HomeMy WebLinkAbout940657.tiff RESOLUTION RE: APPROVE PURCHASE OF SERVICES AGREEMENT BETWEEN THE COLORADO DEPARTMENT OF HEALTH'S MIGRANT HEALTH PROGRAM AND FAMILY EDUCATIONAL NETWORK OF WELD COUNTY (FENWC) AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Purchase of Services Agreement between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of Family Educational Network of Weld County (FENWC) , and the Colorado Department of Health's Migrant Health Program, commencing June 1, 1994, and ending October 10, 1994, with further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Purchase of Services Agreement between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of FENWC, and the Colorado Department of Health's Migrant Health Program, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said agreement. Kirkmeyer O 940657 J; -P r CC ; 115 ; HU PURCHASE OF SERVICES AGREEMENT THIS AGREEMENT, made and entered into this /34 day of , 1994, by and between the Colorado Department of Health's Migrant ealth rogram, hereinafter referred to as "Health Program," and the Weld County Division of Human Resources' Family Educational Network of Weld county, hereinafter referred to as "FENWC." In order to provide medical and dental services to approximately 386 eligible Migrant Head Start children ages 0 - 5 in the following areas in Weld County: Hudson, Frederick, Ft Morgan, and six sites located in Greeley, and the Western Slope (Olathe & Grand Junction). FENWC cooperatively enters into this Agreement with the Colorado Department of Health's Migrant Health Program, such services as defined within will be provided per this Agreement. NOW, THEREFORE, in consideration of the mutual covenants herein, the parties hereto agree as follows: 1. Physical Examinations: The Health Program will provide physical examinations for eligible Migrant Head Start children. FENWC agrees to reimburse the Health Program a maximum of $10.00 per child for the examination services not to exceed $3,860.00 ($10.00/child x 386 children = $3,860.00). 2. Personnel services to be provided: Time and Cost Breakdown. All staff will keep accurate time records documenting time allocated to the FENWC program and billing. A. Nursing Services: The Health Program will provide nurses and nursing students to serve all centers. The services to be provided are defined in the attached Memorandum of Understanding. Budgeted time and cost for nursing staff is as follows: • Greeley Sites 2 Nurse (100%) @ 9.00/hr X 696 hrs x 2 = $12,528.00 1 Nursing Student (100%) $250/mo. X 2 = $500.00 Total of $13,028.00 • Frederick/Hudson Sites 1 Nurse (100%) @ 9.00/hr X 696 hrs = $6,264.00 1 Nursing Student (100%) $250/mo X 2 = $500.00 Total of $6,764.00 940657 • Western Slope Sites 2 Nurse (100%) @ 9.00/hr. X 400 hrs = $7,200.00 • Fort Morgan Site 1 Nurse (100%) @ 9.00/hr. x 376 hrs = $3,384.00 • Nursing Coordination/Supervision Jean Schuhle @ $16/hr. x 250 hrs = $4,000.00 FENWC agrees to reimburse the Health Program a maximum of $9.00 per hour for nursing services and $250.00 per month for each FTE nursing student and for 250 hours of nursing coordination/supervision at $16/hour for a total not to exceed $34,376.00. All staff will keep accurate time records documenting time allocated to the FENWC program and billing. B. Health Aides: The Health Program will provide health aides for all centers. The services to be provided are defined in the attached Memorandum of Understanding. Budgeted Time & Cost for is as follows: • Fort Morgan 1 Health Aide (50%) @ 6.25/hr x 188 hours = $1,175.00 • Greeley 2 Health Aides (100%) @ 6.25/hr X 696 hours/each = $8,700.00 • Frederick/Hudson 1 Health Aide (100%) @ 6.25/hr x 696 hours = $4,350.00 • Western Slope 2 Health Aide (50%) @ 6.25/hr X 200 hours = $2,500.00 FENWC agrees to reimburse the Health Program a maximum of$6.25 per hour for health aides for a total not to exceed $16,725.00 ($6.25/hr x 2,676 hours = $16,725.00). 2 940657 C. Dental Hygienists The Health Program will provide dental hygienists to all centers. FENWC agrees to reimburse the Health Program a maximum of $11,128.00. The services to be provided are defined in the attached Memorandum of Understanding. Budgeted time and cost for dental hygienists is as follows: • Greeley/Frederick/Hudson 1 Dental Hygienist (100%) @ $13.00/hr X 656 hrs = $8,528.00 • Western Slope 2 Dental Hygienists (25%) @ 13.00/hr X 100 hrs/each = $2,600.00 D. Dental Students/Graduates: The Health Program will provide dental students/graduates for all centers except Greeley. Budgeted time & cost for dental students is as follows: • Frederick/Hudson 4 Dental Students (10%) @ 5.50/hr X 35 hrs/each = $770.00 • Western Slope 2 Dental Students (10%) @ 5.50/hr X 35 hrs/each = $385.00 • Fort Morgan 2 Dental Students (10%) @ 5.50/hr X 35 hrs/each = $385.00 FENWC agrees to reimburse the Health Program a maximum of $1,540.00 for dental students. All staff will keep accurate time records documenting time allocated to the FENWC program and billing. E. Fringe Benefits FENWC agrees to reimburse the Health Program a maximum of $7,468.00 for fringe benefits on all staff noted in this agreement calculated at approximately 12% of gross salary. 3 940657 3. Dental Services: The Health Program will provide dental work specified in the attached Memorandum of Understanding for FENWC centers. FENWC will reimburse the Health Program a maximum of: $15.00 per child served up to a maximum of 386 children totalling $5,790.00. 4. Medical Care The Health Program will arrange and provide medical care for acute conditions and follow up on abnormal screening results specified in the attached Memorandum of Understanding for all FENWC centers. FENWC agrees to reimburse the Health Program $35.00 per child served up to a maximum of 386 children totalling $13,510.00. All staff will keep accurate time records documenting time allocated to the FENWC program and billing. 5. Pharmacy Services The Health Program shall arrange and provide for pharmacy services to include perscriptions and supplies for all FENWC Centers. FENWC agrees to reimburse the Health Program a maximum of $18.00 per child served up to a maximum of 386 children totalling $6,948.00. 6. Travel The Health Program will pay summer staff for travel related to fulfilling this contract including nurses, nursing students, health aides, and dental hygienists assigned to all sites. FENWC agrees to reimburse the Health Program .20/documented mile up to a maximum of $2,800.00. 7. Operating Expenses: The Health Program will provide direct operating cost to the staff it employs to fulfill this contract including costs for recruitment, equipment, orientation, nursing supplies, dental supplies, health education supplies, office supplies, forms and keypunch. FENWC agrees to reimburse the Health Program for direct operating expenses up to a maximum of $4,830.00. All staff will keep accurate time records documenting any costs allocated to the FENWC program and billing. 4 940657 8. Indirect Costs: FENWC agrees to pay the Health Program a maximum of 15% indirect costs calculated on actual costs of program, not to exceed $16,346.00. 9. Maximum Reimbursement: The total maximum amount to be reimbursed to the Health Program under this Agreement is $125,321.00. The Health Program will submit a bill for services to FENWC no later than November 15, 1994. 10. Assurances: a. The Health Program agrees that it is an independent contractor and that its officers, employees, and clients do not become employees of Weld County, and therefore are not entitled to any employee benefits as Weld County employees, as a result of the execution of this Agreement. b. FENWC, the Weld County Board of Commissioners, its officers and employees, shall not be held liable for injuries or damages caused by any negligent acts or omissions of the Health Program, its employees, volunteers, or agents while performing this Agreement. The Health Program, its officers and employees, shall not be held liable for injuries or damages caused by any negligent acts or omissions of FENWC, or its employees, volunteers, or agents while performing functions as described in this Agreement. The Health Program shall provide adequate liability and worker's compensation insurance for all of its employees, volunteers agents engaged in the performance of this Agreement, as required by the Colorado Worker's Compensation Act. Likewise, FENWC, by and through the Board of Weld County Commissioners, shall provide adequate liability and workers' compensation insurance for all employees of FENWC engaged in the performance of this Agreement. c. No officer, member, or employee of Weld County and no member of their governing bodies shall have any pecuniary interest, direct or indirect, in the approved Agreement or the proceeds thereof. 5 940657 d. The Health Program understai s that monitoring and evaluation of the performance of this Agreement shall be conducted by the Weld County Division of Human Resources and the results provided to the Weld County Board of Commissioners. e. The Health Program and FENWC assure compliance with Title VI of the Civil Rights Act of 1986, and that no person shall, on the grounds of race, creed, color, sex, handicap, or national origin be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under the approved Agreement. Webster, Chairperson Col o epartment of Health's Migrant Health Program WE D CO TY DIVISION OF HUMAN RESOURCES e eckman, Executive Director AT EST M(444 WELD COUNTY CLERK THE BOARD By: A Deputy Clerk to the B 6 940657 1994 MEMORANDUM OF UNDERSTANDING By and Between Colorado Migrant Health Program (CMHP) and Family Education Network of Weld County (FENWC) Purpose: The purpose of this Memorandum of Understanding is to define and clarify roles, responsibilities, and activities in support of the contract between CMHP and FENWC for the provision of health services to migrant children in summer Migrant Head Start Programs. 1994 sites will be: Greeley, Frederick, Hudson, Ft. Morgan, Grand Junction and Olathe (Western Slope). Nursing Services: 1. As defined in the contract, CMHP will recruit, hire, train, and provide professional nursing supervision for RN's in the Greeley, Ft. Morgan, Hudson, Frederick and the Western Slope sites. 2. CMHP will assure that nurses provide those services outlined in the Head Start Nurse job description. Any other nursing services not explicitly defined in the job description need to be negotiated between CMHP and FENWC. 3. CMHP will recruit, hire, train, and provide professional supervision for undergraduate nursing students working at all sites. 4. Nursing staff will notify the service coordinators of their hours and when they will not be on site. Medical Care: 1. As defined in the contract and Head Start Performance Standards, 45-CFR-1304, and per the CMHP provider reimbursement schedule, CMHP will pay for all students. 2. Nursing staff will be responsible for triaging, referring, and case managing the students needing care. FENWC will provide guidelines to nursing staff for referrals to specialists within each area. Pharmacy Services: 1. As defined in the contract, and per the CMHP pharmacy reimbursement guidelines, CMHP will pay for pharmacy services. 2. Vaccine and PPD testing material will be available for all sites with contract clinics and county health departments. 940657 Health and Dental Screening: 1. CMHP nursing and dental staff at all sites will assure that students are screened for the following, according to protocol: dental, height (length), weight, head circumference, blood pressure, hematocrit, and vision within five days of the child entering the Head Start program. Hearing Screening: 1. CMHP will provide hearing screening with the audiometer for all four and five year olds and appropriate screening for younger children. Physical Examinations: 1. CMHP will assure physical examinations are completed on all students. Developmental Evaluation and Intervention: 1. FENWC will provide developmental evaluation and necessary intervention at all sites. Results will be shared with the nursing staff and developmental records will be filed in the health record. 2. CMHP nurses will be responsible for identifying medical handicaps for children and referring them to the Health Care Program for Children with Special Needs. Dental Hygiene Services: 1. As defined in the contract, CMHP will hire dental hygienists to provide preventive dental services at all sites. 2. CMHP dental teams will provide dental screening. 3. Inservice programs will be provided upon request. Dental Care: 1. As defined in the contract, CMHP will provide dental treatment. Overtime/Compensatory Time: 1. Staff employed by the CMHP will follow the CMHP policy on overtime and compensatory/flex time. 2 940657 Travel/Miscellaneous Expense: 1. As defined in the contract, FENWC will contract with CMHP for travel and miscellaneous expense for summer migrant Head Start health staff placed on CMHP payroll. Staff will be reimbursed through CMHP for travel and miscellaneous expense per CMHP guidelines and protocol. Health Aides: 1. CMHP will hire health aides for all sites. Health aides will be placed on CMHP payroll. Health aides will be included in the nursing orientation. 2. Nurses will assume responsibility for the professional supervision of health aides. 3. Duties are as outlined in the job description and include: providing translation for non Spanish speaking health team members at the Head Start center and on home visits, assisting with home visits, including some evening home visits, and delivering messages to parents from the health team. In addition, Health Aides will assist with provider visits on site including assuring patient encounter forms and pharmacy forms are completed appropriately and assisting with physical exams, dental screening and referrals, audiology screening, and record keeping. Translation: 1. FENWC will assure that translators are available to health staff at the Head Start site, at medical/dental appointments, and on home visits. A list of the person(s) available to provide translation for each site will be given to CMHP. Transportation: 1. Health aides in all sites will provide transportation for Migrant Head Start students who have appointments with medical or dental providers. Site Coordinators: 1. Will orient the summer health team to the site. 2. Will provide administrative direction and support as needed. Will notify CMHP staff of issues relating to health team activities or health care service delivery. 3. Will ensure the recruiters complete health history forms and immunization/PPD consent forms when enrolling students and give information to health team. Records will be available at the beginning of the summer and as students enroll. 3 940657 4. Will assist health teams with home visits as needed and provide guidance to health teams for strategies in working with families. 5. Will assist and provide guidance to health team with child abuse cases and legal responsibilities for reporting. Bus Drivers: 1. Will deliver health messages to parents as requested by health team. Orientation/Training: 1. Staff attending orientation will include: CMHP nursing staff, nursing students, dental hygienists, health aides, site coordinators, and FENWC health/education coordinators. A list of the FENWC staff attending the orientation will be given to CMHP. 2. CMHP will take the lead role in developing the agenda and providing training. FENWC staff will provide consultation to and assist CMHP in orientation. 3. CMHP will provide lunch one day of the orientation; FENWC will provide lunch the other day. FENWC will provide coffee and paper supplies (cups, plates, napkins, etc.). 4. FENWC will assure that summer health team members have the opportunity for local orientation, i.e. meeting with FENWC director and health coordinator, site coordinators, case managers, teaching staff, local health providers, etc. 5. FENWC staff will assure that teaching staff have been trained on appropriate handwashing procedures. Environment: FENWC will assure that in all sites: 1. Separate sinks will be available for handwashing and preparation of bottles and food. 2. Refrigerators for vaccine and medications will be available at all sites. 3. A telephone for use by the health team will be available at each site. 4. A file cabinet will be available at each site to store health records. Health records will be stored in either a locked file cabinet or locked room in order to maintain confidentiality. 5. A private place where children may be examined by health providers will be available at each site. 4 DAflrCoal • 6. A place where sick children may rest will be provided at all sites. When the nurse is not on site, FENWC will assure appropriate supervision of sick children after receiving instruction for care by nurse. 7. A desk/table and cabinet will be available at each site where the nurse can store supplies, forms, and teaching aids. Also, a place for the nurse to do paperwork will be provided. CMHP will provide beepers for nurses and the dental hygienist in the Greeley sites. Equipment: 1. CMHP and local dental providers will furnish all dental equipment. 2. Medical equipment will be provided as follows: Site CMHP Mig. Educ. FENWC Ft. Dental Supplies: 1. CMHP will provide all dental supplies, including toothbrush kits, for all sites. Nursing Supplies: 1. CMHP will provide all nursing supplies for all sites. A list will be given to FENWC. Nursing staff will return unused nursing supplies to CMHP. Office Supplies: 1. CMHP will provide office supplies for all sites. Nursing staff will return unused office supplies to CMHP. Forms: 1. CMHP will supply CMHP forms to all sites. A list will be given to FENWC. 2. FENWC will give CMHP any FENWC forms used by nursing or dental staff. CMHP will pack these forms in the form boxes. (Physical exam forms, emergency cards) Health Education Materials: 1. CMHP will provide a nursing resource box for all sites. Nursing staff will return the nursing resource box to CMHP at the end of the program. 2. CMHP will provide a dental resource box for all sites. 3. FENWC will give CMHP any health education materials that need to be included in dental or nursing resource boxes. Recordkeeping: 1. All sites will utilize the Migrant Student Encounter Form. The white (original) copy will be retained in the student's health record. The yellow copy will be forwarded to CMHP at the end of the program. 2. Sites will use the 3-part patient encounter forms to document medical services by medical providers. The white copy will remain in the student health record. The yellow and pink copies will be sent to the clinic for enclosure in contract billings. 6 940657 3. Health records will be stored off-season at the FENWC office. If students are returning, FENWC will assure that the health team receives the old health record. immunizations/PPD Testing: 1. CMHP will obtain vaccine and PPD testing material for all sites contracting with local clinics or county health departments. Sub-Contracting: The Health program may sub-contract salaries and stipends of the health professionals and students it employs, and health care dollars for health services delivered, to the UCHSC Schools of Nursing and Dentistry and Migrant Health Centers in areas of coordinated services (Sunrise Clinic and Salud Clinic.)
