HomeMy WebLinkAbout920513.tiff RESOLUTION RE: APPROVE NON-FINANCIAL AGREEMENT BETWEEN WELD COUNTY HEALTH DEPARTMENT AND UNIVERSITY OF NORTHERN COLORADO'S SCHOOL OF NURSING AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Non-Financial Agreement between the Weld County Health Department and the University of Northern Colorado's School of Nursing, commencing July 1, 1992, and ending June 30, 1995, with the further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Non-Financial Agreement between the Weld County Health Department and the University of Northern Colorado's School of Nursing be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said agreement. Webster 920513 Ua "h/cc cc ' }/L, , 11NC1, Agreement Clinical Experience School of Nursing College of Health and Human Sciences University of Northern Colorado This agreement, entered into as of the 22nd day of May , 1992, by and between the University of Northern Colorado, for and on behalf of the School of Nursing (hereinafter referred to as "School") Weld County Health Department. Greeley. Colorado (hereinafter referred to as "Agency"). WITNESSETH: WHEREAS, School of Nursing offers an education program at the Baccalaureate level integrated for the preparation of professional nurses, and WHEREAS, Agency has certain facilities available for clinical experiences and desires to provide such facilities for educational purposes in the preparation of students of the nursing program, and WHEREAS, School and Agency desire to establish an ongoing policy structure in regard to their respective responsibilities, and WHEREAS, School and Agency desire to reduce their agreements to writing, NOW THEREFORE, in consideration of the foregoing premises and the covenants and agreement hereinafter set forth, the parties agree as follows: RESPONSIBILITIES OF THE SCHOOL 1. The School shall provide for the administration and operation of the courses which are a part of the School of Nursing curriculum, including such programs of study offered students using the Agency facilities. 2. The School shall provide qualified and competent faculty members adequate in number for the instruction and supervision of students using the Agency facilities. 3. The School shall select, in consultation with the cooperating professional staff of the Agency, learning experiences to which students will be assigned for educational experiences at the Agency facilities. In the selection of said assignments, appropriate consideration shall be given to the School of Nursing policies, accreditation criteria (both voluntary and regulatory), and the policies, regulations and nursing standards of the Agency. 4. The School shall select and provide the students to be assigned to such clinical experiences. Said students shall have completed all prerequisite academic and clinical coursework prior to their selection for the clinical experience. 5. The School shall instruct all students assigned to the Agency facility regarding both the legal and ethical standards for confidentiality of records and patient/client data imparted during the clinical experience. The School faculty, staff and students are not to be considered Agency employees for any purpose and said persons may not hold themselves out as employees or agents of Agency or otherwise make any representation or commitments on behalf of Agency. 7. Faculty and students of the University of Northern Colorado are covered by the State of Colorado self-insurance program, Chapters 24- 10, C.R.S. and 24-30, C.R.S. Certificates of liability insurance coverage for students and faculty will be provided at the request of the agency. 8. Participating students shall carry mandatory health insurance coverage under the University's health insurance program or show proof of enrollment in a comparable accident and sickness health insurance plan. 9. The University is covered by workmen's compensation insurance with the State Compensation Insurance Fund. This coverage does include all students enrolled in on-the-job training programs except student teaching. 10. The School faculty shall orient students to the Agency unless otherwise agreed upon. 11. The School faculty and students shall adhere to the rules, regulation, procedures and standards of the agency. Weld County Health Department, Greeley Page 4 H. RESPONSIBILITIES OF AGENCY 1. Agency shall recognize a responsibility to maintain a learning environment conducive to sound educational and clinical experiences. 2. The Agency has ultimate responsibility for the quality of care given to patients. Agency staff in the areas to which students are assigned shall be responsible for orienting faculty to Agency policies and protocols, particularly where special rules and regulations are necessary. 3. Agency shall permit students, staff and faculty of the School of Nursing to utilize facilities such as the library, lounges, conference rooms, audio-visual equipment or other teaching equipment consistent with the regulations and policies set by the Agency. 4. Agency staff shall communicate with School representatives concerning any problems that might arise due to a student's performance. A written report shall be provided to the faculty or staff member of the School who is in charge of student supervision. 5. The Agency shall provide for such supervision as is prearranged in consultation with the School. Agency supervisors may provide evaluation statements concerning performance, however, School staff shall have the final responsibility for evaluating performance and assigning grades. The Agency shall maintain no educational records concerning any student assigned to the Agency facilities. All Weld County Health Department, Greeley Page 5 documents in regard to a student's performance shall be forwarded to the School upon the student's completion of the clinical experience. 6. Agency staff are not to be considered employees of the University of Northern Colorado for any purpose and said staff may not hold themselves out as employees or agents of the University or otherwise make any representations or commitments on behalf of the School or University. III. JOINT RESPONSIBILITIES AND TERMS OF AGREEMENT 1. This agreement shall commence as of July 1. 1992 , and continue in full force and effect through June 30. 1995 . This agreement may be terminated by either party during its term only for cause and that party seeking to terminate the agreement shall provide the other party written notice of alleged cause. The alleged breaching party shall have thirty (30) calendar days after receipt of notice to remove the cause or cure the breach. If the cause is removed or the breach cured within that 30 day period, the contract shall remain in force and effect. In the event the cause is not removed or the breach is not cured within the 30 day period, the party providing notice may thereafter terminate the agreement. 2. During the term of this agreement, arrangements shall be made for periodic meetings between representatives of the School and the Agency Weld County Health Department, Greeley Page 6 to promote understanding of and adjustments to any operation or activity involved herein. 3. The nature of this agreement is such that each party undertakes obligations to the other party with no passage of funds between the parties or between personnel of their respective staffs. 4. Both parties agree that they shall conduct their activities under the auspices of this agreement in accordance with State and Federal non- discrimination laws. 5. Both parties recognize that they are bound to comply with the Family Educational Rights and Privacy Act (Buckley Amendment) in the handling of educational records of students enrolled in their programs. It is also understood and recognized that employees and agents of each party will need to have access to the educational records maintained by the other party in properly administering their duties and obligations under this agreement and to the individual students. It is agreed that each party shall thoroughly orient their employees and agents of their obligations under the Family Educational Rights and Privacy Act and shall maintain their practices in strict accordance with the requirements of that Act. Neither party shall be permitted to authorize any further disclosure of educational records of students of the other party to persons or entities not a party to this agreement without first having received permission of the other party and having obtained assurances Weld County Health Department, Greeley Page 7 that the other party has fully complied with the provisions of the Family Educational Rights and Privacy Act. Any permitted redisclosure to persons or entities not a party to this contract shall be under the condition that no further disclosure by such parties shall be permitted. Each party agrees to save, indemnify and hold harmless the other party and their officers, employees and agents from any liability damages, claims, actions, causes of action, demands, judgments or awards of whatsoever kind or nature, arising out of any failure by the other party or its officers, employees or agents to abide by the Family Educational Rights and Privacy Act or its implementing regulations. 6. It is agreed by both parties that any causes of action arising out of this agreement shall be venued in the courts of Weld County, Colorado to the extent that those courts of are reposed with subject matter jurisdiction. Both parties agree to submit themselves to the personal jurisdiction of those courts. Weld County Health Department, Greeley Page 8 8. This agreement shall be construed in accordance with the law of the State of Colorado. 9. This agreement constitutes the entire agreement between the parties and supersedes all prior written and oral agreements. Any changes, mcvlifirarions, supplementations or amendments to this Agreement must be reduced to writing and signed by the parties which are signatory hereto. 10. Any waiver by either party of any term or provision in this contract at any one time shall not constitute a waiver of any other or all. provisions. Any waiver of any part or provision of this agreement at any one time shall not constitute a waiver for all times.
