GONZALES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 25th day of August, 1993, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Jose A. Gonzales, P.O. Box 1015, LaSalle, Colorado 80645, for a Site Specific Development Plan and Special Review Permit to park ditch-lining equipment and store materials on the following described real estate, to-wit: Part of the NW*, Section 3, Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, at the hearing on August 25, 1993, the Board deemed it advisable to continue said matter to September 8, 1993, at 10:00 a.m. , and WHEREAS, at said hearing on September 8, 1993, Jose A. Gonzales, applicant, was present, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposed Special Review Permit area is located within the urban growth boundary area of the City of Greeley. The City Planning Commission has recommended denial of this case, but did offer several Conditions of Approval which have been incorporated into the Department of Planning Services' recommendation. The location of the two-acre Special Review Permit area and the attached Conditions and Development Standards make the proposed use consistent with the Urban Growth Boundary Area Goals and Policies of the Weld County Comprehensive Plan. 930841 PL0920 /at; LiL/E/)/ /7/2/) n, ngrin SPECIAL REVIEW PERMIT - GONZALES PAGE 2 b. The proposed use is consistent with the intent of the Agricultural Zone District and the proposed use is provided for as a Use by Special Review. c. The uses which would be permitted will be compatible with existing and potential surrounding land uses which include rural residences, crop production, native grasses, oil and gas production, and the Greeley/Weld County Airport. d. The proposed use, with Conditions of Approval and Development Standards, will be compatible with the future development of the surrounding area as permitted by the existing zone, the I-3 Zone immediately to the south, and with future development as projected by the comprehensive plans of the County and City of Greeley. e. The proposed Special Review Permit site is located in the Airport Overlay District, and shall conform to all tenets of this district. No other overlay district affect this site. f. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit to park ditch-lining equipment and store materials on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Prior to recording the plat: a. The Special Review Permit plat shall be amended to show the storage area screened from adjacent properties and road rights-of-way and set back a minimum of 50 feet from the west and north property boundaries. 930841 SPECIAL REVIEW PERMIT - GONZALES PAGE 3 b. The applicant shall submit evidence that the use will not be a safety hazard to aviation traffic in this area. c. A dust abatement plan for the on-site road shall be submitted and approved by the Weld County Health Department. d. The screening plan shall be submitted to and approved by the Department of Planning Services' staff. Fencing materials used for screening shall be only those materials specifically manufactured and advertised as fencing materials. The fence shall be a minimum of eight feet tall. The Site Specific Development Plan and Special Review Permit is to park ditch-lining equipment and store materials limited to scrap metal in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. No permanent disposal of wastes shall be permitted at this site. 5. The approved screening plan shall be implemented by January 1, 1995, if the site is still occupied, and said screening shall be maintained at all times on the property. 6. The dirt road providing access to the site shall be dust abated to reduce dust pollution in a manner approved by the Weld County Health Department. 7. No environmentally hazardous or toxic materials shall be stored on the site. 8. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 9. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 10. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 11. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 930841 DEVELOPMENT STANDARDS - GONZALES PAGE 2 12. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 13. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 930841 HEARING CERTIFICATION DOCKET NO. 93-55 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT TO PARK DITCH-LINING EQUIPMENT AND STORE MATERIALS - JOSE A. GONZALES A public hearing was conducted on September 8, 1993, at 10:00 A.M. , with the following present: Commissioner Constance L. Harbert, Chairman Commissioner W. H. Webster, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Greg Thompson The following business was transacted: I hereby certify that pursuant to a notice dated July 19, 1993, and duly published August 12, 1993, in the Windsor Beacon, a public hearing was conducted to consider the request of Jose A. Gonzales for a Site Specific Development Plan and Special Review Permit to park ditch-lining equipment and store materials. Lee Morrison, Assistant County Attorney, made this a matter of record and noted that said matter had been continued from August 25, 1993, due to the applicant not posting his sign in a timely manner. Greg Thompson, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record. Mr. Thompson explained, on behalf of Commissioner Webster, the overhead shows seven acres; however, the applicant proposes to utilize only two acres. Jose A. Gonzales, applicant and owner of Alvin's Ditch Line Company, was present and stated he only needs two acres, but, if the Permit is approved for seven acres, he will maintain the weeds, etc. In response to a question from Commissioner Webster, Mr. Gonzales said there are no cattle pens on the site and the ones to the south have been removed. In response to a request from Commissioner Hall, Mr. Gonzales said plywood, two-by- fours, materials used for framing structures and foundations, as well as ditch-lining materials which include two or three barrels of concrete compound will be stored on site. Mr. Gonzales responded to Commissioner Webster by describing the equipment as three motor graders, three trenchers, a backhoe, a dump truck, two truck tractors, two trailers, pickups, and small storage sheds. Commissioner Hall stated the storage of scrap iron must be limited to ten tons or less. Mr. Gonzales explained that steel posts and rods are picked up from ditches and piled, and then hauled to Andersen's Salvage. Mr. Thompson said Development Standard #1 states the stored material is limited to scrap metal, and he noted plywood was not discussed at the Planning Commission hearing. Chairman Harbert said the plywood would fall into ditch-lining equipment. Mr. Thompson noted the applicant needs to screen the site. In response to a question from Commissioner Hall, Mr. Thompson said Development Standard #5 refers to installation and maintenance of screening. He explained Condition of Approval #3b, required by the Planning Commission, was a Condition to be satisfied prior to scheduling before the Board. However, this request was preadvertised and said Condition, which required a screening plan be submitted to and approved by Planning staff, has not been satisfied. He noted the Condition also requires the fence to be a minimum of eight feet tall and constructed of visual screening material. Mr. Gonzales said the site cannot be seen from 8th Street and, since this is a temporary site until he can buy property, he would like to take the fence with him when he moves. He noted a six-foot fence was already constructed as a sound barrier and questioned whether a fence was necessary on the south side since it cannot be seen from 8th Street. Mr. Thompson said the property owner to the west, whose house sits southwest of the site, has submitted concerns. He noted only the storage area needs to be fenced. In response �r�R/j��-^11/ 1 / 930841 +(�) / RE: HEARING CERTIFICATION - GONZALES PAGE 2 to a question from Commissioner Kirkmeyer, Mr. Gonzales said he has a year-to-year lease, but it does not include removal of the fence. Mr. Morrison clarified the technical term for this lease is "license" and noted it has an addendum to avoid a recorded exemption. In response to questions of the Board, Mr. Gonzales said he agrees with the Conditions of Approval and Development Standards and he expects to be at this site for one more year unless he finds something to buy before then. Chairman Harbert said she does not feel the fence is necessary if Mr. Gonzales will only be there for a year. Mr. Morrison clarified, on behalf of Commissioner Kirkmeyer, that there are no provisions for a temporary use; but, if the use continues past a certain time, the applicant could be required to build a fence. He reminded the Board, however, there has not been a screening plan submitted. Mr. Thompson noted the materials stored could constitute a non-commercial junkyard, which would require screening. Mr. Morrison said the Board could add a Condition of Approval requiring Mr. Gonzales to submit a screening plan to be implemented after January of 1995, and maintained in accordance with said plan. In response to a question from Commissioner Hall, Mr. Gonzales said after October would be the best time for him to move. He agreed to the suggested Condition of Approval requiring screening around the equipment only, after January 1995. There was no public testimony offered concerning this matter. Commissioner Webster moved to approve the request of Jose A. Gonzales for a Site Specific Development Plan and Special Review Permit to park ditch- lining equipment and store materials, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record, and the amended Development Standard concerning screened fencing by January 1, 1993. Commissioner Kirkmeyer suggested the language be added to Development Standard 1/5, and Mr. Thompson noted Condition of Approval #3b also concerns fencing. Mr. Morrison suggested the language requiring the screening plan to be submitted at this time be added as a Condition of Approval; however, it does not need to be implemented until January 1, 1995. Commissioner Webster agreed to amend his motion to include said suggestions. The motion was seconded by Commissioner Kirkmeyer and carried unanimously. [Clerk to Board's note: The abovementioned Condition of Approval #3b will actually be Condition of Approval I/3d in the Resolution of the Board of Commissioners due to the deletion of Conditions of Approval #3a and 3b, which were to be met prior to scheduling before the Board, according to the Planning Commission's Resolution. Jose Alvin Gonzales, applicant explained they need more room for ditch equipment than their present location at 3921 Larson Avenue in Evans provides . He submitted a letter stating they agree to only have the use of the land. The land is owned by a Susan Boulter. They plan to level out the ground and clear it of existing weeds and debris and to park their equipment in an orderly fashion. The Chairperson asked if there was anyone in the audience who wished to speak for or against this application. Lee Bublitz, surrounding property owner, said he is not in favor of this type of use located next to his property. This area is the corridor to the airport and is an eyesore already. If the Planning Commission approves this application, then the property should be screened. Susan Boulter, property owner, reminded the Planning Commission that this is not a permanent operation, the property will be leased on a year to year basis. Lanell Adler, City of Greeley Planner, showed an overhead and explained the City Planning Commission has recommended denial of this application. It is not compatible with surrounding land uses (7 residences) and will be a negative visual impact in this area. This application is in the Airport runway critical area, and safety is a concern. The application does not address hazardous or toxic material storage, etc. Jose A. The screening plan shall be submitted and approved by the Department of Planning Services' staff prior to amending the plat. The City of Greeley Planning Commission considered the request at its August 10, 1993 , regular meeting and recommended denial based on the following: 1. The City of Greeley Comprehensive Plan encourages industrial development to be located in areas where conflict with other land uses are minimal and which have rail access and/or proximity to expressways. Obviously, this site has neither rail access nor close proximity to an expressway. The proposed industrial storage yard with no screening or buffering which is relatively close to existing and potential residential uses will inevitably cause conflicts such as visual pollution and dust. 2 . The City of Greeley Comprehensive Plan encourages industrial development to be located so that negative external influences generated by the industrial use to not affect either existing or potential nonindustrial land uses located within the Long-Range Expected Growth Area. This site is located within the Long-Range Expected Growth Area and, if approved as proposed, will negatively impact both existing and potential nonindustrial uses. Seven residences are currently located with potential visual access to the proposed site. In addition, County R-1 (Low-Density Residential) zoning exists approximately 1, 000 feet north of this site. Negative external visual impacts will affect both existing and potential residential land uses in the area. 3 . The Comprehensive Plan encourages all development to enhance the visual appeal of the City with a special emphasis on the Greg Thompson August 11, 1993 Page Two City's principal thoroughfares, entryways, and activity areas. This site will be visible from East 8th Street, an entryway into the city. The storage of large equipment on an elevated plateau will not improve the visual appeal of the city for drivers entering the area from the east. 4. The Comprehensive Plan encourages all development to be designed to promote compatibility among neighboring land uses of differing intensity and character. These efforts, where practical and appropriate, should include complementary landscaping, building massing, material selection, and site design. The industrial-type development proposed does not encourage compatibility among existing and potential neighboring urban residential land uses since the site includes no buffering landscaping or screening. 5. The Comprehensive Plan states that when developing in the vicinity of the Weld County Airport, commercial and industrial uses are discouraged in the runway critical areas but may be permitted if safety and noise issues are fully addressed. The proposed site is located in the Weld County Airport runway critical area. The Comprehensive Plan discourages the industrial-type use unless safety and noise issues are fully addressed. Although noise impacts do not seem to be an issue in this case, safety issues could be critical in this location. Unless the issues of safety that revolve around the possibility of an aviation accident on the site are addressed, the Comprehensive Plan would not encourage this type of development in this location. Although the City of Greeley would prefer that this application be denied in this location, the Planning Commission offered the following conditions should the Weld County Planning Commission choose to recommend approval to the County Commissioners: 1. Prior to locating the equipment on site: A. An effective visual buffering and screening plan of the storage area should be approved by Weld County to mitigate the visual impact of the site to traffic along East 8th Street corridor and surrounding residence and Cherry Avenue, a proposed City arterial. 9:30941. THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE APPROVED FOR THE FOLLOWING REASONS: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 24.3 of the Weld County Zoning Ordinance as follows: The proposed Special Review permit area is located within the urban growth boundary area of the City of Greeley. The city planning commission has recommended denial of this case, but did offer several conditions of approval which have been incorporated into the Department of Planning Services recommendation. The location of the two acre Special Review permit area and the attached conditions and development standards make the proposed use consistent with the urban growth boundary area goals and policies of the Weld County Comprehensive Plan. The proposed use is consistent with the intent of the Agricultural zone district and the proposed use is provided for as a Use by Special Review. The uses which would be permitted will be compatible with existing and potential surrounding land uses which include rural residences, crop production, native grasses, oil and gas production, and the Greeley/Weld County Airport. The proposed use, with conditions of approval and development standards, will be compatible with the future development of the surrounding area as permitted by the existing zone, the I-3 zone immediately to the south, and with future development as projected by the comprehensive plans of the County and City of Greeley. The proposed Special Review permit site is located in the Airport Overlay District, and shall conform to all tenets of this district. No other overlay districts affect this site. 9a0f341 RECOMMENDATION, USA-1023 Jose A. Gonzales Page 2 Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. The attached Development Standards for the Special Review permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder' s office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Prior to scheduling before the Board of County Commissioners: a. The applicant shall submit a lease which indicates the landlord rents the USE of the land to the applicant, or in lieu of that, the applicant shall submit an application for a recorded exemption to create the two acre parcel for this Special Review permit. The application materials and the Special Review permit plat shall be amended to describe the two acre Special Review permit area. b. The screening plan shall be submitted and approved by the Department of Planning Services' staff prior to amending the plat. Fencing materials used for screening shall be only those materials specifically manufactured and advertised as fencing materials. The fence shall be a minimum of 8 feet tall. 4. Prior to recording the plat: a. The Special Review permit plat shall be amended to show the storage area screened from adjacent properties and road rights-of-way and set back a minimum of 50 feet from the west and north property boundaries. b.
