RE: APPROVE APPROVAL DOCUMENT FOR WELD COUNTY ADMINISTRATIVE OFFICE COMPLEX,
PHASE I, WITH THE CITY OF GREELEY AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Approval Document for Weld
County Administrative Office Complex, Phase I, with the City of Greeley, with the
terms and conditions being as stated in said approval document, and
WHEREAS, after review, the Board deems it advisable to approve said
approval document, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Approval Document for Weld County Administrative
Office Complex, Phase I, with the City of Greeley be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said approval document.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 30th day of March, A.D. , 1992.

the City of Greeley Zoning Code of 1976 and represents approval by
the City of Gfk$ ily, Colorado, of a planned unit development (PUD)
presented ty ;neDCL€4 Council by Weld County, on December 3, 1991.
WHEREAS, the City Council of the City of Greeley, Colorado, has
zoned the aforementioned property PUD and subsequently reviewed
and approved the final PUD plan and directed the preps- * on of
this Approval Document; and
WHEREAS, the boundary of the Weld County Business Park Concept PUD
is more fully described on Exhibit A attached hereto and
incorporated herein by reference; and
WHEREAS, in accordance with the Greeley Zoning Code of 1976, Weld
County has presented a final PUD plan for certain real property
situated within the City of Greeley, County of Weld, State of
Colorado; and
WHEREAS, the spirit and intent of the conceptual PUD plan is being
maintained by the county having committed to replace 17 acres lost
to governmental use in Tract B of the Weld County Business Park
with 30 acres of land in either Tracts A or D of the Weld County
Business Park; and
WHEREAS, the above-referenced commitment is reflected in the
letter from Gordon E. Lacy, Chairman of the Weld County Board of
County Commissioners, and presented as Exhibit B; and
WHEREAS, after evaluating the final PUD plan, City Council has
found that the PUD plan will serve the public interest and that it
will provide the safeguards to he public and to the persons owning
and occupying the land area of the PUD which would be approximately
equivalent to the safeguards provided by the regulations in the
Greeley Zoning Code of 1976.
NOW, THEREFORE, final PUD approval is given to the Weld County
Office Complex Phase I PUD plan which includes the following
provisions:
A. Land Use
The approved land use is office and administrative services.
B. Circulation
Pedestrian and automotive access is to be provided in
accordance with Exhibit C.

C. Building Design and Location
The exterior design of Phase I structures is to be in
accordance with Exhibit D.
Building siting is to be in accordance with Exhibit C.
D. Landscaping and Open Space
Landscaping and open space shall be provided in accordance
with Exhibit E.
E. Signage
Signage is to consist of one 34-square-foot freestanding brick
sign with 4-inch metal letters and two 60-square-foot wall
signs with 10-inch metal letters.
F. Lighting
Exterior lighting is to be consistent with the exterior
lighting approved and installed for the Weld County Human
Resources facility.
G. Grading
Grading should be in general compliance with Exhibit C.
It is understood by all parties that the PUD plan approved by
virtue of this document is an integral part of the zoning of the
above-described tract of land and that pursuant to Section
18.30.260 of the Zoning Code of 1976, all successors, heirs, or
assigns are obligated to comply with the requirements and
limitations of this Approval Document as though such successors,
heirs, or assigns have been landowners at the time this approval
document was issued. Any disputes, disagreements, or matters not
covered by this Approval Document shall be resolved by referring to
the Greeley Zoning Code of 1976 as applicable at the time such
disagreements or matters should arise. It is also understood that
any failure to comply with the requirements and limitations of the
Approval Document will subject the landowner, its successors,
heirs, or assigns to penalties as provided by virtue of Section
18.30.230, 18.30.240, and 18.44 of the Zoning Code of 1976 and
Section 1.32 of the Greeley Municipal Code, as well as all civil
remedies available to the City of Greeley to prevent or remedy any
Zoning Code violations.

Dear Mr. Brennen:
Weld County is in receipt of a copy of your September 16, 1991, letter to Ms.
Rebecca Safarik concerning EDA Project No. 05-01-02311 (Exhibit A) and the City
of Greeley's inquiry of August 30, 1991 (Exhibit B) . We received these copies
after the local news media made inquiry regarding our comments on the letters.
Had we known of the City of Greeley's inquiry, we would have provided information
concurrently.
In the way of background, Weld County government is in the process of locating
additional County offices in the industrial park known as Weld County Business
Park that was funded in part by the EDA grant. The City of Greeley and some
downtown Greeley property owners object to the new County offices not being built
in downtown Greeley.'In fact, they are proposing a charter amendment requiring
all County offices to be built within a six block radius of the County
Courthouse. As a result of their objections, a special election has been
scheduled for October 29, 1991, to allow the citizens of Weld County to decide
about the options of a downtown Greeley site versus the Weld County Business Park
site. It is the opinion of the Board of County Commissioners that the inquiry
to you was politically motivated by the City Manager of Greeley to undermine the
Weld County Business Park site since the inquiry was done without the County's
knowledge, and the result of the City's inquiry was provided to the County after
a press release by the City Manager of your letter. As a local official, I am
embarrassed that the political differences in our county have involved you in
this matter to attempt to use your agency for political gain in a local election
issue.
Weld County via Don Warden, Director of Finance and Administration, made a phone
inquiry to John Zender of your office in July, 1991, regarding the location of
County facilities on the east side of 17th Avenue in the industrial park instead
of the west side, which is where the conceptual plan originally showed them. The
intent was not to dedicate any less than the grant commitment of 76 acres for
private industrial development but to substitute 17 acres on one side of the road

for 17 acres on the other side of the road in the same industrial park. The
reason for the change was to allow for the entrance of the industrial park to be
nicely landscaped and demonstrate development on both sides of the main entrance
drive for marketing purposes. Mr. Zender was very clear that if this was a
change in the commitment or management plan of the industrial park, that the
Regional Director would have to approve such a change. He said to check grant
documents to see if it constituted a change. Upon review of the documents by
County staff, it was not believed to be a change since 76 plus acres in the
industrial park remained for private development, which was the County commitment
as we understood it. In hindsight, a formal written change request or notice of
our plans should have been provided to you. The original site plan (Exhibit D)
showed 76 acres for private development and 66 from public facilities in the
industrial park. The County's intent, even in a 50-year facilities plan, would
use 45 acres or less for public facilities, leaving a total of 97 acres for
private development. In addition, another 40 plus acres are available
immediately adjacent to the industrial park for private industrial development
should we be so fortunate economically to need it at a future date. The City of
Greeley's letter (Exhibit B) leaves one with the impression the County is
abandoning its commitment to use the industrial site for private industrial
development and converting parts or all of this committed acreage to public
(County) facilities. That is far from the intent of our plans and simply not
true.
Weld County, along with Economic Development Action Partnership is actively
marketing the industrial park as demonstrated by the attached brochure (Exhibit
E) . There are interested prospects that we are optimistic may locate at this
site in the next 12-18 months.
The County included public (County) facilities in the industrial park from the
beginning of the conceptual planning of this project not only to accommodate
future facility needs, but also to direct some public and private business
activity in a very economically depressed area.
The changes we are proposing, quite frankly, were being done to enhance the
attractiveness of the industrial park and create more activity in the
neighborhood to attract industrial and commercial development and improve the
neighborhood's employment base. The project, in the minds of County staff and
Commissioners, remains consistent with the initial proposal. The location of
County offices on both sides of the street of the main entrance and the ambulance
building (similar to a firehouse) at the secondary entrance, allows us to fully
landscape the entrances to the industrial park to make the industrial park much
more attractive for marketing purposes. The added activity of 90 county
employees and public traffic of approximately 200-300 citizens visiting the
complex daily will generate significantly more economic activity in an
economically depressed neighborhood that is predominately low-income minority
residents. With these changes, we continue to have acres within the industrial
park available for private economic development. Also, the County intends to
make another 40 acres of County owned land adjacent to the industrial park
available for economic development if the opportunity presents itself in the
future. These changes, the County staff and the Commissioners are convinced,
. will enhance the original intents and purposes of the EDA grant, which were to

attract industrial and commercial development to the area and improve the area's
employment base.
For these reasons, the Board of County Commissioners formally requests that the
following amendments be approved by your agency in relationship to EDA Project
No. 05-01-02311:
1. Fifteen acres in Tract B (Exhibit D) be permitted to be
developed into a County office complex with 11 acres being
offices and parking and 4 acres landscaped green area at
the entrance of "0" Street and 17th Avenue.
2. Two acres in Tract B at the entrance of "N" Street and 11th
Avenue be landscaped and an ambulance station constructed.
3. In return, 30 plus gross acres in Tract A and Tract D originally
designated for public facilities will be designed for private
industrial development. The specific sites will be identified as
development occurs.
Hopefully, you find these changes acceptable to your agency and share our view
that the changes enhance the EDA project's likelihood to attract industrial
development and improve the employment base of the area. I apologize again that
this matter has been used to politicize a local election issue. Since the
special election on the matter that relates to this issue is October 29, 1991,
we would appreciate as rapid of response as possible to eliminate this matter as
an influencing factor one way or the other in the election.
