CHIODO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 23rd day of June, 1993, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Tony S. Chiodo, P.O. Box 84, Loveland, Colorado 80539, for a Site Specific Development Plan and Special Review Permit for a recreational facility (paintball park) in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the SiSI of Section 7, Township 4 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, Tony S. Chiodo, said applicant, was present, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a recreational facility (paintball park) in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. The Site Specific Development Plan and Special Review Permit is for a recreational facility (paintball park) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. The Use by Special Review Permit area shall be limited to 120 player use hours per day for a maximum of three days per week. Player use hours is defined as the number of players times the number of hours played. The hours of operation shall not exceed 9:30 a.m. to 5:30 p.m. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The relocated access shall be twenty-five feet in width with a thirty-foot radius and enter Weld County Road 46 at right angles. The access shall not exceed a six percent grade and shall be level with Weld County Road 46 from the back of the radius. 4. No permanent disposal of wastes shall be permitted at this site. 5. Fugitive dust shall be controlled on the site. 6. The facility shall be operated in compliance with the requirements of the Department of the Army, Corps of Engineers. 7. The facility shall be operated in compliance with the requirements of the Flood Hazard Overlay District. 8. The maximum permissible noise level shall not exceed the commercial limit of 60 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 9. An individual sewage disposal system shall be installed on-site according to the Weld County Individual Sewage Disposal System Regulations. An adequately sized vault system is allowed. If an absorption sewage disposal system is to be used, the system shall be designed by a Colorado Registered Professional Engineer. 10. The facility may operate from April 1 until October 15. 11. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 12. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 13. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 930546 DEVELOPMENT STANDARDS - CHIODO PAGE 2 14. Personnel from the Weld County Health Department, Division of Wildlife, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. Records of use shall be made available at all times. 15. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 16. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. CHIODO A public hearing was conducted on June 23, 1993 at 10:00 A.M. , with the following present: Commissioner Constance L. Harbert, Chairman Commissioner W. H. Webster, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Keith Schuett The following business was transacted: I hereby certify that pursuant to a notice dated June 2, 1993, and duly published June 10, 1993, in the Windsor Beacon, a public hearing was conducted to consider the request of Tony S. Chiodo for a Site Specific Development Plan and Special Review Permit for a recreational facility (paintball park) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Keith Schuett, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. Tony Chiodo, applicant, was present and stated there is a need for this type of facility in Northern Colorado. He said the dates of operation would be from April 1 to October 15; however, he has a problem with the man-hour limitation, which the Planning Commission set at 120 per day. Mr. Chiodo said they have been averaging ten to fifteen players per weekend, and he would prefer a limit of 30 per day for five or six one-half-hour games. After further discussion, Mr. Morrison explained his understanding of the calculation of man hours as being one-half of a man hour per each person per game. He suggested the Board hear public testimony on this issue and its impact before resolving. Mr. Chiodo explained the safety equipment used and said this game has a lower injury rate than badminton. He said the games are refereed and strictly controlled, and he carries a small loud speaker with him to communicate with the players. Mr. Chiodo said the guns are powered by a seven-ounce CO2 tank and have a speed limitation of 300 feet per second. He said there are yellow ropes along the boundaries and a four to five-foot berm on the south side. Mr. Chiodo said he is leasing the property from Arborland Nursery/Eugene Kammerzell. He explained he has a per capita contract with the option to terminate only by notice. Mr. Chiodo said the paintballs are biodegradable, totally wash out of clothing, and are allowed in national forests and parks. Alexander Brown, surrounding property owner, stated concerns about the safety of the operation and location of a sanitary facility in the floodway. He requested better delineation between the properties and proper setbacks for protection. Otis Philpott, representing a surrounding property owner, said he would like the operation to cease September 1 when the hunting season starts. He also requested a 100-foot setback and a fence with signage. Barb Tokunaga, surrounding property owner, stated concerns about the risks to the habitats of the wildlife. Mr. Chiodo said they could net the boundary, but it would prohibit the wildlife from crossing. He said a gas company pushed the existing berm up, and there are two pins indicating the property line. Mr. Chiodo explained the boundary of the playing field and the parking situation. He said there have been no conflicts with the canoers. He indicated the driveway will access from Weld County Road 46, and they are working closely with the / CC ; / RE: HEARING CERTIFICATION - CHIODO PAGE 2 Corps of Engineers on all excavation. Mr. Chiodo said he also feels a vault system would be a risk in the floodway and proposed using a Port-A- John. John Pickle, Health Department representative, said portables are illegal, and an engineer- designed system would be required in a floodplain. There was further discussion concerning the process of constructing the facility. Mr. Chiodo explained the floating bridges, on which he also has been working with the Corps of Engineers. He said the playing field is 900 to 1000 feet from Highway 60. All trash is cleaned up daily and the rains and/or snows will clean the paint off the trees. He reiterated that the National Forest has found no damage resulting from this game. Mr. Chiodo said there is a horse trailer, which is taken in and out daily, for staging, picnic tables, and four posts for a tarped shade area. He said as far as the wildlife, the area is cleaner and in better condition than it was before. Mr. Chiodo said they have been playing games for eight weeks, and no animals have left the area. He indicated they have no intention of damaging the area or the wildlife. Commissioner Kirkmeyer moved to approve the request of Tony S. Chiodo for a Site Specific Development Plan and Special Review Permit for a recreational facility (paintball park) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Baxter. Mr. Pickle answered Commissioner Webster's questions concerning the sanitary system, and Mr. Chiodo said he would comply with whatever was necessary. On roll-call vote, the motion carried three to two with Commissioner Hall and Chairman Harbert voting nay. We feel the Division of Wildlife ' s recommendation should be followed. In addition, we question the wisdom of promoting recreation that treats the hunting and "shooting" of people as a game. In an increasingly violent society, paint ball does not seem to be a desirable form of recreation for adults or youth. LOCATION: At the southwest corner of the intersection of Highway 60 and Weld County Road 46. Tony Chiodo, applicant, explained paintball parks are in existence throughout the United States and this game is a growing sport. The guns are CO2 powered and the cartridges are made up of food coloring, sugar, and water. Tony Chiodo said this sport promotes team work and large corporations use the sport to overcome problems employees have working together. The property initially had trash and debris on it. They have cleaned it up. Ropes were placed along boundary lines to define the approximate 5 acre field of play. Equipment includes the guns, paint cartridges, face masks, and head gear. They have placed a horse/tack trailer in what is referred to as the staging area (an area 700-800 feet off of Highway 60) where each game is organized and the player is outfitted. He also spoke about the concerns of the Division of ss Wildlife. He explained the area is cleaner now than when they arrived and will i be continually policed. This game is no more detrimental to the wildlife in the ` area than uses of the property in the past such as camping, hunting and canoeing. They plan to have a picnic area near the "staging area" , potable water, which 3 will be determined by the Weld County Health Department, and port-a-potty's vs. permanent vaults or a septic because the property is located in the floodplain. The actual game time is 1/2 hour with teams starting approximately once an hour. Team numbers vary but total players would not exceed 35 or 40 a day. They would w like to operate between the hours of 9:30 and 5:30, three days a week with one scheduled tournament a year assigned by the National Paintball Association. Paintball is allowed in some of the National Forests and Parks. The color does not remain on the property, it either is washed away when it rains or it wears off in about a week's time. b The Vice-Chairman asked if there was anyone in the audience who wished to speak for or against this application. Alexander Brown, surrounding property owner, has 256 acres adjacent to the proposed paintball park. He has genuine concerns. He would like to see the property left in it' s natural habitat. He raises kids and hunts birds on his property. He doesn' t understand the economics of the proposal and feels the applicant will have more people on the property than originally determined. Mr. Brown feels commercial river bottom property would be a better location. If this proposal is recommended favorably, he would like to see a better property divider than the existing rope. Courtney Crawford, Division of Wildlife, explained his concerns about possible wild turkeys nesting in the area. He was not aware the applicant had already hosted 2 events, with the County Commissioner's permission. Boyd Jenkins, spoke in favor of the operation. He operated a paintball park in the Greeley area about 11 years ago. He is in favor of this proposal. At the time of operation of his park, pelicans and cranes were on the property and remained there during and after the park was closed. Economics were improved because of the influx of people. The property is now completely bare due to sheep grazing it. Thor Gust, spoke in favor of the application also. He is an avid outdoorsman who is new to the sport and doesn't feel it is harmful to the environment or the wildlife in the area. 930S46 MINUTES OF THE WELD COUNTY PLANNING COMMISSION MEETING May 4, 1993 Page 3 Kathy Chiodo, applicant' s wife, explained this land is leased from the property owner who has not put the property to use in years. She said there is a guideline/rule book published for paintball, parks and it will be strictly enforced. Concerns were voiced by Jean Hoffman about access onto the property. This was discussed and the applicant is willing to change the access point onto the property for safety reasons . Bill O'Hare asked if this is a year round operation. Tony Chiodo said no, if the weather is below 40 degrees, the guns won' t fire. Bud Clemons said this operation is no different than other uses throughout the County such as a sporting clay range. He feels the property owner could damage the land far more than the present proposed use (exotic plants fenced for protection that would deter animal crossing; or sheep and cattle .y grazing) and not need a Special Review permit. Bud Clemons also asked Courtney Crawford, Division of Wildlife, why the Division did not appropriate this land if the possible nesting turkey's are a concern. Courtney Crawford stated the property is not large enough for the Division of Wildlife to consider controlling it. Lanell Adler read the proposed Development Standards and Conditions of approval into the record. Richard Kimmel moved Case Number USR-1009, Tony S. Chiodo, be forwarded to the Board of County Commissioners with the addition of Condition of Approval Number 4, the change to Development Standard Numbers 1, 10 and 14, and the renumbering of the remaining Development Standards, with the Planning Commissions recommendation for approval. Bud Clemons seconded the motion. The Vice-Chairman asked the secretary to poll the members of the Planning Commission for their decision. COMMENTS: Jean Hoffman: As much as I appreciate what's been said here and you certainly brought up an interest in the game, I'd like to see it and try it and I appreciate the fact that you have gone out and cleaned up the area. I have gone by that area many times and I appreciate what you've done there, but I believe, based on the testimony of Mr. Crawford and the District Wildlife Manager, and on the staff's original recommendation, that there are probably many other sites that are more suitable for your game. I appreciate the applicant' s planning and working with the various entities they had to work with in trying to get something like this , so I will vote yes. Don Feldhaus: It appears the applicant has a sincere desire to cooperate and work with the surrounding neighbors and make this a win, win situation. & Shirley Camenisch: I believe the same way Jean does. It is not exactly the area for something like this. I know they've worked hard out there, I drove by it today. I keep thinking about the spectators that are there too, and the r people that are going to be there just to walk their dogs and get some exercise and come along with the players. I vote for denial. Bud Clemons: I think to deny this would be to deny Mr. Kammerzell (the property owner) some of his property rights. I feel that there is evidence provided to show that the applicant' s sincerity in trying to protect the habitat, to create minimum disturbance to the wildlife. There are numerous options that the landowner could do that would create far more damage to the wildlife and the environment, than what this operation would do. I agree that there might be a better place, but there' s always a better place for every landfill and every undesirable situation and there had to be a place for everybody and if there is a better place I'm sure the applicant has searched for a suitable site. I know the area quite well, I've lived in the neighborhood and it seems to be fairly adequate and I have had some limited experience with these operations, so I know something about them. I vote yes. The maximum permissible noise level shall not exceed the commercial limit of 60 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 9. An individual sewage disposal system shall be installed on-site according to the Weld County Individual Sewage Disposal System Regulations. An adequately sized vault system is allowed. If an absorption sewage disposal system is to be used, the system shall be designed by a Colorado Registered Professional Engineer. 10. The facility may operate from April 1 until October 15. 11. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 12. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 13. THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE DENIED FOR THE FOLLOWING REASONS: The proposal is not consistent with the Environmental Quality and Natural Resource Goals and Policies as set forth in the Weld County Comprehensive Plan. The Environmental Quality and Natural Resource Goals state: "All land use proposals shall be designed and operated to conform with all applicable Federal, State, and local regulations pertaining to air, water, noise, and other environmental quality standards" ; and, "Weld County will cooperate with local, State, and Federal agencies to identify, conserve, and protect fish and wildlife habitat and in implementing measures for the protection of such areas. " One of the Environmental Quality and Natural Resource Policies states: "Development and design of land uses which require drainage, excessive removal of riparian vegetation and alterations of river or stream banks shall be discouraged in order to protect river or stream quality and to protect waterfowl areas. " A representative of the State of Colorado, Division of Wildlife, has stated that altering the existing habitat along the river to provide for the paintball playing field and increased human activity would definitely be a detriment to wildlife in the area. According to the Division of Wildlife, the area proposed for this project consists of lowland riparian habitat, and in its present natural state is valuable to a variety of wildlife. The State Department of Transportation and the Weld County Engineering Department have both stated that the existing access presents a safety problem as it currently exists. The access point must be moved to the west. Relocation of the existing access point and construction to County Standards would further negatively impact the wildlife in this area. It is the opinion of the Department of Planning Services' staff that this application is not consistent with the Goals and Policies of the Weld County Comprehensive Plan and should be denied. 930546 ADDITIONAL COMMENTS Tony S. If an absorption sewage disposal system is to be used, the system shall be designed by a Colorado Registered Professional Engineer. 10. This facility shall not be operated from April 1 through June 15, for protection of the riparian wildlife during nesting. 11. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 12. The letter written to you by Mr. Crawford from the Division of Wildlife causes me great concern. While he is correct in describing the area in__ all it 's physical attributes, i .e. the trees, weeds and brush, he fails to mention the other things that have been going on there. For instance, on almost a weekly basis, tresppssers are there shooting pistols, dumpling trash and letting their dogs run. My "No Trespassing" signs have either been removed or shot up beyond all recognition. I look forward to the proposed use by Chiodo and Stone as a means of policing my property and keeping an undesirable element out. My retail business Is less than one quarter of amine from this pasture land and It is possible that a stray bullet could reach my home or sales yard. In his letter to you Mr.. Crawford in effect denies that I have a deer problem in my fields because he has not received a complaint in the last three years. What he failed to mention is that I had to sign a document which holds the Colorado Division of Wildlife safe from further damage claims in order to obtain the deer fence. Any complaining that I would do at this point is pointless. In fact, I still do have a problem with deer in my fields. I am losing 15 to 20 trees a year to deer. Prior to the fence, we were losing approx. 40 trees per year, so the fence has helped, but the real problem comes from the cover that my pasture gives them to breed in and hide in. Again, he fails to mention that there is a reserve area of approx. 14 8Eition for the purpose of nesting habitat for ground game fowl just rhe river and on the east side of Hwy 60. This area is so large that it dwarfs my pasture land and is being patrolled by the owner to disallow intruders. Surely this habitat is large enough to render my property insignificant in comparison. Concerning water fowl , there are literally miles of river — both upstream and downstream to satisfy the needs of ducks and geese. Old cottonwood and willow trees abound In this area. In so far as the wild turkeys are concerned, I find it ludicrous to pro— pose that my private land's use should be structured around introduced game fowl . I was never consulted by the Division of Wildlife to see if it met with my approval to introduce a foreign species into my property. No one told me that I would have to forego the liberty of my property in exchange for the introduction of wild turkeys. The Division of Wildlife just did it ! Now for them to try to dictate the use of my land based upon their unsolicited actions is arrogance at it's worst. I own this land — not the Division of Wildlife, not Weld County or anyone else for that matter. The government with it's many arms of might is trying to dictate what I can and can not do with my private property and I RESENT ITI I ask you, how far away from communism are we when the government views the landowner only as the source for property tax and strips him of his AMERICAN RIGHT of self determination? The Division of Wildlife sees the opportunity to increase their revenue by adding another game bird to the area for which to sell hunting licenses. This in itself is fine. I personally would like to see turkeys establish here just for the beauty of it. However, one can not lose sight of the little announced fact that entrepreneurs and our free market system are, what is responsible for the life blood of our economy. To disallow this Use Permit based upon the Division of Wildlife's biased opinion Is to take more power from the people (both myself and the paintball business) and give it to the government for the purpose of making It even bigger. Greeley, Co . 80631 Dear Planning Services : The 'following letter is in response to your request for comments concerning application for a special use permit by Tony Chiodo for setting up and operating a paintball playing field . The area proposed for this project consists of lowland riparian habitat, composed of a mixture of cottonwood and willow overstory along with a dense understory of grasses, weeds and brush(snow- berry) . This property in its present, natural state is valuable to a variety of wildlife . As stated in the application narrative, the area is utilized by mule deer and white-tail deer throughout the year . Both species are known to use this habitat for raising fawns, bedding areas and escape cover . The narrative also states that operating the paintball playing field would help to alleviate damage by deer to the adjacent tree nursery. The Division of Wildlife has provided the nursery with protective electric fence and we have received no complaints form the landowner for at least 3 years . Hawks owls and other birds of prey are common and utilize the area for nesting, roosting and hunting for prey. Waterfowl also frequent the project site with canada geese nesting on adjacent islands and sandbars . Wood ducks have extended their breeding range in recent years and are nesting along the South Platte River . These birds are dependant upon tree cavities for nesting along with ripaarian areas for rearing their young. This area provides some excellent habitat for wood duck reproduction. Approximately 4 years ago, Rio Grande turkeys were transplanted to nearby Phelps property for the purpose of establishing wild turkeys along the South Platte River . I have observed turkeys on the proposed project property and I have observed them displaying during the breeding season directly across the road(WCR 46 ) from the proposed project Turkeys are ground nesters and require dense cover for successful nesting. This same cover provides important food for poults in the form of insects and it also provides protection from predators . Turkeys are also very dependant on large cottonwoods for roosting at night . Altering the existing habitat to provide for the the paintball playing field and increasing human activity would definitely be a detriment to wildlife in the area . The County is reminded that vehicular use and operation of public accesses (county roads) to the state highway system is their responsibility. The narrative states that the business will be open only on the weekends, except for an occasional tournament. The normal weekend traffic along SH 60 would not warrant acceleration or deceleration lanes. Should the business extend its hours to include week days, it would be necessary to re-evaluate its impact to the highway to determine if accel/decel lanes might be necessary. A list of player's signatures will be provided to Landowner after a day of play along with the appropriate funds. LAND USE The Landowner agrees to let Lessee obtain from the Weld County Department of Planning Services a Special Use Permit and will supply any and all documentation needed to obtain this permit. INSURANCE The Lessee will provide all the necessary insurance to operate said venture which shall release Landowner from any liability associated with this business. TIME LENGTH OF LEASE Landowner agrees to lease said property for an indeterminate amount of time. This will be based upon player involvement and feasibility of this ventures continuation. COVENANTS/AGREEMENTS Lessee agrees to: 1 . Clean up and maintenance of said property. 2. Abide by all government, state, county, regulations, including all police, fire and sanitary regulations. 3 . Landowner s ndowner Lessee USE BY SPECIAL PERMIT APPLICATION REQUIREMENTS FOR: C.C.C.P. CENTRAL COLORADO COMPETITIVE PAINTBALL DESCRIPTION: We propose to set up and operate a paintball playing field. The game of paintball is played on a 4 to 10 acre field with 2 opposing teams consisting of 3 to 20 players on each team. Each player is equipped with a protective face mask, a CO2 paint pellet gun, and their choice of protective clothing, (they supply their own clothing) . The field is divided into two bases, that each team starts play at. Various games are played, such as Capture the Flag, Football, Search and Capture, etc. . Each game has a preset time limit, when the time expires the team with the most players left wins or the team that reaches the objective first. The CO2 guns fire a.68 caliber paint ball. When the ball strikes an object it brakes and leaves a bright colored paint spot. A spot the size of a quarter and your out of the game. Paintballs are made from natural gelatin products, are fully biodegradable and non-toxic. They wash off of and out of everything. The guns are regulated to fire the balls at no more than 300 feet per second. There are 2 referees on the field during play, to enforce strict playing rules at all times. LAND REQUIREMENTS: The playing field should be between 4 and 8 acres. A staging area large enough to set a portable restroom, 2 or 3 picnic tables, and an 8 foot x 12 foot trailer to rent equipment and sell supplies from. Also, there should be a large enough area to allow parking for 10 to 20 cars, and access from primary roads. NEED FOR USE: At the present time there are no paintball playing fields in Northern Colorado. We have found that the need of the players for such a park in Northern Colorado, is great enough to warrant our investment. As players ourselves in this fast growing sport, we have been forced to go to the City and County of Denver just to be able to participate in games and tournaments. Northern Colorado players need a field closer to home. This would help keep the revenues from the weekend playing times in the Northern Colorado area. Currently in the United States alone there are over 1. 2 million active players, with a growth of approximately 15-20% per year. In the state of Colorado there are only 6 playing fields operating. (See attached Paintball's Vital Statistics sheet for nationwide figures) Recently the European governments have adopted laws to permit the playing of paintball in their countries, as have Japan and Australia. A good competitive paintball field can draw from a worldwide pool of players, all of which would have the 1 930546 opportunity to play in the Northern Colorado area. This would place before the communities of Greeley, Milliken, Johnstown, and the Weld county area a substantial number of visitors and possible revenues. These players are not just individuals, but employers of corporations who are trying to build the teamwork skills of their employees to enable them to compete within their markets. These companies would have the opportunity to meet people and view the area of Northern Colorado. TYPES OF EXISTING USES ON SURROUNDING PROPERTIES: To the South of the proposed site is additional vacant wooded area, adjacent to the Platte River. Which is sometimes used for hunting. To the West is open farmland. The area to the North is Arborland Nursery which is the site owner. The area to the East is wooded river bottom land used for cattle grazing and oil well sites. The distance to existing homes is approximately as follows: Southeast .5 miles West 1 .25 miles North . 25 miles South .75 miles EMPLOYEES, SHIFTS, HOURS OF OPERATION: The two partners and their spouses in this venture shall be the operators in the beginning. With future plans for 3-4 employees as the operation becomes established and grows. Hours of operation shall be Saturdays and Sundays 9 a.m. to 6 p.m. Occasionally weekdays as individual teams or corporations request upon advanced reservation. TYPE OF WATER SOURCE: Since there is no real water consumption associated with this venture, we will supply bottled water for drinking and for the cleaning of required face masks. All players come prepared in the same manner they do for other outdoor activities. ACCESS ROUTES/TYPES OF TRAFFIC: The site is located at the intersection of Highway 60 and County Road 46. There is currently off road access into the site with a parking area sufficient for players to park. The traffic entering the site will be comprised of passenger vehicles ranging from compact cars to pickup trucks. Traffic should be arriving between the hours of 8:45 to 11:00 a.m. and leaving between the hours of 4:00 to 6 :30 p.m. SEWAGE FACILITIES: Since this is a weekend venture, we will have on site, two porta-johns for patrons use. These will be cleaned and serviced weekly to assure sanitary conditions at all times. In the off season and because the site is in a flood plain, these facilities can be removed safely, which will insure against environmental pollution or damage. 2 930546 FIRE PROTECTION MEASURES: The site is bounded by the Platte River on all sides. Smoking is the only possible danger and this will only be allowed in the staging area which is under our direct supervision at all times. We will have available on site, during business hours, necessary hand tools and fire extinguishers in the case of any on site fire occurrence. THERE ARE NO ANIMALS ASSOCIATED WITH THIS OPERATION. WASTE REMOVAL: The only waste involved will consist of pop cans, candy wrappers, paper towels, etc. . We will have trash containers on site for these items. The site will be cleaned at the end of each day of operation and removed to a proper disposal site. STORM WATER RETENTION: We are not changing any of the original landscaping. The present drainage will not be altered. DISPOSAL OF DEBRIS/JUNK ASSOCIATED WITH PROPOSED USE: There will be no debris or junk associated with this venture. However, currently there is quite a bit of littering and trash bag dumping on this site, of which we will remove and cleanup to help promote this area visually. We hope that with our activities on this site, we will be able to discourage this type of activity in the future. LANDSCAPE PLANS AND EROSION CONTROL MEASURES: In the parking area we will mow weeds, grade, and apply roadbase as necessary. The staging area will be mowed and a few picnic tables setup for player use. The playing field will be left natural except for a few portable barricades (empty spools, pallets, etc. . ) for the play of the games. We are situated directly in a flood plain where erosion control is dictated by nature. RECLAMATION PROCEDURES UPON CESSATION: The only reclamation procedures that would be needed would be removal of the tables in staging area, the portable barricades in the playing area, and reseeding of any damaged grassy areas. The parking area could be left for future use by owner. TIME-TABLE: We estimate that use could begin on March 15, 1993 . Construction could begin immediately and be completed in one week's time. The March 15 date is necessary to meet an early spring deadline for us to be able to accommodate the scheduling of tournaments by the other Colorado playing fields. These are association events of which all fields in a five state area participate. 3 930546 WELD COUNTY COMPREHENSIVE PLAN COMPATIBILITY: Since the site is in a flood plain, our proposed use is consistent with the county comprehensive plan in that it is for recreational use. Environmentally we are not damaging or changing this site which is a concern of the county and we hope is a concern of the surrounding property owners. INTENT OF USE COMPATIBILITY: Since the distance between this site and that of surrounding residences is quite lengthy, we feel safe in the belief that our venture will not harm or annoy anyone in anyway. With another business adjacent to the proposed site, we do not foresee that this venture will cause any additional problems within the district, and we feel that it is compatible with the districts use guidelines as we are providing a recreational business in a recreational use area. Another added benefit would be that this venture would bring in much needed revenue and visibility to the surrounding communities. The land directly to the south of our proposed site is currently used, seasonally, by a members only hunting club which has not tried to insure the safety of the natural environment or property owners in the area. Trash, debris, and human waste are not disposed of, nor is any form of water or fire protection provided, as is our intention to do in accordance with the Weld County Planning and Zoning Board. The other adjacent property owner is a nursery business of which we will be obtaining our site from. This will help him in that he has a problem with deer in the fall coming into his nursery and destroying his trees. Hopefully, with our activity on the site we will be able to help protect his inventory from this type of damage. This does not mean that we will be shooting at the animals on the site as this is strictly forbidden in the play of the game. The presence of people should provide the necessary deterrent. Because of our compliance with the county regulations and our concern for the health and safety of the surrounding area and its citizens, we feel assured that our business venture will not only be legal but fully compatible to the area. POSSIBLE FUTURE DEVELOPMENT: The zoning on this site of flood plain usage assures that this site is unusable for anything but recreational. Surrounding development would not be affected in anyway.
