Dear Mr Cervi: Thank you for your letters of April 15 and May 3. Planning Department staff has reviewed your requests to locate three to five additional frac tanks on the property as part of the skimming process and to activate the mister on Pond E. Planning staff has determined that the use of the mister on Pond E would not be appropriate at this time. Agreements were made in the past as to the misters/aerators on the ponds and a procedure was agreed to as to how and when these could be installed. It is also my understanding that this process to install a system has been started. Planning Department staff is still unclear as to the reasons why there Is a need for the additional frac tanks based upon the representation of the new equipment that has been installed on site. Please provide additional written information documenting this need. When this information is provided, staff will review this further. Please call or write me if you have any questions. The purpose of the inspection was to inspect and assess the facilities compliance with the "Regulations Pertaining to Solid Waste Disposal Sites and Facilities", as promulgated by the Solid Waste Disposal Sites and Facilities Act, Title 30, Article 20, part 1, C.R.S. , as amended, and the Development Standards set forth in the U.S.R. - 5'2:0:83:3. On this date, the following conditions were observed and the above referenced facility is not in compliance with the Regulations. The areas of non- compliance/concern are as follows: According to Development Standard I - " The evaporation pond(s) shall be kept free and clear of oil skims". (1) Pond C surface impoundment was covered with approximately 33% scum. This is a violation of section 9.7.5 of the Regulations. In addition, erosion of the embankments on impoundment E have not been repaired. Appropriate actions to repair the damage was requested by the Division in a letter to you dated May 25, 1993. Provide a schedule which states when liquids will be removed (ie. pumping or evaporation) and repair work will commence. If the liquid is to be eliminated through evaporation, provide calculations which support your case. These conclude the Division's comments regarding the inspection of this facility. Please respond, in writing, to each of the aforementioned items within 30 days of the receipt of this letter.
