HomeMy WebLinkAbout921123.tiff i'1 RESOLUTION RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION NO. 1456 - 3 FARMS CORPORATION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the request for Recorded Exemption No. 1456, submitted by 3 Farms Corporation, % Miriam Bromley for properties which are located in part of the NNW} of Section 23, Township 1 North, Range 67 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 45.1 acres and 34.9 acres, and WHEREAS, after reviewing the Planning staff's concerns and hearing the testimony presented, the Board determined that said request shall be denied for the following reasons: 1. It is the opinion of the Board of County Commissioners that this proposal evades the purpose of the Weld County Subdivision Regulations as defined in Section 1-3. 2. The Board feels this division would be inconsistent with efficient and orderly development. 3. That the proposed lots will not have access to an adequate supply of water in terms of quality, quantity, or dependability. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request for Recorded Exemption No. 1456, submitted by 3 Farms Corporation, % Miriam Bromley be, and hereby is, denied. The parcels of land are described as the north half of the northwest quarter of Section 23, T1N, R67W of the 6th P.M. , and part of the southwest quarter of Section 14, TIN, R67W of the 6th P.M. , Weld County, Colorado. Recorded Exemption 1456 is located south of Weld County Road 8, east of Weld County Road 21. Recorded Exemption 1457 is located north of Weld County Road 8, east of Weld County Road 21. Recorded Exemption 1456 proposes dividing an 80 acre parcel into two lots of 45.1 and 34.9 acres, more or less. Recorded Exemption 1457 proposes dividing an 80 acre parcel, which is Tract 2 of Minor Subdivision 3, approved in 1972, into two lots of 45.1 and 34.9 acres, more or less. The applicant proposes using wells and septic systems on the properties. One house, served by an existing well, exists on the proposed 34.9 acre parcel of Recorded Exemption 1456. The rest of the lots have been in agricultural production. The State Engineer's Office, Division of Water Resources, has commented that an in-house-use-only well would be available on the 34.9 acre parcel which currently does not have a residence unless a well was drilled to a nontributary source of groundwater in the Laramie-Fox Hills aquifer 500 to 790 feet below ground surface. Domestic well permits would be available on both 45.1 acre parcels. The Department of Planning Services' staff recommends this request be denied for the following reasons: The proposed land divisions are not in compliance with the Weld County Comprehensive Plan. The guidelines set forth in the comprehensive plan to allow a division of an agricultural lot into two separate lots are outlined in Agricultural Policy 7. The intent of this policy is to: 921123 Board of County Commissioners RE-1456/RE-1457 Page 2 A. Enable the property owner who is retiring an opportunity to live on or sell the existing farm improvements; B. Enable the property owner to sell off agricultural land that is nonproductive for one single family dwelling homesite; and C. Enable the property owner to provide a residence for direct members of the farm family and also for workers employed at the farm. The effect of this proposal would be to split off one set of existing farm improvements. The effect is also to divide two 80 acre farms into large acreages so that the farmable, productive ground is no longer in one ownership and would no longer be farmed as a unit. The proposed division would be inconsistent with efficient and orderly development. As shown on the attached aerial photographs, the level of development in this area and the potential for continued divisions may evade the intent of the Weld County Subdivision Regulations. The 80 acre parcel north of Weld County Road 8 is Tract 2 of Minor Subdivision 3. Minor Subdivision 3 divided a 99 acre parcel, in 1972, into two parcels of 18 acres and 81 acres, more or less. Ten parcels of land already exist in this half-section. Further division in this area will increase the density of the area which will increase service demands. Increased residential development in rural areas requires more urban-type services such as road maintenance, snow removal, utilities, sheriff and fire protection, and school busing. District 2 Dear Ms. Swanson: We have reviewed the two referenced proposals for recorded exemptions to split two 80 acre tracts into tracts of 45.1. acres and 34.9 acres from each 80 acres. The proposed water supply is to be from individual wells on each tract. According to the information submitted to us,the applicant indicates there is an existing well on the proposed 34.9 acre tract in Section 23. In reviewing our records, we are unable to find that the well has ever been issued a permit number by this office or decreed by the Division 1 Water Court. We assume this well serves the old homestead located in Section 23. We do not object to the continued use of this well providing its use does not exceed the exempt type uses as defined by statute. The applicant does not define to what depth the proposed new wells would be constructed. Based on data developed for the Denver Basin Rules (Senate Bill 5), the only nontributary source of ground water at this location would be the Laramie-Fox Hills aquifer in the approximate interval from 500 feet to 790 feet below ground surface. In both exemption proposals, the applicant is proposing tracts of less than 35 acres. If wells shallower than the Laramie Fox Hills aquifer were proposed for these smaller tracts, the use of the wells would have to be limited to ordinary household purposes inside one single family dwelling and the watering of the user's own noncommercial domestic animals. The irrigation of home gardens and lawns or other outside uses would be prohibited. The return flows from the use of these type of wells would have to be back to the same stream system in which the wells are located. We would suggest that the applicant consider splitting the two 80 acre tracts in such a way that all the tracts result in 35 acres or more each. We could then make permits available for each tract without an existing well, which would allow for fire protection, ordinary household purposes inside single family dwellings, the watering of domestic animals and livestock, and the irrigation of not more than one acre of home gardens and lawns on each tract.
