RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION #1618 - OWEN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held
in the Chambers of the Board, that a certain parcel of land, to be divided into
two parcels, as shown on the plat known as Recorded Exemption #1618, does not
come within the purview of the definition of the terms, "subdivision" and
"subdivided land", and
WHEREAS, the request for Recorded Exemption #1618 was submitted by
Robert K. Owen, 42944 Weld County Road 39, Pierce, Colorado 80650, for property
which is described as Lot B of Recorded Exemption #745 being a part of the Et SW'-*
and the SW* SE,' of Section 32, Township 8 North, Range 65 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described in the plat which shall
be provided by the applicant and known as Exhibit "A", said plat to be recorded,
and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 108 acres and 2 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby
is, exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1618 submitted
by Robert K. Owen be, and hereby is, approved conditional upon the following:
1. A Weld County septic permit is required for any proposed home. The
septic system shall be installed according to the Weld County
Individual Sewage Disposal System (ISDS) regulations.
2. Prior to recording the plat, the applicant shall submit evidence
that and ISDS evaluation has been completed by the Weld County
Health Department on all existing septic systems.
3. The ISDS permit shall be finalized and approved by an Environmental
Protection Specialist within one (1) year of the application date.
4. There shall be no additional accesses created from Lot A and Lot B
onto Weld County Road 86.

5. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County
Clerk and Recorder. The plat shall be prepared in accordance with
the requirements of Section 11.7 of the Weld County Subdivision
Ordinance. The plat shall be submitted within sixty days from the
date of approval by the. Board of County Commissioners. The
applicant shall be responsible for paying the recording fees.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote or, the 29th day of June, A.D. , 1994.

Subject: Recorded Exemption 1618.
This application for a recorded exemption in the A (Agricultural) zone district
was submitted by Robert K. Owen. The parcel of land is described as Lot B of
Recorded Exemption Number 745 being a part of the E2 of the SW4 and the SW4 of
the SE4 of Section 32, T8N, R65W of the 6th P.M. , Weld County, Colorado. The
property is located north of and adjacent to Weld County Road 86 and
approximately 1/2 mile east of Weld County Road 39. The parcel under
consideration is the total contiguous land holdings of the applicant. The
request is to divide a 110 acre parcel into two parcels of 108 acres and 2 acres,
more or less. The applicant wants to sell the 2 acre parcel with the
improvements. The 108 acre parcel will remain in agricultural production.
There is an existing dwelling on proposed Lot A, proposed Lot B is vacant.
Proposed Lot A is currently served by a domestic well for its water. North Weld
County Water District is proposed as an alternative water source for Lot A, and
is proposed for Lot B. A septic system provides sewage disposal on Lot A and is
proposed for Lot B. The Town of Ault has reviewed this request and finds no
conflicts with its interests. The Weld County Health Department and Public Works
Department recommended conditional approval of this request.
The Department of Planning Services' staff recommends conditional approval of
this request. It is the opinion of the Department of Planning Services' staff
that this request complies with the standards of Sections 11.5.1 through 11.5.6
of the Weld County Subdivision Ordinance.

Dear Mr. Owen:
Your recorded exemption application is complete and in order and will be processed
on or before June 4, 1994. If it is determined that the application meets the
approval criteria of the Weld County Subdivision Ordinance, you will be notified
that the recorded exemption is approved. If the staff determines that the
application does not meet the approval criteria, you will be notified and asked to
appear before the Board of County Commissioners at a public hearing. You will be
informed of the hearing date prior to the hearing. The Board of County Commissioners
will then consider your application and make a final decision on the recorded
exemption.
It is the policy of Weld County to refer an application of this nature to any town
or municipality lying within three miles of the property in question or if the
property under consideration is located within the comprehensive planning area of a
town or municipality. Therefore, our office has forwarded a copy of the submitted
materials tothe Ault Planning Commission for its review and comments. It is
recommended that you and/or a representative be in attendance at the Ault Planning
Commission meeting to answer any questions the Commission members may have with

REODED EXEMPTION QUESTIONNAC
1. Explain the reason for the proposed recorded exemption and how each
proposed lot will be used. To dispose of excess and non-productive
property located in the Southeast corner of the property,
consisting of an old house and domestic well . The large parcel
will continue to be utilized for production of agriculture
crops. The smaller parcel could be used as a residential site.
2. Describe the location, size and present use of the areas where each
proposed new lot will be created. The property is located 3 miles
Northeast of Ault , Colorado. The present use of the larger 108
acre parcel is agricultural crop production. The current use
of the proposed smaller 2 acre parcel is non-productive and
requires maintenance, additional herbicides and presents a fire
hazard .
3. Explain how the proposal is consistent with the Weld County Comprehensive
Plan and any adopted municipal plan, if applicable. The larger parcel
meets the minimum lot size requirements of 80 acres irrigated .
The proposal will not adversely affect crop production and will
allow for a more efficient farming practice.
4. Explain how the uses permitted will be compatible with existing uses
surrounding the proposed recorded exemption. The surrounding area is
primarily crop production and residential sites. The current
use of the agricultural land should remain unchanged .
5. Explain how the proposal is consistent with the intent of zoning district
• it is located within. The current zoned district is agricultural
and the proposal will not adversely affect the use of the
property or other property in the area .
6. Explain how the proposal is consistent with efficient and orderly
development. The proposal is consistent with orderly development
as it is consistent with the recorded exemption process defined
by the Weld County Subdivision Ordinance.
7. Explain how adequate provision for the protection of the health, safety,
and welfare of the inhabitants of the neighborhood and the County will be
accomplished. Since there is no change in the existing use of
the property, it will not adversely affect the health , safety
and welfare of the inhabit of the neighborhood . Development
of the small parcel should eliminates a fire hazard in the area
and eliminate maintenance and herbicide use.
