RE: ACTION OF BOARD CONCERNING REQUEST FOR EXTENSION TO INTERGOVERNEMNTAL
AGREEMENT WITH TOWN OF ERIE
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, on August 14, 1991, the Board of County Commissioners did execute
an Intergovernmental Agreement with the Town of Erie, concerning a Treasurer's
Deed for the Erie Airport, and
WHEREAS, the Board has been presented with an Extension Agreement from the
Town of Erie, extending the closing date by an additional 61 days, with the
further terms and conditions being as stated in said Extension Agreement, and
WHEREAS, pursuant to the Weld County Home Rule Charter, Article 3, Section
3-13, the concurrence of three of the members of the Board is required to approve
a Resolution, and
WHEREAS, the motion to approve the Extension Agreement received only two
votes and therefore failed; the effect of the failure to obtain a majority vote
is a denial of the motion.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Extension Agreement with the Town of Erie be, and
hereby is, deemed denied.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 19th day of August, A.D. , 1991.

THIS EXTENSION to that certain Intergovernmental Agreement
Between The County ot Weld , State u1 Colorado and The `!'own ut
Erie , County of Weld, State of Colorado, entered into and
ell.ect.ive this loth Day oT August , 191 .
WHEREAS ,WHEREAS , the parties entered a certain Agreement , a copy
of which is attached hereto and incr:rpoiatPd herein as
Exhibit A" , and ;
WHEREAS , a majority of the Erie Huard or Trustees
resolved to enter into this extension agreement, .°end :
WHEREAS , the parties are desirous of extending the
elusina date and all other dates in the contract for a period
of b1 days:
NOW THEREFORE, in consideration ut the mutual agreement
Lo extend . and other good and valuable consideration, the
parties agree as follows:
1 . The parties agree to extend closing and all other
operative dates thereunder for a period of 61 days .
2 . In the event the bankruptcy Court does not grant or
give reliei i.rom the automatic stay , currently in eitect. , the
parties may, upon mutual agreement, execute an additional
extension of the Agreement.
