Ranch Eggs Subdivision
Dear Commissioners:
At your meeting on June 27, 1990 you briefly considered the
Dirkson Request to Vacate, and then tabled the matter for two
weeks to allow further study of a complicated matter. I appeared
at that meeting in behalf of Robert Fortner, a neighbor who is
affected by the request. My intent is to remain in contact with
the County Attorney to discuss the resolution of this matter , and
to appear before you again when the matter comes up for hearing.
Unfortunately, I will be out of town on July 11. I will be
returning from Washington D .C. on that date, and would greatly
appreciate your continuing the hearing to a later date.

previously existed in the plat of Ranch Eggs Subdivision will be considered
by the Weld County Board of Commissioners at its regular meeting at 9:00
a.m. , on Wednesday, June 27, 1990. Said meeting will be held in the
Chambers of the Board of County Commissioners of Weld County, Colorado, Weld
County Centennial Center, 915 10th Street, First Floor, Greeley, Colorado,
at the time specified. All persons in any manner interested in this matter
are requested to attend and may be heard.

Subject: Vacating a Portion of South Delaware in Ranch
Eggs Subdivision
Attached are materials pertaining to a request by Melvin and
Bernadine Dirkson of 3198 WCR 4 to vacate South Delaware Street as
it previously existed in the plat of Ranch Eggs Subdivision. It
appears that a replat was done but the plat does not appear to
contain sufficient language to establish a vacation of South
Delaware Street. Therefore, in order to carry out the effect of
the replat, I am recommending that the Board consider this
vacation of South Delaware Street. The Board should be advised
that there may be some discussion on this matter from the former
owner of the lot, George Strubel, whose address is now 3051 South
Hobart, because of a foreclosure which became final after the
replat occurred. The foreclosure resulted in a Deed issuing which
was for the lot only and didn' t include the additional footage
from the old Delaware Street. As a result, George Strubel, the
former owner, may claim that he retained an interest in half of
the road.
I recommend notice be given to any of the parties who signed the
original plat or their successors in interest as well as Mr.
George Strubel.

Dear Mr. Morrison,
The purpose of this letter is to request the revacating of a
portion of South Deleware Street to the owner of record of the
following lot in Ranch Eggs Subdivision:
The North 308.84 ft. of the East 80. ft. of Lot 3, and all
of Lot 4, except the West 80. ft. of the South 308.74 ft. of
Lot 4, Block 1, Ranch Eggs Subdivision, Filing #2, located
in the NW4 of Section 34, Township 1 North, Range 68 West
of the 6th Principal Mendian, Weld County, Colorado.
The above subject property was acquired by Charles F. Curry
& Co. of Kansas City, M0. thru foreclosure on a Deed of Trust.
I represented Charles F. Curry & Co. as listing agent for the
sale of the property to Mr. & Mrs. Melvin Dirksen.
When Charles F. Curry Co. acquired title to the property
thru foreclosure, the replat had not been recorded. As a result
Land Title Guarantee Co. would not insure title on the portion
of land created by the vacated road. Charles F. Curry Co. conveyed
& warranted only that portion that they actually acquired in the
foreclosure. From our previous discussion on the phone, I under-
stand that re-vacating that portion of the road adjacent to the
subject property will give title to that strip of ground to the
new owners, Melvin & Bernadine Dirksen.

Re: Ranch Eggs, Inc. Subdivision; Filing No. 2 ; First Replat
Dear Ms. Curry:
Pursuant to our telephone conversation of Wednesday,
February 7 , 1990, enclosed herewith please find the following
documents:
1) A copy of the first Replat of Ranch Eggs, Inc.
Subdivision, undated;
2) Resolution Approving Subdivision, dated May 14 ,
1986, executed by Weld County Board of County Commissioners;
and
3) Proposed Quiet Title Complaint.
The situation as I understand it is that the my client,
Charles F. Curry Company, loaned money to George A. Struble, a
signatory on the Replat secured by Lot 4 , Block 1, Ranch Eggs,
Inc. Subdivision, Weld County (the "Subject Property") on or
about February 16, 1983 . During 1986, Weld County, for
reasons I am not aware of, decided to vacate certain right of
ways that it held pursuant to the initial subdivision of Ranch
Eggs, Inc. which right of ways adjoined the subject property.
This vacation vested title in the vacated right of way in Mr.
Struble. In 1987 Mr. Struble defaulted on his obligations
under the deed of trust to my client and a foreclosure action
was commenced. However, the Public Trustee 's Deed which
issued did not include the previously vacated right of way, as
my client had no security interest in such right of way at the
time of the vacation. Nonetheless, the right of way is
appurtenant to the subject parcel and I do not believe it
could be used separately and distinctly from the subject
parcel. Nonetheless, Strubles title to the vacated property
makes the subject property difficult to market.

Currently, my client has a purchaser willing to purchase
the subject property but will not go through with the purchase
unless the vacated property is vested in the Charles F. Curry
Company. I realize that Weld County is under no obligation to
alert parties holding a security interest in adjoining
properties to the fact that vacation of a right of way is
occurring. However, my purpose in contacting you at this time
is to determine: I
1) Whether you believe the subject vacation correctly
carried out what I have described herein; and
2) Whether you have any ideas on how this matter could
be resolved short of a Quiet Title Action.
After you have had an opportunity to review the matters
set forth herein, I would appreciate discussing it with you
further.
