LLOYD WASHBURN WHEREAS, the Board o£ County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d), CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Amended Recorded Exemption No. 971, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Amended Recorded Exemption No. 971 was submitted by J. Lloyd Washburn for property which is located in part of the Wi NW} of Section 28, Township 8 North, Range 62 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 52.463 acres and 3.537 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the applicant submitting a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. Lloyd Washburn. The parcel of land on which this request is being made is described as Lot "B" of Recorded Exemption #971, located in part of the W2 NW4 of Section 28, T8N, R62W, of the 6th P.M. , Weld County, Colorado. The property is located south of and adjacent to State Highway 14 and north of the Town of Briggsdale. The request is to change the size of the existing Lot "B" from 56 acres, more or less, to 52.463 acres, more or less. The applicant wishes to retain this property for agricultural purposes. The 3.537 acres will be exempted by the approval of SE #407. Based upon the submitted information and policies of the County, the Department of Planning Services' staff recommends the request be approved for the following reasons: 1. The applicant has demonstrated in the submitted application materials that the request complies with the submission requirements of Section 9-2 C. , of the Weld County Subdivision Regulations. 2. The applicant has demonstrated in the submitted application materials that the standards and conditions of Section 9-2 E. (1) (a) through (m) of the Weld County Subdivision regulations have been met. Attached is a copy of the Agreement between the two parties . I currently own the property which the Fire Protection District intends to transfer to Weld County. The property is now included in Recorded Exemption No. 0545-28-2-RE971 . I intend to transfer the property to the Fire Protection District, reserving a 30 foot access easement on the east edge of the property. It is my understanding that in order to accomplish this task, I must first apply for an Amended Recorded Exemption and Subdivision Exemption. This letter shall serve as my statement pursuant to the application for the Amended Recorded Exemption and Subdivision Exemption. The Recorded Exemption Application requirements are attached. The completed Application form is attached. 2 . The completed Certificate of Conveyances on the subject property is attached. 3. Attached is a copy of the Deed which indicates that I have an interest in the subject property. 4 . The purpose and reason for splitting off the subject property from Lot "B" of RE971 is best stated in a Memorandum from Bruce T. Barker, Assistant Weld County Attorney, dated March 20, 1991 . A copy of the Memorandum is attached. Please note that the grader shed which will be placed on the subject property will be serviced with water from the Briggsdale Water Company. 5 . The proposal is consistent with the policies of the Weld County Comprehensive Plan, because the use of the property for a grader shed by Weld County, Colorado, will not take productive farm ground out of production. The subject property currently lies immediately to the west of an abandoned railroad grade. It is separated from the rest of Lot "B" of RE971 by this railroad grade. The property is small in size (3 . 537 acres, more or less) . Its separation from the rest of Lot "B" and its small size make the property unusable for farm production. 6 . See the answer to 5 . , above. 7 . The use of the subject property for the placement of a grader shed for Weld County, Colorado, is permitted as a Use by Right in the "A" (Agricultural) District. The use will be compatible with existing surrounding land uses, because the property will do nothing more than house a grader shed and a mobile home to be used by the grader operator. The grader operations which will emanate from the property are necessary for the maintenance of County roads which are used in the course of farm production. Most, if not all, of the surrounding uses are geared toward farm production. 8 . The uses permitted will be compatible with the future development of the surrounding area as permitted by the existing zone and with future development as projected by the Weld County Comprehensive Plan. 21.0626 • 9 . The Proposal will be consistent with efficient and orderly development of the area. Access to the property will be adequate from either State Highway 392 or State Highway 14 . Use of the property for placement of a grader shed will aid the efficient and orderly development of the area, because it is hoped that the grader operations which emanate from the property will more efficiently serve the residences and businesses in the Briggsdale community. 10. The subject property is serviced by the Briggsdale Water Company. The grader shed and the mobile home will be serviced by individual septic disposal systems . 11 . The property under consideration for the Amended Recorded Exemption is not located in a flood plain, geologic hazard, and/or the Weld County Airport Overlay District. The Application complies with Section 50, Overlay District Regulations, as outlined by the Weld County Zoning Ordinance. 12 . Assistant County Attorney sub;.<t: The Purchase of Parcel for Briggsdale Grader Shed The Board of County Commissioners of Weld County has asked the County Attorney' s Office to complete the purchase of property for the relocation of the Briggsdale Grader Shed. The details of the transaction have been negotiated by Gordon Lacy and Kay Washburn, President, Briggsdale Fire Protection District. As of this date, we are in the process of having both parties sign a written agreement for the transaction. Details of the transaction are as follows : a. The property is shown on the attached plat as provided by Chuck Jones, Surveyor. He has also provided a written description which was required by Transamerica Title. A copy of the written description is attached. b. The property was originally part of Lot B of Recorded Exemption No. 0545-28-2-RE971. The parcel is located immediately north of Lot A of that Recorded Exemption. Lot A is now owned by the Briggsdale Grain Company. All of Lot B is currently owned by Lloyd Washburn, the father of Kay Washburn. c. The parcel will need to be excluded from the Recorded Exemption. In order to do that, we have discussed with you the following procedure: 1 . Mr. Washburn will apply for an amendment to the Recorded Exemption which will exclude the subject parcel from Lot B. 2 . The parcel will then be exempted from the Subdivision Regulations pursuant to the definition statement found in Section 2-1A. (3) . d. After the Recorded Exemption is complete, Lloyd Washburn will transfer ownership of the parcel to the Briggsdale Fire Protection District. Mr. Washburn will reserve a 30-foot access easement on the east side of the parcel . e. The Briggsdale Fire Protection District will then transfer ownership of the parcel to Weld County. There are a few other details which will be included in the written agreement. First, the Fire Protection District will pay for an extension of the water line and hookup for the new parcel. Second, the Fire Protection District will pay for a new propane tank to be located on the parcel. The property is currently owned by Lloyd Washburn. Mr. Washburn plans to transfer the ownership of the property to the Fire District.
