RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION N0. 1356 - CULLISON
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held
in the Chambers of the Board, that a certain parcel of land, to be divided into
two parcels, as shown on the plat known as Recorded Exemption No. 1356, does not
come within the purview of the definition of the terms, "subdivision" and
"subdivided land", and
WHEREAS, the request for Recorded Exemption No. 1356 was submitted by
Thomas and Deborah Cullison for property which is located in part of the SE; of
Section 29, Township 7 North, Range 67 West of the 6th P.M. , Weld County,
Colorado, being more particularly described in the plat which shall be provided
by the applicant and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 80.5 acres and 2.5 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby
is, exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that this approval is subject to the
following conditions:
1. A Weld County septic permit is required for the proposed home and
its septic system shall be installed according to the Weld County
Individual Sewage Disposal System (ISDS) regulations.
2. An ISDS evaluation by the Weld County Health Department on all
existing septic systems will be necessary prior to issuing the
required septic permits on the existing systems.
3. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County
Clerk and Recorder. The plat shall be drawn in accordance with the
requirements of Section 9-2C. (4) of the Weld County Subdivision
Regulations. The plat shall be submitted within sixty days from the
date of approval by the Board of County Commissioners. The
applicant shall be responsible for paying the recording fees.

Subject: Recorded Exemption Application # 1356
Dear Commissioners:
This request for a Recorded Exemption is submitted by Thomas and Deborah
Cullison. The parcel of land is described as part of the SE4 of Section 29, T7N,
R67W of the 6th P.M. , Weld County, Colorado. The property is located north of
and adjacent to Weld County Road 76 and approximately 1/2 mile west of State
Highway 257. This request is to divide an 83 acre parcel into two parcels of
80.5 acres and 2.5 acres, more or less. There is one set of improvements on the
proposed 2.5 acre lot and no improvements on the larger lot.
The applicants propose using North Weld County Water District as the water source
for both lots. Individual septic systems will provide sewage disposal.
This request for a recorded exemption represents the applicants response to
correct a subdivision violation. In October of 1983 Recorded Exemption #639 was
approved by the Department of Planning Services' staff. Recorded Exemption #639
split off a one acre parcel (as shown in the submitted materials) . Also in
October of 1983 the Department of Planning Services' staff approved Subdivision
Exemption #198 for financing purposes only. Subdivision Exemption #198 did not
create a separate legal lot. According to Section 9-3 B (2) of the Weld County
Subdivision Regulations, the Cullisons were not eligible to create a separate
legal lot through the subdivision exemption process since the property did not
contain two sets of existing improvements. The subdivision violation occurred
on November 17, 1983 when the building site was conveyed to the applicant.

The staff has made an effort to work with the applicants to correct the violation
in a manner consistent with the Weld County Subdivision Regulations and the
Comprehensive Plan. The staff has offered to approve this request if the
applicant is willing to rejoin Lot A of Recorded Exemption x/639 with the rest of
the farm. Neither parcel contains improvements and both parcels are currently
under the ownership of Emmerson Cullison.
The staff recommends that this request be denied. Mr. Cullisons approach to
correcting the subdivision violation creates another lot. Continued divisions
in the area evade the purpose of the Weld County Subdivision Regulations.
Currently there are in excess of 50 parcels in this section which includes
Northwest Estates Subdivision. Residential development in rural areas creates
an increased demand for road maintenance, police and fire protection, school
busing, snow removal, utilities and other urban type services.
The staff request that the Board of County Commissioners consider the application
and determine if the Standards of Section 9-2 E (1) (a) through (m) of the Weld
County Subdivision Regulations have been met.

Statement describing purpose & reason for dividing a lot into two lots
In September of 1983 , my parents, Emerson G. and Mae Cullison,
desired to convey a building site to my younger sister, and myself,
from their farm that had been in the family since the days of Governor
Benjamin Eaton. Benjamin Eaton was my grandmother's uncle. We, with the
assistance of our attorney, Barnard Houtchens, and the employees of the
Department of Planning Services, conferred on the matter. We were
advised that one lot could be a recorded exemption, and a second lot a
subdivision exemption. We submitted our plans, went before the county
commissioners, and explained in detail that both lots were to be deeded
to my sister and myself for the purposes of building homes on them. It
was passed, the exemptions recorded, and I started the process of
building my home on the Subdivision exemption that was deeded to me.
In 1985, the planning office issued an address to me, and a
building permit to my contractor. We followed all the procedures for
building, water and sewer requirements, and a Certificate of Occupancy
was issued to us on December 30, 1985 . In October of 1989 my wife and I
separated and eventually divorced. Because of my inability to afford
the house payment, the bank asked that I either sell the home, or they
would be forced to foreclose on it.
I unintentionally erred, by allowing the home and property to sell
in April of 1990, without changing the property to a recorded exemption
from its Subdivision exemption. I'm not sure what would have been done
if the home and property had been foreclosed on by the bank. I truly
didn't know that the exemption was a legal requirement, the real estate
agents, and the title companies also didn't catch the error.
In summarization, the reason for this request is to correct an
error on my part, whereas the county law requires this parcel of land
to be a recorded exemption.

The larger lot is as was, agriculture, and the smaller lot was and
is a single family residence, within one half mile of the Roth
subdivision, 4 miles north of Windsor, Colorado.
The subdivision exemption in 1983 , and my sisters recorded exemp-
tion of 1983 were both sent before the town of Windsor with no negative
responses.
Attached are letters and/or copies of the permits for the water and
sewage methods.

Legal access is from Weld County Road 76 , Water is from North Weld
Water, which has a line in WCR 76. Gas is from Public Service Company,

field, were put in with proper permits, engineering, and inspections .

Gentlemen:
This firm represents Larimer & Weld Irrigation Company. Our
client has received a copy of the proposed exemption with the
plat. Larimer & Weld opposes the requested exemption which
includes lands adjacent to the Eaton Ditch. If the exemption is
granted, Larimer & Weld Irrigation Company should receive a deeded
right-of-way for the full width of the ditch and its existing
easement through the property. In addition, any exemption which
is granted should provide that there will be no construction of
improvements on the existing easement and right-of-way of the
ditch company and that no steps will be taken to block the ditch
company's access along its maintenance road, nor would any steps
be taken to damage or impair the integrity of the ditch bank.

Gentlemen:
This letter follows our prior letter to you dated June 26,
1991 opposing the referenced exemption on behalf of our client,
Larimer & Weld Irrigation Company. We have recently reviewed the
matter with the applicant's attorney, John Houtchens. Based on
that review and our understanding of the exemption request,
Larimer & Weld Irrigation Company hereby withdraws its opposition
to this exemption request. This is based on the ditch company's
understanding that the subdivided lot will be approximately 900
feet south of the irrigation ditch, that no construction or change
in the use of the property adjacent to the ditch is contemplated
and that the applicant or the owner of proposed Lot A would not be
entitled to use of the ditch maintenance road.
