HomeMy WebLinkAbout911287.tiff RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR COMMERCIAL USE (EXCAVATING CONTRACTOR SHOP) IN THE A (AGRICULTURAL) ZONE DISTRICT - ELAINE ZADEL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 23rd day of October, 1991, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Elaine Zadel, 18250 Weld County Road 19, Johnstown, Colorado 80534, for a Site Specific Development Plan and Special Review Permit for a commercial use (excavating contractor shop) in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the SW'y SW*, Section 34, Township 4 North, Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by David Shupe, Landmark Engineering Ltd. , and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposed use is consistent with the Weld County Comprehensive Plan. The Special Review Permit area is located within the urban growth boundary area of the Town of Milliken. The Town of Milliken Planning Commission reviewed this request and found no conflicts with its interest. b. The proposed commercial use of the property is consistent with the intent of the A (Agricultural) Zone District and is provided for as a use by special review. c. The uses permitted will be compatible with the existing surrounding land-uses which include irrigated agricultural production, dry land pasture, and rural residences. No overlay districts affect the site. e. Special Review Permit Development Standards and Conditions of Approval will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a commercial use (excavating contractor shop) in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Within two weeks of approval by the Board of County Commissioners and prior to recording the plat map, the applicant shall submit estimate of costs, and a proposal for a performance guarantee as allowed in the Weld County Zoning Ordinance, Section 24.4.3, for construction and installation of the screening plan approved by the Department of Planning Services and the Soil Erosion Control Plan approved by the Platte Valley Soil Conservation District. The estimated amount and performance guarantee shall be reviewed and approved by the Board of County Commissioners. The performance guarantee shall be in a form acceptable to the Board of County Commissioners. 4. Prior to recording the plat map: a. A recorded exemption shall be reviewed and approved by the Department of Planning Services. As part of the recorded exemption application materials, evidence shall be submitted that the land split with the property to the east is in compliance with the Weld County Subdivision Regulations. b. The performance guarantee to ensure installation, and completion of the approved screening and soil erosion control plans shall be filed with the Clerk to the Board for the proper amount. The guarantee shall be returned to the 911287 Page 3 RE: USA - ZADEL applicants or released after the improvements have been satisfactorily completed. Should the improvements not be completed within 120 days from the date of approval of the Special Review Permit by the Board of County Commissioners, the County shall take corrective action to ensure compliance with the approved plans and the guarantee shall be forfeited. 5. Within 30 days of approval by the Board of County Commissioners an I.S.D.S. evaluation on all existing septic systems shall be necessary, prior to issuing the required septic permits on the existing systems. 6. A bathroom with adequate toilet facilities serviced by an individual sewage disposal system, is required for the proposed facility and the system shall be designed by a registered professional engineer and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 7. A zoning permit for temporary use during construction shall be applied for and approved for the existing mobile home prior to the issuance of a building permit for the site constructed dwelling. 8. The existing mobile home shall be removed from the Special Review Permit Area within 30 days of occupancy of the site constructed dwelling. The Site Specific Development Plan and Special Review Permit is for a commercial use (excavating contractor shop) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. Any required emissions permit shall be obtained from the Air Pollution Control Division, Colorado Department of Health for fugitive dust and odors. 5. No permanent disposal of wastes shall be permitted at this site. 6. All waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 7. Fugitive dust shall be controlled on this site. 8. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 9. The approved screening and soil erosion control plan shall be maintained at all times. Any dead or dying plants shall be replaced within the next planting season with substantially similar kind. 10. Weld County Road 19 shall not be used as a haul route. 11. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 12. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 13. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 911287 Page 2 RE: DEVELOPMENT STANDARDS - ZADEL 14. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 15. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 16. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Lee Morrison, Assistant County Attorney, made this a matter of record. Keith Schuett, Planning Department representative, recommended the Resolution of the Planning Commission and the Planning staff's recommendation be entered into the record as written, with a change to Condition of Approval 03. He said all requirements have been met except for the improvements agreement, which is to be submitted to the Board within two weeks. He said the agreement has been received, but not yet reviewed by staff. David Shupe from Landmark Engineering Ltd. , represented the applicant, and stated the change was agreeable. He also explained Mr. Zadel's absence. There was some discussion concerning the bridge requirement on Road 19. Mr. Schuett said the applicant has agreed to travel on Road 38. There was no public testimony offered concerning this matter. Mr. Shupe said the applicant has no problem with the recommended Development Standards and Conditions. Commissioner Webster moved to approve the request of Elaine Zadel for a Site Specific Development Plan and Special Review Permit for a commercial use (excavating contractor shop) in the A (Agricultural) Zone District, based on the recommendation of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Kennedy, and carried unanimously. John Zadel, representative for Elaine Zadel asked if the Planning Commission had any questions. Judy Yamaguchi asked about weight of the equipment. John Zadel said they have 3 rubber tire backhoes that weigh 8 to 10 tons, and a small axle dump truck weighing 50,000 pounds that has to be hauled with a semi-tractor. Judy Yamaguchi asked about proposed routes. John Zadel explained there is a paved road 1 mile west of the proposed location. They will not use Weld County Road 19. The Chairman asked if there was anyone in the audience who wished to speak for or against the application. No one wished to speak. Lanell Swanson explained that new structures will have to be within code requirements for floodplain areas. Fred Otis discussed the problem the surrounding town and city governments have in understanding the Change of Zone issue. The Chairman asked if there was anyone in the audience who wished to speak for or against this application. John Nolan, surrounding property owner, said he had no objection to the zoning change but 2 nearby properties have been for sale for a considerable time. What about using existing Industrial property instead of converting more. Ann Garrison asked if this property has been used recently as zoned. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. Any required emissions permit shall be obtained from the Air Pollution Control Division, Colorado Department of Health for fugitive dust and odors. 5. No permanent disposal of wastes shall be permitted at this site. 6. All waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 7. The current residence, a mobile home, is to be removed as soon as a site-constructed residence is completed on the site in the location shown on the map. The Contractor, Northern Colorado Constructors, is basically a small excavating and pipeline-laying company. Storage of several pieces of construction equipment, listed below, is accomplished at the site, coupled with repair and routine maintenance of the Contractor' s own equipment. No repair work is performed for others. The agricultural context of much of the work performed has dictated this location for the business. The owner resides in the mobile home, and also raises some cattle on the property. Currently there are some six head of cattle on-site. Adjacent land uses are agricultural , except for the railroad right-of-way. The nearest residential structures are some 500 feet South and East, except for the owner' s mother ' s residence which is on lot A of the exemption being filed concurrently. That residence is some 700 feet or more North of the shop building which is the hub of this request. The nature of this business is such that it seldom if ever involves client visits to the site. It would not average one visit per day from clients. It employs one person in addition to the owner, and operates one shift per day, Monday through Saturday, during which the actual work takes place at the various job sites. Equipment is kept and serviced at this site. Water supplied to the site is from the Little Thompson Water District. Their letter of commitment is attached. Access to the site is provided via Weld County Roads 38 and 19, to which it is adjacent. Equipment for the business includes a dump truck, a low-boy trailer, two backhoes, a loader and a motor patrol . All are well within legal weight limits, and under normal operating patterns would not leave and enter the premises more than once per day. 0 The complex is served by a septic system, which was approved by the Weld County Health Department. Fire protection can be supplied by simply pumping from the pond near the South- west corner of the property, or from pumper trucks. Based upon preliminary contacts with the Platteville Fire Protection district, no additional improvements will be required. As stated above, six head of cattle are pastured on the premises, and are considered to be the optimal number to be cared for at any one time. At no time would the number of animal units kept at the site exceed the maximum use by right for the Agricultural Zone. No waste, stockpile or outside storage areas are associated with this use, and debris, junk and other wastes generated at various job sites are trucked to a landfill from there rather than being recycled through the business site. Trash generated incidental to the house and to equipment repair and maintenance functions will be stored in a commercial dumpster, and picked up on a regular periodic basis. An unnamed natural swale which drains an area of approxi- mately 300 acres o£ farmland, traverses the extreme Southwest corner of the site. Its flow has been interrupted upstream of the property by construction of farm ponds. These are of a "flow-thru" type and, therefore, drainage from storms does enter the property thru the culvert under County Road 19 . The applicant has created a detention pond to receive such runoff. It is then discharged to the county Road 38 borrow ditch thru two 12" diameter pipes. This pond is also a "flow-thru" type, but since its outlet is of lower capacity than its inlet, it does provide detention, in the event of major storms. The bulk of the on-site drainage flows overlot to either the County road borrow ditch or the railroad borrow ditch. The construction contemplated by this request, the new house, will increase the impervious surface of the area by less than two tenths of 18 , and thus will not have a measurable impact upon the runoff generated by this subbasin. The flat area graded out to the Southeast of the main shop building is to be the site of the new residence. It will have a walkout basement. The fill slopes will be shaped, graded and planted to grass upon completion of the house, both controlling possible erosion and beautifying the site. The business is in operation now, so no time is required for construction or start-up. No reclamation procedures are deemed to be necessary in the event of cessation of this use. c�i .lQ _ Compatibility Statement This proposal is for a Contractor ' s Shop, consistent with recent revisions to the Weld County Zoning Ordinance. It is located in the Agricultural Zone and has general ties to that district, in that some of the work performed is for agricultural purposes. These include installation and repair of rural water lines, installation of septic systems, field drains, irrigation lines and ditches, for example. The land itself is of relatively poor agricultural quality, according to SCS data supplied within this application. The use has extremely low traffic impacts as stated, and will not intrude upon the health, safety or welfare of the neighborhood or the County. Residential and agricultural uses will continue on the property, generally insuring compatibility with adjacent uses, particularly as the ser- vice rendered by this business take place off the premises. Other than the railroad right-of-way and oil-removal opera- tions, the adjacent uses are all agricultural in nature. While this proposal lies within the urban growth area bound- ary of the Town of Milliken, as shown by the map on p. 32 of the Weld County Comprehensive Plan, it is not contiguous to . the town and is not, therefore, eligible for annexation. On the other hand, it requires no urban services of a level not already available at the site. The use is existing, and has proven that it needs no further County services and, there- fore, does not adversely impact the county tax base. No infrastructure improvements are deemed necessary, so no proposal for distribution of costs is included. Growth of the Milliken-Johnstown complex to this area is not within the foreseeable future, and this use is not incompatible with fringe development at the edges of rural communities. The special use review area does not lie within a flood plain, geologic hazard or airport overlay district. Because the services rendered by this business are conducted off- premises, the applicant feels a noise report is unnecessary, and requests that the requirement for it be waived by the Department of Planning Services. Alternate year harvesting is suggested, and anticipated yields are relatively low. Building site limitations noted in Table 6 for the Nelson Loam are mitigated simply by matching the size of foundation elements to the soil bearing capacity. The sanitary facility limitations noted in Table 7 can be mitigated by moderate mounding of the system. Because of the large size and the slope of the property, this technique poses no physical problem. Preliminary permeability data would tend to indicate a percolation rate in the 30 - 60 min. /in. range, which is not a severe limita- tion for the use intended. The underlying bedrock is a sandstone. In this type of material the percolation rate often improves with use, as cements and fines are gradually leached through. Again, required clearances can be main- tained by mounding, however.
