RESOLUTION
RE: APPROVE VACATION OF SUP #259 - COOLEY GRAVEL COMPANY
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated January 14, 1975, the Board did approve
Special Use Permit #259, for a gravel pit operation, for Harold Baumgartner on
the following described real estate, to-wit:
SE*SWLL of Section 9, NW* of Section 16, and
part of the NEII of Section 17, all in
Township 2 North, Range 68 West of the 6th
P.M. , Weld County, Colorado
WHEREAS, by Resolution dated June 15, 1994, the Board did approve Special
Review Permit #1046, for an open pit sand and gravel mine, including concrete and
asphalt plants, for Cooley Gravel Company, and
WHEREAS, Condition of Approval #3e of Special Review Permit #1046 required
the applicant to submit a letter requesting the vacation of Special Use Permit
#259 from the Board of County Commissioners by separate resolution, and
WHEREAS, in accordance with said condition, Cooley Gravel Company has
submitted to the Board such a letter, and the Department of Planning Services
staff has recommended said vacation be approved, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the
recommendations of the Department of Planning Services staff and all of the
exhibits and evidence presented in this matter and, having been fully informed,
deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Special Use Permit #259 be, and hereby is, vacated.

RE: Weld County Colorado SUP259
Dear Ms. Dunn,
We are hereby requesting vacation of the subject SUP259 which was granted several years ago.
That permit was never activated and as the current owner of the property encompassed by the
old SUP, we never expect to activate that permit.
The current request for a use by Special Review for a gravel mine permit at this location is in
compliance with the current mining standards. Upon approval by Weld County and the Division
or Minerals and Geology of the State of Colorado, we expect to consummate the mining
operation in accordance with the adopted development plans and standards.
