RE: APPROVE INTERGOVERNMENTAL AGREEMENT AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Intergovernmental Agreement
between the County of Weld and the City of Greeley, with the further terms and
conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said
agreement, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Intergovernmental Agreement between the County of Weld
and the City of Greeley be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 13th day of January, A.D. , 1992.

INTERGOVERNMENTAL AGREEMENT
THIS AGREEMENT, made and entered into this 13th day of
January , 1992 , by and between the COUNTY OF WELD, State
of Colorado , hereinafter called "County " , and the CITY OF
GREELEY, Colorado , hereinafter called "City" .
WHEREAS, the City of Greeley Public Works Department and the
Weld County Department of Engineering jointly determine it to be
in the City' s and County' s best interest to cooperate in a chip
seal project being administered by Weld County along North 6th
Avenue (Monfort Lamb Plant Annexation) and Weld County Road 62
(Ogilvy Third Annexation) in 1990 .
WHEREAS , these two sections of roadway were chip sealed in
1990 with the agreement that 1991 Food Tax Street Maintenance
Funds would be used to reimburse the County for the cost of chip
sealing the portions of these roadways located within Greeley
City Limits .
WHEREAS, the chip seal project was administered in August of
1990 , with the City 's share of the project being $6 , 292 . 58 .
NOW, THEREFORE, in consideration of the mutual covenants and
conditions hereinafter set forth, the County and City mutually
agree as follows :
The City of Greeley will process payment in the amount of
$6 , 292 . 58 to the County for chip sealing administered by the
County on street sections within the City Limits of Greeley
as defined above.
IN WITNESS WHEREOF, the parties hereto have duly executed
the Agreement the day and year first-above written .

CITY OF GREELEY, COLORADO
Ordinance No. 64 , 1991
AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF GREELEY,
COLORADO TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH WELD
COUNTY, COLORADO FOR THE 1990 CHIP SEAL PROGRAM.
BE IT ORDAINED BY THE CITY COUNCIL OF GREELEY, COLORADO:
Section 1. The Greeley City Charter, Section 3-7, permits
the City Council, by ordinance, to enter into contracts and
cooperative or joint activities with other governmental bodies
and that C.R.S. , $29-1-201, It seq. , articulates a state policy
encouraging governmental cooperation.
Section 2 . An agreement has been reached between the City
and Weld County to have the County chip seal certain City
roadways adjacent to County roadways. The cost of the program
has been included in the 1991 Food Tax Program. There are no
administrative or engineering costs involved.
Section 3 . The City of Greeley desires to enter into such
Intergovernmental Agreement for the purposes named in said
agreement.
Section 4. It is in the best interests of the City of
Greeley to enter into said Intergovernmental Agreement.
Section 5. The City of Greeley authorizes the Mayor to
enter into the Intergovernmental Agreement according to the terms
of the agreement described in Attachment "A".
Section 6. This ordinance shall become effective five (5)
days after its final publication, as provided by the Greeley
Municipal Charter.
PASSED AND ADOPTED, SIGNED AND APPROVED this 17th day of
December , 1991.

Attached please find four ( 4 ) copies of an intergovernmental
agreement for chipseal work done by Weld County in 1990 . The
City Council approved the required ordinance on December 17 ,
1991 . Please review the agreement , obtain Weld County
signatures , and return them to me for signatures .
