic systems will provide sewage disposal. The Department of Planning Services' staff recommends that this request be denied. Continued divisions of this property will evade the purpose of the Weld County Subdivision Regulations. This property has been the subject of two previous recorded exemptions. In 1978, RE-341 separated off an 11.266 acre parcel in the northeast corner of the farm. In 1979, Amended RE-341 expanded the size of the 11.266 acre parcel to 20 acres, more or less. In 1987, the 20 acre parcel was further subdivided by RE-1006, into parcels of 19 acres and one acre, more or less. In 1981, James Davis sold Lot B of RE-341 containing 211.565 Acres to William and Sharon Mehl and Robert and Barbara Lewis as tenants in common. In 1982, Mehl and Lewis further subdivided the farm by conveying three parcels to Robert and Barbara Lewis. Two of the three parcels conveyed are under 35 acres and therefore are considered illegal landsplits. The 211.56 acre farm is currently divided into 5 different parcels. Three of those parcels are illegal, including the 3.3 acre parcel which is the subject of this recorded exemption. 911171 Travelers Insurance/William and Sharon Mehl October 2, 1991 Page 2 Continued divisions of this parcel will evade the purpose of the Weld County Subdivision Regulations. If this application is approved, there will be four legal parcels where prior to 1978 there was one. These parcels access onto Weld County Road 46 which is a gravel road. Residential development in rural areas necessitates an increased demand for road maintenance as well as police and fire protection, school busing, snow removal, utilities and other urban type services. It is the opinion of the Department of Planning Services' staff that this proposal is inconsistent with efficient and orderly development and is not consistent with the intent of the zone district. The creation of a residential parcel which is totally surrounded by a large agricultural tract could create future conflict between residential and the agricultural uses which are allowed by right. The applicant has failed to demonstrate how this application is consistent with the agricultural goals and policies of the Weld County Comprehensive Plan. It is the opinion of the staff that the purpose of the recorded exemption process is not to correct mistakes made by property owners and lending institutions. The purpose of the recorded exemption process is to allow efficient and orderly development in accord with the established regulations. It is also the opinion of the staff that no individual or organization should benefit from violating the Weld County Subdivisions regulations.The staff requests that the Board of County Commissioners consider the application and determine if the standards of Section 9-2 E. I understand from Brian Grubb, current Planner, that the Commissioners will be addressing this Exemption in its meeting on October 2, 1991 and that the staff has issued a preliminary letter to the Commissioners recommending that the request be denied. On behalf of Travelers I have reviewed the preliminary letter of September 25, 1991 from Mr. Grubb and wish to bring a few things to your attention in your consideration of the Exemption request. The Travelers made a loan to James Davis on June 4, 1979 . That loan was secured by Lot B of RE #341 less the 20 acre parcel in the northeast corner of the farm. The sale in 1981 from Davis to Lewis and Mehl was subject to the Travelers Deed of Trust. The Travelers loan was personally assumed by the Mehls in April of 1981. In 1982 , The Travelers partially released the lien of its Deed of Trust for 2 parcels. One of the released parcels was Lot A of Recorded Exemption No. 1061-14-1-RE-341. The second partially released parcel was approximately 3 . 3 acres, which was represented to Travelers by the Mehls as another Recorded Exemption which was being approved by the County of Weld. I enclose a Recorded Exemption map which was furnished to Travelers at the time of the partial release which evidenced to Travelers ._4 P-71 • ROTHGERBER, APPEL, POWERS & JOHNSON Board of County Commissioners September 30, 1991 Page 2 that the lot would be further divided into a Lot A and Lot B. Apparently, this Recorded Exemption was never accepted by the County, although Travelers was not aware of that fact until recently notified by the Planning Department. Travelers partially released its Deed of Trust to enable Mr. Mehl to build a house on the new "Lot A" , as described in the enclosed map. In 1985, Travelers foreclosed on its lien, obtaining a Public Trustee's Deed pursuant to court order to Lot B of the attached map. Travelers had leased the property for a period of time and recently determined to sell the property. Upon Travelers' closer scrutiny of the property to be sold, it became clear that the home shown on the attached map was not built in the proper area. The home built by Mr. Mehl was to the south of "Lot A" , meaning that only a small portion of Mr. Mehl's home was actually located on the lot he owned free and clear of Travelers' Deed of Trust. In actuality, all but the garage of Mr. Mehl's home was located on Travelers' property. To make matters worse, Mr. Mehl had obtained a loan from Security Pacific Financial Services and had pledged "Lot A" as collateral . Therefore, Security Pacific had a piece of collateral with no improvements and The Travelers had a major encroachment upon its remaining property. The Exemption Request which was submitted to Weld County was designed to relocate Lot A to its proper position. In conjunction with that relocation, Travelers has executed a Deed to Mr. Mehl of the revised "Lot A" . Mr. Mehl has executed a Quit Claim Deed to Travelers conveying his interest in the old Lot A. It was not until I spoke to Brian Grubb that Travelers was aware, in any way, of the previous illegal subdivisions. Based upon these facts, we believe that the assumptions of the Planning Department upon which its recommendation was based are incorrect in some respects. The first paragraph of the second page of the recommendation expresses concern over continued division of this parcel and increased demand for road maintenance, as well as police and fire protection, school busing, snow removal , utilities and other urban-type services. In fact, this home has been on the property for approximately ten years. If no increased demands have been felt yet, the correction of this improper lot line will certainly do nothing to increase those demands in the future. The preliminary recommendation also indicates that the staff's opinion is that no individual organization should benefit from violating the subdivision regulations. We agree with that position; however, in this circumstance there certainly was no knowing violation of any exemption requirements by either Qi r w w ROTHGERBER, APPEL, POWERS & JOHNSON Board of County Commissioners September 30, 1991 Page 3 Travelers or Security Pacific. In fact, Travelers was provided a Recorded Exemption map to document the fact that all procedures were being properly followed. Travelers' good faith belief that the exemption had been approved and placed of record was its only shortcoming in this process. In total, the Lot A and Lot B in the Recorded Exemption map attached hereto comprise about 150 acres. The division of this large parcel into one of 3 acres and one of the balance has not created any additional demand for services and has not created r _ t„ a..h o over the past e years uiiy increased density �^. �.,� area t. .� � a ten � a_s an should not do so in the future. Even with the prior illegal subdivisions (of which Travelers had no knowledge) the 211 acre farm would be, at most, divided into 5 parcels. That is an average of over 42 acres per parcel which, again, has not and will not create any type of increased demand upon County services in the area. In conclusion, both Travelers and Security Pacific are attempting to work through the exemption process in good faith. The previous representations of Mr. Mehl to Travelers have been reasonably relied upon by Travelers. We trust that the Commissioners will respect the good faith of Travelers, realize that this Recorded Exemption will not create any increased demand upon Weld County services, in any way, and see fit to approve the subdivision exemption. Mehl prepared a description for a 3 . 09 acre parcel within Lot B, Recorded Exemption 1061-14-1-RE341, for the sole purpose of financing a new home . That 3 . 09 acre parcel was released from the loan on Lot B, RE341, resulting in two separate loans . One on the balance of Lot B, RE341 and one on the new home on the 3 . 09 acre parcel . Subsequently, Travelers Insurance Company, the lien holder on Lot B, RE341, foreclosed upon Lot B, RE341 and became the owner of same . The result is that the 3 . 09 acre parcel is now separated from Lot B, RE341 which has created a parcel in violation of Weld County Subdivision Regulations . It is the desire of the parties to properly plat and process this 3 . 09 acre tract to bring it into compliance with the Regulations . 5. This proposed split is consistent with the policies of the Weld County Comprehensive plan . 6 . This proposal is consistent with the intent of the zone district in which the subject property is located . When the 3 . 09 acre parcel was described for financing, Mr . Mehl farmed the remainder of Lot B, RE341, with the small parcel being his residence . 7 . Lot A of this recorded exemption will be used for single family residential purposes and Lot B will continue to be used for agriculture . 8 . The surrounding area is comprised of agricultural uses, specifically farming . Most of the adjoining farms have a residence on them consistent with this farm. Future uses of this property and the adjoining properties are projected to continue to be agricultural uses much like those currently in place . Therefore this property is compatible with the comprehensive plan and is outside the master plan area of the nearest municipalities . 9 . The proposed recorded exemption will not be inconsistent with efficient and orderly development because the uses are in place and have been since 1982 . The necessary building permits have been granted in the past and no change in the present uses is proposed . 10 . The proposed Lot A is served by septic system.
