RE: ASSESSMENT OF COSTS OF IMPROVEMENTS FOR WELD COUNTY 83RD AVENUE LOCAL
IMPROVEMENT DISTRICT N0. 1991-1
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
o O WHEREAS, in accordance with CRS, Section 30-20-607, as amended, a statement
of expenses and apportionment has been filed with the Weld County Clerk to the
o Board by the Weld County Engineer, which is attached hereto as Exhibit A, and

o WHEREAS, pursuant to CRS, Section 30-20-608, there has been proper notice

0 w of this hearing and of the costs of the improvements, and the share to be
assessed to each lot, and

W WHEREAS, the Board of County Commissioners finds that the properties
o described herein, which includes those properties described in the Exhibits B,
w C, D, and E, to the Petition which are attached hereto and incorporated herein
by this reference, have been specifically benefitted by the construction of the
ti improvements authorized under the Resolution of June 19, 1991, for the following

m a A. The market value of each of the properties will increase;

m Z B. The proposed improvements will adapt the property to a more
w profitable use;

w C. There will be an alleviation of fugitive dust, eliminating the
o a health hazards to the benefitted properties and to users of the
w public roads to be improved;

cr.� 2 D. The alleviation of fugitive dust will reduce maintenance costs to
the subject properties and paving will lessen the maintenance
V required for a public road; and
E. The proposed improvements will facilitate access to each of the
N properties and thereby increase the convenience of the use of said

m w WHEREAS, copies of the Resolution creating this Local Improvement District
have been provided to the Division of Local Government and the Weld County
Treasurer and Assessor, and
WHEREAS, at the time and place set forth in the notice, the Board of County
Commissioners met in open session for the purpose of hearing and considering any
complaints, objections, and protests that might be made against the proposed
assessments and there being no protests, complaints, or objections, and

WHEREAS, the Resolution shall be prima facie evidence of the fact that the
property assessed is benefitted, the amount of the assessment, and that the
assessment has been lawfully levied.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado:
A. That a local improvement district for the construction and
oo v installation of street improvements, to include shaping, grading,
o drainage, preparation of the base and grading, compaction, and
.
N o paving, together with any necessary incidentals on a certain County
V Road as hereafter described, was created and established in
q accordance with the laws of the State of Colorado, and is known as
o �� "Weld County 83rd Avenue Local Improvement District No. 1991-1."
o All proceedings heretofore taken by the Board of County
o x Commissioners and the County staff and then adopted in connection
Q with the district are hereby ratified, approved and confirmed. The
proposal to create said district was initiated by the Board of
County Commissioners by Resolution of April 17, 1991, upon a
d a petition, proper in form, subscribed by a majority of the owners of
property who will bear the cost of more than 1/2 of the total

%.o proposed assessment in the district and notice duly given as
x heretofore stated.

m V B. That the property to be assessed for said improvements shall be the

properties specifically benefitted by said improvements and more
o particularly described as follows:

m The area to be included within the district includes those

o properties described in Exhibits B, C, D, and E to the Petition,
rn w which are attached hereto and incorporated herein by this reference.

z C. That the Statement of Expenses and Apportionment, attached hereto
cNy g and incorporated herein by this reference as Exhibit A, has been
o „ submitted based upon the fact that there has been completion of the
a: g entire local improvement as previously authorized.
M D. That the assessment, as set forth in the attached Exhibit F (Table
o of Proportionate Mined Acreage and Cost) , per lot or parcel being
rn o levied for the improvements shall be due and payable within thirty
w (30) days after the effective date of this assessing Resolution.
However, all such assessments may be paid at the election of the
owner in ten (10) equal annual installments of principal together
with installments of interest on unpaid installments at an interest
rate of nine percent (9%) simple interest per annum. The first of
said installments of assessment shall be due and payable at the same
time as ad valorem property taxes for the year 1991, due and payable
in 1992, and similarly in each successive year thereafter until all
are paid in full.

E. Cost of the improvements assessed to property within the District is
$124,640.00.
F. The Clerk to the Board shall prepare a local assessment roll, in
cooperation with the Weld County Treasurer and Accounting
Department, in a form showing in suitable columns, each parcel of
land assessed, the total amount of assessment, the amount of each
0 U installment of principal and interest if, in pursuance of Part 6 of
o Article 20 of Title 30, CRS, the same is payable in installments,
en o and the date when each installment will become due, with suitable
v columns for use in case of payment of the whole amount or of any
o installment or penalty, and shall deliver the same, duly certified,
o saj under the County seal, to the County Treasurer for collection.

o x G. Failure to pay the whole assessment prior to January 1, 1992, shall
� 0be a conclusive determination and held to be an election on the part
a
0 of all persons interested, whether under disability or otherwise, to
Wpay in such installments. All persons so electing to pay in
a installments shall be conclusively held and considered as consenting
to said improvements. Said election shall be conclusively held and
io considered as a waiver of any right to question the power or
" w jurisdiction of the County to construct the improvements, the
quality of the work, the regularity or sufficiency of the
a� u proceedings, the validity or correctness of the assessments, or the
m z validity of the lien thereof.

ro Ew+ H. That all Resolutions or parts thereof in conflict with this
~ a Resolution are hereby repealed.

rn w I. Failure to pay any installment, whether principal or interest, when

N 2 collectible immediately, and the whole amount of the unpaid
<v r� principal and accrued interest shall thereafter draw penalty
o interest at the rate of one percent per month from the first day of
w a May until the day of payment, or until the day of sale. In
x computing the amount of penalty interest due under this section, any
v portion of a month shall be counted a whole month.

H o J. That all Resolutions or parts thereof in conflict with this
p w Resolution are hereby repealed, but all portions of the Resolution
indicating the intent to create the District not in conflict with
the provision of this Resolution are re-enacted as if set forth
herein.
K. The effective date of this Resolution shall be December 1, 1991.

The paving on 83rd Avenue was performed under contract by Coulson Excavating
Company, Inc. , and the final payment was made on August 22, 1991, in the amount
of $147,152.93. The Improvement District is to pay for paving only and not
base course and shoulder work.
The items in the contract relative to paving were hot bituminous pavement,
tack, sweeping, and section corner boxes. Those items totaled $125,480.93.
o O In accordance with the petition the cost of the improvements cannot exceed
o $124,640.00. Therefore, the proportionate cost to be assessed to each parcel
n o should be as follows:

ssnecc83rd Avenue Local Improvement District Assessment Hearing
The paving on 83rd Avenue was performed under contract by Coulson Excavating
Company, Inc. , and the final payment was made on August 22, 1991, in the amount
of $147,152.93. The Improvement District is to pay for paving only and not
base course and shoulder work.
The items in the contract relative to paving were hot bituminous pavement,
tack, sweeping, and section corner boxes. Those items totaled $125,480.93.
In accordance with the petition the cost of the improvements cannot exceed
$124,640.00. Therefore, the proportionate cost to be assessed to each parcel
should be as follows:

Dear Mr. Hall:
As a property owner, you are probably aware that there are efforts to
improve 83rd Avenue (aka Weld County Road 27) between U.S. 34 Business
route and "0" Street (aka Weld County Road 64) .
This is to notify you that a meeting with the Board of County
Commissioners concerning the Local Improvement District will be held at
10:00 a.m. on Wednesday, May 8, 1991, in the First Floor Hearing Room,
Weld County Centennial Center, 915 Tenth Street, Greeley, Colorado. The
purpose of this meeting will be to consider the adoption of a preliminary
order and preliminary plans and specifications, which would describe the
materials to be used, the number of installments and the period of time in
which the cost of improvements shall be payable and the property to be
assessed. The preliminary order will also contain the cost estimates and
approximate amount to be assessed on each property. A great deal of this
information is now contained in your petition.
You are encouraged to make your feelings known either through your
appearance at the meeting, through a power of attorney to another person
so that he may testify on your behalf, or you may submit a letter, prior
to the hearing, to the Board of County Commissioners, P.O. Box 758,

STATEMENT OF COST; AND PORTION TO BE ASSESSED UPON EACH LOT
Docket No. 91.-28
All owners of real estate and property hereinafter described and all
persons generally, are hereby notified that the Board of County
Commissioners of Weld County, Colorado, has received a Notice: of
Completion, Statement of Expenses, and Apportionment regarding the Local
Improvement District within unincorporated Weld County, Colorado,
designated as Weld County 83rd Avenue Local Improvement District No.
1991-1, all in accordance with the laws of the State of Colorado. The
property within the Local Improvement District is described as follows:
Portions of the NI of the SI, the Si of the NI and the NW,' of
the NW! of Section 31, and the Nl and the N? of the Sz of
Section 32, all in Township 6 North, Range 66 West all in
relation to the 6th Principal Meridian in an unincorporated
portion of Weld County, Colorado, in an area generally north and
west of the inhabited portions of Greeley, Weld County,
Colorado, alongside the Cache LaPoudre River and south of "0"
Street, also known as Weld County Road 64, and on either side of
83rd Avenue, also known as Weld County Road 27.
1. All persons are further notified that the whole cost of the
improvements as has been completed is to be $124,640.00 which
excludes any casts which have been assumed by the County in terms of
engineering and administrative fees. The costs to be apportioned to
the landowners are the costs of the labor and materials for
installation of hot bituminous pavement and base preparation which is
to be apportioned among the four parcels in an apportionment as shown
in the attached Table of Proportionate Mined Acreage and Cost._ No
portion of the costs will be paid by a district-wide sales tax.
2. Any owner of the affected lots may file a complaint or objection in
writing addressed to the Weld County Board of County Commissioners,
915 10th Street, P.O. Box 758, Greeley, Colorado 80632, which
objection must be filed within twenty (20) days from the publication
date of this notice. Any complain_ or objection properly made will
be heard and determined by the Board of County Commissioners before
the passage of any Resolution assessing the costs of the
improvements.
3. The hearing where such complaints or objections will be heard will be
on the 20th day of November, 1991, at or about 9:00 a.m. , in. the
First Floor Meeting Room of the Centennial Center, 915 10th Street,
Greeley, Colorado.
