HEARING CERTIFICATION BUILDING CODE AND ZONING VIOLATIONS RE: VIOLATIONS OF THE WELD COUNTY BUILDING CODE AND ZONING ORDINANCES A public hearing was conducted on June 14, 1994, at 10:00 a.m. , with the following present: Commissioner W. H. Webster, Chairman Commissioner Dale K. Hall, Pro-Tem Commissioner George E. Baxter Commissioner Constance L. Harbert Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Lin Dodge County Attorney, Bruce Barker Planning Department representative, Barry Kramer Planning Department representative, Monica Mika The following business was transacted: I hereby certify that a public hearing was conducted to consider whether to authorize the County Attorney to proceed with legal action against the individuals named for violations of the Weld County Building Code and Zoning Ordinances. County Attorney Bruce Barker reviewed hearing procedures and verbiage required in motions. He indicated cases whose representatives were present at the hearing would be heard first. Cases heard were as follows. VI #2090 - Leonard Amendola/Rick Scott (tenant) : Barry Kramer, Department of Planning Services, made this a matter of record and presented the case report, including a video of the property made June 13, 1994, and Planning staff's recommendation for referral for legal action. He indicated this noncommercial junkyard is a violation of Sections 31.2 and 31.3.9 of the Weld County Zoning Ordinance. He reported that a large amount of the trash and junk has already been removed and the primary concern at this time is the wood pallets still piled up on the property. To correct the violation, a screening plan must be approved and then installed or the pallets removed from the property. Rick Scott, tenant, was present and represented the property owner. He indicated he is buying the property from Mr. Amendola and has been cleaning it up since he moved there in October 1993. Mr. Scott stated he plans to put up a fence and to use the pallets for firewood. He indicated the pallets are neatly stacked and not visible from the road. In response to Commissioner Harbert, Mr. Scott stated that he has arranged for help this summer and could be in compliance by September 1, 1994. Staff reiterated the necessity of submitting a screening plan and the Board urged Mr. Scott to work with Mr. Kramer in complying with Planning Department requirements and procedures. Commissioner Kirkmeyer verified that the gas line to the accessory storage structure had been disconnected. No public comment was offered. Commissioner Harbert moved to delay referral to the County Attorney for legal action of VI #2090 against Leonard Amendola/Rick Scott until September 1, 1994 to allow the tenant, Rick Scott to bring the property into compliance. The motion was seconded by Commissioner Baxter, and carried unanimously. VI #2060 - William and Marita Mitchell: Mr. Kramer made this a matter of record and presented the case report, including a video of the property made June 13, 1994, and Planning Staff's recommendation for referral for legal action. He explained this case was also a violation of Sections 31.2 and 31.3.9 of the Weld County Zoning Ordinance, a noncommercial junkyard which included derelict vehicles, a large pile of tires, stacked wood pallets and miscellaneous building materials next to the road. William Mitchell, property owner, was present and explained the pallets are used to stack hay on and they are planning to use the lumber to build a storage shed and lean-to. He also explained one vehicle is operable, but unlicensed to prevent his underage son from driving it; two other 941619 PL0824 BUILDING CODE AND ZONING VIOLATIONS PAGE 2 vehicles have minor mechanical problems and are unlicensed to save considerable money on vehicle insurance. Mr. Mitchell verified for Commissioner Harbert that they are trying to sell the other two vehicles. In response to Commissioner Baxter, Mr. Mitchell stated he had talked with Mr. Kramer about permitted storage buildings, has removed most of the tires, and those remaining tires will be moved to an appropriate storage area on the property. In discussion, Mr. Mitchell verified he uses most of the pallets to store about three tons of hay on and has owned the property for about three years. In response to Commissioner Harbert's questions, Mr. Kramer stated he would prefer the pallets be screened to bring it into compliance, and Mr. Mitchell indicated he would be able to complete the improvements by the end of August. No public comment was made. Commissioner Kirkmeyer moved to delay referral of VI 112060 for William and Marita Mitchell to the County Attorney for legal action until September 1, 1994 to allow the property owner to move or store the tires and building materials and screen the wood pallets, license or remove the vehicles, and build the storage shed and lean-to. Seconded by Commissioner Harbert, the motion carried unanimously. VI #2099 - Brad and Carolyn Deroo: Mr. Kramer made this a matter of record and presented the case report, including a photo, marked Exhibit A, and Staff's recommendation for referral for legal action. He stated the commercial business in the A (Agricultural) Zone District is a violation of Section 31.2 of the Weld County Zoning Ordinance and to bring the property into compliance, a Use by Special Review or a Change of Zone must be applied for and approved or the business must be removed from the property. Carolyn Deroo, property owner, explained two trash trucks are parked in the building at night and there are no employees on the premises; the employees pick up the trucks in the mornings, park their private vehicles inside the building, bring the trash trucks back in the evening, and park them inside the building. She stated no business is conducted from the site, no employees stay at the site during the day and no vehicles are parked outside at any time. In response to Commissioner Hall, Mrs. Deroo indicated their business office is in their home, on a different property about 2.5 miles away. Monica Mika, Department of Planning Services staff, explained the Zoning Ordinance and rationale for the violation citation. Discussion followed with Ms. Mika responding to questions regarding the applicability of home occupation versus home business status and whether this use should be considered a commercial business use or an acceptable A (Agricultural) use. Commissioner Harbert questioned whether the actual commercial business is taking place on the site. Bruce Barker cited the Zoning Ordinance definition of "commercial" for the Board. No public comment was offered. Commissioner Harbert moved to dismiss VI #2099 against Brad and Carolyn Deroo and Commissioner Baxter seconded the motion. Commissioner Baxter stated the Board is dealing in a difficult and very grey area of permitted uses and had to rely on common sense, as well as the definitions and guidelines stated in the Zoning Ordinance. Commissioner Kirkmeyer reiterated that a trash truck is not a tractor and trash hauling is not an agricultural use. The Zoning Ordinance does not say a trash truck can be stored in an A (Agricultural) Zone District; however, this use does not fit the home occupation or home business criteria, either. With no further discussion, the motion carried unanimously. VI #2086 - Robert and Carolyn Welter: Mr. Kramer made this a matter of record and presented the case report, photos of the property, marked Exhibits A and B, a video of the property made June 13, 1994, and Planning staff's recommendation for referral for legal action. He explained the numerous unlicensed, inoperable vehicles on the property constitute a noncommercial junkyard and is a violation of Section 32.6.2 of the Weld County Zoning Ordinance. The property owners must remove the vehicles from the property to correct the violation. Mr. Kramer reported that the Welters have built a fence as screening, but since Hill-N-Park is zoned R-5, noncommercial junkyards are not allowed; therefore, screening is not an option. Commissioner Baxter verified that the only options to correct the violation in the R-5 Zone would be to store the vehicles in a building, bring the vehicle up to road standard, or remove them from the property. Robert and Carolyn Welter, property owners, were present and stated they built the fence as screening, following the definition of noncommercial junkyards Planning staff had sent them. Mrs. Welter BUILDING CODE AND ZONING VIOLATIONS PAGE 3 indicated she had spoken with Mr. Kramer about the screening and was not told that was not an option, again citing the Zoning Ordinance definition for noncommercial junkyards. Responding to questions from the Board, Mr. and Mrs. Welter stated they have five sons who refurbish the vehicles, and that four of the five vehicles are not licensed. When questioned by the Board about licensing and a workable timeframe to bring the vehicles up to standard, Mr. Welter indicated the restorations were on-going and the vehicles run, they just are not licensed. In response to the Board's question regarding what is required for a vehicle to be "road legal, " Mr. Barker indicated the appropriate equipment to operate on its own power is required, and a derelict vehicle is inoperable or unable to run on its own power. Mr. Welter reiterated that licensing was not the actual problem; the vehicles would have to be insured to be parked on the street. He indicated that because of previous problems encountered, the Weld County Sheriff's Office had already told them they could not park all the vehicles on the street and they have been put in this position by misinformation. Further discussion followed and staff clarified the violation as it relates to R-5 zoning, as well as State statute regarding inoperable vehicles versus R-5 zoning requirements. Mr. Welter readdressed the confusion that came from the initial information given them by Planning staff regarding noncommercial junkyards and the screening option. There was no further discussion and no public comment. Commissioner Hall moved to delay referral to the County Attorney for legal action of VI 02086 against Robert and Carolyn Welter for sixty days to allow the property owners to come into compliance by licensing the vehicles or moving them from the property. Seconded by Commissioner Baxter, the motion carried unanimously. (Let the record reflect Lee Morrison is now acting as Attorney of Record. ) VI 02093 - Clarence Langley: Mr. Kramer made this a matter of record and presented the case report, including Planning staff's recommendation for referral for legal action. He explained the noncommercial junkyard on this property is a violation of Sections 31.2 and 31.3.9 of the Weld County Zoning Ordinance, and to correct the problem the property owner must submit a screening plan for approval or remove the junk from the property. Holly Cronk, tenant on the property, explained Mr. Langley has been working on a pipeline in Wyoming and she has had difficulty contacting him; however, she is concerned about the violations and is acting on her own behalf at this hearing. She stated she has cleaned up the property considerably and has fenced the south side. Ms. Cronk indicated she would rather have the junk off the property, but cannot afford to move it herself. In response to Commissioner Hall, she stated she forwards Mr. Langley's mail to him, but has not heard from him recently. Ms. Cronk requested at least thirty day to contact the property owner to discuss correcting the violation. After further discussion, Ms. Cronk stated that she felt the property could be brought into compliance within sixty days. No public comment was offered. Commissioner Hall moved to delay referral of VI 02093 against Clarence Langley to the County Attorney for legal action for sixty days to allow the property owner to bring the property into compliance. The Board thanked Ms. Cronk for appearing and asked that she give Mr. Langley's Wyoming address to Planning staff, and directed Planning staff to correspond directly with Mr. Langley, and to send copies of all correspondence regarding this violation to Ms. Cronk, to facilitate communication between all parties. VI 02098 - Kandace Malwitz: Mr. Kramer reported this case closed. VI 02095 and BCV 02114 - Michelle Zeatlow/Sylmar Manor: Mr. Kramer reported this case closed. VI 02085 and BCV 02113 - GBG 1, Inc. : Mr. Kramer reported this case closed. VI 02096 - Hill-N-Park, Inc. : Mr. Kramer reported this case closed. VI #2092 - Kenneth Koch and Estate of Shirley Koch: Mr. Kramer advised the Board that Kenneth Koch had written requesting an extension, citing medical and financial problems at this time. Commissioner Harbert moved to delay referral of VI #2092 against Kenneth Koch and the Estate of Shirley Koch to the County Attorney for legal action until October 1, 1994. The motion was seconded by Commissioner Hall, and carried unanimously. VI #2078 and VI #2088: The property owners in these cases were not present at this hearing, and no public testimony was given. Commissioner Hall moved to accept Planning staff's recommendations and refer VI #2078 against Harvey and Donna Carey and VI #2088 against Doyle and Martha Nelson to the County Attorney for legal action. The motion was seconded by Commissioner Kirkmeyer, and carried unanimously. This Certification was approved on the 20th day of June, 1994.
