HomeMy WebLinkAbout941207 AK24)8983 RESOLUTION RE: VACATION OF A PORTION OF WELD COUNTY ROAD 62 (BLISS ROAD) BETWEEN WELD COUNTY ROADS 45 AND 47 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on November 22, 1994, the Board of County Commissioners of Weld County received a letter from Kevin Bunnell, Airport Manager, Greeley-Weld County Airport, requesting the vacation of a portion of Weld County Road 62 (Bliss Road) between Weld County Roads 45 and 47, and WHEREAS,that portion of Weld County Road 62 to be vacated is more particularly described as follows: Weld County Road 62 (Bliss Road) beginning at a point approximately three tenths of one mile east of the northwest section comer of Section 2, Township 5 North, Range 65 West of the 6th P.M., Weld County, Colorado (the intersection of Bliss Road and Weld County Road 45), thence proceeding east approximately 1,600 feet, and WHEREAS, by notice dated November 21, 1994, and mailed on November 23, 1994, the adjoining landowners were notified by the Board of County Commissioners of a public hearing on December 7, 1994, to consider the vacation of said portion of Weld County Road 62, in accordance with the requirements of Section 43-2-303(2)(b), C.R.S., and WHEREAS, notice of said public hearing was also published in the Windsor Beacon on November 24, 1994, and WHEREAS, the Board of County Commissioners convened said public hearing on December 7, 1994, and heard testimony and reviewed all other evidence presented therein by staff and the public, and WHEREAS, the evidence showed that the vacation of the portion of the roadway mentioned above will not leave any land adjoining the roadway without an established public road or private access easement connecting the land with another established public road, and WHEREAS, the Board of County Commissioners now deems it advisable to vacate said portion of Weld County Road 62, with said vacation to become effective at the time and upon the conditions set forth below. 2418983 B-1471 P-495 12/14/94 03:30P PG 1 OF 2 REC DOC Weld County CO Clerk & Recorder 0.00 941207 EG0033 RE: VACATE WCR 62 (BLISS ROAD) PAGE 2 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Weld County Road 62 (Bliss Road), beginning at a point approximately three tenths of one mile east of the northwest section corner of Section 2, Township 5 North, Range 65 West of the 6th P.M., Weld County Colorado (intersection of Bliss Road and Weld County Road 45), thence proceeding east approximately 1,600 feet, be, and hereby is, vacated, with said vacation to become effective only if the Federal Aviation Administration finds that the closure of said portion of Weld County Road 62 will present no significant impact to the environment in the area, and, if said finding be made, said vacation to become effective only at such time as construction begins on the new runway (alternative "NW") at the Greeley-Weld County Airport and all real property necessary therefore has been purchased or otherwise acquired. H. Webster, Chairman Commissioner Dale K. Hall, Pro-Tem Commissioner George E. Baxter Commissioner Constance L. Harbert Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Carol Harding County Attorney, Bruce Barker Director of Finance and Administration, Donald Warden The Greeley City Council conducted a special meeting concurrent to Weld County's hearing. Present for the City of Greeley: Mayor William Morton Councilmember Charles Archibeque Councilmember Nancy Brigden Councilmember Tom Selders Councilmember Ruth Slomer City Manager, Paul Grattet City Attorney, Rick Brady City Clerk, Betsy Holder The following business was transacted: I hereby certify that pursuant to a notice dated November 21, 1994, duly published November 24, 1994, in the Windsor Beacon, and mailed to adjoining property owners on November 23, 1994, a public hearing was conducted to consider the request of the Greeley- Weld County Airport Authority Board for the vacation of Weld County Road 62 (Bliss Road) between Weld County Roads 45 and 47 for the construction of an airport runway in conjunction with the Airport Master Plan. Bruce Barker, County Attorney, made this a matter of record. He explained the decision to be made by the Board after hearing public testimony is to either vacate a portion of Weld County Road 62, commonly known as Bliss Road, or approve the construction of a tunnel under the new airport runway. When the Airport Master Plan was approved by Weld County, the "NW" Alternative , Exhibit B, was approved. Rick Brady, City Attorney, informed City Councilmembers the Council does not have authority concerning the vacation of the road; Council action will be to recommend its preference to the Board of County Commissioners. Neil Rood, Isbill Associates, Inc., reviewed the recent history of the Airport Master Plan and the compilation of the environmental impact assessment required by the Federal Aviation Administration (FAA). He explained George Cicoff, Weld County Director of Public Works, was contacted to review the area and recommend how to address road impacts or suggest possible alternatives. Mr. Cicoff explained a traffic count was taken, one day only from 6:00 a.m. to 6:00 p.m., which indicated 345 vehicles at the location of the proposed tunnel. Mr. Cicoff explained the preparation of approaches, installation of a storm drainage system, sloping, repaving of existing road, and other preparation of the site would cost approximately $1,260,000, with another$3,000,000 being planned for construction of the tunnel. Mr. Cicoff stated staff was unable to determine a reasonable estimate of maintenance costs associated with the tunnel. He said pumping storm water is not considered to be a practical alternative since the size of the drainage area would require pumps and motors, which would easily double the minimum cost estimate for the drainage project; therefore, his recommendation is that no further consideration be given to the alternative of constructing a tunnel under Bliss Road. In response to questions from the Board, Mr. Cicoff stated the tunnel being considered is 15 941207 RE: HEARING CERTIFICATION - VACATION OF WCR 62 (BLISS ROAD) PAGE 2 feet below existing ground elevation, the approaches were estimated using a two percent grade, and three drainage areas were considered, with two of them being drained away from the planned site. Mr. Rood responded to Mr. Baxter's questions that a height of 15 feet is generally allowed for clearance, with two 12-foot lanes and 4-foot walkways on each side. He stated this tunnel is being proposed at 800 feet in length. Mr. Cicoff stated lighting the tunnel would also need to be considered, which was not included in his estimates, and clarified for Councilmember Tom Selders that Sand Creek below the existing site would not have to be modified. Dewey Zabka, owner of Martin Produce and Zabka Farms, spoke against the closure. He stated there are methods to bury pipeline to drain the tunnel, and the Board appears to be wary of the project based only on the cost. He indicated $5 million is peanuts compared to the loss the farmers in the area will suffer through equipment damage because of the increased travel distance and safety problems related to interference of slow-moving equipment with other traffic. Clyde Faatz, Attorney representing a number of individuals in the area, stated they are totally against the runway if it closes Bliss Road. He said the FAA is willing to fund their portion of the underpass, as indicated in a previous Airport Board meeting and to him this morning on the phone. He pointed out that, without the extension of the runway, the road would not need to close and indicated the Board would be unfairly placing the financial burden on the landowners in the area instead of the City and County assuming the burden. He discussed the gross inconvenience to farmers and stated the FAA requires local impacts be considered. Mr. Faatz asked why they should have to pay an additional price, as well as lose their land for the runway. He estimated the cost of travelling around the runway on the perimeter road, which is 1.5 miles more. Based on the 345-vehicle traffic count per day, 365 days per year, the cost to area residents will be approximately$50,000 per year. Mr. Faatz stated concerns about impaired access to some properties and reminded the Board the FAA will pay for 90 percent of the cost of the underpass. In response to Mayor William Morton's question concerning the size of equipment, Mr. Zabka explained 13.6 feet is the height limitation per State law, and 14 feet is the approximate width of most farm equipment. He noted State law would require a permit and would also require travel around the tunnel if over-height and over-wide loads were being moved. Charles Warren, who farms immediately north of Bliss Road, stated concerns about the closure being detrimental to the farmers and the tremendous impact which will occur if farm equipment is moved onto Eighth Street. Barnard Geisick, who operates a farm on Bliss Road and runs a custom combine business, discussed the amount of traffic on Bliss Road and the safety hazards which will be created by individuals going to Eighth Street, with very slow and wide equipment impeding traffic. He stated some of his equipment is moved four or five times per day. Bob Noffsinger, Jr., landowner, stated he is also a supporter, tenant, user and customer of the Airport. He feels the Airport, County, and City can afford the underpass. Mr. Noffsinger presented a petition, Exhibit A, signed by 150 individuals in the area, who are in favor of the underpass and against the closure of Bliss Road. He pointed out Road 62 is a key agricultural road, and everyone who has attended previous hearings felt the underpass was a given, with some even feeling a second underpass might be done. In response to Commissioner Baxter, Mr. Noffsinger stated the cost is going to be astronomical to the businesses in the area and most traffic will go to Eighth Street. Bob Kelly, Airport Authority Board member, reiterated everyone felt the tunnel was a done deal and the FAA had agreed to fund it. He pointed out that, although the County would have to maintain the tunnel, it certainly would not cost the extra $50,000 it will cost the public to travel around. He said if the road is closed not only farm machinery but a large portion of the 345-vehicle count will be added to the traffic already on Eighth Street. Wayne Howard, farm owner, stated he is opposed, not only to the closure of Bliss Road, but also to the entire expansion of the Airport. Alex Heckman, of Griffith/Holder Corporation, explained he has twelve trucks making four or five trips per day, and 15 or 20 trips per day during onion season. He stated the added cost to the public will fall, in large part, on the low-income workers in the area. Mr. Faatz noted his calculation of $50,000 total was based on 345 vehicles traveling one way. Mr. Barker reviewed the options of the Board. Mr. Rood answered additional questions from the Board and Council, explaining it would not be feasible to raise the runway to a height which would allow adequate drainage and stated there is no obligation of Federal funds until the environmental assessment is completed. He said the FAA has been supportive of the project and has been looking at $3 million for the 941207 RE: HEARING CERTIFICATION - VACATION OF WCR 62 (BLISS ROAD) PAGE 3 structure, with $9 million for the entire runway. Councilmembers Slomer and Selders, Commissioner Webster, and Mayor Morton expressed their desires to have better cost estimates before making a determination. Commissioner Hall discussed the impossibility of installing a storm drainage system, on a functional basis, and pointed out the more cost estimates that are required, the higher the total project cost goes because of engineering studies to figure the costs. In response to Mayor Morton, Commissioner Baxter stated the cost to upgrade the surrounding roads will be $500,000 to $600,000. Councilmember Archibeque, who is the City's representative on the Airport Authority Board, explained the continuance of this matter tonight would slow down the entire Master Plan process. He stated the environmental assessment needs to be completed, which includes all public comments, and a delay tonight would delay the entire process. He stated he felt everyone should work to keep the project moving in order to be eligible for 1995 funding. Mr. Rood reiterated the environmental assessment plan, as currently written, includes paving alternative roads and the closure of Bliss Road. He said the paving of the alternative roads is on a 90/10 split; therefore, the City and/or County would have to fund $50,000. Councilmember Archibeque pointed out if the environmental assessment shows a high impact on the area because of the closure of Bliss Road, the funding would not be approved. In response to questions from the Board, Mr. Barker stated the only method to close the road is to vacate said road; however, the matter could be continued to a date certain in order to allow future public testimony. He said approval could be conditional upon the FAA's approval, and the effective date could be conditional upon the date of the initiation of construction of the runway; however, it would then need to be placed on the Board's regular agenda to rescind the vacation Resolution. Mayor Morton, Councilmember Archibeque, and Commissioners Harbert and Hall all stated they feel it is time to move on; they do not want the entire project stopped at this point. Mr. Barker read the proper verbiage for conditions as discussed above. Following discussion among the City Council members, it was duly approved to continue this matter to the December 20, 1994, City Council regular meeting. Considering the exorbitant cost and the Public Works Director's recommendation that an adequate storm drainage system cannot be accomplished, Commissioner Kirkmeyer moved to approve the draft resolution to vacate that portion of Weld County Road 62 (Bliss Road) between Weld County Roads 45 and 47. Commissioner Hall seconded the motion and stated the only altemative to vacating the road is the underpass, which is unacceptable. On a roll-call vote, the motion carried unanimously. This Certification was approved on the 12th day of December, 1994. COLORADO November 23, 1994 FIELD(1) RE: Notification of Hearing on December 7, 1994 Concerning Possible Vacation of Bliss Road, Between WCRs 45 and 47 Dear FIELD(2): On January 11, 1994, the Board of County Commissioners of Weld County and the Greeley City Council held a joint hearing to choose one of three alternative plans for the expansion of the runway at the Greeley-Weld County Airport. The alternative chosen as the "preferred alternative" was Alternative "NW". A copy of the diagram showing the placement of the runway and associated airport properties under Alternative "NW" is enclosed. Alternative "NW" will necessitate having the proposed expanded runway and associated airport properties cross Bliss Road (WCR 62) between WCRs 45 and 47. There are two options for the crossing. The first option is to close Bliss Road by having the Board of County Commissioners vacate that portion of the roadway which is necessary for the expanded runway and associated airport properties. The second option is to build a tunnel for Bliss Road so that it may remain open to ongoing traffic. On December 7, 1994 at 4 p.m. the Board of County Commissioners and the Greeley City Council will hold a joint meeting at which time they will choose one of the two options to pursue. If the first option is chosen (closure of Bliss Road), then the Board of County Commissioners will need to consider a resolution formally vacating the necessary portion of Bliss Road between WCRs 45 and 47. Enclosed is a copy of the Notice which has been published in the Windsor Beacon notifying the public of the hearing to consider the resolution to vacate this portion of Bliss Road on December 7, 1994. I have also enjoyed nearly twelve years on the Airport Authority, including several terms as Chairman. My primary responsibility currently is the management of Farr Feeders, a commercial cattle feeding operation located at the east end of Bliss Road . My historical relationship with the airport and the agricultural community has provided me with a somewhat unique perspective on the airport expansion proposal , especially the closure of Bliss Road . By virtue of my location and the nature of the cattle feeding business , the re-routing or closure of Bliss Road would have a potentially greater negative impact to Farr Feeders than any other single user. I am totally dependent on roadway access. Annually we receive approximately 900 truck loads of feeder cattle. We receive over 7 , 000 truck loads of feedstuffs . We ship close to 1 , 700 loads of finished cattle and another 6 ,000 loads of organic nutrients. There are in excess of 7 , 000 automobile trips of employees traveling to work. With this in mind , I would like to voice my sincere support for the airport expansion project, including the closure of Bliss Road for that segment directly impacted by the runway construction . I am of the firm belief that the benefits the City of Greeley and Weld County derive from the airport improvements will far offset the inconvenience incurred by the users of Bliss Road. The Department has prepared a cursory estimate of the project costs for excavation, paving and drainage, which were not included in the original estimates for construction of the tunnel. Provisions for a storm drainage system would be required for the tunnel. The drainage system cannot be constructed due to the minimum depth to which the tunnel must be installed and the elevation of the existing culvert that carries the waters of Sand Creek under the existing airport runway. Computations associated with this conclusion are attached. Basically, the staff was able to determine from the existing ground elevations and the 1980 airport expansion plans that it is impossible to install a functional storm sewer system. If the project were possible to construct, backwaters from the Sand Creek Drainage Basin could cause flooding within the tunnel. To make the project feasible with a conventional storm drainage system,the elevation of the proposed runway would have to be raised a minimum of 4.2 feet. Practically speaking, the runway would have to be installed 10 feet higher than currently planned. Increasing the runway elevation compounds the problems and costs associated with constructing the runway itself. Construction costs associated with providing the storm sewer, had it been possible to install an appropriate system,would have cost approximately $749,500. The additional earth work required to provide approaches to the tunnel and repave the road would cost approximately $132,500. An appropriate allowance was made for administration, legal, engineering and contingencies to reach the total estimated project cost of$1,260,000. The staff was unable to locate any reasonable means of estimating maintenance costs associated with the tunnel. Pumping storm water was not considered a practical alternative since the size of the drainage area would require pumps and motors, which would easily double the minimum cost estimate for the drainage project. Power and maintenance costs associated with pumping storm water are usually considered a reasonable alternative only when the size of the drainage area is very limited. For the above stated reasons,the Department recommends that no further consideration be given to the alternative to constructing a tunnel under Bliss Road. As you may recall , the two Boards and the City Council held a joint hearing on January 11 , 1994 to consider the alternatives for the new runway . The decision was made at that time to approve Alternative "NW" as the preferred plan . Alternative "NW" will necessitate either the closure of Bliss Road , or construction of a tunnel for the roadway . The hearing on December 7 , 1994 will necessitate consideration of which of these two options should be pursued . After visiting with Bruce Barker , Weld County Attorney , it is my understanding that if the decision is made to pursue the closure of Bliss Road, then there will be the need to vacate that portion of the roadway where the runway and the associated airport property will intersect . Therefore , I respectfully submit this letter as a formal request for the vacation of a portion of Bliss Road (approximately 1600 feet ) , between WCR 45 and WCR 47-- should the decision on December 7 , 1994 be to pursue the option of closing Bliss Road. I'm especially appreciative to the members of the Weld County Board of County Commissioners for their endless support in the building and start-up of the SEI Customer Support Center in Greeley. As a result of these efforts and those of so many other community members, we have, in less than one (1) month, hired 225 employees and anticipate hiring an additional 150 employees by mid-January 1995. This is, as you know, well ahead of the initial schedule. Within the last three (3) weeks we have received, in our Greeley facility, clients and potential clients representing major software and hardware manufacturers located throughout the United States. Additionally, we have relocated several key staff members to the Greeley site and, by necessity, had many of our staff members temporarily assigned to Greeley to assist in the start-up operations. As you and other members of the County Commissioners may remember, I highlighted the necessity of expanding your airport facilities to accommodate our business expansions to Greeley. To accommodate our corporate aviation, as well as obtaining local commuter travel, it was projected the Greeley Airport would need to extend its runway facilities to 10, 000 feet. During our initial meetings, which included State officials, we, likewise, emphasized the need for the State to assist in an expansion of the airport facilities. Box 727 Greeley, CO 80632 Dear Mr. Bunnell: Having flown from the Greeley-Weld County Airport since 1968 and being on the Blue Ribbon Committee, I have followed the master planning for the airport with great interest. The latest allegations about traffic count have prompted me to write this letter. I am sure you are aware that accommodating jet aircraft is also a major reason to accept the master plan, not just the traffic count. However, since the count issue has been raised again, please consider the following facts and then completely disregard the bogus traffic count conducted for only ten days from February 19 through March 16, 1994. 1. The FAA will use only counts made from samplings taken over the entire year. 2. The February-March time period is usually a low flight activity period as evidenced by low fuel sales. 3. The proponents of the test stated that "the test was conducted only during perfectly clear flying weather with surface winds of less than ten (10) knots." This was simply not true. With this in mind, I have reviewed the official weather tapes (AWOS) and found the following: A. Wednesday, February 23 - The morning was so foggy (1/4 mile visibility) as to stop all VFR operations until at least 10:55 a.m. The visibility was below 10 miles until 12:55 p.m. and yet the count started at 10:00 a.m. B. Thursday, February 24 - Early morning winds from 6 a.m. to 7 a.m. varied, but were from 13 knots to 22 knots for part of this period. Winds in the afternoon starting around 1:00 p.m. until 5:00 p.m. were always more than 10 knots with gusts as high as 26 knots. The count was conducted from 6 a.m. until 6 p.m. C. Monday, February 28 - Ms. Wieland noted "raining" twice on her log. The official weather records show either lower than 10 miles visibility or clouds for most of the day, although the weather remained marginal VFR. I must also correct a major understatement made by Mr. Robert Kelley in his July 26 letter claiming Aims Flight Training Center to have only 20-30 students. Aims has had between 70-90 students enrolled at the Greeley Flight Training Center for the past year. Our enrollment at the present time is 81. The Aims Tri-County operation has an additional 27 students enrolled.
