The applicant has complied with all the application requirements listed in Section 21 . 7 et seq. , of the Weld County Zoning Ordinance. 2 . This request is consistent with the Urban Growth Boundary Section of the Weld County Comprehensive Plan. Urban Growth Boundary Goal #1 recommends concentration of urban development in or adjacent to existing municipalities. Lee Morrison, Assistant County Attorney, made this matter of record and noted that this hearing was rescheduled from January 24, 1990, at the request of the applicant. R. Russell Anson, Attorney, came forward to represent the applicants. As part of his presentation, Mr. Anson read portions of a letter from the City of Greeley into the record. Commissioner Lacy asked what uses are allowed in an I-2 Zone, and Ms. Curry read the allowable uses into the record. (Tape Change #90-8) No public testimony was offered concerning this request. Commissioner Lacy asked about fire protection at this location, and Robert Comer came forward to explain the water system options available. Mr. Comer also explained the steps they intend to take to correct a drainage problem at this location. Mr. Comer said both of these matters will be addressed in the site plan review. Commissioner Kirby moved to approve the request of Robert E. and Lanora Comer for a Change of Zone, subject to the Conditions contained in the Planning Commission's favorable recommendation. The motion, seconded by Commissioner Kennedy, carried unanimously. This Certification was approved on the 12th day of February, 1990. The Department of Planning Service's staff has proposed right-of-way reservation for Highway 34. A structure currently exists within the 20 foot right-of-way requested west of Cherry Avenue. A variance was granted by the Board of Adjustment to place this building approximately 6 feet from the existing road right-of-way. The staff recommends no right-of-way reservation for Cherry Avenue. The Weld County Health Department has recommended approval subject to certain conditions which will be reviewed during the site plan review process. A field check of the site showed there are three accesses from Highway 34 instead of one access as shown in the application materials. The Division of Water Resources has stated approval of the request cannot be recommended unless an augmentation plan is implemented for the irrigation well. The applicant has submitted evidence that the well is augmented through GASP. Russell Anson, Attorney at Law, represented the applicant. This is actually three separate parcels that have been joined by the a single owner. The City of Greeley Planning Commission recommends approval. This same request was denied by the Board of County Commissioners in 1987. Since this decision appears to be in error, the applicant is now going through the rehearing process. The conditions of approval will be addressed in the Site Plan Review application, and at the time of building permit issuance. Robert Comer, property owner and applicant, discussed the recommendation of the Western Hill Fire Protection District. The Chairman called for discussion from the members of the audience. There was none. The Chairman asked the applicant if he had reviewed the recommendation and conditions presented by the Department of Planning Services' staff. He has no objections to any of these. CASE NUMBER: USR-897 NAME: C & M Companies REQUEST: A Site Specific Development Plan and a Special Review Permit for a Gravel Mining Operation, and Concrete and Asphalt Batch Plants LEGAL DESCRIPTION: Part of Section 32 and part of the WI of Section 33, all in T6N, R65W of the 6th P.M. , Weld County, Colorado LOCATION: Approximately .25 miles north of the City of Greeley; south and adjacent to Weld County Road 64 and east and adjacent to Weld County Road 27 APPEARANCE: Gary Tuttle, Tuttle and Applegate, Inc. , represented the applicant. They have had several meetings with the City of Greeley and the landowners in the area. Their concerns are centered primarily on Phase 1, or the easterly phase of this proposal. Therefore, they have changed the location of the processing plants. They will not disturb any trees along the proposed Poudre River Trail. Only eight acres will be mined at a time. When the ninth acre is begun, reclamation will begin on the previous eight acres. This is a dry pit, but reclamation plans call for a lined water storage reservoir that will obtain its storage water from irrigation water runoff, etc. There will be no seepage of water. There will be approximately 48 trucks (24 trips) per day initially. They will work with the County Engineering Department on road maintenance and haul routes. They will maintain residential standards for noise. Each phase of mining will last from four to eight years. If groundwater drops, C & M Companies will take care of each individual problem at no cost to the property owner. Tape 361 - Side 2 Lee Morrison briefly reviewed current law regarding the definition of a well and storage water rights and the National Wetlands Act. Rod Allison reviewed the concerns of the Division of Water Resources. These have been written into the staff's comments. Conditions presented by the staff can be worked out with the various departments and at County Commissioner's work sessions prior to being heard by the Board of County Commissioners. The existing site is served by three accesses from East 18th Street (U.S. Highway 34) and approximately 200 feet of access from Cherry Avenue. - The proposed change of zone is not located within the Geologic or Flood Hazard Overlay Districts, but is located within the Airport Overlay District Horizontal Zone. All structures must comply with the Airport Zone Height Limitations. - The soil conditions on the proposed site will not cause moderate or severe limitations to the construction of structures or facilities proposed for the site. This recommendation is based, in part, upon a review of the application submitted by the applicant, other relevant information regarding the request and the responses of the referral entities. The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. Prior to recording, the Change of Zone Plat shall be amended to show an additional twenty foot reservation from the right-of-way of Highway 34. The plat shall also be amended to exclude the twenty foot reservation from the area affected by the zone change. This area will remain C-3 (Commercial) and R-1 (Low Density Residential) . 2. Prior to any expansion of the facility, drainage concerns on the site shall be addressed to the satisfaction of the Weld County Engineering Department. 9C0149 ADDITIONAL COMMENTS COZ-451 Robert E. and Lenora Comer The City of Greeley Planning Commission has raised concerns regarding the adequacy of water for firs protection and right-of-way dedication along Cherry Avenue and U.S. Highway 34. The Department of Planning Service' s staff has proposed right-of-way reservation for Highway 34. A structure currently exists within the 20 foot right-of-way requested west of Cherry Avenue. A variance was granted by the Board of Adjustment to place this building approximately 6 feet from the existing road right-of-way. The staff recommends no right-of-way reservation for Cherry Avenue. The Weld County Health Department has recommended approval subject to certain conditions which will be reviewed during the site plan review process. A field check of the site showed there are three accesses from Highway 34 instead of one access as shown in the application materials. The Division of Water Resources has stated approval of the request cannot be recommended unless an augmentation plan is implemented for the irrigation well. The applicant has submitted evidence that the well is augmented through GASP. We have researched the information which you have requested and found the following: 1 . A water flow test at the fire hydrant located at East 20th Street and Cherry Avenue indicated that the hydrant can supply 820 gallons of water a minute . 2. The hydrant has two 2 1/2" discharges and one steamer connection which will supply large diameter hose . 3 . The hydrant is approximately 1100 feet from your property and fiction loss would be approximately 65 PSI between the water supply and your property utilizing 3" supply hose which is currently used by our agency. 4. Currently the fire district does not carry large diameter fire hose . However , the district has ordered 500" feet of 5" supply hose which will be in service very soon. Currently the district must rely on mutual aid to assist with large diameter hose . 5. The process of installing a fire hydrant at your facility would be a substantial financial expense . According to the City of Greeley Water Department no improvements are planned in this area in the near future . It may be possible to extend a water line from the fire hydrant located at the New Life Center on Birch Avenue , or from the water main which is located at East 20th Street . In any case you would need the City of Greeley"s approval and pay all cost associated with the improvement . It is most likely that a Automatic Fire Extinguishing system would be required under the Uniform Fire Code for any expansion in your facility. For example ; 1100 feet of 3" hose has friction loss of 65 PSI and 1100 feet of 5" has only 6. 1 PSI of friction loss. Cost of 5" hose is approximately $580 .00 for each 100 ' foot section. It would seem appropriate to explore the installation of a water main, and fire hydrants if your company is considering further expansion. The same staff and Planning Commission comments are presented here for Case Z-451 since the proposals are the same. It was previously agreed upon that this area is changing to such a degree that redevelopment is warranted, especially when it is in conformance with Comprehensive Plan policies. This site, originally approved as an industrial USR in a commercial zone is now requesting an expansion that would be more suitable to industrial zoning. The site is appropriately located in regard to policy discussions on the desirability of matching land uses with the City's expected service plans. This site is appropriately located in regard to expressway access and major thoroughfare industrial land use location and mix. The policies also point out the need to minimize conflicts and promote compatibility. Expansion of this use would need to address cumulative intensity of use. The location of this use at the intersection of a designated expressway (U.S. 34) and arterial (Cherry Avenue) means adequate right-of-way should be dedicated and access should be limited with access in the safest location. This may mean no expressway access. The State Department should be involved in the discussions. 900149 Lanell Curry Page 2 October 25, 1989 The area zoned industrial to the northwest of this site has had many development requests including residential, multifamily and commercial uses. These uses have generally been incompatible with the industrial zoning. This suggests that there is a need for zoning compatible with the mix of uses in this area. This includes zoning for this manufacturing use. The off-site impacts associated with this use are controlled by factors unique to this site and use: 1. The 20 feet of right-of-way being dedicated along U.S. 34 (arterial) and the 50 feet setback from the new right-of-way line provide a setback to buffer intensity of site use. 2. The largely inside location of the manufacturing will limit noise, although air compressors and other machinery may contribute to noise problems. The applicant should be aware that state and city standards are set at 55 dBA for residential areas and that this use would have to comply with those standards at the property line. 3 . The existing tree line provides for a visual, and to a lesser extent, noise screen and should be retained and maintained. 4 . Industrial traffic should only be permitted onto Cherry Avenue to avoid impacts to U.S. 34 and to residential uses. The expansion of this industrial use conforms to Comprehensive Plan policies, and the area is changing to warrant redevelopment. Any additional industrial development in the area should, however, be designed so as to enhance the visual appeal of the area. The County requires 15% of an industrial site to be landscaped. Additionally, the County requires all outside storage and parking for vehicles over 6, 000 gross pounds to be screened from adjoining rights-of-way and non-industrial zoning districts. This screening, if adequately enforced, should insure that this development is compatible with adjoining rights-of-way. The Administrative Review Team (ART) comments include the following: 1. The Fire Department noted that there is inadequate water service to provide fire protection in this area. The State Highway Department noted that right-of-way should be dedicated. They would also like to review future site plans for access permit approval. 3 . The proposal is consistent with the Weld County Comprehensive Plan as outlined in the URBAN GROWTH BOUNDARY GOALS SECTION located on page 33 of the Comprehensive Plan. The first goal listed recommends that urban development should be concentrated in or adjacent to existing municipalities. The proposed site is located approximately 2600 feet east and 1300 feet north of the incorporated boundaries of the City of Greeley. The second listed goal states that regulations in the urban growth boundary area should be maintained to allow the county and municipality to coordinate matters affecting the orderly development within the urban growth boundary areas . The proposed rezoning would be in conformance with Greeley ' s Comprehensive Plan Policies . This site was originally approved as an industrial use in a commercial zone by the issuance of a special review permit. Because of the present use of the property and the proposed expansion, industrial zoning would be more appropriate. Under the urban growth boundary policies, the Weld County Comprehensive Plan, paragraph C on page 34 it states that "a municipality' s adopted comprehensive goals and policies or the recommendation of the land use decision making body will be considered when reviewing development within an urban growth boundary area. When this same application had been submitted in 1987, on July 14 of that year the Greeley Planning Commission recommended no objections to the requests for the rezoning application. The Greeley Planning staff suggested at this hearing that the area is changing to such a degree that redevelopment is warranted especially when it is in conformance with Greeley ' s Comprehensive Plan Policies . The Board of County Commissioners on September 23 , 1987 , despite favorable recommendations from the planning staff and the planning commission for approval of the rezoning application, denied such application. However, at a hearing held on January 4 , 1989 , the Board of County Commissioners approved a reapplication for a change of zone stating that a substantial change in facts and circumstances regarding the application had occurred since the original application had been denied . 3 .surrounding hi rezoning landuses . The purpose of this investigation was to obtain the technical information and soils aproperty data necessary for the design and construction of foundations for the pro- posed structure. The conclusions and recommendations presented in this report are Ibased upon analysis of field and laboratory data and experience with similar soils in the general vicinity. FIELD INVESTIGATION ' The field investigation consisted of 2 borings at selected locations on the site. The borings were advanced with a 4-inch power auger. All borings were continued to a depth sufficient to describe the bearing strata and assure continuity between borings. Complete logs of the boring operation are shown on the attached plate and include visual classifications of each soil , location of soil changes, standard penetration test results, and water table measurements. As the boring operation advanced, an index of soil relative density and consistency was obtained by use of the standard penetration test, ASTM Standard Test D-1586. The penetration test result listed on the log is the number of blows required to drive the 2-inch split-spoon sampler one foot into undisturbed soil by a 140-pound hammer dropped thirty inches. Undisturbed samples for use in the laboratory were taken in thin wall samplers , (Shelby) , pushed hydraulically into the soil . All samples were sealed in the field and preserved at natural moisture content until time of test. 1 I 2 - 3149 I I I LABORATORY TESTING The laboratory testing program was undertaken to measure critical shear and con- I solidation-swelling characteristics of the soils. Additional testing included tests necessary to verify visual classification and moisture content of soils from borings. All test results are summarized in Table 1 . SUBSURFACE SOIL CONDITIONS A 6-inch layer of silty, slightly organic sand covers a uniform soft sand to depths of at least 10 feet. Gravel and sand was encountered in test hole 1 at 10 to 12 ' feet but because of the very cohesionless nature of the sand, caving occurred in test hole 2 at a depth of 10 feet and drilling was stopped. ' FOUNDATION RECOMMENDATIONS IThe selection of the foundation type for a given situation and structure is governed by two basic considerations. First, the foundation must be designed so as to be safe against shear failure in the underlying soils; and second, differential settle- ment or other vertical movement of the foundation must be controlled at a reasonable ' level . Two basic controls are available to us in selecting the foundation type and allow- able loads. These are the standard penetration test and consolidation-swell testing. The ultimate bearing capacity of the foundation soil depends upon the size and shape of the foundation element, the depth below the surface, and the physical character- istics of the supporting soil . The soft sand is uniform, non-expansive and has bearing values of about 1 ,500 lbs./sq. ' ft. This material is acceptable as a bearing strata if loading does not exceed 1 ,500 lbs./sq. ft. Under no conditions should fill material be used as the bearing strata. t t 2 900149 I I I FOUNDATION RECOMMENDATIONS ( CONT ' D) Continuous spread-type footings with design loads not exceeding 1 ,500 p.s.f. bearing in the sand unit are recommended. An inspection of foundation excavations by a qualified soils engineer prior to placing concrete is recommended to assure that conditions as described in this report are continuous over the area. GENERAL RECOMMENDATIONS Every precaution should be taken to prevent wetting of the subsoils and percolation of water down along the foundation elements. Finished grades should be sloped ' away from the structure on all sides to give positive drainage. A minimum of six inches fall in the first ten feet is recommended. Sprinkling systems should not be installed within ten feet of the structure. Downspouts are recommended and should be arranged to carry drainage from the roof at least five feet beyond the foundation walls. Slabs should be constructed "free floating", isolated from all bearing members , reinforced with wire mesh, and jointed frequently. Slabs on grade should be underlain with a four-inch layer of clean gravel or crushed rock to help distribute floor loads and provide a capillary break. Slabs should be underlain with a vapor barrier. Backfill around the outside perimeter of the structure should be compacted at optimum moisture, or above, to at least 90 percent of Standard Proctor density as determined by ASTM Standard Test D-698. Puddling should not be permitted as a means of compacting backfill . During the course of this investigation, every effort has been made to determine the subsurface soil conditions representative of the entire site. It is, of course, necessary to interpolate between test borings. Soil conditions have been known to change radically within short distances. Therefore, we recommend that a soils engineer inspect each excavation prior to placing concrete.
