HomeMy WebLinkAbout900356.tiff RESOLUTION RE: APPROVE EMPLOYEET NO.BENEFIT III FUND MASTER AUTHORIZEDOCUMENT THE CHAIRMAN TO SIGN WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board has been presented with Amendment No. III to the Master Plan Document of The Weld County Employee Benefit Fund, and WHEREAS, after review, the Board deems it advisable to approve said Amendment, a copy being attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Amendment No. III to the Master Plan Document of The Weld County Employee Benefit Fund be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said Amendment. III to the Master Plan Document of THE WELD COUNTY EMPLOYEE BENEFIT FUND The above document is hereby amended, effective January 1, 1990, as follows except as otherwise stated in this amendment: Pages 37 and 38 The section entitled CONTINUATION OF COVERAGE is hereby deleted in its entirety and replaced with the following: CONTINUATION OF COVERAGE If a Qualified Beneficiary loses coverage under the plan as a result of a Qualifying Event, the Qualified Beneficiary is entitled to elect, within the election period, continuation of coverage under the plan. DEFINITIONS Covered Employee means an individual who is (or was) provided coverage under the group health plan as defined previously in this document. Qualified Beneficiary means an employee participating in the group health plan, and any other participating individual who, on the day before a Qualifying Event, is a beneficiary under the plan, as the employee; as the spouse of the employee; or as the dependent child of the employee. Qualifying Event means any of the following events which would result in the loss of coverage for a Qualified Beneficiary, were it not for the coverage requirements of this section: - death of covered employee - termination of the covered employee's employment, (other than by reason of gross misconduct) - divorce or legal separation of the covered employee by the employee's spouse - the covered employee becomes entitled to benefits offered under Title XVIII of Social Security Act (Medicare) - a dependent child becomes an ineligible dependent child as defined previously in this plan - reduction of an employee's work hours to fewer than the minimal required to participate in the plan. 990356 BEN: WeldCoAm3 Period of Coverage means the period beginning on the date of the Qualifying Event and lasting until the earliest of the following: - 18 months after the date of the Qualifying Event if the Qualifying Event is termination of employment or a reduction of hours - 29 months after the date of the Qualifying Event for an employee determined to be eligible for Social Security disability benefits at the time of termination of employment or reduction of hours - 36 months after the date of the Qualifying Event for all other Qualifying Events - for dependents, 36 months after the date during the continuation period the covered employee becomes entitled to Medicare benefits Termination of Coverage means the continuation of coverage shall terminate upon the occurrence of any of the following events: - the date on which the employer ceases to provide any group health plan to any employee - the end of the period allowed for the continued benefit - the date on which coverage ceases under the plan because the Qualified Beneficiary fails to make timely payment of any premium required under the plan - the date on which the Qualified Beneficiary first becomes a covered employee or dependent under any other group health plan, which does not contain any exclusion or limitation with respect to any pre-existing condition for such Qualified Beneficiary. This provision is effective January 1, 1990 - the date the Qualified Beneficiary is entitled to Medicare (Title XVIII of the Social Security Act) Election Period means the period in which a Qualified Beneficiary must elect continuation of coverage. The election period begins the later of, the Qualifying Event or the receipt of the Notice (see Notice of Qualifying Event), and terminates 60 days after the receipt of the Notice. The Qualified Beneficiary must pay the required monthly costs for the Continuation of Coverage period preceding the initial Election no later than 45 days following the Election. Notice of Qualifying Event means that: 1. The employer must notify the Plan Administrator within 30 days of the Qualifying Event if the event is: - death of the covered employee - termination (other than gross misconduct) - reduction of hours of the covered employee - covered employee becomes entitled to benefits under Title XVIII of the Social Security Act (Medicare) - retirement 300356 BEN: WeldCoAm3 2. A covered employee or Qualified Beneficiary is responsible for notifying the Plan Administrator within 60 days of the later of (1) the date of the Qualifying Event or (2) the date dependents would lose coverage if the event is: - divorce or legal separation of the covered employee - dependent child ceases to be eligible under the plan 3. In the event of any of the Qualifying Events referred to in 1 or 2 above, the Plan Administrator shall notify the Qualified Beneficiary with respect to the Qualifying Event of such beneficiary's right under continuation of coverage within 14 days of the date on which the Plan Administrator learns about a Qualifying Event. Notification to the individual who is a Qualified Beneficiary, as the spouse of the covered employee, shall be treated as notification to all other beneficiaries residing with the spouse at the time notification is made. Applicable Premiums The Qualifying Beneficiary shall pay the applicable premiums for any period of continuation coverage. Applicable premiums may not exceed 102% of the cost of the plan for similarly situated individuals. The Qualified Beneficiary may elect to pay the applicable premiums in monthly installments. In the event a Qualified Beneficiary is eligible to extend the maximum period of continuation coverage from 18 to 29 months due to disability, applicable premiums payable by the Qualified Beneficiary for the 19th through the 29th month of coverage may not exceed 150% of the cost of the plan for similarly situated individuals. Payment of Claims No claims will be payable under the Continuation of Coverage provision until an election is made and all applicable premium has been received. IT IS AGREED BY WELD COUNTY that the provisions contained in the above document and Amendment No. III thereto, are acceptable and will be the basis for the administration of the WELD COUNTY EMPLOYEE BENEFIT FUND described herein.
