RESOLUTION
RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW
PERMIT FOR A GRAVEL MINING OPERATION, CONCRETE AND ASPHALT
BATCH PLANTS, OFFICE, AND SCALES IN THE AGRICULTURAL ZONE
DISTRICT - SIEGRIST CONSTRUCTION COMPANY AND ST. VRAIN
SANITATION DISTRICT
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 28th day of March, 1990 , at the hour of 10 : 00 a.m.
in the Chambers of the Board for the purpose of hearing the
application of Siegrist Construction Company and St. Vrain
Sanitation District, 6999 York Street, Denver, Colorado 80229,
for a Site Specific Development Plan and Special Review Permit for
a gravel mining operation, concrete and asphalt batch plants,
office, and scales in the Agricultural Zone District on the
following described real estate, to-wit:
Part of the W} E} , Section 31, Township 3
North, Range 67 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, said applicants were represented by Vern Nelson, of
Nelson Engineers, and
WHEREAS, Section 24 .4.2 of the Weld County Zoning Ordinance
provides standards for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicants and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 .7 , 44 .1 , 44 .2 and
44 .3 of the Weld County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicants have shown compliance with Section
24 .4 . 2 of the Weld County Zoning Ordinance as follows:

a. This proposal is consistent with the Weld County
Comprehensive Plan' s Mineral Resource Goals and
Policies, the Urban Growth Boundary Area Goals and
Policies, and the Transportation Goals and
Policies. The Comprehensive Plan encourages the
extraction of mineral resources when the mining
plan promotes reasonable and orderly development of
the mineral resources. The Comprehensive Plan also
encourages land-use development proposals within an
urban growth boundary as long as they conform to
the desires of the local land-use decision making
body. The Tri-Area Planning Commission recommended
approval of this request at its January 9 meeting.
The Conditions of Approval and Development
Standards will ensure that these goals and policies
are met.
b. The proposal is consistent with the intent of the
Agricultural Zone District and is provided for as a
Use by Special Review.
c. Conditions of Approval and Development Standards
will ensure compatibility with the existing
surrounding land uses which include agricultural
production, gravel mining, the St. Vrain Sanitation
District treatment plant, oil and gas production,
and rural residential homesites. The use will be
compatible with the future development of the
surrounding area as permitted by the Agricultural
Zone District. No objections have been received
from surrounding property owners.
d. The Special Review Permit site is located in the
100-year floodplain. Special Review Permit
Development Standards address the overlay district
requirements. No other overlay districts affect
the site.
e. Special Review Permit Development Standards will
provide adequate protection of the health, safety,
and welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Site Specific Development Plan and Special Review Permit for a
gravel mining operation, concrete and asphalt batch plants,
office, and scales in the Agricultural Zone District on the
hereinabove described parcel of land be, and hereby is, granted
subject to the following conditions:

1 . The attached Development Standards for the Special
Review Permit shall be placed on the Special Review plat
prior to recording the plat. The plat shall be
delivered to the Department of Planning Services and be
ready for recording in the office of the Weld County
Clerk and Recorder within 15 days of approval by the
Board of County Commissioners.
2 . The Special Review activity shall not occur nor shall
any building or electrical permits be issued on the
property until the Special Review plat is ready to be
recorded in the office of the Weld County Clerk and
Recorder.
3. Prior to recording the Special Review permit plat:
a. The applicant shall amend the plat to show the
location of all structures including the batch
plants. All structures shall meet the offset and
setback requirements of the Weld County Zoning
Ordinance.
b. The applicant shall submit evidence that an
agreement has been made with Panhandle Eastern Pipe
Line Company regarding the relocation of its lines.
c. The following notes shall be placed on the Special
Review permit plat:
"Panhandle Eastern maintains a 50-foot wide
right-of-way on all pipelines and will not allow
any building within that easement area. Utility
lines, streets, sidewalks , and driveways may be
installed at approximate right angles to the
pipeline herein authorized, provided, however, that
all utilities cross under the pipeline with a
minimum clearance equal to the diameter of the
larger utility or 18 inches, whichever is greater.
No paved or traveled portion of any street,
sidewalk, driveway, road, alley, or curbing will be
placed substantially parallel to and within 15 feet
of the pipeline, provided adequate working space is
available on the other side of the pipeline. "
"The Mined Land Reclamation Board has the authority
to issue permits for mining and reclamation
activities. Activities related to mining and
reclamation are, therefore, under the jurisdiction
of the Mined Land Reclamation Board. However, Weld

County has jurisdiction of those matters outlined
in the Development Standards. "
d. An off-site road improvements and maintenance
agreement shall be approved by the Board of County
Commissioners to mitigate impacts generated by the
operation on County roads. A copy of the agreement
shall be submitted to the Department of Planning
Services. If material excavated from this pit is
to be processed at other locations in the area
owned by Siegrist Construction Company, haul routes
shall be established and addressed in the
maintenance agreement.
4. Prior to the Special Review Permit activity occurring on
the site, evidence shall be submitted to the Department
of Planning Services that:
a. The requirements of Senate Bill 89-120 regarding
well permits and augmentation have been met; that a
water supply and use plan has been reviewed and
approved by the State Engineer' s Office, Division
of Water Resources, including identification of
water to be stored in the pits once completed and
how the water is to be administered; and that any
other water supply or source on the property is a
legal supply for the use.
b. The applicant shall submit an agreement with
adjacent property owner (s) for transportation of
the discharge water from the pits to the river, if
required.
c. An emissions permit has been obtained from the Air
Pollution Control Division, Colorado Department of
Health, for fugitive dust and odors, if required.
it. A dust control plan has been approved by the Weld
County Health Department.
e. An NPDES Permit has been obtained from the Water
Quality Control Division of the Colorado Department
of Health, if required.
f. The requirements of the Longmont Fire Protection
District have been met.

g. The Special Review Permit activity will not cause
injury to vested or conditional water rights as set
forth in Section 44 . 4. 11 of the Weld County Zoning
Ordinance.
5 . Prior to the issuance of building permits or the
stockpiling of materials on the site, the applicant
shall obtain a Flood Hazard Development Permit for each
materials stockpile or any building or structure
requiring a building permit that is located in the
100-year floodplain.
6 . Prior to the issuance of building permits, the applicant
or operator shall provide a complete set of plans to the
Longmont Fire Protection District. Plans shall indicate
building location, size, and planned use.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 28th day of
March, A.D. , 1990 .

1 . The Site Specific Development Plan and Special Review Permit
is for a gravel mining operation as submitted in the
application materials on file in the Department of Planning
Services and subject to the Development Standards stated
herein.
2 . Approval of this plan may create a vested property right
pursuant to Article 68 of Title 24 , C.R.S. , as amended.
3 . The gravel mining operation shall comply with Section 44 .4 of
the Weld County Zoning Ordinance. Any violation of these
regulations shall be grounds for enforcement of Section 44 .6
of the Weld County Zoning Ordinance.
4 . The property shall be maintained in compliance with the Weld
County Flood Hazard Overlay District requirements.
5 . The property shall be maintained in compliance with Section
404 of the Clean Water Act, if applicable.
6 . The mining activity shall be maintained in compliance with
the requirements of the Oil and Gas Conservation Commission.
7 . Waste oil, waste paints, stains, antifreeze, and other
associated liquid and solid wastes, shall be stored and
removed for final disposal in a manner that protects against
surface and groundwater contamination.
8 . The Special Review Permit site shall be maintained in
compliance with any required emissions permit obtained from
the Air Pollution Control Division, Colorado Department of
Health, for fugitive dust and odors.
9 . No permanent disposal of wastes shall be permitted at this
site.
10 . The septic system for the proposed office shall be designed
by a Colorado Registered Professional Engineer according to
the Weld County Individual Sewage Disposal Regulations. An
employee restroom with sanitary toilet facilities shall be
provided and shall be installed according to the Weld County
Individual Sewage Disposal Regulations.

11 . Overburden and top-soil materials shall be handled and stored
in a manner that controls fugitive dust, blowing debris, and
other potential nuisance conditions.
12 . Fugitive dust shall be controlled on the site.
13. The maximum permissible noise level shall not exceed the
industrial limit of 80 dB (A) , as measured according to
25-12-102, Colorado Revised Statutes.
14 . If required and obtained, the NPDES permit shall be
maintained in compliance with the Water Quality Control
Division, Colorado Department of Health, requirements.
15 . Dust shall be controlled on all haul routes on site so that
it does not constitute a nuisance condition to adjacent
property owners .
16 . The dust control plan approved by the Weld County Health
Department shall be maintained in compliance at all times.
The operator of the facility shall have sufficient equipment
on site and available as needed to control dust.
17 . Access roads on the site shall be a minimum of 20 feet
unobstructed width; shall be designed and maintained to
support the imposed loads of fire apparatus; and shall be
provided with a surface so as to provide all-weather driving
capabilities.
18 . All quantities of flammable and combustible liquids stored on
site shall be reported to the fire district and shall meet
the requirements of Article 79 of the Uniform Fire Code for
storage of flammable and combustible liquids.
19 . Excavation may take place no closer than 20 feet from the
right-of-way of Weld County Road 26 , provided that material
is replaced leaving 50 feet between the right-of-way of Weld
County Road 26 and the edge of the reclaimed excavation.
20 . The haul route to the site shall be designated as Weld County
Road 26 from the access to the pit west to Weld County Road
13 . Hauling shall not be allowed on Weld County Road 26 west
of Weld County Road 13.
21 . All construction on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance.

22 . The property owner or operator shall be responsible for
complying with the Design Standards of Section 24 .5 of the
Weld County Zoning Ordinance.
23 . The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24 . 6 of the
Weld County Zoning Ordinance.
24 . The property owner or operator shall be responsible for
complying with the operation policies of Section 44 .4 of the
Weld County Zoning Ordinance.
25 . Personnel from the Weld County Health Department, Longmont
Fire Protection District, and Weld County Department of
Planning Services shall be granted access onto the property
at any reasonable time in order to ensure the activities
carried out on the property comply with the Development
Standards stated herein and all applicable Weld County
Regulations.
26 . The Special Review area shall be limited to the plans shown
herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Major changes from the
plans or Development Standards as shown or stated shall
require the approval of an amendment of the Permit by the
Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or
Development Standards are permitted. Any other changes shall
be filed in the office of the Department of Planning
Services.
27 . The property owner or operator shall be responsible for
complying with all of the foregoing Development Standards.
Noncompliance with any of the foregoing Development Standards
may be reason for revocation of the Permit by the Board of
County Commissioners.

The following business was transacted:
I hereby certify that pursuant to a notice dated -February 12, 1990, and
duly published March 15, 1990, in The New News, a public hearing was
conducted to consider the application of Siegrist Construction Company
and St. Vrain Sanitation District for a Site Specific Development Plan
and Special Review Permit for a gravel mining operation, concrete and
asphalt batch plants, office, and scales in the Agricultural Zone
District. Lee Morrison, Assistant County Attorney, made this matter of
record. Zanell Curry, representing the Department of Planning
Services, entered the favorable recommendation of the Planning
Commission into the record. She stated that the agreement required by
paragraph b. of Condition #4 has been reached. Vern Nelson, of Nelson
Engineers, came forward to represent the applicants. He stated that
the required permits are pending, and he explained the various
agreements which have been entered into by the applicants. Drew
Scheltinga, Weld County Engineer, had earlier submitted a memorandum
concerning excavation within fifty feet of the right-of-way of Weld
County Road 26. No public testimony was offered concerning this
request. After discussion, Commissioner Kennedy moved to approve this
request for a Site Specific Development Plan and Special Review Permit,
based upon the Conditions and Development Standards contained in the
-Planning Commission's recommendation, with Development Standard #19
amended pursuant to the memorandum received from Mr. Scheltinga.
Commissioner Kirby seconded the motion, and it carried unanimously.

I wish -to bring to your attention item number 4 of your
development standards The Special Review Permit does not lie with-
in the 100-year flood plain. Please refer to the enclosed copy
of Corps of Engineers ' August 28 , 1986 letter to Nelson Engineers
in reference to the location of the 100-year flood in relation to
the St. Vrain Sanitation District sewage treatment plant. Also
-enclosed are copies of two letters from Nelson Engineers to Tanell
Swanson, Weld County Planning, dated June 8 , and June 9, 1987
discussing the disparity between "Flood Insurance Rate Map"
(FIRM) and the Corps of Engineers location and determination of
the 100 year flood plain. Enclosed with these letters is the
"Plot and Piping Plan" map referenced in the June 9, 1987 letter.
Plan sheets 1 and 2 of 3 of of the referenced submittal
depicting the approximate location of the 100-year flood plain in
=elation to the property is enclosed.

This letter is. in response to your telephone call of August
11 , 1986 in which you requested'.the 100-year flood elevation at
_ the NW 1 /4 of the SE 1 /4 of Section 31 , T. 3 N., R. 67 W., in
Weld 'County, Colorado in order to design a sewage disposal -
facility.
This location is. about 2-1/2 miles downstream of I-25 on St. •
V-rain Creek. Detailed flood hazard information has not been
published for this area. The Omaha District Corps of Engineers
h-as performed a detailed hydraulic study for this reach and
provided the results to the State of Colorado. •
Based on our computations, the 100-year flood elevation at a
point 2,500 feet downstream from County Road 13 is 4,802.7 feet
mean sea level. This is approximately at the center of the NW
1 /4 of the SE 1 /4 of Section 31 . The 100-year-flood elevation is
4,804.6 at a point 1 ,000 feet upstream from this point and is
4,799.3 at a point 1 ,000 feet downstream from this point.

Dear Lanell:
Please find -enclosed two applications for a Flood Hazard
Development Permit, two copies of "Plot and Piping Plan" to be
used as the Flood Hazard Development Permit Map, a letter dated
August 28, 1986 by the Corps of Engineers, a copy of the deed and
a check for the application fee.
A specific study of the 100 year flood plain was conducted
by the U.S. Army Corp of Engineers in conjunction with the State
of Colorado. The results of that study for the site mentioned in
the application was provided to us in a letter dated August 28,
1967 from Larry S. Buss, Chief, Flood Plain Management Services
Branch, Planning Division, Department of Army Corps of Engineers.
I have enclosed this letter for your records . The specific study
by the Corps of Engineers differs substantially from the "Flood
Insurance hate Map" (FIRM) for this area. The study performed by
the Corps of Engineers was conducted to determine specifically
the elevation of the 100 year floodplain along the St. Vrain
Creek in the vicinity of the St. Vrain Sanitation District sewage
treatment plant, while the FIRM maps are general in the presenta-
tion of flood plain elevations along the creeks and rivers in the
vicinity_
The wastewater treatment facility is designed to be above
the 100 year floodplain elevation as defined by the specific
study conducted by the Corps of Engineers . The 100 year flood-
plain is shown on the "Plot and Piping Plan" as a dark dashed
line north of all the ponds. The standards set in Section 26 .5
of the weld County Zoning Ordinance have been met by placing no
structures within the 100 year flood plain.
The Flood Hazard Development Map has been provided to your
office in the form of a 24" x 36" plan as approved by Brian Bing-le
in a telephone conversation held June 4, 1987 . The map does not

show the floodprone and floodway districts for the site because
these districts are not defined for this area by the Corps of
Engineers .
It is respectfully requested that the planning staff -approve

Dear Ms. Curry:
We have reviewed the above referenced proposal to create a gravel pit
operation on a 71+ acre site. The operation will have up to ten employees.
The area involved in the operation will be 11.5 acres. The mine area is
tributary to the St. Vrain River, an over-appropriated river.
Water is to be pumped from the pit into a pond to accommodate
clewatering. Dust control requirements should not exceed 3,000 gallons per
day. The reclamation plan calls for ponds with approximately 55 surface
_acres. The submittal materials do not provide sufficient details on water use
requirements or the water supply sources to allow an evaluation of adequacy to
be made.
Several items relating to water use must be addressed by the applicant
before we can comment on the adequacy of this proposal . They are:
1 . Under Senate Bill 120, effective July 15, 1989, a well permit must be
obtained from this office for any open sand and gravel pit operation
which exposes ground water to the atmosphere. Additionally, the
permit cannot be issued in an over-appropriated basin without a Water
Court approved plan for augmentation or an approved temporary
substitute water supply plan to replace steam depletions introduced
by the exposure of ground water to the atmosphere.
2. The source of water for dust control , gravel washing or irrigation of
revegetation has not been identified. Which water rights will be
used for these needs? Are these rights decreed for these uses?
3. What will be the water supply for the office area?

APPEARANCE:
Vern Nelson, Nelson Engineers, represented the applicant. This property is
approximately 3 miles east of Del Camino along the St. Vrain Creek. The
applicants will _comply with the Colorado -Mined Land Reclamation Board's
recommendations. The area will be fenced and locks will be on the gates
-when the property is not in operation. This site is adjacent to the St.
Vrain Treatment lagoons. As part of the main operation, Siegrist will
excavate The additional lagoon _cells for the sanitation 'district. However,
they will sot be used until the system needs enlarged and approval is
obtained from the state. The -entire area cannot be mined profitably because
of an _overburden area, and this area will be used To store equipment. The
applicants intend to comply with the recommendation of The Department of
Planning Services' staff. They are taking exception to Development Standard
#19. This would only allow them to mine within 50 feet of the road
right-of-way. They would like To mine within 70 feet of the road
right-of-way, and then fill in to 50 feet with overburden. He will work
with the County Engineer regarding this standard prior to the request being
heard by the Board of County -Commissioners.

Prior to the plat being recorded, they will show an irregular shore line for
the ponds. Upon completion of the mining -operation, the land will be
reclaimed as a recreational site.
The Chairman called for discussion from the audience.
Harold Nelson, adjacent property owner, stated he is not against this
request, but he is concerned about the water. 'There is a lot of shallow
water 1n this area, and the can see no way to get it off the 'Dining site
without going through his property. He is also concerned about the mining
01 gravel at night. He feels the applicants should be allowed to mine
closer than 50 feet from the road right-of-way. This is not marginal land,
but it is hard to farm because of the gravel content and the amount of water
need to raise a crop.
Thelma Schwarts, surrounding property owner, has no objections to this
request, but she is -concerned about the the possibility of increased traffic
and dust.
Lanell Curry recommended the Planning Commission replace Condition #4, item
one with the staff's recommendation. Also, if adopted, the first sentence
should read. . .Senate Bill 89-120. . .
AMENDMENT:
Ann -Garrison moved the existing item one of Condition #4 be deleted and a
new condition be added to read as follows:
the requirements of Senate -Bill 89-120 regarding -well permits
and augmentation have been met; that a water supply and use
plan has been reviewed and approved by the State lEngineer's
Office, Division of Water Resources, including identification
of water to be stored in the pits once completed and how the
Mater 1s to be administered; and that any -other water supply
or source on the property is a legal supply for the use;

This proposal is consistent with the Weld County
Comprehensive Plan's Mineral Resource Goals and Policies, the
Urban Growth Boundary Area Goals and Policies, and the
Transportation Goals and Policies. The comprehensive plan
encourages the extraction of mineral resources when the
mining plan promotes reasonable and orderly development of
the mineral resources. The comprehensive plan also
encourages land-use development proposals within an urban
growth boundary as long as they conform to the desires of the
local land-use decision making body. The Tri-Area Planning
Commission recommended approval of this request at its
January 9 meeting. The conditions of approval and
development standards will ensure that these goals and
policies are met.
The proposal is consistent with the intent of the
Agricultural zone district and is provided for as a use by
special review.

- Conditions of approval and development standards will ensure
compatibility with the existing surrounding land uses which
include agricultural production, gravel mining, the Saint
Vrain Sanitation District treatment plant, oil and gas
production, and rural residential homesites. The use will be
compatible with the future development of the surrounding
area as permitted by the Agricultural zone district. No
objections have been received from surrounding property
owners.
- The Special Review permit site is located in the 100 year
flood plain. Special Review permit development standards
address the overlay district requirements. No other overlay
districts affect the site.
- Special Review Permit Development Standards will provide
adequate protection of the health, safety, and welfare of the
neighborhood and County.
This recommendation is based, in part, upon a review of the application
materials submitted by the applicant, other relevant information regarding
the request, and responses from referral entities.
The Planning Commission's recommendation for approval is conditional upon
the following:
1. The attached Development Standards for the Special Review permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the Department
of Planning Services and be ready for recording in the Weld County
Clerk and Recorder's office within 15 days of approval by the
Board of County Commissioners.
2. The Special Review activity shall not occur nor shall any building
or electrical permits be issued on the property until the Special
Review plat is ready to be recorded in the office of the Weld
County Clerk and Recorder.
3. Prior to recording the Special Review permit plat:
- the applicant shall amend the plat to show the location of
all structures including the batch plants. All structures
shall meet the offset and setback requirements of the Weld
County Zoning Ordinance.

15. Dust shall be controlled on all haul routes on site so that it does not

20. The haul route to the site shall be designated as Weld County Road 26
from the access to the pit west to Weld County Road 13. Hauling shall
not be allowed on Weld County Road 26 west of Weld County Road 13.

1. The submitted materials are in -compliance with the application
requirements of Section 24.7, 44. 1, -44.2, and 44.3 of the Weld
County Zoning Ordinance.
2. It is the opinion of the Department of 2lanning Services' staff
that the applicant has shown compliance with Section 24.3 of the
Weld County Zoning Ordinance as follows:
- This proposal is consistent with the Weld County
Comprehensive Plan's Mineral Resource Goals and Policies, the
Urban Growth IBoundary Area Goals and Policies, and the
Transportation Goals and -policies. The comprehensive -plan
encourages the -extraction of mineral resources when the
mining plan -promotes reasonable and orderly development of
the mineral resources. The comprehensive plan also
encourages land-use -development proposals within an urban
growth boundary as long as they conform to the desires of the
local land-use decision making body. The Tri-Area Planning
Commission recommended approval of this request at its
January 9 meeting. The conditions of approval and
development standards will ensure that these goals and
policies are met.
- The proposal is consistent -with the intent of the
Agricultural zone district and is -provided for as a use by
special review.
- Conditions of approval and development standards will Ensure
compatibility _with the existing surrounding land uses _which
include agricultural production, gravel mining, the Saint
Vrain Sanitation District treatment plant, oil and as
production, and rural residential homesites. The use will be
compatible with -the future development of the surrounding
area as permitted by the Agricultural zone district. No
objections have been received from surrounding property
owners.

- The Special Review permit site is located in the 100 year
flood _plain. Special Review permit development standards
address the overlay district requirements. No other overlay
districts affect the site.
- Special Review Permit Development Standards -will provide
adequate protection mlthe health, safety, and welfare of the
neighborhood and County.
This recommendation is based, in part, upon a review of the application
materials submitted by the applicant, other relevant information regarding
the xequest, and responses from referral entities.
The Department of 3lanning Services' staff recommendation for approval is
conditional upon the following:
1. The attached Development Standards for the Special Review permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the Department
of Planning Services and be ready for recording in the Weld County
Clerk and -Recorder's office within 15 days of approval by the
Board of County _Commissioners.
2. The Special Review activity shall-not occur nor shall any building
or electrical permits 'be issued on the property until the Speci-al
Review plat is ready to be recorded in the office of the Weld
County Clerk and Recorder.
3. Prior to recording the Special Review permit plat:
- the applicant shall amend the plat to show the location of
all structures including the batch plants. All structures
shall meet the offset and setback requirements of the Weld
County Zoning Ordinance.
- the applicant shall submit evidence that an agreement has
been made with Panhandle Eastern Pipe Line Company -regarding
the relocation of its lines.

I have reviewed the application materials and have the following comments:
1. No -excavation should take place within 50' of the right-off-way of Weld
County Road 26.
2. The haul route to the site should be designated as Weld County Road 26
from -the access to the pit to Weld County Road 13. Also, hauling
should not be allowed on Weld County Road 26 west of Weld County Road
13 because of similar restrictions on -other gravel mining operations
in the area.
3. If the material excavated from this pit is to be processed at other
locations in the area owned by Siegrist Construction Company, haul
routes should be established.
4. A Road Maintenance and Improvements Agreement addressing Weld County
Road 26, as well as other haul routes, should be negotiated with the
Board of Weld County Commissioners, subsequent to the approval of the
USR.

This letter is in regard to your request to review and comment
on the Siegrist Construction Company and St. Vrain Sanitation
District site specific plan for an open pit mining operation,
sec 31-3N-67W.
I have reviewed the application and do not find any conflicts
with the plans presented. It does not appear that any wells
are in the mining area and lease roads to the the wells are not
of concern.
I have enclosed an area well plat for your information.
Future drilling in this area, should it occur , will have to
comply with our safety rules, specifically:
Rule 603 (a) Wells shall be located a distance of 150 feet or
one and one-half times the derrick, whichever is greater , from
any occupied building, public road, or major above ground
utility line or railroad.
Rule 604 (a) (3) Tanks shall be a minimum of 200 feet from the
residences, normally occupied buildings, or well defined
normally occupied outside area.
Rule 604 (b) (5) Fired vessel, heater treater , shall be a
minimum of 200 feet from residences, occupied buildings, or
well defined normally occupied outside area.

Environmental Protection Services has reviewed this proposal and recommends for
approval, subject to the following conditions:
1. Waste oil, waste paints, stains, anti-freeze, and other associated
liquid and solid wastes, shall be stored and removed for final disposal
in a manner that protects against surface and groundwater
contamination.
2. Required Emissions Permit is obtained from the Air Pollution Control
Division, Colorado Department of Health.
3. No permanent disposal of wastes shall be permitted at this site.
4. The septic system for the proposed office is required to be designed
by a Colorado Registered Professional Engineer according to the Weld
County Individual Sewage Disposal Regulations.
5. Overburden and top-soil materials shall be handled and stored in a
manner that controls fugitive dust, blowing debris, and other potential
nuisance conditions.
6. Fugitive dust must be controlled on this site.
7. Required NPDES Permit shall be obtained from the Water Quality Control
Division of the Colorado Department of Health, and/or amended if
appropriate if appropriate for the increased operation.
8. Maximum permissible noise level shall not exceed the industrial limit
of 80dB(A) , as measured according to 25-12-102 , Colorado Revised
Statutes.
9 . An Employee Restroom with sanitary toilet facilities is required for
the proposed facility and shall be installed according to the Weld
County Individual Sewage Disposal Regulations.

40. Dust will be controlled on all haul so that it does not constitute a
nuisance to adjacent property owners.
1. A dust control plan shall be submitted to the Weld County Helath
Department for review and approval. The operation of the facility

Please find enclosed a copy of our as-built map , which shows our pipelines
( 14-10-075-200-3" and 16-10-075-155-4" ) , in the hi-lighted areas, located in
part of the West Half of the East Half of Section 31 , Township 3 North , Range
67 West , Weld County, Colorado.
Please refer to Application for Special Use Permit dated November , 1989 -
Siegrist Construction Co. ; according to "Exhibit B to Warranty Deed dated
April 8, 1988 between Eldon L.Von Ohlen and Mary Sue Von Dhlen, Grantors Eldon
L. Von Ohlen and Mary Sue Von Ohlen , Grantors, and Siegrist Construction Co. ,
Grantee" , paragraph number 3, Panhandle's facilties and right-of-way has been
acknowledged and also on the attached map referenced as" Exhibit B - Index
Map". However , refer to map referenced as" Exhibit F - Reclamation Plan" ,
whereby Panhandle lines have been relocated. Panhandle Eastern is unaware of
any type of plans for relocation of our lines and we have not been contact by
Siegrist Construction Company about this project.
Therefore, Panhandle denies approval for this request until such time that we
are contacted by Siegrist Construction Company and the necessary arrangements
and agreements are made regarding their plans for development , and they are
made aware of the following stipulations.

Panhandle Eastern maintains a 50-foot wide right-of-way on all pipelines and
will not allow any building within that easement area. Utility lines,
streets, sidewalks, and driveways may be installed at approximate right angles
to the pipeline herein authorized, provided, however, that all utilities cross
under our pipeline with a minimum clearance equal to the diameter of the
larger utility or 18" , whichever is greater . No paved or traveled portion of
any street , sidewalk , driveway , road , alley, or curbing will be placed
substantially parallel to and within fifteen (15' ) feet of the pipeline,
provided adequate working space is available on the other side of the
pipeline.
In the event of a proposed crossing with a road or utility, please contact
Utility Notification Center of Colorado (UNCC) at 534-6700 (Local & Metro
Denver) , or 1-800-922-1987 (Outside the Metro area) , with two (2) business
days notice, and at no cost to you, we will locate and mark our lines to
eliminate accidents that can occur from foreign forces.
We will be more than happy to work with everyone involved, however , it must be
noted that if for any reason our lines must be moved , it will be at the
expense of the developer or the person or persons asking for this movement.

St. Vrain Sanitation District to mine gravel south of the St. Vrain Creek in
the E z of Section 31, T-3-N, R-67-W, Weld County, Colorado.
This letter is to inform you that the proposed activity will not require
a Department of the Army (DA) Permit.
Although a DA Permit will not be required for the project, this does not
eliminate the requirement that other applicable Federal, State and Local Permits
be obtained as required.
During a January 10, 1990 telephone conversation with Mr. Arthur Uhrich
of Nelson Engineers, representatives for Siegrist Construction Company, it was
determined that the portion of wetland as shown on the enclosed map will not
be disturbed.

Use By Special Review Permit Application
Dear Ladies and Gentlemen:
The accompanying application is a request for a Use By Special
TReview (USR) permit for the extraction of gravel in the West One-
half of the East Half of Section 31, Township 3 North, Range 67
West of the Sixth Principal Meridian, Weld County, Colorado. The
majority of the property is owned by Siegrist Construction Company,
with the St. Vrain Sanitation -District owning approximately 9 . 5
acres.
The site is located approximately three miles east of the Del
Camino development and as the vicinity map indicates, it lies less
than 500 feet south of St. Vrain Creek. Properties along St.
Vrain Creek have a high commercial value for sand and gravel as
seen by the number of gravel mines in the immediate area.
As the Weld County Comprehensive Plan states, the present
economy along the front range corridor is causing an increasing
demand for sand and gravel -extraction in Weld County. To be
consistent with the Comprehensive Plan, extraction must follow a
rehabilitation plan, which is presented in the application. The
location is consistent with surrounding mines and is compatible
with the Comprehensive plan guidelines on mineable lands.
The area was investigated for its potential use as farm-
land. -Due to the relatively thin layer of overburden, much of
the water used in irrigation permeates to the gravel situated
below and recharges the alluvial aquifer. -'able 5 of the USSCS
"Sail Survey, Weld County, _Southern Part" reveals yields of crops
to be poor to marginal.
The applicant proposes safeguards to prevent access to the
site during nonworking hours with secure fencing and locked gates.

As previously stated, the proposed use is compatible with
the surrounding land uses -which consist of sand ant gravel mining
to the west and north. The areas south and east are farmed, with
some oil and gas production. As the demand for more gravel for
construction purposes increases, more of the land along St.
Vrain Creek will become gravel mines.
The site does not lie in a flood plain, a geologic hazard
zone, or the Weld County airport overlay district area.
We hope that this application has addressed the Use By
Special Review requirements and concerns of Weld County. If you
have any questions, please contact our office.

EXHIBIT E - Reclamation Plan
a. The operator proposes to reclaim the area through
development of water impoundments with seeded
dikes and picnic area for recreational purposes .
-The reclamation will consist of one impoundment,
generally within the natural ground water levels
of the immediate area. Because the bottom of the
excavations are well below normal ground water ,
the future use is development of ponds to be used
for fishing at such time as stocking is accom-
plished . Provision will be made in reclamation
for access to all locations along roadways on the
dikes as required. All finished slopes from five
feet above to ten feet below the expected water
line will have a slope no steeper than 3
horizontal to 1 vertical, and will be compacted
using standard heavy duty earthmoving equipment.
The majority of the area will be reclaimed for
recreational purposes. Phase I, approximately
ten acres , will be reclaimed for sewage treatment
ponds by using overburden from the remaining
sixty acres to fill the excavated area to the
required elevations .
b. The ponded areas can be reclaimed and used in
much the same way as the Barbour Ponds along
Interstate 25, three miles west of this site.
The reclaimed area used as a recreational area
will fit well into the agricultural zoning of the
local land use plan according to local zoning
regulations.
c. The affected lands will be reclaimed for recrea-
tional purposes within five years after -each phase
of reclamation has commenced Except the north ten
acres for purpose stated previously. Use of the
reclaimed land shall be in accordance with the
limited liability landowner liability law con-
tained in Article 41 of Title 33, C.R.S . 1973 .

c-l . Grading - all grading will be accomplished when
feasible, approximately one year after the min-
ing process in a particular phase is completed,
using heavy earthmoving equipment. All areas out-
side the site will be protected from erosion or
siltation as a result of the operations . No
refuse and acid forming or toxic materials that
might create water pollution are anticipated to
result from the proposed mining operation. No
drill or auger holes , or shafts will result from
the mining operation. All finshed slope from
five feet above to ten feet below the expected
water line will have a slope no steeper than 3
3 horizontal to 1 vertical.
c-2 . Water - the operator intends to comply with
applicable Colorado water laws and regulations
governing water rights and with all applicable
Federal and Colorado laws and regulations govern-
ing water quality and dredge and fill require-
ments where applicable. Although the excavated
area will remain inundated, no water is generated
nor consumed as a result of the mining operation.
The water impounded is that occuring from natural
ground water seepage in the area or entering the
area from adjacent natural surface drainage ways.
Since no water is consumed, an amount of water is
released that is equivalent to the waters enter-
ing the area. See also USDA Soil Conservation
Service information marked Exhibit AA regarding
ground water, soils, and grasses in the area.
c-3 . Wildlife - the Colorado Division of Wildlife is
currently reviewing the Pre-Mining Plan. A copy
of their review is included as Exhibit H. No
conflicts with wildlife are anticipated with
regard to reclamation.
c-4 . Topsoiling - topsoil is limited and it is generally
-of poor quality as shown on Exhibit AA; however,
the limited topsoil will be stockpiled above the
100 year floodprone district, elevation 4 , 803 and
will be spread uniformly in depths of approximate-
ly 8 inches on the dike areas above the water
line of the impoundments and in other locations
that might have been disturbed during the mining
operations to provide a support for vegetation .
Topsoil will be maintained in a useable condition
by creating vegetative cover if prolonged storage
is required.

c-5 . Revegetation - revegetation will occur only on
the dikes above the water line of the impoundment
and on the locations disturbed by the mining oper-
ation. It will consist of seeding of grasses
compatible to the area as described by Soil Con-
servation Service in Exhibit AA or as further
recommended by that agency. Seeding schedules
and application rates will be as recommended by
Soil Conservation Service. Trees or shrub areas
that are adaptable to the region will be included
Plantings will be in accordance with Soil Conser-
vation Service recommendations as area are com-
pleted for reclamation. No trees or shrubs are
allowed on the sewage lagoon embankments .
d. See Exhibit E, paragraph C-4 , and Reclamation Plan
Map, Exhibit F.
e . Timetables - Phase I - 9 .6 acres. This area will
be mined within two years of approval from the
Mined Land Reclamation Board. This area will
require approximately two years to be mined.
Reclamation of Phase I will begin approximately
January, 1992.
Phase II - 61 . 8 acres. Only 43 acres is minable
due to utility restrictions and quality of
aggregate deposits. The overburden will be used
to reclaim Phase I for wastewater treatment lagoons.
Phase II will be mined for a period of about 11
years ; 1992 - 2003 . Reclamation will be completed
within the five-year limit allowed by Colorado
Mined Land, Act 34-32-101, CRS 1973 as amended,
revised 1988 Legislative session. Grass planting
will occur according to recommendations and
schedules of the Soil Conservation Service.

Upon reclamation, the operation is expected to have a
minimal affect upon other water systems in the area
since no consumption of water occurs for the reclama-
tion purposes of conservation/wildlife habitat/recrea-
tional uses . The water impoundment will undoubtedly
seek a water level equal to the surrounding underground
water table such that in effect the impoundment is
no more than an extension of the innate qualities of
the preexisting conditions . The underground water
table from the alluvial aguifer in those areas sur-
rounding the site will be relatively unaffected by
the reclaimed area.
Water from dewatering operations will be pumped into
existing ponds or ponds developed for this purpose.
All excavations and piled materials will be sloped so
that runoff from disturbed areas will flow into the
created ponds designed for that purpose.
Wastes from machinery maintenance will be confined to
localized areas so that none of those wastes reach
water areas .
There will be no project water requirements for
development mining phases, other than occasional dust
control operations. The amount of water needed for
dust control is not expected to exceed 3 , 000 gallons
per week during dry conditions. The applicant curent-
ly owns ample water from ditch water rights to provide
dust abatement procedures .

EXTRACTION STANDARDS
1 . No excavation or processing of sand and gravel shall be per-
mitted nearer than 10 feet to the boundary of adjacent pro-
perty, easement, or irrigation ditch or right-of-way, nor
nearer than 125 feet to any existing residence unless by
written agreement the owner or owners of such adjacent pro-
perty consent to a lesser distance and the Planning Commission
approves a lesser distance.
2 . All sand and gravel operations shall be conducted during the
hours of _daylight except in the case of public and private
emergency, or to make necessary repairs to equipment. This
restriction shall not apply to operation of administrative
and executive offices or repair facilities located on the
property.
3 . Weeds and other unsightly or noxious vegetation shall be cut
ar trimmed as may be necessary to preserve a reasonably neat
appearance and to prevent seeding on adjoining property.
4 . Existing trees and ground cover along public road frontage
and drainage ways shall be preserved, maintained, and supple-
mented if necessary, to reduce noise, dust, and erosion.
5 . Insofar as practicable, all means of access to the property
from any street shall be located and designed as to avoid
the routing of vehicles to and from the property over streets
that primarily serve residential development.
6. Applicant will maintain the integrity of existing roads , by
stabilization, if required and provide water for dust abate-
ment.
7 . Rock crushers and concrete and asphalt mixing plants may be
allowed; however, the Planning Commission or Board of County
Commissioners may set out additional conditions under which
these operations may be permitted, and said conditions may
vary by location due to abutting land uses .
8 . If a septic system for sanitary waste disposal is necessary
for any offices and/or maintenance buildings, a permit for
such a system must be obtained through the Environmental
Services Division, Weld County wealth Department. The system
must be designed by a registered professional engineer.
9 . An emission permit (fugitive dust ) must be obtained from the
Air Pollution Control Division of the Colorado Department of
Health , for dust emissions from mining activities, road con-
struction, and parking lot areas .

10 . A National Pollutant Discharge Elimination System (NPDES )
-permit must be obtained from the Water Quality Control Divi-
sion, Colorado Department of Health for any discharge of
water into State waters .
11 . Noise levels shall comply with those limitations listed in
2-5-12-103 , C.R.S. , 1973 .
12. No diking or berm shall be allowed in the Special Use Permit
area which would cause damage to upstream or downstream pro-
perties by altering the historic drainage pattern.
13 . Material stockpiles will be developed parallel to creek flows
and as far therefrom as practical.

RECLAMATION STANDARDS
1 . Upon completion of operations the land shall be left in a safe condition.
Sufficient drainage shall be provided so as to prevent pockets of water or
undue erosion. Grading shall be accomplished in such a manner that storm
wate-r leaves the property at the original drainage points . Runoff at any
one such point shall not -normally be increased over historic flows . In-
creases over historic flows shall be allowed only when it is shown that the
increased flows will not adversely impact uses or lands affected -by such
flows . Frees , shrubs, legumes , _grasses, or other ground cover shall be
replaced in order to avoid erosion insofar as is practicable.
2. All excavated areas shall be graded or excavated Fn such a manner so as to
conform with the use of the land proposed in the reclamation plan. Ridges ,
banks , and mounds shall be formed so as to minimize erosion. In no event
shall a slope of less than 3: 1 (horizontal :vertical ) be left when operations
are complete. In addition, ri-dges and peaks shall be struck off to a width
of not less than fifteen feet at the tap.
3. Excavations made to a water-producing depth anxi which will not to refilled
must leave a minimum water depth of at least five feet measured from the low
water mark.
4. Any graded or tackfilled area shall be covered with topsoil to a minimum
depth of six inches , except that no -greater depth of topsoil shall be
required than that originally existing on the property prior to commence-
ment of operations. The property shall be graded so that stagnant water
will not be permitted to collect thereon.
5. Rehabilitation shall conform, where applicable, to the Weld County Open-Cut
Mining Regulations and to the full provisions of the "Colorado Mined Land
Reclamation Act."
6. Ultimate use of the land shall be for conservation/wildlife habitat and
associated recreational activities .
7. For the most part, reclamation activiti-es shall be performed concurrently
with mining operations. Revegetation will be accomplished as soon -as
practicable.
8. Gravel haul roads will be located appropriately during mining operations to
serve as access roads for the permit area' s ultimate land use.

Reference is made to your letter of November 6, 1989 regarding this matter.
The Board of Directors at its regular meeting on November 9, 1989authorized you,
in behalf of your client Siegrist Construction Company, to include the easterly
nine to ten acres of its treatment plant site in the mining and reclamation plan
you are preparing for the contiguous property to the south. This authorization
includes its subsequent incorporation in your application to Weld County for a
Use By Special Review permit and a mining permit from the Colorado Mined Land
Reclamation Board.
