RE: APPROVE AGREEMENT FOR SERVICES AND AUTHORIZE CHAIRMAN TO SIGN - MIDEXCO
CONSTRUCTION, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement for Services
between Weld County, Colorado, by and through the Board of County Commmissioners
of Weld County, and Midexco Construction, Inc. , with the terms and conditions
being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said
agreement, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Agreement for Services between Weld County, Colorado,
by and through the Board of County Commmissioners of Weld County, and Midexco
Construction, Inc. be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted/by the following vote on the 4th day of May, A.D. , 1992.

THIS AGREEMENT FOR SERVICES is made this `-— day of
Ll"Yl cuteI , 1992, by and between Weld County, Colorado, by and
through the Bthard of County Commissioners of Weld County, whose address is
915 Tenth Street, Greeley, Colorado 80631, hereinafter referred to as
"COUNTY" and Midexco Construction, Inc. , whose address is 417 East 8th Avenue,
Greeley, Colorado 80631, hereinafter referred to as "CONTRACTOR". `b!< ' '-`1 ,
WITNESSETH:
WHEREAS, County is in the process of constructing buildings at its Weld
Business Park located generally at the southwest corner of the intersection
of "M" Street and 11th Avenue in Greeley, Colorado, and
WHEREAS, County is in need of the services of a company for the coring
under roadway for the laying of certain utility lines, and leave four (4) inch
conduit through core hole at two locations.
WHEREAS, Contractor has the labor and equipment available to accomplish
this task, also make all necessary contacts to locate any and all underground
utilities prior to commencing work.
NOW, THEREFORE, in consideration of the sum of $3,942.00, to be paid to
Contractor by County upon the completion of the work contemplated herein, the
Parties hereto agree as follows:
1. That Contractor shall core under the pavement of "M" Street and
proposed street, located generally at 17th Avenue and "M" Street, and
core certain conduit lines through said cut and leave four (4) inch
conduit for future phone lines at two different locations according to
the direction of County.
2. That Contractor agrees to release, indemnify, defend and hold
harmless County and its employees from any and all loss, claims,
demands, suits or other action, or any liability whatsoever, whether
suffered, made, instituted or asserted by the Contractor, its employees
and/or agents, or by any other party or person, for any personal injury
to or death of any person or persons, or for any loss, dem,4ge, or
destruction of any property, whether owned by the customer or others,
incurred in the course of or as a consequence of or result of the work
contemplated herein.
