HomeMy WebLinkAbout930523.tiff RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A SINGLE FAMILY DWELLING UNIT ON A LOT UNDER THE MINIMUM LOT SIZE IN THE A (AGRICULTURAL) ZONE DISTRICT - BURL VAN BUSKIRK WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 16th day of June, 1993, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Burl Van Buskirk, 140 Denver Avenue, Fort Lupton, Colorado 80621, for a Site Specific Development Plan and Special Review Permit for a single family dwelling unit on a lot under the minimum lot size in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the SW' of Section 2, Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, Burl Van Buskirk, said applicant, was present, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan's Urban Growth Boundary Goals and Policies. The proposal is located within the urban growth boundary area of the City of Fort Lupton and presented no conflict with Fort Lupton's interests. The uses permitted will be compatible with the existing surrounding land uses which include oil and gas production, dry land pasture, turkey breeding, cattle feed lot, and rural residences. d. The uses permitted will be compatible with the future development of the surrounding area as permitted by the Agricultural Zone District. e. No overlay districts affect the site. f. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a single family dwelling unit on a lot under the minimum lot size in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. The access easement which serves the parcel will be required to meet the standards of the State Highway Access Code. 4. If new utility lines or connections are required within the State Highway right-of-way, a utility permit will be required from the State Department of Transportation. 5. The Site Specific Development Plan and Special Review Permit is for a single family dwelling unit on a lot under the minimum lot size in the (A) Agricultural Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. An Individual Sewage Disposal System must be located at least 100 feet from any well. 4. A Weld County Septic Permit is required for the proposed home septic system and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 5. An Individual Sewage Disposal System Permit must be finalized and approved by an Environmental Protection Specialist within one year of the application date. 6. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 7. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 8. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 9. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 10. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 11. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Lee Morrison, Assistant County Attorney, made this a matter of record. Chuck Cunliffe, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. Mr. Cunliffe said, in addition, a letter has been received from the Platte Valley Soil Conservation District; however, the letter only stated concerns and no recommendations. Therefore, a copy of the letter has been given to the applicant for information only and entered into the record. Burl Van Buskirk, applicant, stated the purchaser of the property wants to build a home on the site. He said they are aware of and have no problems with the Conditions of Approval and/or the letter from the Soil Conservation District. Mr. Van Buskirk said they already have the well permit. In response to questions of the Board, Mr. Van Buskirk said the lot is 35.025 acres on which they will build a two or three bedroom home and a small horse barn. He said the ground has been farmed in the past but is now dry land with a well for domestic and animal use. Mr. Van Buskirk said there is enough pasture for three or four horses. There was no public testimony offered concerning this matter. Commissioner Kirkmeyer moved to approve the request of Burl Van Buskirk for a Site Specific Development Plan and Special Review Permit for a single family dwelling unit on a lot under the minimum lot size in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The location of this land is 35 . 025 acres in part of the SW4 of section 2 , T1N, R66W, Weld County, Colorado. Please be aware that there is the potential of slight seepage from septic tank absorption fields . This soil has properties that can affect absorption permeability of the effluent, and leaching into seasonal high water tables . Lateral seepage, effluent surfacing to the top, and indirect soil erosion from seepage and surfacing could occur if the septic tank or absorption field is placed on an excessive slope . sewage lagoon areas, trench sanitary landfills, area sanitary landfills are not recommended for this site . Due to the sandy nature, and depth of this soil, there is the possibility of severe cave-ins and erosion for shallow excavations, pipelines, sewer lines, basements and open ditches . Also, the extensive use of gravel in this area is not recommended, due to the instability and erodibility of the sand that is dominant on this site . This soil has a low shrink swell potential , and a slight incumberment to the construction of houses with and with out basements, as well as other small buildings and road ways . The dry land pasture area in excellent condition, with seventy-five percent or more of the potential plant community present, will produce approximately 900 pounds of forage during an average year. Which can be grazed at 2 . 6 acres per cow per month, or 3 . 25 acres per horse per month. Thus, your stocking rates will be dependant on your available acres, species of animal, and the plant community that is present . Burl Van Buskirk, representative, explained the owners of the property wanted to sell due, in part, to a medical condition. The buyers want to place a home on the site. They already have a well permit. Shirley Camenisch asked what type of residence they plan to build. Burl Van Buskirk said they did not know yet. The Chairperson asked if the applicant agreed with staff' s recommendation. Mr. Van Buskirk said yes . Bud Clemons said he has observed this area from an aerial map and it is already divided into smaller areas with numerous owners. The Chairperson asked if there was anyone in the audience who wished to speak for or against this application. James Vawter, representative, for the property owner, Georgia McIrvin, explained they feel it is necessary to sell the parcel due to medical conditions and amount of upkeep required. We plan to build, place modular, or possibly move in a house on this property. This will be our home in the country and we will have 2 to 4 horses, a few dogs and possibly a few calves. We have sold our property at Brighton and will close on it at the end of March. This will be our only home. This property is in a rural area and the closest residence is about 1/8 of a mile away. The surrounding properties are all rural home sites and many of them have horses or livestock. My wife and I and our daughter will be the principal residents at this property. The traffic will amount to three to six vehicles in and out each day. A copy of well permit # 165214 is attached. The access is from Highway 52, an existing access with a deeded easement to our property. The vehicle traffic will be typical farm residence traffic consisting of automobiles, pickup, and an occasional horse trailer. The sewage system will be a county approved septic and leach field. The property is located in the Fort Lupton Fire Protection District and will also have the normal outside water spigots to assist in any fire fighting. Probably the largest number of animals on the property will seldom exceed 10 or 12 animals, which is far below the county code limits. Any excess animal waste will be spread on the land to improve the soil. The soil is very sandy and storm water will not be a problem. The water will soak into the soil. At the house downspouts, the area will be graveled to prevent any washing of the soil. We plan to landscape the yard area with bushes and grass. We will have a lawn and garden. The balance of the property will be planted to a dryland grass for pasture. Our time schedule is short and we plan to commence building as soon as we can get a permit. This property will be landscaped with a lawn and small garden with the normal bushes and trees. If this application is approved, this proposal will be consistent with the Weld County Comprehensive Plan. It is located in an agriculture district and shall remain agriculture. ACCESS Access is to be provided by an existing driveway, and this is appropriate. The Map does not address the function of that existing driveway, specifically the amount of traffic it carries and the design of that drive. These items should be considered as additional use of the drive is planned. The Quit Claim Deed submitted (to James R. Vawter, and others) describes the access easement, and states that the easement is granted for the use of Parcels One, Two, Three, and Four, all in the SW 1/4 of Section 2 . It is possible that the existing access could require improvements if it does not currently meet the standards of the State Highway Access Code. This office should be contacted for further discussion of this issue, and to determine the need for a site visit and possibility that an Access Permit could be required. DRAINAGE The Special Review Map does not specifically address drainage of the property. The narrative seems to indicate that the nature of development would not include a change of the drainage of the property.
