Thank you for your letter of October 15 . The Department of Planning Services
staff have reviewed your letter and determined the location and use of the
bridge and conveyor across the St . vrain diver and the change to the mining
stages as proposed would not he considered a material deviation from the
approved plans for Case Number USR- 639 .
Building permits and a flood hazard development permit are required to be
approved prior to the start of construction .

i This is in response to a letter from Environment , Tnc . ,, by Steven . L
O ' Brian , dated October 15 , 1990 . Adding a bridge and conveyor across the
St . Vrain River , and revising the mining stages , will not have an adverse
impact on the county roads . By leaving the plant site at its present
location , access onto Road 13 can be main.ta. ined through the life of the
site . Eliminating access onto Road 26 , which is unpaved , will decrease.

This letter is a request for determination on changes planned
by Tectonic Construction , Co , on the J- Bar -- B # Inc . gravel pit in
Weld County . I do not feel these charges are significant , but
would like the planning staffs opinion so I know which gray to
proceed ,
As you know we will be applying for a Flood Plane permit for
the Garage and the first change they plan may affect this permit .
Depending on your comments we may have to comeback later to add
this item to the Flood Plane pe rmi t . Du ring my discussion with Mr .
L ow de rm i l k regarding the Flood Plane Permit , he indicated they
would like to make some minor charges to the operation . We would
like the Weld County Panning Departments opinion on the changes
outlined below . Will we need a change to the Special Use Permit
or are these changes currently acceptable as now permitted ?
1 ) Can Tectonic Construction , Co . construct a bridge and
conveyor across the river for access to the southern parcel
of property under the existing approved permit ?
If so , should this change be included in the Flood Plane
Permit , too ?
2 ) Can Tectonic Construction , Coe remove the Staging plan and
start mining is the Southwest part of the southern parcel
without revising the special Use Permit ?
Below is a brief discussion on the changes .
BRIDGE AND CONVEYOR CROSSING
Tectonic Construction , Co . would like to place a temporary
bridge and conveyor across the St ; vrain to allow access to the

southern n portion of the property . The bridge will be a single
span unit , used for interior pit access for equipment and will be
removed when mining is complete . The conveyor would transport the
mined gravel to the plant for processing *
Tectonic has two railroad flat ears that were used at another
operation for this purpose . When complete the bridge would be 18
feet wide . Picture number 1 and 2 enclosed , show the bridge
sections . Picture number 3 shows the abutments the bridge would
rest on . The location of the bridge would be on Panhandle
Easterns ' R . O * w , * Tectonic has been in touch with Panhandle
Eastern and they are receptive to the idea . The approximate
location is shown on the attached map in red .
Advantages Qf this _ cilange :
( 1 ) The gravel plant can be kept in the northern part of the mine
away from the homes on WCR 26 ,
As you know the current permit allows us to move the
processing plant to the south side of the river when we
move to that area to mine , i . e . a floating plant site .
If we move the plant it would be closer to residential
sites along WCR 26 and affect our neighbors more .
Building the bridge allow us to leave the plant where it
is and thus resolves this issue .
( 2 ) We can use the same access to county roads
This will correct a haul route problem if the plant is moved .
If the plant is roved we will have to use WCR 26 , a dirt
road , for hauling gravel to market . If the bridge and con-
veyor is allowed we would continue to use WCR 13 which is
paved ,
MINING STAGE CHANGE
' As - with most - mining operation it is very difficult to plan
the final mining sequence when a permit is written . After oper at--
ing this pit for a number of year we have found that the original
plan to r� '
p mine north of the river and move to the south side and
work to the south and west is impractical . The way we originally
addressed this was to move the plant site from stage to stage as
mining progresses . 1n the current plan Stage 1 is north of the
river , Stage 2 is on the northern end of the south parcel and
Stage 3 is the southern portion of the south parcel . We will
complete Stage 1 mining within the next 2 to 3 years .
What we propose is to remove the Staging plan altogether ,
this will allow more flexibility in the plan . Then mining would
commence in lake 7 , move to the west side of lake 45 then into
lake 6 and finally complete the east side of lake 4/ 3 as we pull
back into Stage le The reclamation plan would remain the same and

would follow mining as close as possible , This would he possible
if bridge and conveyor crossings are allowed .
If we leave the plant in Stage 1 as now proposed and install
the bridge and conveyor , without making this staging change we
would he constantly working over the area we have and reclaimed ,
We have also found that the Colorado Interstate Gas companies gas-
line # 80F26 , along the south side of the river has been abandoned .
We plan to remove the gravel in the R . O . 14 . to maximize the
extraction as required by 34 - 32 - 100 et seq . This R . 0 . W . has bee
colored green so you will know which one will be mine . When the
pipeline ROW is mined we will have combined lakes 4 and 5 into one
lake .

2 ) Mining would m ov a away from the neighbors horses on W CR
26 instead of towards them .
3 ) We would not be disturbing areas already reclaimed .
We feel these changes minor in nature and are intended to
make this operation less disruptive to neighbors and improve the
economic and operating aspects of this pits
e will have a surveyor on the property this weep or next to
locate the garage for the Flood Plane Permit application . We will
also have him located the bridge and conveyor crossing so if we
need to add that to the application we will have the information
necessary .
If you could let me know your thoughts on the Bridge , and
conveyor crossing I can add them to the Flood Plane permit
application and save us all some time . If you have any question

The garage is not a temporary structure as defined by the Weld County Zoning
Ordinance , building permits and a fled hazard development permit are
required . The approval of the building permit and flood hazard development
permit will bring the property into compliance the Weld County Zoning
Ordinance Section 53 . 7 and the operation standards as approved for Special
Review permit USR-- 63' 9

I have been contacted by Mr . Robert Lowdermil k regarding the
problems at their operation on WCR 13 , 0 . 75 miles north of WCR 26 ,
My company prepared the original permits and represented 3- Bar B ,
Inc . at the County and State hearing for this gravel mine in 1984 .
J Bar B , Inc . then leased the gravel and mining permits to Tectonics ' .
I ' m preparing this letter to let you know I will be working
with Tectonic to correct the problems with the garage and any
other problems that may arise with the operation of the pit ,
Mrs Lowdermil k indicated you needed a letter regarding their
plans concerning the 5 . 00 ac ± Beat grass nursery they have near
the entrance road to the pit .
The original permit was a Special Use permit in an Agriculture
zone district . The original permit did not preclude LT Bar B , Inc .
o r their lessee from utilizing the land for agricultural purposes
during mining . It all owed for the extraction of gravel and associated
u ses at the same time because that would have meant a loss of income
from agriculture crops on those areas that were not being mine at
any given time . According to the current Zoning Ordinance , effective
N ov . 21 , 1989 , section 31 # 2 i4 allows growing of nursery stock as a
U se Allowed by Right within the Agricultural District . Sod is
considered nursery stock by the landscaping industry .
Tectonic has indicated they plan to continue to raise the
Bent grass sod as allowed by the Zoning Ordinance . Please let me
know if this does not resolve the Bent grass nursery problem . If
you disagree with my assessment please inform me what act i on _ .i s

necessary to resolve this issue and where in the zoning ordinance
.it supports your requirement .
As for the garage problems , if I read Section 31 . 3 right this
garage would be an Accessory use in the A district . In the original
Special Use Permit 639 : 84 : 35 approved on July 19 , 1984 . Item 3 • B . r
allowed for temporary buildings and ether items saying the items
noted " . a shall be securely anchored and adequately flood -
proofed . . " and that " Following comple to tic n of mining , all
temporary buildings shall be removed . " From this it appears
Tectonic does not need a variance to the flood plane overlay but
only needs a Building Permit for the garage and to take action to
insure the it complies with the flood proof ing requirements . If
you still feel Tectonic needs a variance to the Flood Hazard
Overly please explain to me your reasoning in light of the above
information .
The garage can he Flood - proofed as it was constructed and
Tectonics will apply for the Building Permit as soon as we can
work out our disagreement on the need for the Variance . Tectonic
is willing to work with weld County to resolve this issue in the
quickest manner possible .
I look forward to working with you on these problems and
welcome any input you have to help me prepare the proper documents .
