WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter„ is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1531, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, on September 15, 1993, the request for Recorded Exemption No. 1531 was submitted by Liaison International, Inc. for property which is located in part of the SW; of Section 1, Township 2 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, at said meeting of September 15, 1993, said matter was continued to September 29, 1993, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 100 acres and 30 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11. 7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 2. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 3. Prior to recording the plat, the applicant shall submit evidence that an ISDS evaluation has been completed by the Weld County Health Department on all existing septic systems. 931025 RE: RE #1531 - LIAISON INTERNATIONAL, INC. PAGE 2 4. An Individual Sewage Disposal System Permit shall be finalized and approved by an Environmental Protection Specialist within one (1) year of the application date. 5. An individual Sewage Disposal System must be located at least 100 feet from any well. 6. The following note shall be placed on the recorded exemption plat prior to recording: A Flood Hazard Development Permit will be required for any new construction or substantial improvement of existing structures in the Floodway or Floodprone Districts located on the property. 7. Prior to recording the plat, the applicant shall submit an executed agreement to vacate the existing, easement shown across Lot A of RE #1057. 8. Prior to recording the plat, the plat shall be amended to show the new access road across the proposed 30-acre lot of this Recorded Exemption. The parcel of land is described as part of the SW4 of Section 1, T2N, R67W of the 6th P.M. , Weld County, Colorado. The property is located northeast of the intersection of Weld County Roads 23 and 24. This request is to divide a 130 acre parcel of land, which is the total contiguous landholdings of the applicant, into two lots of 100 acres and 30 acres, more or less. The Central Weld County Water District does provide water service to the property. Septic Systems provide sewage disposal. The Town of Platteville has no objection to this request. The Weld County Health Department recommended conditional approval. The Department of Planning Services' staff has concerns regarding the further subdivision of this property utilizing the Recorded Exemption process. Recorded Exemption 1057 was approved in 1987 splitting 29.436 acres, more or less, from the southwest quarter of this section leaving 130 acres. The applicant is now proposing a further subdivision of the 130 acre parcel. Three residences already exist in this quarter section. If this request is approved a fourth residence would be allowed to be built on this quarter section. The Board needs to determine what level of development is acceptable in the area. Our office has received a letter from Howard Cantrell, a surrounding property owner, concerning the thirty foot easement from ingress and egress to the property. This easement was established when Recorded Exemption 1057 was approved in 1987. The realtor who is trying to sell the property, Mr. Bruce Hiller, has responded to Mr. Cantrell's concerns in his letter dated September 13, 1993. The easements were created and recorded in Oct. 28 , 1987 in book 1174 Reception No . 2119182. Mr Cantrell purchased his tract at a later date subject to existing easements. Liaison International Inc. uses the easement access road to get to the eastern part of the farm. This is the only access they have because of a large slew which sep- rates the east and west fields . Mc name is Howard Cantrell , and I am the owner of lot A , Recorded Exemption Number 1311-1-3-RE1057 , recorded October 28th 1987 in Book 1171 at Reception Number 119182 . The property described is adjacent to , and directly south of Liaison International ' s property . As you are aware Liaison international has requested a special exemption for subdividing , and subsequent sale of their property. 1 would like to take Ibis opportunity to express some deep concerns and problems I have regarding this exemption. My problem and concern is Liaison ' s Easement which runs across my property . When I bought the property in the Spring of 1991 , my lawyer , the real estate agent , and the hank from whom T purchased the property all expressed that the ingress and egress easement in the deed was the legal description of the water easement Liaison was granted when they purchased their property . The problems began the following • fall . At that time Liaison informed me that they had two separate easements , and that they would be using my road for unlimited hunt club access , The road runs beside mothers house and barns , and through our horse pasture . The use and negligence of this road by Liaison ' s agents led to many confrontations over the next two years . Some examples of ibis negligence were numerous gates being left open , parking of vehicles in qry fields , reckless driving which endangered the members of my family , and confrontations between Liaison ' s agents and our animals . I have tried in the hest neighborly fashion to work out these problems . I have gone so far as to construct a new road around the horse pasture to keep Liaison ' s agents away from our structures , and give them an easier access to Liaison ' s property . This eased the problems some what until the Spring of 1993 . At that time Liaison listed the property for sale . Subsequently , we have had countless numbers of unsupervised strangers coming across our property . The problems with open gates , and confrontations with these strangers began again . We tried once again to work out these problems with Liaison ' s representatives . We went so far as to offer to build a new road across Liaison ' s property. Explain the reason for the proposed recorded exemption and how each proposed lot will be used. We are requesting an exemption because we find this large property very difficult to operate, but we wish to maintain 30 acres to continue our current activities. The 100 acre portion will continue being used for crop raising and cattle grazing while the smaller 30 acre lot will be devoted to more intensive horticultural use. 2. Describe the location, size and present use of the area where each proposed new lot will be created. The property is 130 acres, located at the SE corner of Weld County Roads 23 and 241 and is presently used for residence, greenhouse operation, tree raising, alphalfa raising and cattle grazing. The properties are attractively landscaped and blend well into the surrounding environment. All natural, forested areas will be left intact. Efforts have been made to provide for and encourage waterfowl habitats. 3. Explain how the proposal is consistent with the Weld County Comprehensive Plan and any adopted municipal plan, if applicable. Both lots have direct access to WCR 23, either adjacently or by an existing road also used as an access road by the gas well company. 4. Explain how the uses permitted will be compatible with existing uses • surrounding the proposed recorded exemption. It is intended that the present uses of the property will be maintained, thereby basically conforming to general farming activities already being conducted in the area. 5. Explain how the proposal is consistent with the intent of the zoning district it is located within. Neither property will be less than one acre in size, as required by zoning ordinances. One septic tank has been in service for several years and it is believed that another tank on the second lot will be permitted, thus complying with sewer service requirements of the zoning district. 6. Explain how the proposal is consistent with efficient and orderly development. This property (130 acres) is the total contiguous land owned by the applicants and has not been divided or part of an approved recorded exemption within the last five years. 7. Explain how adequate provision for the protection of the health, safety, and welfare of the inhabitants of the neighborhood and the County will be • accomplished. The property is approximately seven miles from the nearest urban community. I' o EASEMENT AGREEMENT This Easement Agreement is made this 29th day of September, 1993, by and between HOWARD W. CANTRELL, VERONICA J. CANTRELL and BLANCH SULLIVAN, whose legal address is 11016 Weld County Road 23, Fort Lupton, Colorado 80621, the Owners of Lot A, as shown on Recorded Exemption Number 1311-1-3-RE1057, recorded October 28, 1987, in Book 1174 at Reception No. 02119182 of the real estate records in the office of the Clerk and Recorder of Weld County, Colorado, Parties of the First Part, and LIAISON INTER- NATIONAL, INC. , a Colorado corporation, whose legal address is 876 Ventura Street, Aurora, Colorado 80011, the Owner of Lot B, as shown on the Recorded Exemption described above, Party of the Second Part. In consideration of the mutual covenants herein exchanged, and for other good and valuable consideration, the receipt and sufficiency of which are herewith confessed and acknowledged, the parties agree as follows: 1. The Parties of the First Part will construct a new road on Lot B along its southern side, commencing at and connecting with Weld County Road 23 , and continuing to the point where it will intersect with the existing road to the oil tanks on Lot B. The new road, with culverts and cattle guard, shall be at least the same size and quality as the existing access road on Lot A, with curves that will allow tractor-trailer and farm machinery traffic. 2 . Prior to the commencement of construction ction the f the new road, Parties of the First Part will (a) proposed location of the new road within 10 days ss romm held from the date hereof; and (b) obtain all necessary permits County, including but not limited to a driveway permit to allow unrestricted access by the new road to Weld County Road 23 . The exact location of the new road, culverts and cattle guard, shall be subject to the reasonable discretion of the Party of the Second Part, so long as the new road is generally along the southern boundary of Lot B and no portion of it is on Lot A. Parties of the First Part and their contractors shall have reasonable access to Lot B for the purposes herein specified. 3 . Upon completion of construction of the new road, with culverts and cattle guard, and acceptance thereof by the Party of the Second Part, said party will release and reconvey to the Parties of the First Part the present access easement over and across Lot A, as shown on the Recorded Exemption, and as more particularly described on Exhibit B to that certain Warranty Deed dated November 4, 1987 , and recorded November 5, 1987, in Book 1175 at Reception No. 02120260 of the real estate records in the office of the Clerk and Recorder of Weld County, Colorado. • r 4 . The Parties of the First Part shall pay for the construction of the new road and the preparation of legal documentation pertaining thereto. The Party of the Second Part agrees to pay its legal expenses and any engineering consultation fees. 5. The Party of the Second Part will retain its 10- foot irrigation ditch easements along the western and southern boundary lines of Lot A, as shown on the Recorded Exemption, and access thereto, including the right of access to the westerly ditch granted by Easement Agreement dated November 4, 1987, and recorded November 5, 1987, in Book 1175 at Reception No. 02120262 of the real estate records in the office of the Clerk and Recorder of Weld County, Colorado, but these easements and access will be limited as follows: (a) to the extent it is practicable to do so, Parties of the First Part will be notified in advance of entry of heavy equipment (bulldozers, dump trucks, front-end loaders, draglines, etc. ) ; (b) motorized and foot traffic shall be confined to the existing roads on Lot A and to the irrigation easements except as otherwise required by work being conducted on the irrigation ditches on Lot A; (c) if any crop or other damage occurs on Lot A as a result of the use of the easements or the repair and maintenance of the irrigation ditches by the owner(s) of Lot B or its (their) agents, then the owner(s) of Lot B will be responsible for such damage; and (d) at all times, to the extent possible, authorized users of the irrigation easements will respect the privacy of the owners of Lot A. 6. This Easement Agreement and the covenants set forth herein shall run with the land for the benefit of both Lot A and Lot B and burdening said lots as herein described. The heirs, successors, assigns and personal representatives of the parties hereto shall have the benefit of and shall be bound by this Easement Agreement to the same extent as the parties hereto.
