RE: ACTION OF BOARD CONCERNING VACATION OF RIGHT-OF-WAY - WELD COUNTY ROAD

WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a request for vacation of right-
of-way for Weld County Road 23.75 being further described as part of Sections 25
and 36, Township 1 North, Range 67 West of the 6th P.M. , Weld County, Colorado,
and
WHEREAS, a hearing before the Board was held on September 30, 1992, at
which time the Board deemed it advisable to continue said matter to October 14,
1992, then to October 21, 1992, at 9:00 a.m. , to allow the County Attorney's
staff adequate time to acquire the necessary documents,
WHEREAS, at said hearing on October 14, 1992, the Board deemed it advisable
to continue said matter to October 21, 1992 at 9:00 a.m. , to allow County staff
time to acquire the necessary legal documents, and
WHEREAS, at said hearing on October 21, 1992, the Board deemed it advisable
to continue said matter indefinitely.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that this matter be, and hereby is, continued indefinitely.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 21th day of October, A.D. , 1992.

Dear Mr. LaBroila:
On September 30 , 1992 the Board of County Commissioners of Weld
County, Colorado will consider the vacation of the road right-of-
way known as WCR 23 3/4 as it is located in Sections 36 and 25,
Township 1 North, Range 67 West of the 6 P.M. , Weld County,
Colorado. The vacation will be only for that portion of the
roadway which runs north/northeast .
The Board will consider the vacation at its regular Board meeting
at 9 a.m. in the first floor meeting room, Weld County Centennial
Center Complex, 915 10th Street, Greeley, Colorado. The Board will
hear any public comments on the vacation at that time.
Please call me at 456-4000, Extension 4389 if you should have any
questions regarding the proposed vacation of this portion of
WCR 23 3/4 .

Dear Ms . Dershan:
On July 13, 1992 the Board of County Commissioners of Weld County,
Colorado considered your June 6 , 1992 letter which requested a
vacation of WCR 23 3/4 in Sections 36 and 25, TIN, R67W. The Board
agreed that the County should vacate the roadway, given the fact
that you have been maintaining it for a number of years . The Board
directed me to contact surrounding landowners to let them know that
the Board would be considering the vacation at one of its regular
meetings .
I plan to place the matter of the vacation on the Board' s agenda
for September 30 , 1992 . The hearing will take place at 9 a.m. in
the Commissioners ' first floor meeting room, Centennial Center
Complex, 915 10th Street, Greeley, Colorado.

Thank you for discussing my questions concerning awed County
Road 23-3/4 on Friday. As . indicated tc you. I would like to
have that road vacated as a county road since it serves on? ,., az
ingress and egress to my residence . I have maintained that
particular stretch of road the twelve years I have lived here and
the peel le before me maintained the road themselves as well .
