RE: ACTION OF BOARD AT PROBABLE CAUSE HEARING CONCERNING SPECIAL REVIEW
PERMIT #887 - LARRY SMITH
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is
vested with the authority of administering the affairs of Weld County,
Colorado, and
WHEREAS, on December 18, 1991, a Probable Cause Hearing was held
before the Board to consider setting a Show Cause Hearing to determine
whether or not Larry Smith, was in compliance with certain Conditions of
Approval and Development Standards contained in Special Review Permit
#887, and
WHEREAS, the alleged violations were said to be occurring on property
described as Lot 1, Block 6, Carmacar Ranchettes, Weld County, Colorado,
and
WHEREAS, the Board, after hearing testimony from the Planning
Department, finds that pursuant to the Standard in the Administrative
Manual there is sufficient probable cause to schedule a Show Cause Hearing
to consider whether or not the Special Review Permit issued to Larry Smith
should be revoked for failure to comply with certain Conditions of
Approval and Development Standards, and
WHEREAS, the Board shall hear evidence and testimony from all
interested parties at said Show Cause Hearing.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Weld County, Colorado, that a Show Cause Hearing be scheduled to
determine whether or not the Special Review Permit issued to Larry Smith,
should be revoked.
BE IT FURTHER RESOLVED by the Board that the issue to be considered
by the Board at said Show Cause Hearing is whether or not the permit
holder is in compliance with the following Development Standards:
9. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
BE IT FURTHER RESOLVED by the Board that the date for the Show Cause
Hearing shall be January 8, 1992, at or about 10:00 a.m. , and the hearing
shall be held in the First Floor Hearing Room of the Weld County
Centennial Center, 915 10th Street, Greeley, Colorado.

LEGAL DESCRIPTION: Lot 1, Block 6, Carmacar Ranchettes, Weld County,
Colorado.
LOCATION: 1960 Spruce Drive.
It is the opinion of the Department of Planning Services' staff that the
following Development Standard, as approved for USR-887 is not in
compliance:
9. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
USR-887 was approved by the Board of County Commissioners on February 7,
1990. The Special Review permit was for an accessory building larger than
1500 square feet in a recorded subdivision. The applicant applied for the
Special Review permit to correct a zoning violation regarding outside
storage of vehicles. The zoning violation notice was issued on July 7,
1987.
Building Permit x/35584 was issued to Larry Smith on April 27, 1990. The
building permit was for a 3,200 square foot building as allowed by USR-887.
The building was to be used to store derelict vehicles.
A 10-day notice to call for a final building inspection was hand-delivered
on October 29, 1991. The notice gave Mr. Smith until November 7 , to call
for inspection. The doors and soffits have still not been installed on
this building. A building code violation notice was issued on December 5,
1991. Mr. Smith has not called for inspection.
Based upon the above information, the Department of Planning Services'
staff recommends that the Board of County Commissioners schedule a "Show
Cause" public hearing on January 8, 1992, to consider revocation of/ USR-
887.

Notice is hereby given that on Wednesday, December 18, 1991, at 9:00 a.m. , or as
soon thereafter as the agenda of the Board of County Commissioners permits, the
Board of County Commissioners of Weld County will hold a Probable Cause public
hearing pursuant to Section 81 of the Weld County Zoning Ordinance. This meeting
will take place in the Commissioners' Hearing Room, Weld County Centennial
Center, 915 Tenth Street, Greeley, Colorado.
The purpose of this public hearing will be to review Case Number USR-887 for
compliance with the Development Standards as approved by the Board of County
Commissioners on February 7 , 1990, to determine if probable cause exists to hold
a hearing on revocation of USR-887.
Inspection by representatives of this office have identified that you are not in
compliance with Development Standard #9 of USR-887.
If it is determined at the public hearing that there is probable cause that you
are not in compliance with Development Standard #9 of USR-887 , the Board of
County Commissioners will schedule a Show Cause public hearing to consider
revocation of the Special Review permit.
