HomeMy WebLinkAbout931682.tiff HEARING CERTIFICATION DOCKET NO. 93-01 RE: HEARING TO CONSIDER CREATING LOCAL IMPROVEMENT DISTRICT - ARROWHEAD A public hearing was conducted on March 31, 1993 at 10:00 A.M. , with the following present: Commissioner Constance L. Harbert, Chairman Commissioner W. H. Webster, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Bruce Barker County Engineer, Drew Scheltinga The following business was transacted: I hereby certify that pursuant to a notice dated January 6, 1993, and duly published January 14, 1993, in the Windsor Beacon, a public hearing was conducted to consider the creation of a local improvement district in Arrowhead Subdivision on February 17, 1993. At said hearing of February 17, 1993 said matter was continued to March 31, 1993, pursuant to an amended notice dated February 17, 1993. Bruce Barker, Assistant County Attorney, made this a matter of record. Mr. Barker noted the amended notice was sent to all property owners, and he said the Board should consider accepting the draft resolution to create a local improvement district. Drew Scheltinga, County Engineer, explained a map which illustrated roads to be paved and roads already paved in Arrowhead Subdivision. There are 163 total parcels, of which 110, or 67%, petitioned for the district. Mr. Scheltinga explained the lots adjacent to the unpaved roads will be assessed a full assessment; and lots adjacent to roads already paved will be assessed one-half of an assessment. He said of the 111 lots to receive a full assessment, 70% petitioned, and of the 52 lots to receive one-half of an assessment, 62% petitioned. He explained State statute requires the petition be based on cost. Of the estimated total which is $179,470.00, $123, 140.00, or 69%, was petitioned, which meets statutory requirements. Mr. Scheltinga said there will be no grading and only minor readjustments. There will be shaping and improving to the bed as it exists, with 2" to 4" of basecourse added. Two 12' paved lanes will be created with 21" of asphalt. The shoulders will vary with the conditions. No major drainage improvements will be done, even though there are drainage problems in the area. Mr. Scheltinga said the original cost estimate was $160,000.00 to $180, 000.00. At the original creation hearing held in February, the Board authorized the Engineering Department to proceed with the bid process. The lowest bid received was $193, 480.00, which is 7% over the high end of the estimated amount. Mr. Scheltinga said the asphalt is going to cost $22.35 per ton; however, the gravel, which was estimated at $5.80 per ton, is going to cost $6. 75 per ton for the base and $7.00 per ton for the shoulders. He noted that the 111 lots will be assessed $1,413.00, generating $156,843.00, and the 52 lots will be assessed $706.00, generating $36, 712.00, for a total of $193,555.00. Mr. Scheltinga explained the County's financing is over 10 years, with 8% simple interest. He noted the increase in payments would be approximately $18.00 per year for full assessments and $9.00 or $10.00 per year for one- half assessments. Mr. Scheltinga said all utilities have been located, and no problems are anticipated. In regard to the major gas line, Mr. Scheltinga read part of the January 25, 1993, letter from Peggy Fitzgerald, Public Service representative, stating there are no apparent conflicts. The City of Evans maintains 10 water valves in the area, which will require minor adjustments. Two minor realignments will need to be done, one at Pawnee and Arrowhead Drives, and one at Kiowa and Arrowhead Drives. The surrounding property owners have been contacted, and there are no conflicts. Jane Hopper, property owner, asked if the final assessment is a fixed amount or if it will change again. Mr. Scheltinga explained the final amount is based on the final cost of construction. He said they have much tighter control now because the contractor will be paid only for the amount bid. He noted the original estimate was based on last year's costs and said no increase is anticipated. In response to a question from Chairman Harbert, Mr. Scheltinga said the assessment will be adjusted, up or down, according to the final cost. In response to a question from Ms. Hopper, Mr. Scheltinga confirmed that the cost of the gravel cannot go up again, because the bid is fixed and the contractor is required to submit a bond guaranteeing said price. Donald Moss, property owner, said he feels the unit costs are reasonable and recommended continuing with the project as described. Randee Cook, property owner, asked if the pavement will be torn up because of the water valves. Mr. Scheltinga said the valves will be located and all repair and/or major work will be done prior to paving. Mr. Scheltinga explained the valves will actually be paved over, the utility company will cut a small hole in the pavement, adjust the valve, and pour a concrete collar around the valve. He reiterated that all utility companies have been contacted, and all work is to be done prior to paving. Ms. Cook questioned whether the water pressure will be improved and stated she is in favor of the district. Mr. Scheltinga said the City of Evans has not mentioned the water pressure. Commissioner Hall moved to approve the creation of Weld County Arrowhead Local Improvement District #1993-1, and Commissioner Kirkmeyer seconded the motion. Mr. Barker noted that the amounts in Paragraph F of the draft resolution need to be adjusted according to the bid. Commissioners Hall and Kirkmeyer agreed to include such in the motion, which carried unanimously. Mr. Scheltinga stated the work will probably begin in three to four weeks, based on weather and road conditions. This Certification was approved on the 5th day of April, 1993.
