RESOLUTION TO SIGN AGREMENT WITH
STATE HIGHWAY DEPARTMENT REGARDING
PROJECT S-0034 (2) & S0057 (1)
WELD COUNTY.
BE IT RESOLVED, by the Board of County Commissioners, Weld County
Colorado that they sign agreement with the Colorado Department of Highways
dated October 31, 1952 whereby the County obligates itself to participate
in the cost of Federal Aid Secondary Project S 0034 (2) & S 0057 (1), to
consist of improvements on State Highway Nos. 257 & 392, Windsor-Lucerne,
as per the terms of said Agreement, and authorized the execution of
said Agreement on behalf of Weld County by signatures of the entire Board.

AGREEMENT TO PARTICIPATE
IN THE COST OF HIGHWAY IMPROVEMENT
THIS AGREEMENT entered into this 31st day of October, 1952, by and between
THE STATE HIGHWAY COMMISSION OF COLORADO, a public corporation, for the use and
benefit of the DEPARTMENT OF HIGHWAYS of the STATE OF COLORADO, hereinafter called
the "Department", and the COUNTY OF WELD, hereinafter called the "County",
WITNESSETH that
WHEREAS the Department has included in the Budget for 1952, dated December
15, 1951, a Federal Aid Secondary Project, designated as S 0034(2) & S 0057(1), to
consist of improvements on State Highway Nos. 257 & 392, Windsor-Lucerne, for
which the sum of $148,000.00 has been allocated, and in which the County has previ-
ously agreed to participate to the extent of twenty-two (22) percent of the cost of
the project,
NOW, THEREFORE, in consideration of the premises and the mutual covenants
and agreements herein contained, and the faithful performance thereof, the parties
hereto promise and agree as follows:
1. The Department will prepare the plans, specifications and estimates
for the work, will advertise for bids, will award the contract, prepare the monthly
and final estimates, and pay the contractor according thereto. Also the Department
will arrange for the force account work by railroad, utility and irrigation
companies.
2. The County will secure at its own expense all right of way required for
project, as indicated by right of way lines shown on project construction plans.
3. It is the intent of this Agreement that the County will reimburse the
Department, in the amount of twenty-two (22) percent of the final cost of the
Project, exclusive of right of way, and with the understanding that the charges
for engineering will not exceed six (6) percent of the construction cost. If after
bids are received it appears that the final cost will be materially in excess of
the budgeted amount above named, any obligation of the County in excess of
$32,560.00 will be subject to negotiation.
4. The Department will submit each month a statement covering twenty-two
(22) percent of the cost of the construction work on the project as represented by
the progress estimate paid to the contractor. This will not include any charges
for engineering, which charges will be billed when the project is completed and
final estimate made. The County agrees to promptly pay approved statements
submitted as per this paragraph.
5. The County further agrees that when the project is completed and ready'
for traffic, the County will maintain the same in a satisfactory manner, and if
said project is not so maintained the Department is authorized to do said main-
tenance with its own forces and to bill the County for the cost thereof. If pay-
ment is not made within thirty (30) days after receipt of said bill or bills, the
State Treasurer is authorized and requested to transfer to the State Highway Fund,
from the County's apportionment of the Motor Vehicle Fees, Chapter 16, C.S.A.
1935, and the Motor Fuel Taxes, Chapters 128 and 130, S. L 1947, sufficient funds
to cover the delinquent payment or payments.

6. This agreement shall not be deemed valid until it shall have been
approved by the Controller of the State of Colorado, or by such assistant as he
may designate.
7. This Agreement shall be binding upon and inure to the benefit of the
successors and assigns of the parties hereto, respectively.
8. This Agreement is executed under authority of Sections 6, S. B. No.
1, approved February 14, 1952, and with reference to the signatories on behalf of
the County by virtue of a resolution passed at a meeting of the Board of County
Commissioners held on ,44,G,.„4c„., jC , 1952, a certified copy of which is
attached hereto.
IN WITNESS WHEREOF, the parties hereto have caused the foregoing Agreement
to be executed the day and date first above written.

We enclose seven copies of agreement dated October 3L.
1952, between Weld County sed this Departkent covering
construction of Project 3 00 4(2) and 3 0057(1).
3. H. Nei. 257 and 392, Windsor-Luearae with the Comity
participating to the extent of 22% of the cost of the work,
now estimated to be $140,000.00.
Please have the County sign and return five copies of the
agreement with the customary resolution along with the
attest and seal of the County Clerk. The remaining two
copies may be retained by yourself and the County, pending
return of the executed agreement.
