APPROVED WITH CONDITIONS
The Department of Planning Services has determined through the review that
the standards of Section 9-2 E. (1) (a) through (m) of the Weld County
Subdivision Regulations have been met. This Recorded Exemption is approved
with the following conditions in accordance with information submitted in
the application and the policies of the County.
A Weld County septic permit is required for the proposed home and its
septic system shall be installed according to the Weld County Individual
Sewage Disposal System (ISDS) regulations.
An ISDS evaluation by the Weld County Health Department on all existing
septic systems will be necessary prior to issuing the required septic
permits on the existing systems.
The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be prepared in accordance with the requirements
of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within sixty (60) days from the date of approval by the
Department of Planning Services. The applicant shall be responsible for
paying the recording fees.

Dear Planning Staff :
It is my wish to divide off a five acre parcel from the rest of
my farm. This parcel encompasses a residence as well as several
outbuildings . This parcel is nonproductive farm ground and since
the property is under lease I have no intentions of living on
this site .
The smaller parcel will be utilized as a horse setup which is
allowed in the agricultural zone . The larger parcel shall remain
an irrigated farm consequently, there would be little change from
what currently exists .
I believe this proposal would be consistent with the Weld County
Comprehensive Plan which indicates this property lies within the
Urban Growth area of several surrounding communities . The
agricultural district allows for nonproductive farm ground to
subdivided from the remainder of the farm. Immediately West of
my property is Antelope Hills Subdivision . To the East, South
and North are irrigated farms with single family dwellings . It
would appear my proposal is similar in nature to the existing
uses surrounding my farm.
I feel my proposal would have negligible impact on county
services such as road maintenance, fire and police protection .
The residence is currently served by North Weld County water
District and utilizes a septic system for a sewage disposal . Any
future residence on the remaining 75 acres could be served with
North Weld water as indicated in the attached letter . It would
also be my intention to construct a septic system for any new
residence on the 75 acre tract .
This parcel does not lie within a geological hazard or flood zone
as indicated on the appropriate maps . Neither does it lie within
the Weld County airport Overlay district .

If it is determined that the application meets the approval criteria of Section 9-2
E. (1) (a) through (m) of the Weld County Subdivision Regulations, you will be
notified that the recorded exemption is approved. If the staff determines that the
application does not meet the approval criteria, you will be notified and asked to
appear before the Board of County Commissioners at a public hearing. You will be
informed of the hearing date prior to the hearing. The Board of County Commissioners
will then consider your application and make a final decision on the recorded
exemption.
It is the policy of Weld County to refer an application of this nature to any town
or municipality lying within three miles of the property in question or if the
property under consideration is located within the comprehensive planning area of a
town or municipality. Therefore, our office has forwarded a copy of the submitted
materials to the Town of Windsor Planning Commission for its review and comments.

be in attendance at the Windsor Planning Commission meeting to answer any questions
