Re: Road Maintenance Agreement for the East Weld Sanitary Landfill
Dear Commissioners :
Waste Services Company is currently working to satisfy the various
requirements of the Certificate of Designation and Use by Special
Review Permit issued for the East Weld Sanitary Landfill . One of
the conditions requires an agreement to be formalized with Weld
County concerning the maintenance of the access route to the
facility.
Toward this end we recently contacted County Engineer Drew
Scheltinga and Assistant County Attorney Lee Morrison, who
instructed us to initiate discussions with the Board of
Commissioners concerning the agreement.
It is our understanding that the agreement will cover our
designated access route consisting of approximately 3/4 of a mile
of WCR 18 between WCR 57 1/2 and WCR 59 , and approximately 1 3/4
miles of WCR 59 from WCR 18 north to the end of WCR 59 . Due to the
isolated location of our site this 2 1/2 mile long access route
will be used by virtually all of the traffic traveling to our
facility.
As you may know, this route is also the sole access to the Coors
coal mine and ash disposal facility. To support those operations
over the past several years Coors Energy Company has made
substantial investments in improving and maintaining this access
route . The roadway appears to be in good condition and capable of
serving our projected traffic.
Given the above , Waste Services Company proposes for your
consideration the following:
1 . An engineering assessment of the access route would be
conducted under the supervision of the County Engineer to
determine the current structural status of the roadway and the
need for any further improvements based on our projected
usage .

2 . Any further structural improvements that the engineering
assessment finds are immediately necessary to accommodate our
projected traffic would be paid for by Waste Services Company.
Such amounts paid by Waste Services Company would be applied
as a credit toward future payments due pursuant to the county
solid waste surcharge on revenues from the facility.
3 . Following the completion of initial improvements , if any,
Weld County would retain full responsibility for all future
road maintenance and repairs of the roadway. Those costs
would be funded by the ongoing collections of the county
solid waste surcharge. Our analysis indicates that the
surcharge revenues to be generated by the East Weld Sanitary
Landfill will be more than adequate to cover the reasonably
anticipated maintenance and repair costs .
4 . Snow and debris removal along the access route would be
performed by Waste Services Company at its sole expense over
the operating life of the facility.
In addition to the cost-sharing provisions of the agreement, we are
aware of the requirement that we provide collateral to secure our
future performance .
We would respectfully request a work session with you at your
convenience to discuss the foregoing proposal and to reach an
agreement as to the primary elements of the agreement so that our
legal counsel may proceed with drafting a formal agreement .
