BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
February 13, 1991

The Board of County Commissioners of Weld County, Colorado, met
in regular session in full conformity with the law and bylaws of
said Board at the regular place of meeting in the Weld County
Centennial Center, Greeley, Colorado, February 13, 1991, at the
hour of 9:00 A.M.
ROLL CALL: The meeting was called to order by the Chairman and on roll call
the following members were present, constituting a quorum of the
members thereof:
Commissioner Gordon E. Lacy, Chairman
Commissioner George Kennedy, Pro-Tem
Commissioner Constance L. Harbert
Commissioner C. W. Kirby - Excused
Commissioner W. H. Webster
Also present:
Weld County Attorney, Thomas O. David
Acting Clerk to the Board, Carol Harding
Finance and Administration Director, Don Warden
MINUTES: Commissioner Kennedy moved to approve the minutes of the Board
of County Commissioners meeting of February 11, 1991, as
printed. Commissioner Harbert seconded the motion, and it
carried unanimously.
ADDITIONS: There were no additions to today's agenda.
CONSENT AGENDA: Commissioner Kennedy moved to approve the consent agenda as
printed. Commissioner Webster seconded the motion, and it
carried unanimously.
DEPARTMENT HEADS/
ELECTED OFFICIALS: There were no reports given today.
WARRANTS: Don Warden presented the following warrants for approval by the
Board:
General fund $241,067.90
Commissioner Kennedy moved to approve the warrants as presented
by Mr. Warden. Commissioner Harbert seconded the motion which
carried unanimously.
Let the record reflect that a recess was taken at this time to
allow the Board to convene as the Board of Social Services.
Let the record reflect that Commissioner Kirby is now present.
BIDS: PRESENT SIGN MATERIALS - ROAD AND BRIDGE DEPARTMENT: Pat
Persichino, Director of General Services, presented this bid
which will be submitted for approval on February 27, 1991, and
read the names of fifteen bidders into the record.
PRESENT 1991 STEEL BID - ROAD AND BRIDGE DEPARTMENT: Mr.
Persichino read the names of six bidders into the record. This
bid will be submitted for approval on February 27, 1991.

PRESENT TRACTOR AND MOWER - ROAD AND BRIDGE DEPARTMENT: Mr.
Persichino read the names of the three bidders into the record.
Kay Jan is the apparent low bidder. This bid will also be
submitted for approval on February 27, 1991.
PRESENT AND EMERGENCY APPROVAL ON 1991 CHEMICAL BID - EXTENSION
SERVICES DEPARTMENT: Mr. Persichino presented the 1991 chemical
bid and read the names of the eight bidders into the record, as
well as a letter of recommendation from Ron Broda, Weld County
Pest Inspector. Mr. Broda was present and is requesting an
emergency approval on this bid. His recommendation is to take
the low bid except for 2,4-D and Roundup. He recommended that
both of those items go to the next lowest bid. Mr. Persichino
read the list of chemicals being recommended into the record for
Cornbelt Chemical Company in the amount of $39,598.67, and for
Pueblo Chemical and Supply Company in the amount of $28,450.60.
This makes a grand total of $68,049.27 being recommended.
Commissioner Kennedy moved to approve the 1991 chemical bid as
recommended by Mr. Broda on an emergency basis. The motion was
seconded by Commissioner Harbert and carried unanimously.
APPROVE BULLDOZER WITH RIPPER - ROAD AND BRIDGE DEPARTMENT: Mr.
Persichino read a recommendation from Dave Becker, Assistant
Road and Bridge Director, into the record. The Road and Bridge
Department is recommending the bid from Wagner Equipment Company
with Option 111, 112, and 113 for a total of $181,842.00. This
recommendation is based upon: 1) Adherence to specifications;
2) Bid price; 3) Total hours operational cost for ten years; 4)
Resale value based on the Green Guide published by Equipment
Guide Book, Division of Nielson/Data Quest; and 5) Dealer parts
and service organization. Commissioner Webster moved to approve
the Bulldozer, per staff recommendation in the amount of
$181,842.00. Commissioner Kirby seconded the motion, which
carried unanimously.
APPROVE ASPHALT PAVER/FINISHER - ROAD AND BRIDGE DEPARTMENT:
Mr. Persichino read a recommendation from Dave Becker, Assistant
Road and Bridge Director, into the record. The Road and Bridge
Department is recommending the low bid from Faris Machinery.
The total, with Option 112, 113, and 114 is $173,815.00.
Commissioner Kennedy moved to approve recommendation of staff,
in the amount of $173,815.00. Commissioner Harbert seconded the
motion, which carried unanimously.
APPROVE TANDEM DUMP TRUCK - ROAD AND BRIDGE DEPARTMENT: Mr.
Persichino read a recommendation from Dave Becker, Assistant
Road and Bridge Director, into the record. The Road and Bridge
Department is recommending the low bid from Colorado Mack in the
amount of $62, 988.50 with Options 111, 112d, and 113. Commissioner
Webster moved to approve staff recommendation in the amount of
$62,988.50. Commissioner Kennedy seconded the motion, which
carried unanimously.
APPROVE MOTORGRADERS - ROAD AND BRIDGE DEPARTMENT: Mr.
Persichino read a recommendation from Dave Becker, Assistant
Road and Bridge Director, into the record. The Road and Bridge
Department is recommending the bid from Wagner Equipment Company
with Option 111, 112, 113, and 116 for a total of $94,028.00 for
each grader. The trade-in value for four graders is $115,000,
making the grand total for four graders $260,587.00. This
recommendation is based upon: 1) Adherence to specifications;
2) Bid price; 3) Total hours operational cost for ten years; 4)
Resale value based on the Green Guide published by Equipment
Guide Book, Division of Nielson/Data Quest; and 5) Dealer parts
and service organization. Commissioner Kirby moved to approve
staff recommendation in the amount of $260,587.00. Commissioner
Kennedy seconded the motion, which carried unanimously.

APPROVE END DUMP TRAILER - ROAD AND BRIDGE DEPARTMENT: Mr.
Persichino read a recommendation from Dave Becker, Assistant
Road and Bridge Director, into the record. The Road and Bridge
Department is recommending the low bid from Wagner Equipment at
a price of $23,608.00. Commissioner Kennedy moved to approve
the low bid. Commissioner Webster seconded the motion, which
carried unanimously.
APPROVE TANDEM TRUCK TRACTOR - ROAD AND BRIDGE DEPARTMENT: Mr.
Persichino read a recommendation from Dave Becker, Assistant
Road and Bridge Director, into the record. The Road and Bridge
Department is recommending the low bid from Colorado Mack with
Option #1, #2, #3, and 114 on the tandem truck-tractor with
hydraulic at a total cost of $60,900.35 and Option 111 on the two
tandem truck-tractors without hydraulics at $58, 725.35 each, for
a grand total of $178,351.05. Commissioner Harbert moved to
approve staff recommendation in the amount of $178,351.05.
Commissioner Kennedy seconded the motion, which carried
unanimously.
APPROVE THREE-TON TRUCK - ROAD AND BRIDGE DEPARTMENT: Mr.
Persichino read a recommendation from Dave Becker, Assistant
Road and Bridge Director, into the record. The Road and Bridge
Department is recommending the low bid from Fogle Olds-GMC with
Option 111, for a total price of $61, 699.00. Commissioner
Kennedy moved to approve the low bid. Commissioner Webster
seconded the motion, which carried unanimously.
APPROVE SNOW PLOW WITH HITCH - ROAD AND BRIDGE DEPARTMENT: Mr.
Persichino read a recommendation from Dave Becker, Assistant
Road and Bridge Director, into the record. The Road and Bridge
Department is recommending the low bid from Timpte, Inc. at a
price of $4,884.00 each. Commissioner Harbert moved to approve
staff recommendation for a total of $9,768.00. Commissioner
Kennedy seconded the motion, which carried unanimously.
BUSINESS:
NEW: CONSIDER RENEWAL OF 3.2 BEER RETAIL LICENSE FOR LILLIAN GOOCH,
DBA CROW VALLEY CAFE: Lt. Kim Fliethman, Weld County Sheriff's
Office stated that they have had no calls or violations on this
business. Commissioner Kennedy moved to approve said renewal.
Commissioner Kirby seconded the motion, which carried
unanimously.
CONSIDER INTERGOVERNMENTAL MUTUAL AID AGREEMENT BETWEEN WELD
COUNTY SHERIFF'S OFFICE AND THE CITY OF EVANS: Commissioner
Kennedy moved to approve the Intergovernmental Mutual Aid
Agreement between the Sheriff's Office and the City of Evans.
Commissioner Webster seconded the motion, which carried
unanimously.
CONSIDER LINCOLN NATIONAL HEALTH PLAN MASTER GROUP CONTRACT
APPLICATION AND AUTHORIZE CHAIRMAN TO SIGN: Mr. Warden
explained that this is to provide clarification on the health
insurance coverage upon termination of an employee.
Commissioner Webster moved to approve said Contract.
Commissioner Kennedy seconded the motion, which carried
unanimously.
CONSIDER AGREEMENT BETWEEN ANDESITE ROCK COMPANY AND WELD COUNTY
ROAD AND BRIDGES: Drew Scheltinga, Weld County Engineer,
explained that this is a renewal of the road maintenance
agreement with Andesite Rock Company in the area near Carr. The
term of the Agreement is March 1, 1991 through March 1, 1992.
Commissioner Harbert moved to approve the Agreement.
Commissioner Webster seconded the motion, which carried
unanimously.

PLANNING: CONSIDER RESOLUTION RE: VIOLATIONS OF THE BUILDING CODE
ORDINANCE - DOOLEY AND MILLER: Commissioner Kennedy moved to
approve this Resolution authorizing the County Attorney to
proceed with legal action against Gerald Dooley and Norma Miller
for violations of the Weld County Building Code Ordinance.
Commissioner Harbert seconded the motion, and it carried
unanimously.
CONSIDER RECORDED EXEMPTION #1326 - COLORADO COMMODITY TRADERS,
INC. : Chairman Lacy stated that Lanelle Curry, Department of
Planning Services, requested this matter be continued to
February 20, 1991, since the representative from Colorado
Commodity Traders, Inc. could not be here today. Motion made by
Commissioner Kennedy to continue R.E. #1326 to February 20,
1991. Seconded by Commissioner Harbert, the motion carried
unanimously.
RESOLUTIONS AND
ORDINANCES: The Resolutions were presented and signed as listed on the
consent agenda. There were no Ordinances.
Let the minutes reflect that the above and foregoing actions
were attested to and respectfully submitted by the Acting Clerk
to the Board.
There being no further business, this meeting was adjourned at
9:30 A.M.
