Of course you are correct when you state that our agreement with Weld County includes soils testing. I apologize if I led anyone to beliede otherwise but I thought I was making myself clear when I stated " . . .we intend to cease all monitoring activities . . . . not specifically included in our agreement. . . " . Just to clarify the matter further, these included monitoring activities are; monthly effluent holding tanks samples, daily irrigation records, quarterly well sampling, annual field summaries, monthly separator flows, biannual solids analysis, biannual soil profiles of eight selected fields, and annual soil surface sampling of all application sites . All samples will be collected by National Hog Farms employees or contractors and analyzed by A & L Labs of Omaha, Nebraska. All of this information as well as parameters tested for and sampling protocols are included in "National Hog Farms Inc. Waste Management Calendar of Activities" which predates our agreement and which was included therein. What I was specifically referring to in my October 28, 1992 letter and my telephone conversation with John Pickle were the monitoring steps Weld County Health and National Hog Farms entered into on a temporary basis . These procedures were outline in my letter to you dated December 12 , 1990 . You will note that each of these procedures has an agreed-to termination date. The latest of these dates was December 12 , 1992 . After considerable discussion with the Weld County Board of County Commissioners about this testing outlined in my December 12 , 1990 letter, it was decided to drop these specific operations and return to only those activities outlined in our Agreement. The purpose of this change is to restore our relationship to one more closely resembling the one outlined in our Agreement and clarify what was meant by performance standards . 06-14;-6 930856 4>2 . I believe our Agreement would allow you to collect samples or conduct inspections whenever you suspected a violation of a compliance standard of the agreement or of an applicable State or County ordinance. It would follow then that you would also be able to show cause for your concern before making your collection or inspection and we would appreciate you extending us that courtesy. We at National Farms welcome any opportunity to meet with you and your staff . The best time for me would be sometime on the last week of January or the first week of February. At that time we will be able to introduce a new member of our staff to you and your people. We have hired an individual with extensive experience as an E.P.A. chemist and lab technician. He will coordinate our activities with Weld County Health and Agri Waste Technology. With his help, National Hog Farms and Weld County Health will find more ways to work together toward our common goals . MISSOURI 64102 AGREEMENT FOR THE SAMPLING AND ANALYSIS OF DRINKING WATER BY THE WELD COUNTY HEALTH DEPARTMENT THIS AGREEMENT is made and entered into this CO day of 19 q3 , by and between NATIONAL HOG FARMS, INC. whose address is , hereinafter referred to as "System, " and the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Health Department, whose office is located at 1517 16th Ave.iue Court, Greeley, Colorado 80631, hereinafter referred to as "Health Department." WITNESSETH: WHEREAS, Weld County Ordinance No. 60-B authorizes the Weld County Health Department to perform by agreement the testing of drinking water for suppliers thereof and the testing of pollutant discharges for those persons and entities holding permits to discharge pollutants into state waters, and WHEREAS, system supplies 7(7 persons with drinking water, and WHEREAS, Health Department possesses the necessary equipment and expertise required to perform the sampling and analysis of the drinking water for System as required by federal law, and WHEREAS, the services provided by Health Department pursuant to this Agreement shall benefit the health, safety, and welfare of those persons residing within the area served by System. NOW, THEREFORE, in consideration of mutual promises and covenants contained herein, the parties hereto agree as follows: Section 1 - Authorization to Act: The System hereby authorizes Health Department to perform the services listed in this Agreement and in Weld County Ordinance No. 60-B, for the testing of Drinking Water on behalf of System. The provisions of Weld County Ordinance No. 60-B are incorporated herein in their entirety. Health Department shall act as an independent contractor in relation to the System in the performance of services set forth in this Agreement. None of the Health Department employees and/or agents shall become employees of System, and no employees of System shall be deemed or become employees of the Health Department by virtue of this Agreement. Section 2 - Term: This Agreement shall become effective on January 1, 1993, and shall remain in full force and effective until December 31, 1993, unless and until otherwise terminated sooner, pursuant to the provisions of Section 5 below. Agreement for the Sampling and Analysis of Drinking Water Section 3 - Services to be Provided by Health Department: Health Department agrees to provide the following services to System during the term of this Agreement: Type of Test Contracted Number of Samples Contracted Fee Bacteriological Routine $17.00 each (Total Coliform) (two per quarter minimum) Resample As Required $22.50 each Confirmation As Required $15.00 each Note: If multiple resamples are taken on the same day, same location - the first sample is $22.50, each additional sample is $6.50. Methods used by Health Department in providing said services shall be in accordance with Section I(b) of the Welc County Ordinance No. 60-B. Health Department shall provide further services as mutually agreed upon by Health Department and System at times and for compensation as agreed to by the parties hereto. By signing this Agreement and providing the services herein, Health Department does not insure the accuracy of the results of any tests performed by Health Department and does not make any representations as to the adequacy of Systems compliance with federal or state law governing the sampling of drinking water. Section 4 - Release and Hold Harmless: The System agrees to release and hold harmless Health Department from any and all liability and/or damages resulting from the acts or omissions of Health Department in performing the services set forth in this Agreement. Section 5 - Termination: Either party may terminate this Agreement upon 30 days written notice to the other party at the addresses set forth below. Section 6 - Obligations and Duties of System: System shall perform all of the obligations and duties set forth in Section II(c) of Weld County Ordinance 60-B. In addition, System shall pay for the services rendered by Health Department pursuant to this Agreement according to the contracted amount set forth in Section 3, above, and/or as may be mutually agreed to by the parties hereto. Payment shall be due within ten (10) days upon of receipt of the bill. Billing will be sent within ten (10) days of the quarter ending: i.e. , March 31, June 30, September 30, and December 31, 1993. Section 7 - Waiver of Immunities/Duty of Care: No portion of this Agreement shall be deemed to constitute a waiver of any immunities the parties or their officers or employees may now possess, nor shall any portion of this Agreement be deemed to or created a duty of care with the respect to any persons not a party to this Agreement. The parties hereto declare that they would have entered into this Agreement and each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases may be declared to be unconstitutional or invalid. EHT sampling and analysis A. Collect samples every month. Refrigerate samples as soon as possible. Note : Samples should be taken at two points : separator effluent and EHT effluent. B. Sample size : One quart. C. Ship samples to lab (Note : Samples should be refrigerated or frozen during shipment. ) . D. Contact AWT (919-851—B528; 919-737-3121 ) so analyses desired can be relayed to lab. E. Send sample key (' keyno3' ) to AWT. F. Collect data on the operation of each EHT; send ' eht' forms to AWT monthly. Well Sampling and Analysis A. Collect samples quarterly (Mar, Jun, Sept, Dec) (after initial background tests) from the monitoring wells identified in the IT Report. B. Sample size: One pint. C. Ship samples to lab. (Note: Samples should be refrigerated or frozen during shipment. ) D. Contact AWT (919-851-8528; 919-737-3121 ) so analyses desired can be relayed to lab. E. Send sample key (' keyno3' ) to AWT. F. Send copy of completed ' apply' forms for each quarter section to AWT on June 1 and Dec. 1. IV. Field Summary A. Report crop type, harvest dates and yields on Section II of ' fldsuml' . B. Send partially completed ' fldsuml' forms to AWT in Nov. C. AWT will complete and return forms by mid—Jan along --. with an annual summary report. V. Seperator Records A. Take readings as to actual separator flowthrough rates once or twice per month and record on ' sep' forms. B. Vary time of day when readings are taken. C. Note any changes to separator configuaration (change in size or type of screen) . D. Send ' sop' record to PWT on June I and Dec. 1 . VI. Forage Samples for analysis during harvest (June and Sept. ) . B. Contact AWT. C. Record the semples on ' keyno4' forms and send copies to AWT. D. Ship the samples to ALL. VII. Separator Solids A. Sampling Frequency - See calendar of activities for National Hog Farms, Inc. Before waste is applied for the first time at any site well water samples should be taken to establish background conditions. 2. Sample Size — 500 ml plastic sample bottle 3. Sample Preservation — Refrigerate as soon as collected ; freeze as soon as passible ; send to lab frozen 4. Standard Parameters To Be Tested: Nitrate —N Chloride Conductivity pH Nitrite—N Calcium Total Dissolved Solids Sodium Sulfate Magnesium Iron Manganese Copper 5. Sampling procedure: ., Well Water a. Use only thoroughly cleaned bottles i500 ml ) ; plastic. If possible rinse with distilled water and allow to dry before use. b. Run water from sampling port for 2-3 minutes before taking sample. c. Ship samples to lab. Groundwater • a. Measure and record the depth of the water in the well. b. Using a pump remove water from the well (approximately 2-3 times the volume of water that is in the well when the sampling procedure is initiated) . c. When sufficient water has re—entered the well collect the desired sample and place it into a sample container. d. Remember to replace the cap on the monitoring well. e. Ship samples to lab. -2- • Separator Liquid Samples ( Influent and Effluent Holding Tank Samples 1. Sampling Frequency — see calendar of activities for National Hog Farms, Inc. 2. Sample Size — 1 liter plastic bottle. 3. Sample Preservation — Refrigerate as soon as sample is taken; Freeze as soon as possible. 4. Collect sample either directly in sample container or in a bucket and immediately transfer to sample container. c. Refrigerate immediately and freeze as soon as possible. d. Before any field receives waste for the first time soil samples should be taken to establish background conditions. In some cases it may be good to take duplicate samples and send them to different labs to compare results. 2. Sample Size — Approximately 1 pint. 3. Sampling Procedure - Soil Samples from Top Horizon: a. Use a soil sampling probe to collect cores from the top 12 inches. Place each core in a plastic bucket (approximately 2 gallon in size) . b. Take samples uniformly over the entire field. Take 15-20 cores for each field. c. • Mix the cores thoroughly by hand and then fill the appropriate sample container. d. Place a sample number' on the container and ship the sample to the laboratory. Profile Samples : a. The first subject discussed was nitrogen loading at the center pivots. I have included the latest calculations done by Dr. Safley describing PAN applied by pivot from January through November of 1990. We believe these PAN applications are reasonable and in accordance with industry standards. In connection with these PAN calculations we agreed to continue our volatilization testing. These tests will be conducted in the same manner as the first one conducted in June of this year. We agreed to conduct tests in January, April, July and October of 1991 with the objective of checking the validity of our PAN calculations. We also discussed the fact that we have had a hard time establishing good grass stands on some of the pivots earlier this year. Early this summer we took it upon ourselves to accelerate pivot installation and planting schedules so that we could relieve pressure on pivots one through six while good stands were established. Our current application schedule illustrating this has been included. We believe these problems are behind us for pivots 1 through 16 and that we will be in a good position relative to grass stands going into the Spring of 1991. Procedures for EHT effluent testing were the next items discussed. We agreed to add to our current bi-weekly grab sampling, a series of four collection pans set under pivots receiving effluent. These grab samples and pan samples will be tested for TKN, nitrate, and ammonia. It will be necessary to collect a one-half gallon sample for this testing from under the pivots. These pan samplings will go on as long as Weld County deems them useful. In addition, it was agreed to drop VS and COD determinations from EHT in and out samplings. P and K determinations will be dropped from the ENT in analysis. General agreement was reached that more in depth study of the dynamics of the pivot systems is desirable. To this end we agreed to the following: A. Study the soils under pivots 1, 4, 16, 20 more intensely. We will take ten cores per pivot each month for the 'next twelve months. Samples will be tested at 0 - 6", 6 - 12", 24 - 30" and 42 -48" depths as is our norm. All samplings will be taken at least 48 hours after the most recent effluent application. These samples will be tested for nitrate and ammonia levels. National will have the company currently doing our soil sampling conduct these also, with a split sample going to Weld County. B. We agree to study the possibility of installing lysimeters under pivots 1, 4, 16 and 20. These lysimeters will be installed at 1, 3, 6 and 9 foot depths. They will be checked monthly for one year. After these 12 months, Weld County and National will decide whether or not to continue sampling based on the degree of success achieved in sampling and obtaining meaningful information. March 1991 was suggested as a start up date. Wes agreed to help us choose the equipment. Development of these lysimeters will be contingent on what is available, how they can be installed (ie. If we cannot find one that can be augered or cored into the ground, we will not install to the nine foot depth because of the turf destruction that would be caused by a backhoe) , and the method used to extract the sample. C. All monitoring and compliance wells will be tested monthly for the next 24 months. We agreed to analyze these samples for TDS, PH, nitrate and depth to water. At the end of this 24 month period (December of 1992) , the decision will be made by National Hog Farms, Inc. and Weld County about whether or not to return to quarterly testing. Additional items discussed and agreed to include: A. Moving EM 9 and EM10 with the addition of another well in the same general vicinity to give us better definition of "downstream" from pivots 9 through 12 and "upstream" of 4 through 8. B. The purchase of materials to supply each monitoring well with its own sampler. The monitoring well statistics discussed in some length at our meeting are currently being further analyzed by a statistician at North Carolina State University in a blind study. I have gone over the raw data you supplied to us at the meeting and have complied tables which include the following revisions: A. I added all of the Monfort labs data obtained through split samples drawn by Weld County. B. I added an EM 15 sample drawn on 9/28/89, also EM 16, CPD2, CPD3, CPD4, CPU2, CPU3, CPU4 samples taken 5/25/90 which were left out. C. In addition, I found two instances I cannot explain; On 8/22/90 EMB, we have a Monfort analysis of a split sample, but no corresponding Weld County report appears in your data. On 10/18/90 EMS has two samplings (reference numbers 90335 and 90327) . A copy of the data tables as they will be submitted to the statistician is included. Randy, I think we had a very good and productive meeting. We understand and appreciate the concerns you and your staff expressed at the meeting. We will make the commitment to establish four new 120 acre pivot systems in Sections 15 and 16 R62WT5N if these new monitoring agreements and testing protocols do not alleviate your concerns by August 1, 1991. The decision for us to expand the system as described will be yours alone to make come August 1. The effluent system is already designed and engineered to accomplish this expansion. All we would have to do is install the pivots and establish the grass. I will be sending you updated PAN application information and statistical analysis of well data as they become available. As you will recall, this letter terminated all monitoring activities not specifically included in the agreement of February 21, 1990. You indicated in the letter, and a subsequent telephone conversation with John Pickle, that this would terminate soil sampling, as well as the lysimeter sampling, effective immediately. Upon discussion with the Board and Mr. Lee Morrison, County Attorney, the Department feels that soil profile samples, and soil surface tests were included in the February 21, 1990 agreement. Exhibit "B", Waste Management Calendar of Activities, and Waste Management Plan Monitoring Procedures, outline the months of collection, and procedures for collection of Soil Profile Samples, and Soil Surface Tests. It would follow then, that if National wishes to continue the February 21, 1990 agreement, that would include soil sampling as outlined in Exhibit "B." It was further discussed by the Board, that the agreement or subsequent correspondence, in no way prevents the Department from collecting whatever samples we deem necessary, at our own expense.
