RE: APPROVAL OF RECORDED EXEMPTION 111587 - COFFAN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held
in the Chambers of the Board, that a certain parcel of land, to be divided into
two parcels, as shown on the plat known as Recorded Exemption #1587, does not
come within the purview of the definition of the terms, "subdivision" and
"subdivided land", and
WHEREAS, the request for Recorded Exemption #1587 was submitted by Robert
and Simone Coffan, 2871 Weld County Road 10, Erie, Colorado 80516, for property
which is located in part of the SE of Section 9, Township 1 North, Range 68 West
of the 6th P.M. , Weld County, Colorado, being more particularly described in the
plat which shall be provided by the applicant and known as Exhibit "A", said plat
to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 1.26 acres and 0.57 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby
is, exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that the 0.57-acre parcel be, and
hereby is, exempt from the one-acre minimum requirement.
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1587 submitted
by Robert and Simone Coffan be, and hereby is, approved conditional upon the
following:
1. The following notes shall be placed on the Recorded Exemption plat
prior to recording:
a. A Geologic Hazard Development Permit will be required for any
new construction or substantial improvement of existing
structures in the Geological Hazard Overlay District located
on the property.
b. The 0.26 acre, more or less, septic easement located on Lot B
for the benefit of Lot A is permanent and shall continue in

3. Prior to recording the plat, any existing septic system which is not

require an Individual Sewage Disposal Evaluation.
4. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County
Clerk and Recorder. The plat shall be prepared in accordance with
the requirements of Section 11. 7 of the Weld County Subdivision
Ordinance. The plat shall be submitted within sixty days from the
date of approval by the Board of County Commissioners. The
applicant shall be responsible for paying the recording fees.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 14th day of March, A.D. , 1994.

1. The following notes shall be placed on the Recorded Exemption plat prior
to recording:

Dear Commissioners:
Our neighbors, Robert and Simone Coffan are requesting a recorded
exemption from Weld County for their property at 2871 and 2861
WCR 10, Weld County, Colorado.
We understand that the exemption will subdivide the property
along the current fence lines, allowing both homes to exist as
separate, taxable lots.
We are in favor of this exemption. Both homes have been here for
many years. This exemption will not contribute to any further
subdividing of property in our area . Rather, it will more
clearly define the actual property lines which are currently
respected and have been for many years. The exemption will also
allow both homes to be owner-occupied if desired. Allowing the
choice for each home to be owner-occupied will encourage the
responsible use and maintenance of each home.
In general , we agree with the policies governing property
subdivision in our county. However we feel that this is an
exception to the rule and ask that you grant the exemption.

Dear Commissioners:
This request for a recorded exemption is submitted by Robert and Simone Coffan.
The parcel of land on which this request is being made is described as part of
the SE4 of Section 9, TiN, R68W of the 6th P.M. , Weld County, Colorado. The
property is located north of and adjacent to Weld County Road 10 and
approximately 600 feet west of Weld County Road 7. The request is to divide a
1.83 acre parcel into 1.26 and .57 acre parcels. A residence exists on each
proposed parcel.
Left Hand Water District serves both lots. Individual septic systems are
existing. The Board of County Commissioners must determine, however, if it
wishes to grant an exemption from the minimum one acre requirement prior to
approval of the Recorded Exemption. The Weld County Health Department has
indicated no objection to the creation of a .57 acre lot provided that a portion
of the larger lot be established for use as a permanent septic easement for
future repair, if needed. The applicant's plot plan designates an area on the
1.26 acre parcel for this purpose.
One access from Weld County Road 10 serves both parcels. The proposed large lot
has no frontage to the road as it is situated directly behind or north of the
small lot. An existing chain link fence physically divides the property. The
Department of Planning Services' staff has concerns about the driveway and septic
easement occupying the same ground (see plot plan) .
The subject site is located within the Urban Growth Boundary of both Erie and
Frederick. The Town of Erie has no objection and the Tri-Area Planning
Commission recommends approval of the request.
The Coffan property is located in a Geologic Hazard Overlay District of the
County. James M. Soule of the Colorado Geologic Survey, with whom the applicant
consulted, recommends conditional approval of this recorded exemption because
there will be no change in land use on the property.

The Department of Planning Services has concerns in recommending approval of this
proposal. The staff requests that the Board of County Commissioners consider
this request and determine whether the recorded exemption standards of the Weld
County Subdivision Ordinance have been satisfied.

This proposal does not meet the requirements for a Recorded Exemption because the
applicants are requesting Lot A to be less than the minimum lot size of one acre.
Section 11.8.5 of the Weld County Subdivision Ordinance states that such a
request may only be approved if the Board of County Commissioners wishes to
exempt the proposed subdivision from the minimum one acre requirement.
Therefore, approval of lot size exemption is necessary prior to granting the
Recorded Exemption.

Subject: Robert Coffan: Proposed Recorded Exemption
Robert Coffman called and asked if the Division could recommend for approval of
a subdivision for a lot of less than an acre. He is proposing to divide his lot
into two lots of .57 and 1.23 acres. I informed him that it is the policy of the
Division to recommend against approval of subdivisions with lots less than one
acre. The lots have heavy soils and there is concern about adequate space to
make repairs in the future in the event of failure. He offered to pursue an
easement on the larger property which would be dedicated for future repairs to
the septic system on the smaller lot. Given the conditions at this site, I told
him that an easement that provided an overall total of at least .75 acres would
provide an adequate safeguard for future failure. Therefore, the staff would be
able to recommend approval of such a proposal on the condition that such an
easement is attained. If you have any questions on this matter, call me at 353-

Mr. Soule:
I appreciated our phone conversation this morning. It was enlightening, and I am
looking forward to reading the paper that you are sending me.
As we discussed, I am sending my pending application for exemption in Weld County
directly to you to see if you feel there are any problems, and if I truly do have to go
through the rigorous Geologic Hazard review.
Briefly:
The exemption concerns a 1.8 acre parcel of land that has had 2 homes on it
for almost 30 years. There are other homes in the immediate vicinity. No
physical changes whatsoever are planned for the property. The property
already has 2 separate electrical lines (on 2 different power poles), 2 water
taps, 2 septic systems, and 2 gas meters. My request is a paperwork change
only.
A copy of my entire application is enclosed. This larger scale diagram locates my
smaller scale map for you in the area.
Thank you again for considering this. I would certainly appreciate a written and/or
verbal exemption from you indicating that the Geologic Hazard process is not
necessary for my request. Please call me if you have any other questions or
concerns.

At the request of Mr. Coffan, I have quickly reviewed his subdivision proposal. As this will
result, effectively, in no changed land use, our review of the proposal would serve no useful
purpose at the present time. Consequently, we recommend that you exempt him from the
requirements of Senate Bill 35 (1972) at this time. If, however, any new construction on, or
resubdivision of, or sale of these lots is proposed in the future, then the statute would apply
and the proposal should be reviewed by this agency prior to your approval of it.

1. Explain the reason for the proposed recorded exemption and how each
proposed lot will be used.
In reality, this property has been divided into two, unique
homesites, as shown on the map, for over 25 years. This
application for exemption is simply to update records to show
that reality. There will be no change in use for either lot.
Both will be used for single family residential dwelling.
2. Describe the location, size and present use of the area where each
proposed new lot will be created.
The smaller (o. 57 acres) lot adjacent to Rd 10 is presently
used as a primary dwelling; and has been used as such at least
since 1965*. ( exibit A) . The larger (1. 26 acres) lot to the
north is also presently used as a primary dwelling and has been
used as such since at least 1978. Old photographs at the

3. Explain ow t e proposal is consistent with the Weld County Comprehensive
Plan and any adopted municipal plan, if applicable.
The only concern with the exemption thus far has been from the
County Health Department regarding the size of the smaller lot
2861 in the event of a septic system failure, though the septic
system is new and adequately sized. An easement would be created
on the larger lot ( see map) offering u to 0. 26 acres for the f

surrounding the proposed recorded exemption.
The parcels are located in an area of other rural residential
dwellings. Rd 10 from Rd5 to Rd7 and Rd7 from Rd10 to Rd8 are
lined with 27 homes.
Though the smaller lot is less than 1 acre, it is large enough
to be consistent with current, local land use, and has been
used this way for many years.
5. Explain how the proposal is consistent with the intent of the zoning
district it is located within.
One intention of zoning in the area is to curtail the subdivi-
sion of parcels for new, high density, residential growth.
Granting this application will not change the existin-g density
at all. All water, gas, electrical, and septic systems are
currently in place and in use.
( see attached photocopies from utilities)
6. Explain how the proposal is consistent with efficient and orderly
development.
As explained above, there is no new development associated
with this application. It would be a change on paper only,
and would provide a separate tax lot for the economic base
of the county.
7. Explain how adequate provision for the protection of the health, safety,
and welfare of the inhabitants of the neighborhood and the County will be
accomplished.
Little would change in the neighborhood. Local welfare may improve
due to better responsibility of two, individual lots.
