RE: APPROVE SERVICE AGREEMENT WITH THE ENGINEERING COMPANY FOR CONSULTANT
SERVICES AND AUTHORIZE CHAIRMAN TO SIGN - 49TH STREET PROJECT
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Professional Service Agreement
between The Engineering Company and the Weld County Health Department, with terms
and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said
agreement, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Professional Service Agreement between The Engineering
Company and the Weld County Health Department be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 18th day of October, A.D. , 1993.

SERVICE AGREEMENT

SERVICE TO BE RENDERED:
Perform feasibility study for possible upgrade solutions for failing septic systems in the"49th" street area.
Solutions to be investigated are a community septic system with collection system and repairing existing
systems.
PERIOD OF SERVICE:
[ ] Services will commence upon return of signed copy of this Agreement.
[X] Services will commence immediately but may be suspended if signed copy of this Agreement is
not returned within ten (10) calendar days.
[ ] Services will commence
[ ] Basic Services will be completed within calendar days after the commencement thereof,
subject to delays beyond the control of The Engineering Co.
COMPENSATION: Client will pay The Engineering Co. for Basic Services:
[ ] A lump sum amount of$ .
[X] On the basis of The Engineering Co. current billing rates plus expenses.
[X] Not to exceed $5.000.00.
Payment will be due in full by the tenth(10th)of the month following the month in which the work is invoiced. It is agreed that if payment
in MI is not paid when due,The Engineering Co.may immediately cease work. Client may suspend or terminate The Engineering Co.services
for cause by written notice. In the event any delay or suspension by Client exceeds 3 months,The Engineering Co.may require adjustment
of the compensation provided for herein. In the event this Agreement is terminated by either patty prior to the completion of services,Client
will pay The Engineering Co.for all services rendered and expenses incurred to the date of termination plus expenses attributable to termination.
The Client will pay a finance charge of 1.50%per month on the unpaid balance on accounts after thirty(30)days,it being expressly understood
that the amount of the finance charge wilt be added each month to the account balance. It is agreed that The Engineering Co.'s liability m Owner
and all construction contractors for professional errors, omissions or negligence in the services rendered under this work order shall be
$125,000.00 or the amount of Engineer's compensation as set forth above,whichever is greater. Contract documents prepared for construction
of the Project shall include similar provisions.
