RE: APPROVE LEASE WITH WELD COUNTY SCHOOL DISTRICT 6 AND
AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Lease between
Weld County School District 6 and Weld County, and
WHEREAS, the terms and conditions of said Lease are as stated
in the Lease, a copy of which is attached hereto and incorporated
herein by reference , and
WHEREAS, after study and review the Board deems it advisable
to approve said Lease.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Lease between
Weld County School District 6 and Weld County be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Lease.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 23rd day of
May, A.D. , 1990 .

THIS LEASE, made and entered into this 23rd _ day of
May , 19 90 , by and between the COUNTY OF WELD,
BY AND THROUGH THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF
WELD, 915 Tenth Street, Greeley, CO 80631 , herein after referred
o to as "Lessor, " and WELD COUNTY SCHOOL DISTRICT 6, 811 15th

"Lessee. "

WE-1 FURTHERMORE, the Lessee, in consideration of leasing said
oa premises as aforesaid, covenants and agrees as follows:

owA. To keep said premises and any and all improvements which
o may be located upon said premises in good repair at the
roz expense of Lessee, and at the expiration of this Lease,

ua order and condition as when the same were entered upon,

wy B. To sublet no part of said premises, nor assign this

C. To use said premises for no purpose prohibited by the
laws of the United States or the State of Colorado, or
the ordinances of the City of Greeley or of the County
of Weld and for nc improper or questionable purpose
whatsoever;
D. To neither hold nor attempt to hold the Lessor liable
for any injury or damage, either approximate or remote,
occurring through or caused by any repairs, alterations,
injury, or accident to adjacent premises or other parts
of the above premises not herein demised, or by reason

of the negligence or default of the owners or occupants
thereof, or any other person.
E. To purchase, construct, use, and maintain any and all
improvements to said premises without the use of funds
supplied by Lessor.
FURTHERMORE, the parties hereto agree to the following:

e 1 . That no assent, express or implied, to any breach of any
N o one or more of the covenants or agreements hereof, shall
o be deemed or taken to be waiver of any succeeding or

0 3 2. That upon termination of this Lease, the Lessee hereby
h w covenants and agrees to surrender and deliver up said
m premises to Lessor immediately.

w 3. That Lessor shall retain the right to travel over said
m▪ x premises, without payment to Lessee, at any time for the
- 0 purpose of gaining access to Lessor ' s adjacent premises.

W IT IS FURTHER EXPRESSLY UNDERSTOOD AND AGREED that all the
u covenants and agreements contained in this Lease shall extend to

w express understanding and agreement that if either party wishes to

ti W terminate this Lease, it may do so by providing the other party
c' w with thirty (30) days written notice prior to the contemplated
N z termination date. In the case of termination prior to the end of
N < the ninety-nine (99) year Lease as contemplated herein, the Lease
off+ sum shall be prorated accordingly and any remainder returned to
w g the Lessee.
