Z I O W h W U - -�Iftri- �- -1-- oom Ill 4' �= I RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR EXPANSION OF AN EXISTING CHURCH IN THE R-2 (DUPLEX RESIDENTIAL) ZONE DISTRICT - MOUNT CALVARY LUTHERAN CHURCH WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 31st day of October, 1990 , at the hour of 10: 00 a .m. , in the Chambers of the Board for the purpose of hearing the application of Mount Calvary Lutheran Church, 650 South Park Avenue, Fort Lupton, Colorado 80621 , for a Site Specific Development Plan and Special Review Permit for expansion of an existing church in the R-2 (Duplex Residential) Zone District on the following described real estate , to-wit: Part of the NE} , Section 7 , Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado; Lots 2-5 and 8-11 , Peaceful Acres Subdivision WHEREAS , said applicant was represented by Charles W. Blanco, Pastor of Mount Calvary Lutheran Church, and WHEREAS, Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: ' 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24. 4 . 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan' s Urban Growth Boundary Goals and Policies. The City of Fort Lupton Planning municipalities. The City of Fort Lupton Planning Commission did not make a recommendation but expressed concerns which are addressed in the Conditions of Approval, Development Standards, and additional comments. b. The proposed use is consistent with the intent of the R-2 (Duplex Residential) Zone District. The R-2 District is intended to accommodate non-residential land uses that are both accessory to and compatible with residential uses allowed by right in the District. The proposed use is permitted as a Use by Special Review in the R-2 Zone District. c. The use which would be permitted will be compatible with the existing surrounding land uses which include residences, a personal storage business, and County Roads. The use will be compatible with the future development of the surrounding area as permitted by the R-2 Zone District. d. No overlay districts affect the site. e. Development Standards and Conditions of Approval of the Special Review Permit will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for expansion of an existing church in the R-2 (Duplex Residential) Zone District on the hereinabove described parcel of land be , and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder' s Office within 15 days of approval by the Board of County Commissioners. 2 . The expansion shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 901101 Page 3 RE: USR - MOUNT CALVARY LUTHERAN CHURCH 3 . Within 30 days of approval by the Board of County Commissioners: a. A grading and drainage plan, approved by the Weld County Engineering Department, shall be submitted to the Department of Planning Services; b. The applicant shall submit evidence to the Department of Planning Services that the septic system for the proposed facility has been designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations; c. A landscaping plan shall be submitted to and approved by the Department of Planning Services. The landscaping plan shall include a plan to screen the parking lot from the adjacent property on the north side. 4 . Prior to the issuance of building permits: a. The applicants shall submit evidence to the Department of Planning Services that an adequate legal source of water is available for the outside uses on the property; b. A set of building plans shall be furnished to the Fort Lupton Fire Protection District; and c. The applicant shall submit evidence that a permit has been obtained for the well on the property from the Division of Water Resources. 5. The weeds on lots 2 through 5 shall be removed and replaced with adaptive grasses during the 1991 growing season. 6. The applicants shall submit an estimate of costs for the grading, drainage, landscaping, and screening. The estimated amount shall be reviewed and approved by the Board of County Commissioners. Prior to recording the Special Review Permit plat, sufficient performance guarantees to ensure installation and completion of the grading and drainage, landscaping, and screening shall be provided to the Board of County Commissioners for the approved amount as allowed by Section 24 .4 . 3 of the Weld County Zoning Ordinance . The performance guarantee shall be in a form acceptable to the Board of County 901101 Page 4 RE: USR - MOUNT CALVARY LUTHERAN CHURCH Commissioners. The guarantee shall be returned to the applicants or released after the improvements have been satisfactorily completed. If the improvements have not been completed within one year of the date of approval of the Special Review Permit by the Board of County Commissioners , the County shall take corrective action to ensure compliance with the approved plans and the guarantee shall be forfeited. The Site Specific Development Plan and Special Review Permit is for an expansion of an existing church in the R-2 (Duplex Residential) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S. , as amended. 3 . The approved grading and drainage plan shall be maintained on the property. 4 . All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 5 . No permanent disposal of wastes shall be permitted at this site. 6 . Any portion of the site which is not gravelled or hard surfaced shall be seeded with adaptive grasses . 7. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 8 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 9 The property owner or operator shall be responsible for complying with the Operation Standards of Section 7.4 . 6 of the Weld County Zoning Ordinance. 10 . Personnel from the Weld County Health Department, Fort Lupton Fire Protection District and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 901101 Page 2 RE: DEVELOPMENT STANDARDS - MOUNT CALVARY LUTHERAN CHURCH 11 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 12 . The property owner or operator shall be responsible for complying with all of the foregoing Development Standards . Lacy Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Bruce Barker Planning Department representative, Lanell Curry The following business was transacted: I hereby certify that pursuant to a corrected notice dated October 4, 1990, and duly published October 18, 1990, in The New News, a public hearing was conducted to consider a Site Specific Development Plan and Special Review Permit for expansion of an existing church in the R-2 (Duplex Residential) Zone District requested by Mount Calvary Lutheran Church. Bruce Barker, Assistant County Attorney, made this matter of record. Lanell Curry, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record. Ms. Curry recommended that the Board consider the estimate and form of the performance guarantee concerning the drainage and grading at this hearing. Charles W. Blanco, Pastor of Mount Calvary Lutheran Church, explained the request and answered questions of the Board concerning the well and required permits. No public testimony was offered concerning said request. Commissioner Lacy moved to approve the Site Specific Development Plan and Special Review Permit for expansion of an existing church in the R-2 (Duplex Residential) Zone District based upon the recommendation of the Planning Commission. Commissioner Harbert seconded the motion which carried unanimously. Ms. Curry said that Drew Scheltinga, County Engineer, had reviewed the performance guarantee and recommended approval. The estimated amount shall be reviewed and approved by the Board of County Commissioners. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Department of Planning Services ' staff that the applicant has shown compliance with Section 24.3 of the Weld County Zoning Ordinance as follows: The proposal is consistent with the Weld County Comprehensive Plan's Urban Growth boundary goals and policies. Urban development is encouraged to concentrate in or adjacent to existing municipalities. The City of Fort Lupton Planning Commission did not make a recommendation but expressed concerns which are addressed in conditions of approval, development standards, and additional comments. - The proposed use is consistent with the intent o£ the R-2 (Duplex Residential) zone district. The R-2 district is intended to accommodate nonresidential land uses that are both accessory to and compatible with residential uses allowed by right in the district. The proposed use is permitted as a use by special review in the R-2 zone district. - The use which would be permitted will be compatible with the existing surrounding land uses which include residences, a personal storage business, and County Roads. The use will be compatible with the future development of the surrounding area as permitted by the R-2 zone district. - No overlay districts affect the site. USR-923 Mount Calvary Lutheran Church Page 2 Special Review permit Development Standards and conditions of approval will provide adequate protection of the health, safety, and welfare of the neighborhood and County. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. The attached Development Standards for the Special Review permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's office within 15 days of approval by the Board of County Commissioners. 2. The expansion shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Within 30 days of approval by the Board of County Commissioners: - a grading and drainage plan, approved by the Weld County Engineering Department, shall be submitted to the Department of Planning Services; - the applicant shall submit evidence to the Department of Planning Services that the septic system for the proposed facility has been designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations; a landscaping plan shall be submitted to and approved by the Department of Planning Services. The landscaping plan shall include a plan to screen the parking lot from the adjacent property on the north side. 4. Prior to the issuance of building permits: - the applicants shall submit evidence to the Department of Planning Services that an adequate legal source of water is available for the outside uses on the property; €>,t USR-923 Mount Calvary Lutheran Church Page 3 - a set of building plans shall be furnished to the Fort Lupton Fire Protection District; and - the applicant shall submit evidence that a permit has been obtained for the well on the property from the Division of Water Resources. 5. The weeds on lots 2 through 5 shall be removed and replaced with adaptive grasses during the 1991 growing season. 6. Prior to scheduling this request before the Board of County Commissioners, the applicants shall submit an estimate of costs for the grading, drainage, landscaping, and screening. The estimated amount shall be reviewed and approved by the Board of County Commissioners. Prior to recording the special review permit plat, sufficient performance guarantees to ensure installation and completion of the grading and drainage, landscaping, and screening shall be provided to the Board of County Commissioners for the approved amount as allowed by Section 24.4.3 of the Weld County Zoning Ordinance. The performance guarantee shall be in a form acceptable to the Board of County Commissioners. The guarantee shall be returned to the applicants or released after the improvements have been satisfactorily completed. If the improvements have not been completed within one year of the date of approval o£ the special review permit by the Board of County Commissioners, the County shall take corrective action to ensure compliance with the approved plans and the guarantee shall be forfeited. SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS Mount Calvary Lutheran Chruch USR-923 1. The Site Specific Development Plan and Special Review permit is for an expansion of an existing church in the R-2 (Duplex Residential) zone district as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S. , as amended. 3. The approved grading and drainage plan shall be maintained on the property. 4. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 5. No permanent disposal of wastes shall be permitted at this site. 6. Any portion of the site which is not gravelled or hard surfaced shall be seeded with adaptive grasses. 7. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 8. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 9 The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 10. Personnel from the Weld County Health Department, Fort Lupton Fire Protection District and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. v. USR-923 Development Standards Page 3 11. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 12. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. ADDITIONAL COMMENTS DSR-923 Mount Calvary Lutheran Church The Fort Lupton Planning Commission has recommended that paved parking areas be required and that parking areas be screened from adjacent residential uses. A representative of the City of Fort Lupton has stated that the screening concern refers only to the property north of the church. The additional roof area proposed will increase storm water runoff. Also, it is my understanding, the City of Fort Lupton recommended paving the parking areas. Paving the parking areas will compound the problem. Lupton is the applicant for this Use by Special Review. It is their intent to construct a 50' x 72' addition on to the existing church building. NEED FOR USE The church congregation has been experiencing steady growth and are anticipating a congregation of 200 members maximum, therefore, the need for additional area is required. USE OF SURROUNDING PROPERTIES The Mount Calvary Lutheran Church lies within the Peaceful Acres Subdivision, which is residential . It is surrounded on all sides by residential properties. OPERATIONS The church holds one service Sunday mornings at 9:00 a.m. which would not exceed 200 members being in attendance. Services and meetings being held on Wednesday evenings or other intermediate services would not be attended to full capacity. At this time the church employes 3 individuals. Church office hours are 8:00 to 5:00, Monday-Friday. u. ' WATER SOURCE Water is provided by a well located on the site. At the time this well was drilled it was not required to obtain a permit . ACCESS AND TRAFFIC The main access to this parcel is provided by Park Avenue. The majority of the traffic that enters this property will occur on Sunday mornings by the congregation. It will consist of approximately 50 family owned passenger vehicles. There is now an existing gravel parking lot . SEWAGE FACILITIES Mount Calvary Lutheran Church is proposing a septic system for this parcel . An engineered septic system has been prepared and submitted to Weld County Health Services for approval . FIRE PROTECTION This parcel is in the Ft . Lupton Fire Protection District . At the time of construction, the building will be constructed according to the Fire District requirements and codes. n"4- , ANIMALS No animals will be allowed on this parcel . PROPOSED TIME TABLE Approximately 30-60 days after the approval of all required documents and plans construction will begin. The entire project will be completed within 3 months, weather permitting, after the issuance of all permits. GENERAL STATEMENTS 1) This Use by Special Review is consistent with the Weld County Comprehensive Plans because the intent is not to change anything, but for a proposed addition to an existing Church that is well established.
