HY. 52: Commissioner Andersen offered the following resolution and moved its adoption: WHEEEAS, Weld County, Colorado has heretofore pledged matching money for State Highway No. 52 from Hudson east, and WHEY.EAS, it is desired that work be started for improving State Highway No. 52 from Hudson east at an early date. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Weld County, Colorado that matching money is hereby pledged for a continuation project fob the improvement of State Highway No. 52 from Hudson east for the year 1952. No. 14 Weld County AGREEMENT TO PARTICIPATE IN THE COST OF HIGHWAY IMPROVEMENT • THIS AGREEMENT entered into this 16th day of October, 1950, by and between the COLORADO STATE HIGHWAY DEPARTMENT, hereinafter called the "Department," and the COUNTY OF WELD, hereinafter called the "County," WITNESSETH that WHEREAS the Department has included in the Budget for 1950 dated January 27, 1950, a Federal Aid Secondary Project designated as S 0024(4) to consist of improve, ments on State Highway No. 14, between Briggsdale and New Raymer, for which the sum of $115,000.00 has been allocated, and in which the County has previously agreed to participate to the extent of twenty five (25) per cent of the cost of the pro- ject, NOW, THEREFORE, in consideration (di premises and the mutual covenants and agreements herein contained, and the faithful pei'forthance thereof, • the parties hereto promise and agree asifollows: 1. The Department will prepare the plans, specifications and estimates for the work, will advertise for bids, will award the contract, prepare the monthly and final estimates, and pay the contractor according thereto. Also, the Depart- ment will arrange for the force account work by railroad, utility and irrigation companies. 2. The County will secure at its own expense all right of way required for project,-as indicated-by-right of-way—lines-shown:on-project-construction-plans.--------- - 3. It is the intent of this Agreement that the County will reimburse the Department in the amount of twenty five (25) per cent of the final cost of the Project, exclusive of right of'way, and with the understanding that the charges for Engineering will not exceed six (6) per cent of the construction cost. If after bids are received it appears that the final cost will be materially in excess of the budgeted amount above named, any obligation of the County in excess of $28,750.00 will be subject to negotiation before contract is awarded. 4. The Department will submit each month a statement covering twenty five (25) per cent of the cost of the construction work on the project as represented by the progress estimate paid to the contractor. This will not include any charges for engineering, which charges will be billed when the project is completed and . final estimate made. The County agrees to promptly pay approved statements submit- ted as per this paragraph. 5. The County further agrees that when the project is completed and ready for traffic, the County will maintain the same in a satisfactory manner, and if said project-is not--so maintained-the-Department-is-authorized_to do said mainten- ance with its own forces'and to bill the County for the cost thereof. If payment is not made within thirty (30) days after receipt of said bill or bills, the State Treasurer is authorized and -requested to transfer to the State Highway Fund, from the County's apportionment of the Motor Vehicle Fees, Chapter 16, C.S.A. 1935, and the Motor Fuel Taxes, Chapters 128 and 130, S.L. 1947, sufficient funds to cover the delinquent payment or payments. • -1- /C0// ' 2—a , .. _ .) • 6. This Agreement shall not be deemed valid until it shall have been ap- proved by the Controller of the State of Colorado, or by such assistant as he may designate. 7. This Agreement shall be binding upon and inure to the benefit of the successors and assigns of the parties hereto, respectively. 8.
