In return for the payment of such fees outlined stove, the mortici in

sense of decency of the community and the standsrc13 of pructices outlined in
Section 8, of Senate Bill Nn. 449, relating to the licensing of the business and
profession of funeral directors aid embalmers, and in all instances will include
the following minimum requirements$
1. At least one car shall be provided.
2. Services may be held either in the church or the home of
relatives of the deceased, but need not include services
in the uthertnking parlor of the firm prov id i ng the funer..l.
3. The time of the services any be set by the mortician, but in
no instances shall unnecessary delay occur nor shall the time
in any day on which the services are held be incomp►atible with
the standards and customs of the community or the reasonable
wishes of the relatives of the dece:.sed.
4. All bodies must be interred in 1 casket, which casket must be
enclosed in a substantial rough box.
5. Services at the grave need r.ot include expensive artificial
l..vr., canopies, etc., but at all times shall be conducted in
:a spanner befitting the dignity of the occasion and commensurate
with the stn nd-.rds of the community and the profession.
6. Relatives of the dece.sed may provide grave space and pay for
the opening and closing of the grave; r~lso, they may provide
:any other inexpensive detail within re._soa, such as flowers,
music ut the services, or a minister to hold the services.
7. Burials provided under this Agreement may not be supplemented by
relatives except as set forth in Article 6 above. Any money paid
to the mortician to increase the cost of the services vill be de-
ducted from the amount ..11owrd by the Board tor that particular
service.
II8. The mortician shell include with his statement to the Board for I.
services rendered in each case, s notarised, itemised account of
such services.
9. The mortician shall notify the secretary of the State Anatomical
Board of all cases of unknown, unclaimed dead according to
Section 2, of the Colorado Anatomical Law. NG payment for ser-
vices rendered in the care of bodies coming within the scope of
this Act shall be made by the Board, since provision has ,already
teen made for this within the Act.
10. In cases vhere burial space is not already provided and relatives
of the deceased are unable to provide the same, the Po and will
provide grave apace in any cemetery as they deem appropriate,
which shall include the cost of opening and closing.
11. In .,11 cases where bt :tal comes under the terms of this Agree-
ment, relatives may engage the services of Any mortician or
undertaker whom they choose.
12. Authorisation for burial under the terms of this Agreement must
in all cases be obtained from the Weld County Department of Public
Welfare by the mortician when contacted by the relatives of the
deceased.
13. The Weld County Board of Public Welfare reserves the right to
terminate or alter this i greement at any time, but not, however,
vihout giving thirty days' notice in writing to all licensed
morticians and funeral directors doing business as such within
Weld County.

AUTHORIZING COUNTY WHEREAS, it is provided by Chapter 176, Section 126-1, 1935 Colorado Statutes
TREASURER TO INVEST FUNDS: Annotated and acts amendatory thereto ( 1953 Colorado Revised Statutes, Chapter 83, Section
TRUST # 4877: 1-1) that the Board of County Commissioners, by written resolution, may authorize the County
98 Treasurer to invest all or a part of the funds and moneys coming into his possession by virtue
of his office as County Treasurer, in certain securities therein designated, and
WHEREAS, Weld County, Colorado has funds on hand in its County General Fund
in the custody of the County Treasurer of said County, and
WHEREAS said County is authorized by 1935 Colorado Statutes Annotated, Chapter
176, Sec 126-1, and Chapter 83, Section 1-1 of the Colorado Revised Statutes 1953, from time to
time to invest such funds as are not then needed in the conduct of its affairs, in the securities
therein enumerated, and
WHEREAS, of said funds in the hands of said Treasurer as aforesaid the sum of
$198,452.00 is not now needed in the conduct of the affairs of said County.
NOW, THEREFORE, BE IT RESOLVED, that CHARLES 0. BURSIEL AS County Treasurer of
Weld County, Colorado, be and is hereby authorized to invest for the benefit of Weld County,
Colorado, a part of said funds in his hands as said County Treasurer, by the purchase of such •
securities in the amount and in the price as follows, to-wit:

and maturing June 11, 1959, in the amount of
$198,452.00.
BE IT FURTHER RESOLVED, that the United States Treasury Bill herein designated
and authorized to be purchased shall immediately be delivered to the Trust Department of THE

And the County Commissioners, having examined the said application and the other
qualifications of the applicants do hereby grant license Number 666 to sapd applicants to sell
3.2% beer only at retail, at said place, and do hereby authorize and direct the issuance of said
license by the Chairman of the Board, attested by the County Clerk and Recorder of Weld County,
good for one year from the date of issue unless revoked, according to law, provided, however, that
said license shall be issued upon the express condition and agreement that the place where licensee
is authorized to sell beer under said license will be conducted in strict conformity to all laws of
the State of Colorado and rules and regulations relating thereto heretofore passed by the Board of
County Commissioners of Weld County, Colorado and any violation thereof shall be cause for revocation
of the license, expires March 19, 1960.

ment of Revenue of the State of Colorado.
NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners lease
that part of Lot 4, Block 184, together with a cement block brick veneer building 28 feet wide
by 44 feet and located in the City of Greeley, County of Weld and State of Colorado, to the
Department of Revenue of the State of Colorado for a one-year term granting an option to the said
Department of Revenue to renew said lease on successive one-year terms by giving the Board of
County Commissioners at least thirty days written notice of its intention in advance of the
expiration date of any one-year term. The Board of County Commissioners may place a provision
in the said lease that the same may be terminated by giving at least ninety days written notice
of intention to terminate said lease prior to the expiration of any one-year term.
BE IT FURTHER RESOLVED that the lease shall provide for rent at the rate of
$150.00 per month commencing January 1, 1959.

WHEREAS, it is provided by Chapter 176, Section 126-1, 1935 Colorado Statutes AUTH. COUNTY TREASURER
Annotated and acts amendatory thereto ( 1953 Colorado Revised Statutes, Chapter 83, Section 1-1) TO INVEST FUNDS: TRUST
that the Board of County Commissioners, by written resolution, may authorize the County Treasurer # 4877:
to invest all or a part of the funds and moneys coming into his possession by virtue of his office 1 34
as County Treasurer, in certain securities therein designated, and
WHEREAS, Weld County, Colorado has funds on hand in its County General Fund
in the custody of the County Treasurer of said County, and
WHEREAS, said County is authorized by 1935 Colorado Statutes Annotated, Chap-
ter 176, Sec 126-1, and Chapter 83, Section 1-1 of the Colorado Revised Statutes 1953, from time
to time to invest such funds as are not then needed in the conduct of its affairs, in the secu-
rities therein enumerated, and
WHEREAS, of said funds in the hands of said Treasurer as aforesaid the sum of
$198,430.00 is not now needed in the conduct of the affairs of said County.
NOW, THEREFORE, BE IT RESOLVED, that CHARLES 0. BURSIEL as County Treasurer
of Weld County, Colorado, be and is hereby authorized to invest for the benefit of Weld County,
Colorado, a part of said funds in his hands as said County Treasurer, by the purchase of such
• securities in the amount and in the price as follows, to-wit:
UNITED STATES TREASURY BILL dated April 23, 1959
and maturing July 23, 1959 in the amount of
$198,430.00. Maturing Value $ 200,000.00.
BE IT FURTHER RESOLVED, that the United States Treasury Bill herein desig-
nated and authorized to be purchased shall immediately be delivered to the Trust Department of
THE COLORADO NATIONAL BANK OF DENVER, COLORADO, for safekeeping under Trust #4877 for CHARLES
0. BURSIEL, County Treasurer of Weld County, Colorado.
BE IT FURTHER RESOLVED, that said securities, the purchase and deposit of
which are hereby authorized as aforesaid, shall be immediately withdrawn by said Treasurer cash-
ed and returned to the proper County Funds of said County immediately whenever said funds or

A. The majority were around Hereford and the other majority is from Grover --- one-
third from around --- say, from Wyoming that do business in Hereford. They have
shares and everything in the Co-op around Hereford.
Q. Well, are these people --- people to your knowledge wro generally are in the
Hereford area for business purposes?
A. That is right.
Q. From your personal information is there any opposition to this license in the
town of Hereford?
A. No, there is not --- not to my knowledge, there isn't.

to conduct business in selling liquor at retail by the package?
A. You mean where it will be at?

P. Is the area where the 3.2 beer is sold partitioned off from the area in which
you expect to conduct the packaee liquor uusiness?
A. The buildings are connected, but in our license the living quarters and the 3.2
beer is separated. The back part is not considered a part of the building. That is
the way it reads.
Q. Is it all one building?
A. Yes.
Q. You can go from the 3.2 --- the area where you serve 3.2 beer into the living
area. Is that correct?
A. Yes, but we don't live in the living area hack there.
Q. There is nothing there at the present time?
A. No.

A. Yes, we do.

A. It is from the living quarters --- it is the first little room before you go

A. James J. Zitek, Hereford, Colorado.
Q. What is your relationsh'p to Dorothy Zitek?
A. She is my wife.
Q. Are you at the present time conducting a 3.2 beer place and cafe at Hereford?
A. That is right.
Q. You have heard Mrs. 7itek's testimony here today. Would you repeat the des-
cription of the lay-out of the house and the place of business and what will he
done to your knowledre on the liquor store, if granted?
A. Well, in the front end when you open the door, you come --- the 3.? is rig*ht
there. Then you go back into the kitchen and laying right to the east of the
kitchen is what we have --- a store room. Then you come back into the kitchen
and go to the back into the living :soon, what used to he our living room to the
back end and then ajoining the back end to the east is the door that went to the
bed room. That if we get it, will be the package liquor. There is just one window
and we will put the door in there.
Q. You will close it off from the rest or the building?
A. Yes, whatever the law requires.
Q. Mr. Zitek, have you read over petitioner's Exhibit A.
A. Yes, I have.
Q. Are you familiar with the names and signatures on petitioner's Exhibit A?
A. Yes. I am.
Q. State of your own knowledge whether or not those people whose names arn,ears
you actually saw sign, with whatever exception you know about.
A. Well, what I never seen sign, my wife has. One of the other of us have.
took it to the Co-op, and there I think I got about five signers at the Co-op.

A. You want me to name them? Clayton Elder, James Sherra, John Ramon, Fill Davis

A. I would say Ault, if they have a package liquor --- yes, Ault.
Q. If you went east, how far east -- or southeast?
A. Either Sterling or Fort Morgan. Straight south, I don't know, I haven't been
down through there.
Q. Mrs. Zitek said there were ahcut twenty-five that signed who live in Wyoming
and ha e property in Colorado. Is that correct?
A. Yes. Several ha/e property in Colorado. I would say about one-fourth of teem
have property or have interests. In fact, if you want to go Cor interest, there are
more than that that have direct dealin,7s with Hereford.
Q. Is this on the main highway as far as threu h tra:'fic is concerned?
A. No, it is on the Denver - Black Hills Road but very few travel it.
Q. From your experience in operating a 3.2 license and ,afe, what percenta e of
customers are local people?
A. I would say about ninety percent are in the a-ea of Carpenter, `le reford and
Grover.

I am a minister at Hereford, Grover and Prairie Center Churches, and I'm also a
citizen. I feel that we do not have adequate law to care for a liquor problem.
We have excessive drinking among our teenagers now. After a school --- a school
function or a public dance, which usually is of the --- I'm speaking or the public
dance now of teenagers, there are many, many, many cans of 3.2 beer cans around
the streets, around the communities. !e do not have adequate law. I understand
that we do have some deputies --- I understand that Mr. Zitek himself is a deputy.
I understood that there are some in Grover, but we have not controlled our condition,
our liquor problem. And also I would like to say .hat because of this, I have
questioned a number of people that have sined it. People that
MR. ANDE SEN: You mean the petition?
Yes, pardon me. The petition, I have questioned them and they all
MR. MILLER: I object to this hearsay type of testimony. If these people
wish, they may sign a demonstrating petition and may object. I don't think objection
can be presented by someone saying someone said something else.

said so an so. It has been advertised twice and they had a perfect opportunity
to come and object. If it is worthwhile enough to object, it is worthwhile enouh
to be here.
MR. ANDERSEN: I think we will receive it and weigh it for what it is

petition and I wasn't ask to sign it --- there are names on this petition that
are there, that surprise me. I have asked them why and they said they were riven
the impression that the 3.2 place would he closed if the package liquor store was
opened. Also we are sixty miles from adequate law. 4e have had a law problem in
our corn-uni ti.,s and we have asked or help many, many times awl have not received
it, and we are sixty, if not sixty-one miles, I do not know the exact mileage ---
sixty miles from adequate law --- that is the Greeley law, and we are not equipped
to handle anymore than we are, because we are not handling what we have now. I
would also like to ask --- do I say the Court, or the people --- how anyone out of

Wyoming really has an interest in the community to sign a petition to bring some-
thing into Colorado that will harm Colorado people. I don't understand that.
MR. ANDERSEN: I think that I can answer that. I may be wrong, but I
think that they have a perfect right to sign it, and I think the Board of Commis-
sioners weigh the signatures for what we judge they are worth, Miss Horn. Don't
you think that is the correct answer, Bob?

When a postal employee or a banker cannot sign it, I am not --- I do not under-
stand how an out-of-state person --- we might --- we are close to the Nebraska
line, and a Nebraska person could have sif•ned it, and they have no interest in
helping supply the taxes to help take care of the law problem.
MR. ANDERSEN: Well, as I saici a moment ago, we will have to --- we
cannot keep people from signing the petition, Miss Horn, but we do in our ;judgment
--- we probably will consider all of the signatures. We will weigh them, balance

I again say, I have taken my position because I am i_n'erested in young peoplE .

and of course as I said, we are not handling that when a minor can find the beer
that he wants. And we have dozens and dozens of cans in front of the school after
a dance or some activitity of that kind. I do not feel when it takes perhaps ---
it takes four beers to make a boy --- I don't know how many it takes, hut, i sakes
a lot less hard liquor to make a boy drunk or a !rirl and I do not 'eel we can
handle it because we are not prepared by law.

being at the pool hall in Hereford. They said that they had been up there longer
than they had planned, but that it was to be kept open anyway because the Grover
High School Basketball team would be in when they got home after the ball game.

In the beer parlor after the basketball game. That was the remark made by my two
sons --- they were the only two up there that evening. That was the only reason it
was being kept open. And I also don't believe that we have roads that are adequate
any more than we have law that is adequate. That is all that I have to say.
MR. HOUTCHENS: Mrs. Wagner, is it your position that this would be a
law enforcement problem?
A. Definitely.

only thing that I have to say, is that I have two sons and one daughter, and I want
to say that my husband said the other day, if he ever finds out who is selling liquor
to those boys, that the Court won't be too lenient. And I am not saying that either
one of you do, and I don't say that Anderson's do, I don't know. Rut it isn't the
package liquor or just beer, but I know that they are: strong with liquor coming into
that school, and where it is coming from, it should be stopped. And it is minors
not older people that are drinking it. All the basketball boys --- we used to
think that we had a wonderful place out there for our children, that they weren' t
drinking, and we could uphold them to the other schools, but we can' t do that now,
and where the liquor is coming from, I don' t know. Tt's beyond me. I just can't
say who has been selling it to them, but I do know that it is coming in, and it'
a problem that just has --- just as I say --- it is a law problem, and we ^an'+
get law out here. I would like to ask the Commissioners and the Court, n;,,
made the statement the other night that --- he said in the State law, it was told
him several years ago, unless there was a jail and a policeman in the `own, t
had no right to have a liquor store --- that is a package liquor store r-
kind of liquor. Now, I don't know if that is true or not, ;nut they told aim Loat
was in the state law, and I would like to ask that.
MR. AT EA3EN: From my meager knowledge of the law, I would have to dis-
agree with your husband. There is nothing in the law, Mrs. -lerner, that says that
there can't be a package store if there is not a policeman. Now, I want you to
understand that as a Board of County Commissioners, we have no jurisdiction where
there is an incorporated town and policed. We can only issue licenses in rural
and unincorporated areas. If it were an incorporated town, we would have nothing
to do with it. It would be up to the town board.
A. I was just wondering. Now, I don' t know who told him that, hut I was just
wondering to that fact.

some recent cases. I will give these to Mr. Houtchens. (Thereupon the case
of Buddy Lloyd's More A. vs The "'ity Coun •el of Aurora, is given. ) T think that
the entire case here is made on the basis of law enforcement which i3 a problem
that we all have. It is probably easier to say to someone else, you take care of your
child than it is for me to take care of my own. Rut the charge here is a general one
that this is a lack of law enforcement. Time is not specified as to whether it is
the present or preceeding. It is obvious that there are plenty or people in the
community that could bring pressure to bear if such a condition existed. Rut that
condition is not related to the issuance of a license. It is a law enforcement
problem that these people admit that they have at the present time. Whether it
will be solved by ref"•sing the issuance of a license or whether or not the law
enforcement problem will be greater after the issuance of a license, is a matter

of conjecture. It would seem to me if you had a properly licensed source it could
be controlled --- and a matter for the sheriff and I think that these people should
give the law enforcement officer an opportunity to enforce it by telling them what
they know so that the matter can be taken .are of. I 'm not sure that if I had a
son who admitted that he illegally purchased beer that I wouldn't 70 over and tell
the Sheriff. I would either go and tell the Sheriff or I would be still.

AUTHORIZING COUNTY TREAS- WHEREAS, it is provided by Chapter 176, Section 126-1, 1935 Colorado Stat-
URER TO INVEST FUNDS: utes Annotated and acts amendatory thereto (1953 Colorado Revised Statutes, Chapter 83, Section
#4877: 1-1) that the Board of County Commissioners, by written resolution, may authorize the County
159 Treasurer to invest all or a part of the funds and moneys coming into his possession by virtue
of his office as County Treasurer, in certain securities therein designated, and
WHEREAS, Weld County, Colorado has funds on hand in its County General Fund
in the custody of the County Treasurer of said County, and
WHEREAS, said County is authorized by 1935 Colorado Statutes Annotated,
Chapter 176, Sec 126-1, and Chapter 83, Section 1-1 of the Colorado Revised Statutes 1953,
from time to time to invest such funds as are not then needed in the conduct of its affairs,
in the securities therein enumerated, and
WHEREAS, of said funds in the hands of said Treasurer as aforesaid the sum
of $198,550.00 is not now needed in the conduct of the affairs of said County. 4
