In May of 1992 the lots shown were assessed at a value of $3,012, a decrease of
$154.00 from the prior year value of $3,256. In August of 1992 the lots were re-
asses at a value of $5,808, an increase of $2,552 from the prior year value of
$3,256 and an increase of $2, 706 from the assessment 3 months earlier. Senate
Bill 92-101 is cited as the authority.
Senate Bill 92-101 does not specify an effective date. The Property Tax Admini-
stration arbitrarily selected the date of imposition and then enforces it retro-
actively to include 1992. Both his selection of the date of imposition and his
retroactive enforcement to include 1992 are outside his purview and are illegal
and unconstitutional.
The method of assessmert is also suspect in that the absorption (cont. on next pg. )

rate is based on the period of ownership, not historical age, i.e. , 33 lots
were platted and developed in 1976 of which 21 are still owned today. Agreed
there was a lump sum conveyance of all 33 in 1985 but this transaction cannot
be classed as typical absorption by the market; it was merely one investor
"bailing out" another. The market absorption rate has in fact been 0.75
units/year, not 1 .70 units/year since 1985 .
