The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. This proposal is consistent with the Weld County Comprehensive Plan's Mineral Resources Goals and Policies, the I-25 Mixed- Use Development Area Goals and Policies, and the Transportation Goals and Policies. The Conditions of Approval and Development Standards will ensure that these goals and policies are met. The Comprehensive Plan encourages the extraction of mineral resources when the mining plan promotes reasonable and orderly development of mineral resources. 940455 ��317/ QG; NG ' /in//, _l,f AMENDED SPECIAL REVIEW PERMIT #615-2 - ANDESITE ROCK COMPANY PAGE 2 b. The uses permitted will be compatible with the existing surrounding land uses and with the future development of the surrounding area as permitted by the Weld County Comprehensive Plan. Surrounding land uses include gravel mining, crop production, commercial uses, residences, and a recreation area. c. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. Contiguous property previously permitted under this Special Review Permit is currently being mined for gravel and is not prime farm ground. d. The subject site is in a Flood Hazard Overlay District area. Use by Special Review Development Standards address this issue. No other overlay districts affect this site. e. Amended Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Andesite Rock Company for a Site Specific Development Plan and Amended Special Review Permit #615-2 for expansion of an open pit gravel mine to include an additional 40 acres, including a concrete batch plant and portable asphalt plant, in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Amended Special Review Permit shall be adopted and placed on the Amended Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Amended Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Amended Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. Prior to the Amended Special Review Permit activity occurring on the additional 40.7-acre site, evidence shall be submitted to the Department of Planning Services that: a. All permits required by the Army Corps of Engineers have been obtained. b. All permits required by the Mountain View Fire Protection District have been obtained. c. Prior to recording the Amended Special Review plat: a. The following note shall be placed on the plat: NOTE: The Mined Land Reclamation Board has the authority to issue permits for mining and reclamation activities. Activities related to mining and reclamation are, therefore, under the jurisdiction of the Mined Land Reclamation Board; however, Weld County has jurisdiction of those matters outlined in the Development Standards. b. The setback from proposed mining activity to Weld County Road 7 right-of-way shall be consistent with the plan prior to amendment. The Site Specific Development Plan and Amended Special Review Permit is for expansion of an open pit gravel mine to include an additional 40 acres, including a concrete batch plant, in the A (Agricultural) Zone District as submitted in the application materials on file and subject to the Development Standards stated herein. The amended mining area shall be limited to the additional 40. 7 acres, as shown on the plat. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. 'The open cut gravel operation shall comply with Sections 44.4, 44.5, and 44.6 of the Weld County Zoning Ordinance. 4. Hours of operation shall be limited to daylight hours only, or not to exceed 6:30 a.m. to 6:00 p.m. , six days per week, Monday through Saturday. Routine maintenance of equipment shall be allowed after the hour of 6:00 -p.m. 3. Vehicular traffic associated with the Use by Special Review activity consists of -85 trips per day. Traffic shall ingress from and egress to State -Highway 119, with approximately 20% traveling west toward Longmont and 80% traveling east toward I-25. Approximately 50% of the trucks traveling on I-25 shall travel north and 50% south. 6. The property shall be maintained in compliance with the requirements of the Weld County Flood Hazard Overlay District requirements, including: a. No fill, berms or stockpiles shall be placed in the one hundred (100) year flood plain of Idaho Creek which would obstruct passage of flood flows, and b. All fuel tanks, septic tanks, temporary buildings, and any other hazardous items that might wash away during flooding shall be securely anchored and adequately flood-proofed to avoid creation of a health hazard. Following completion of mining, all temporary buildings shall be removed. 7. The applicant shall use a low-noise vibrator in the operation of the concrete batch plant. 8. 'Tanks for flammable or combustible liquid storage or dispensing, either temporary or permanent, shall be installed in accordance with the requirements of the Uniform Fire Code. 9. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 10. No permanent disposal of wastes shall be permitted at this site. 12. Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, -blowing debris, and other potential nuisance conditions. 13. Fugitive dust shall be controlled on this site. 14. The maximum permissible -noise level shall not exceed the industrial limit of 80 dB(A) as measured according to 25-12-102, Colorado Revised Statutes. 15. The applicant shall remove, -handle, and stockpile -overburden, soil, sand and gravel from the facility area in a manner that will prevent nuisance conditions. 16. All phases of the sand and gravel operation shall comply with all County and State Health Standards and regulations pertaining to air quality, water quality, noise emission and sanitary disposal systems. 17. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 1-8. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 19. The property owner or operator shall be responsibble for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 20. Personnel from the Weld County Health Department and Meld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 21. The Amended Special Review area shall be limited to the -plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. She explained the applicant has provided documentation with existing traffic numbers for truck loads and passenger vehicles entering and exiting the site, completed plantings on the north and west boundaries, and amended the plat to show a greater setback from Weld County Road 7, all of which were required by the Planning Commission prior to the Board's hearing. Gary Tuttle, Tuttle Applegate, Inc. , represented the applicant and stated this is an ongoing operation on 60 acres, and the applicant is requesting an additional 40 acres for the same processing equipment. He stated there is a 100-foot setback from the Weld County Road 7 right-of-way, and the amount of traffic in and out of the facility has been taken care of, as well as the plantings. In response to a question from Commissioner Baxter, Mr. Tuttle indicated there has been discussion with the property owner in the northwest corner and the applicant has agreed to maintain the water level in his pond. At the request of Commissioner Hall, Mr. Tuttle gave a synopsis of the reclamation plan which will include a water storage reservoir, with trees and shrubs on the road frontages. The property will remain with the Rademacher family, who is the property owner. Mr. Tuttle and Ms. Dunn confirmed there was no response from the State concerning the coordination of a reclamation easement through the area, and Mr. Tuttle indicated there was no frontage on the river. In response to a question from Commissioner Harbert, Mr. Tuttle stated there are wetlands in the southeast corner; however, they are not being disturbed at all. No public testimony was offered concerning this matter. Hours tf operation shall be limited to daylight hours only, or not to exceed 6:30 a.m. to 6:00 p.m. , six days per week, Monday through Saturday. Routine maintenance of equipment shall be allowed after the hour of 6 p.m. 5. Vehicular traffic associated with the Use by Special -Review activity consists of 85 trips per day. Traffic shall ingress from and egress to State Highway 119, approximately 20% travelling west toward Longmont and 80% travelling east toward I-25. Approximately 50% of the trucks travelling on I-25 shall travel north and 50% south. 6. The property shall be maintained in compliance with the requirements of the Weld County Flood -Hazard Overlay District requirements, including: - No fill, berms or stockpiles shall be placed in the one hundred (100) year flood plain of Idaho Creek -which would obstruct passage of flood flows, and - All fuel tanks, septic tanks, temporary buildings, and any other hazardous items that might wash away during flooding shall be securely anchored and adequately flood-proofed to avoid creation of a health hazard. Following completion of mining, all temporary buildings shall be removed. 7. Tanks for flammable or combustible liquid storage or dispensing, either temporary or permanent, shall be installed in accordance with the requirements of the Uniform Fire Code. 9. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 10. The existing-Emission Permit shall be modified for the increased operation if the Colorado Department of Health determines that such a modification represents a significant change in emissions or production. 11. No permanent disposal of wastes shall be permitted at this site. 12. Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 13. Fugitive dust shall be controlled on this site. 14. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) as measured according to 25-12-102, Colorado Revised Statutes. 15. The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from the facility area in a manner that will prevent nuisance conditions. 16. All phases of the sand and gravel operation shall comply with all County and State Health Standards and regulations pertaining to air quality, water quality, noise emission and sanitary disposal systems. 17. All construction on the property shall be in accordance with the requirements of the Weld County _Building Code Ordinance. 18. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 19. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 20. I have discussed this with Mr. Dave Jones of Tuttle Applegate, Inc . , as I received a submittal directly from the consultants . The application states in the Traffic Statement that the amendment is to continue the existing operation, and further states that the estimates of truck traffic are based upon existing traffic, and may vary somewhat . In conversation with Mr. Jones, he stated that the volume is not expected to change, and the direction of trips should remain the same . The County may wish to monitor this volume of traffic . We have visited the site, and observed that no auxiliary lanes currently exist along WB SH 119 to facilite ingress and egress at the access . The State Highway Access Code provides a warrant to re-evaluate access and possibly to require improvements to access under certain conditions related to traffic volumes, or whenever accident history indicates a substantial safety issue . It would be in the interest of the County and the Department to require the addition of auxiliary lanes if the volume of traffic increases by more than 20% at any time in the future . At such time a-s a 20% increase would be documented or proposed, we should be contacted to re-evaluate access . Any changes to t₹1e access would require a State Highway Access Permit be obtained from this office . I have reviewed the amended mining application and have the following comments: On the Weld County Use By Special Review Application For Mining Permit, Item #7(E) is indicating that this particular facility is a dry pit operation. I believe this is a wet pit operation. On the plans they are showing a de-watering pump. In the plans, Exhibit D, under Mining Plans, the operator intends to maintain a 200' setback from all man-made structures surrounding the perimeter of the mining operation, unless an agreement allowing the operator to mine closer to the structure is obtained. In the Mining Rules and Regulations From The Division of Minerals and Geology, on page 25, Exhibit C Pre-mine and Mining Planned, 112:4:E, Item B is the 200' rule. Exhibit E - Reclamation Plan Although the proposed rehabilitation for this site is a water storage reservoir, I am surprised that there is no proposal to create or improve any wildlife habitat. The finished form of the proposed reservoir is almost square shaped. The shorelines should be more irregular in contour to maximize the potential for wildlife diversity and to be more aesthetically appealing. Several islands could be also created which would be very useful wildlife habitat for nesting birds, etc. Revegetation should not be limited to only grasses as proposed, but also include trees to again improve bio-diversity and an over all pleasant landscape as a finished product. Without the above listed modifications, I cannot give a favorable approval to this project. Furthermore, the Division of Wildlife would be interested in obtaining fishing recreation rights for the public on this proposed reservoir after mining and reclamation is completed. We are not aware that a properly reclaimed mining slope (3:1 and vegetated) at a 25 foot setback has ever damaged a road through slope failure or saturation of the road base. Facilities "Include a portable asphalt batch plant. " So we can better bid on upcoming State and County road work, we need to move an asphalt plant onto the site for a particular job. This plant will not be a permanent facility on the site. Hours of Operation "Hours of operation for mining, processing, and hauling shall be limited to daylight hours, and not to exceed 6:30 am to 6:00 pm six days per week, Monday through Saturday. Maintenance of equipment only may be performed from 6:00 pm to 10:00 pm five _lays per week, Monday through Friday. " From our records we cannot find any hours _of operations restrictions on the Del Camino Pit. Also the operation to the west has no specific restrictions. Generally both companies have worked to fill orders and no longer than dawn to dusk. This situation has worked well here and we are not aware of complaints from neighbors. During reclamation all contours should be reshaped to maintain existing drainage patterns as much as possible. Slopes should be 4/1 or less. This application will fully describe our proposed use of mining and final reclamation. Any additional information as requested by the Weld County Procedural Guide will be addressed in this letter. -Enclosed is a complete application and application fee. The proposed mining operation is consistent with-the Weld County Comprehensive Plan. This area is designated as a Resource Conservation Area where the extraction of the sand and gravel is encouraged to occur over other activities. The pit will be supplying aggregate to various users in Weld County. The proposed site is a valuable resource and will be restored to a beneficial use. This operation will not adversely impact the agricultural economy of the County. The water rights of others in the area will be protected. The water storage reservoir as the reclamation scheme for the mine pit is consistent with existing land _uses as well as-anticipated land uses in the area. The lake will have a surface -area of-approximately 87 acres and will be filled by junior water storage rights acquired by the applicant and property owner. We will need to augment water due to the evaporative losses on the mining operation only. These plans are explained in detail in Exhibit G of the Regular Operation Amendment application. The reclamation of the pit is proposed as a lake for water storage. The creation of ponds and lakes is encouraged by the County in floodplain areas. We will be submitting a Flood Hazard Development Permit application under separate cover. The proposed use is not located in a geologic hazard area or the Weld County Airport overlay district. The mine pit expansion is proposed to be located in the "A" District. The applicant has made a diligent effort to avoid productive agricultural land. The Weld County General Soil Map showing Agricultural Land Capability Classes shows this area as being Class TV and VI - irrigated. These areas are described as having severe limitations that generally make them unsuited to cultivation and limit their uses to mostly pasture land. Currently the Amendment area is used for pasture. The use will not adversely affect agricultural ditches, wells, or senior water rights. The applicant will comply with all conditions of State and local permits thus insuring the protection of the health, safety, and welfare of the inhabitants of the neighborhood and the County. Specific conditions will apply to air quality, water quality, noise, on-site mine safety, and reclamation according to applicable State permits. Noise from the processing site equipment at the property line will be within accepted standards. The closest processing site will be a minimum of 1800 feet from Colorado Highway 119 (Weld County Road 24). The nearest residence is approximately 700 feet away from the processing area, which will be located down in the mining pit. At this distance, all noise at the property line will be less than the agricultural noise standards developed by the State Department of Health. Noise from the existing mining at the site has not been a problem to neighboring properties. Compatibility with surrounding land uses is insured by location and setbacks. To the north is the existing permitted mine area, to the east are reclaimed gravel pits. To the south is pastureland with two commercial areas at the southwestern corner. To the west across Weld County Road 7 is an existing sand and gravel pit operated by Western Mobile Inc. This area has been mined since the mid 1970s, thus the area is accustomed to the-ruck traffic. The mining and processing operations will generally work one, eight to ten hour shift, approximately 250 days per year. Maintenance of vehicles may need to occur after hours. it is expected the operation will continue to employ 10-12 workers on site. There will be no animals allowed near the mining activities at the site. Vehicular traffic and access routes are discussed in the accompanying "Traffic Pattern" statement. (The statement-has been provided separately for ease of reference by County Engineering personnel.) 940455 Mr. Chuck Cunliffe Weld County Department of Planning Services -February 7, 1994 Page 3 There will be no permanent structures proposed with this use. The equipment used is delineated on the Use By Special Review application. In order to minimize the visual impact of the operation, the mining is -divided into phases of about-eight acres each. The phases will limit the amount of disturbed ground at any one time. In addition, the-reclamation will proceed concurrently with the mining. Immediately after the mining is completed in a particular phase the reclamation will begin. Detailed reclamation plans are discussed in the attached Exhibit E and shown on Exhibit F. The pit is located in the floodplain as defined by the Federal Emergency Management Agency (FEMA)-and shown on the Flood Insurance Rate Map (FIRM). The site is shown to be intone A and is described -as "Areas of 100-year flood; base flood elevations and flood hazard factors not_determined". The operator will comply with Sections 53 and 26 of the Weld County Zoning Ordinance by applying for a flood Hazard Development permit. Topsoil and overburden will be stockpiled at various points along the perimeter of the amendment-site for reclamation purposes, or placed directly on previously mined areas. Since reclamation will be occurring concurrently with mining, the topsoil and overburden stockpiles will be moving with the mining. Therefore, there will be a limited amount of stockpiles potentially subject to erosion and floodplain obstruction. Product stockpiles will be placed adjacent to the processing plants. Product stockpile may also be located at the concrete batch plant. Both the stockpiles and the processing plant may change locations to accommodate the mining, but will be located in the bottom of the mining pit. This will greatly -reduce the -chances of any of-this material leaving the site should flooding occur. The vehicular equipment at the site will be equipped with fire extinguishers per MSHA regulations. There will be no permanent structures proposed with this use. The site lies within the Mountain View Fire Protection District. The Regular Operations application Exhibit G discusses the availability of water forxlust control, moisture loss, and ev-aporation loss. The proposed haul route will enter Colorado Highway 119 at the access road and bifurcate. Longmont traffic will proceed west on State Highway 119 towards the Longmont area. Traffic heading for the Denver Metro area and north areas will travel east on State Highway 119 to Interstate 25 and proceed south or north. The location map for truck haul routes shows the estimated distribution of traffic. Approximately 20% will go west toward Longmont, with the remaining 80% going east to the greater Metro Denver area and north on 1-25. Of the 80% truck traffic going east approximately 50% goes south to Denver and 50% goes to various destinations to the north. Some aggregate material may be imported to the site for processing and mixing with on-site materials. This importing will be accomplished with the same truck fleet indicated. To increase efficiency and minimize traffic and road impacts, the import aggregate will be hauled on return trips of fleet trucks delivering product materials. Because of this routing, overall truck trips would not be affected. The area to be added is on the south side of the current permit boundary. This area will also-be-mined using dry mining techniques. Mining will begin at the west end and progress towards the east. Existing topsoil will be stockpiled at various points around the perimeter of the site for reclamation purposes, or placed directly on previously mined areas. This site will be lined and turned into a water storage reservoir following mining. Lining will beaccomplished_using-the overburden available from the site. Scrapers will remove overburden from an area being prepared for mining, and transport it to an area -being backfilled and compacted for the liner. The scrapers will place the material against the excavated edge and compact the material by driving over it. An existing gas line in the western portion of the new area will be relocated at the operators expense, and with the permission of X N Front Range Gathering Company a subsidiary of-K N Energy, from its current location. The new gas line will be routed around the south side of the site to allow-for the extraction of moreaand and gravel resource. The new location is shown on Exhibit C. Correspondence regarding relocating the line is attached as Exhibit D-1. The agreement will -be executed after the mining amendment has been permitted. The mining will maintain a minimum 25 foot setback from the new line and existing-gas well. The operator intends to maintain a 200 foot setback from all manmade structures around the perimeter of the mining operation, unless an agreement allowing the operator to mine closer to the structure is obtained. Mining of this area is expected to last for-approximately 10 ytars, and final reclamation should be accomplished by 2006. Mining of the current concrete plant site and resource stockpile area next to Idaho Creek would occur last if this area is mined. The additional property will increase the reservoir area from 60 acres to approximately 87 acres. The-proposed post mining land use is compatible with surrounding land uses. To the north of the site is 33arbour Ponds State Recreation Area and to the west is another mining _operation conducted by Western Mobile, Inc. To-the east of the pit are older, reclaimed gravel pit lakes and Interstate 25. TD the south are small commercial areasand Colorado Highway 119. While the property is-being mined out, concurrent reclamation is occurring. As the perimeter slopes are backfilled with the overburden from on-site, they will be compacted to create an impervious core area to seal off the reservoir from the groundwater aquifer. The pit floor is a hard sandstone, and will complete the impervious lining of the pit. A _cross-section of the backfilled shorelines is Included as Exhibit E-1. The-reclamation sequence will remain the same for the entireproperty. Topsoil andnverburden will be stripped separately and replaced in phases as mining progresses. This will -minimize handling and disturbance of the materials. The reclamation of the scale house/office area will be-delayed until the final phase of mining is completed. At that time the ground will be scarified, leveled, and seeded with grass. The site access road will be left-following reclamation to allow access to the reservoir. The reclamation of the plant site will be accomplished after all active mining is completed. This area will be scraped of-any usable materials and left with the native sandstone base exposed. The final reclamation of the pro-cessingsite will occur when the-pit is flooded with water and the area inundated. No structures will be left at this site following-reclamation. The proposed reclamation plan meets the requirements of-Rule 6 in the MLRD regulations as follows: Grading Grading will be done to provide stabilized shorelines around the lake. All backfilling will be done using native overburden and topsoil. There are-no known toxic materials in the proposed backfill material and as such will not cause groundwater contamination. E-1 940455 All -grading will be _done to prevent erosion. Final grading and -reseeding will be done immediately after grading and topsoiling-have been done. Allt>ackfilling will be completed in phases after mining is completed. No acid forming materials, refuse, or toxic producing materials are-known to exist in the area and will not be used for reclamation. Any materials of this nature-found during the mining operation will be disposed of according to applicable laws and-regulations. There are no drill or auger holes associated with this mining operation. All slopes left by the mining operation will be no greater than 311:1v from 5 feet above to 10feet below the expected water surface elevation. All other slopes will be-no greater than 2h:lv. Wildlife The proposed reclamation plan does not propose to create wildlife habitat. All activities will be planned considering the safety andprotection of wildlife on the property. The miningplan does call for the preservation of a small wetlands on the cast edge of the property. Some species may be-temporarily displaced by the mining activities. They are expected to re-establish with no difficulty after mining and reclamation have been_completed. Topsoiling The -existing topsoil on the property consists mainly of a sandy loam approximately 4 to 24 inches deep. All available topsoil will be stripped prior to mining and stockpiled, or placed on areas that are currently undergoing-reclamation activities. Stockpiles which remain in place longer than one growing season will be seeded with a fast growing cover to minimize wind and water-erosion. Handling of topsoil will be minimized by efficient sequencing of mining -and reclamation through phases. After mining has passed through an area, non-marketable material will be replaced at an-even depthand the liner installed along shorelines and graded. Soil amendments are not proposed at this time. However, if they are determined necessary by the SC-S, They will be used to enhance plant growth. Revegetation The reclamation plan will revegetate all disturbed areas with the previously approved grass seed mix to minimize erosion, re establish natural terrain and create stabilized shorelines. The grass seed mix is unchanged from the original permit. Reseeding of the property will be done after topsoil is replaced in accordance with accepted planting practices. All grass seeds will be planted with a grass drill equipped with depth bands and press wheels. Seed will beplanted approximately one-half_inch deep-and will be drilled-between November 1 and April 1. The grass seed mix includes drought tolerant varieties and will be planted either in early spring or fall to insure germination. E-2 941)455 If a significant invasion of noxious weeds occurs, the area will be mowed periodically for control. Weeds will be mowed when they reach a height of 6 to 12 inches throughout the first growing season. Mechanical control will be used as a first priority. Chemical methods will only be used if no other alternative pro-duces acceptable results. The property is not forested and will not require fire lanes. A minimum 25 foot setback will be maintained around the permit boundary which will allow access. There are no trees or shrubs planned in this reclamation scheme. Water Disturbance of the area will be done-to minimize the affect on the prevailing hydrologic balance as follows: a) The operator shall comply with all applicable Colorado water laws. b) The operator shall comply with all applicable Federal and State water quality laws and regulations. c) The operator shall comply with all federal and State requirements for dredge and fill. There are no anticipated requirements for this type of activity. d) The operator will regrade all sediment and siltation structures after mining is completed. The reservoir will be created by placing a compacted overburden/clay liner along the shorelines of the excavated pits (see Figure El). Placement of the compacted liner along the shoreline will eliminate groundwater inflow into the pit. The pit will be mined down to bedrock and, therefore, there will be no infiltration of water through the bottom of the pit. The reservoir will be exempt from the regulations of Senate Bill 120 since there will be no groundwater depletions. The original reclamation plan consisted of a groundwater lake approximately 60 acres in size. The only change to the reclamation plan for the existing permit area is the creation of a water storage reservoir by lining the pit slopes rather than a groundwater lake. With the addition of the acreage added by this amendment the reclamation plan will now entail creating a reservoir approximately 87 acres in size. The entire amendment area is within the St. Vrain Creek 100 year floodplain as shown by the FEMA map (see Exhibit G-l). Where possible the topsoil and overburden stockpiles will be aligned with the general direction of flow, to limit obstruction of the floodplain and limit potential for erosion. There will be no stockpiling done within the floodway. All work within the floodplain will conform to Weld County Rood Hazard Regulations. Due to the removal of material from the site the net floodplain cross sectional area will increase and therefore provide more flood storage than what currently exists. Water Use Water use at the site will include evaporation from exposed groundwater, water retained in the material removed from the site, water used for dust control of haul roads and stockpiles, and water used for concrete batching. Quantities of water use for the amendment area are expected to remain the same as the current water use quantities. Therefore, the consumptive use presented below for the amendment area is based on current water use. Mining in the amendment area will intercept the water table. In order to enable dry mining of the amendment site, dewatering trenches will be constructed around the perimeter of the pit. The trenches will route water to the existing discharge point as shown on EXHIBIT C and water will be pumped to an adjacent pond in the same way that it is currently being done. The only evaporation from the site during mining will include water exposed due to the dewatering operation and water pumped from the pit to settling ponds which will be used for the washing operation. Approximately 2.3 acres of water will be exposed in the dewatering trenches and the wash ponds. G-1 949455 The annual evaporation is 39 inches at the subject location. The-precipitation at the mine site is estimated to be the same as that found at-the nearest weather station which is located in Longmont. The annual mean precipitation is 13.00 inches/year. Effective precipitation was determined in order to compute the net lake evaporation. Effective precipitation was computed as 70% of the total precipitation. Effective precipitation was then subtracted from the gross evaporation to obtain the net evaporation. An adjustment is also made for the months of January and February when the water surface is typically frozen. The net annual evaporation from a lake surface at the subject site is 2.34 ft (28.1 inches). Consequently the net annual evaporation_during mining from 1.3 acres of water surface will be 5.4 acre-feet. There will be excavation and sale of material from the amendment property. Approximately 150,000 tons of material will be mined and washed from the amendment area. Assuming a 4% moisture content by weight this would equate to 4.8 acre-feet per year. Water use also includes water applied for dust control. The quantity of water needed for dust control during mining of the amendmentarea should be about 0.8 acre-feet annually. A concrete batch plant is located in the existing permit area. The batch plant has been used very sparingly. When it is used about 5,000 _cubic yards will be batched per year requiring approximately 28 gallons per cubic yard for a total of 0.4 acre-feet. The total annual consumptive use for the amendment operation during mining is projected as follows: Evaporation 5.4 acre-feet Moisture Retained in Material 4.8 acre-feet Dust Control 0.8 acre-feet Concrete Production 0.4 acre-feet Total 11.4 acre-feet Augmentation In order to prevent injury of senior water rights along the St. Vrain Creek and South Platte River, augmentation of the out of priority depletions at the site is required. During mining of the amendment area it is estimated that approximately 11.4 acre-feet of groundwater will be consumed each year. A State Engineer approved substitute supply plan is in place for the existing operation. The plan will be renewed each year and will include the water use in the amendment area. Theaource of replacement water for the plan is 0.2 shares of the Rural Ditch which the landowner, the Rademacher Family, has leased to Andesite for the purpose of augmentation. G-2 94045-5 The Rademacher Family owns a total of 3.31 shares of the Rural Ditch. The average annual headgate yield per share is approximately 130 acre-feet. The historic consumptive use of the 3.31 shares is approximately 212 acre-feet per year and, therefore, the historic consumptive use for the 0.2 shares is 12.8 acre-feet. The 12.8 acre-feet if sufficient to cover the anticipated annual water losses of 11.4 acre-feet due to the mining operation in the amendment area. As stated earlier the final reclamation plan for the site is a water storage reservoir. The reservoir will be sealed off from the surrounding alluvial aquifer to prevent groundwater infiltration. Consequently there will be no long term augmentation responsibilities. Water Storage The source of water for filling of the reservoir will be a junior water storage right. This new water right will be acquired through water court and will permit the diversion of water to storage during periods of no call on the river. During most winter months and during the peak of the spring runoff there is generally no call on the river. During these periods water will be diverted to storage. Andesite is in the process of preparing these water right filings and will provide copies to the DMG when they are completed. Surrounding Water Rights Attached with this exhibit is a map, Exhibit G-2, showing permitted and/or adjudicated water rights within approximately one half mile of the site. Well data from the State Engineers's Office was used to locate the surrounding wells and water rights. The State Engineer's Tabulation of the wells and water rights is also attached. As shown by the well map there are some wells within the vicinity of the amendment area which could potentially be impacted by the dewatering. As required by the State Engineer's Office, waiver agreements will be acquired from well owners with wells within 600 feet of the amendment area. Once mining and dewatering in the amendment area has started, groundwater levels in the immediate vicinity are expected to drop. If the water levels are dropping in adjacent wells such that well owners may be injured, the operator will begin to implement one or more of the following measures. a. Construct recharge ponds at strategic locations within the permit boundary to begin aquifer recharge. b. Modify existing wells to operate under lower groundwater conditions. This would include re-drilling existing wells to deeper depths or lowering the pumps. All work would be done at the operator's expense with the exception of replacing equipment that was non-functional prior to mining. c. If existing wells cannot be repaired, then the operator will drill a new well for the owner to replace the damaged well. The new well will produce water of the same quantity and quality. G-3 , 940455 If a well has not been put to beneficial use prior to mining, the operator should have no responsibility to provide mitigation. Discharge Permit A permit from the Colorado Health Department to dewater the mine site is already in place for the existing operation. The current point of discharge will remain unchanged. 404 Dredge and Fill Permit A wetlands survey was conducted on the amendment property. The location of the wetlands is delineated on the mining plan map. No mining activity will take place within the wetlands boundary and therefore no 404 permit is required. Stormwater Management Plan A Stormwater Management Plan is in place for the existing operation. The plan will be updated to include the amendment area. Available water capacity is low. The effective rooting depth is 60 inches or more. Surface runoff is slow,and the erosion hazard is low. This soil is suited to limited cropping. It is sandy and subject to flooding. Pasture is the best use. Tall wheat- grass, tall fescue, and annual sweetclover are-some of the most-suitable crops. Light, frequent irrigation by-furrows and flooding is best. Commercial fertilizer improves the amount and value of-forage-produced. The potential native vegetation is dominated by switchgrass, indiangrass, sand bluestem, sand reedgrass, sideoats grama, needleandthread, -and blue grama. Much of this range site includes other soils and vegetation in such a complex pattern that it is difficult to map them separately.-Potential production ranges from2,500-pounds per acre in favorable years to 1,500_pounds in unfavorable years. Undesirable weeds and annuals invade the site as range condition becomes poorer.
