What is the closest package store in Weld County or in ColorzOo to Hereford? A. I would say Ault, if they have a package liquor --- yes, Ault. Q. If you went east, how far east -- or southeast? A. Either Sterling or Fort Morgan. Straight south, I don't know, I haven't been down through there. Q. Mrs. Zitek said there were ahcut twenty-five that signed who live in Wyoming and ha e property in Colorado. Is that correct? A. Yes. Several ha/e property in Colorado. I would say about one-fourth of teem have property or have interests. In fact, if you want to go Cor interest, there are more than that that have direct dealin,7s with Hereford. Q. Is this on the main highway as far as threu h tra:'fic is concerned? A. No, it is on the Denver - Black Hills Road but very few travel it. Q. From your experience in operating a 3.2 license and ,afe, what percenta e of customers are local people? A. I would say about ninety percent are in the a-ea of Carpenter, `le reford and Grover. Q. No further questions. CROSS SXAMTNATION BY MR. HOU TT-iENS: Q. Referring to Petitioner's Exhibit A, as I understand it, you helped circulate it, is that correct. A. Yes. Q. The reason you did that is because you have an interest in seeing to it that the license is :•ranted, is that correct? - 8 - 56-K 149 -K A. If the license is granted, she has to borrow the money to buy the pla^e and fix it up --- not me. Q. What was your reason for assisting in the circulation of this petition? A. She asked me to go to the Co-op, she wasn't feeling good. Q. Do you own real estate? A. Yes. Q. This building? A. Yes. Q. '.Jose name is this building in? A. Roth names. It is in joint tenancy, is that correct? A. Yes. Q. Do you expect to charge her rent where she has her package liquor store'.' A. vlell, she didn't charge me any for mine, so I didn't figure I would charge her. -,. This is to he a joint enterprise, is that correct? A. No. Q. Where do you keep your bank account? A. At the Here Cord State Rank. Q. Do you ha're a joint bank account? A. Yes. '. You operate ,;our restaurant and 3.2 beer and the money you take in, you deposit and write checks on that and pay your hills, is that correct? A. Yes. Q. Is your wife authorized to sign checks? A. I would say that she is authorized to sign them. i. Is she authorized to write checks on the account? A. Yes. 3o are you, is that correct? A. Yes. Q. It only requires one of your signatures to --- in crder to withdraw from this account? - 9 - 56-1- 149 -L A. Yes. Q. Do you expect to have this building so arranged that one who is working in the 3.2 beer establishment may also have access to the liquor store and sell package liquor? A. Well, no. What I had in mind, or she had in mind and I su- .ested it to her --- I do now know exactly how the law reads if you can have a back door to the package liquor store or not, but if we can't., we were going to lock the front door and just have a hell on it --- that way nobody could come in without ringing a bell for serwice. L. Lock the front door that enters into the beer establishment? A. No, into the package liquor. Q. So that if you were in serving 3.2 beer and the bell rang, you could go out and open the door and let them in the package liquor store? A. Yes. You would have to Fo outside to come back into the package liquor store. Q. And if you happen to be the one that is conducting the 3.2 beer establishment, you would have to go over and sell the package liquor? A. Not necessarily. We were going to hook it up to the trailer house, and if I ' busy there --- it would be closer tc the trailer house and the front end anyway. Q. Do you have any employees in the 3.2 or cafe other than your wife? A. We have part time. Q. No further questions. RE-DI t ECT EXANI rATIUN FY MR. MILLER: Q. Mr. Zitek, if you need additional help, you will hire it? A. It depends on just how the packave liquor goes over. If it goes over good, we will definitely hire help. And if it don't ---. I would like to answer Mr. Warren if he didn't mind. Q. If Mr. ,ti,'arren wants to ask a question, you may answer it. MR. WARREN BY MR. WARREN: - 10 - 56 -A i4 -fit Q. Maybe you talked with Mr. Robertson? A. Mr. Robertson and I are neighbors and get along very good. Mr. Robertson talked to me about it and which he thought it was a good idea. I told him if the package liquor went good, we would do other means with the place. Q. Then you would eliminate the 3.2 beer establishment? A. If the package liquor went good, I would take it on my own to do something. MR. P"ir'ER.SEN: What do you mean do something? A. If it did make us a living, we would keep the packare liquor and I would work out. MR. AIDEPSF4: Any Curther questicns? Does anyone else care to tes'.ify in behalf of Ziteks in asking for a license? Anyone wish to testify o:posing a license? GERTRUDE HORN being first fully sworn, testifies as follows: My name is Gertrude Horn and my address is Grover, Colorado. Do you want me to talk or am I to be questioned? MR. Aid'ERSEN: You may go ahead and talk. I am a minister at Hereford, Grover and Prairie Center Churches, and I'm also a citizen. I feel that we do not have adequate law to care for a liquor problem. We have excessive drinking among our teenagers now. After a school --- a school function or a public dance, which usually is of the --- I'm speaking or the public dance now of teenagers, there are many, many, many cans of 3.2 beer cans around the streets, around the communities. !e do not have adequate law. I understand that we do have some deputies --- I understand that Mr. Zitek himself is a deputy. I understood that there are some in Grover, but we have not controlled our condition, our liquor problem. And also I would like to say .hat because of this, I have questioned a number of people that have sined it. People that MR. ANDE SEN: You mean the petition? Yes, pardon me. The petition, I have questioned them and they all MR. MILLER: I object to this hearsay type of testimony. If these people wish, they may sign a demonstrating petition and may object. I don't think objection can be presented by someone saying someone said something else. - 11 - 56-K MR. ANDERSEN: You will have to keep your remarks direct to the testimony. That sort of hampers the truth. When a person has given his reason for signing something, it is not as has been stated here today --- been misled MR. MILLER: On the objection, if the witness wishes to disagree with the law, she may do so. That is her privilege. Rut we insist that td s be conduct- ed in accordance with Court practice. MR. HOUTCH!XS: I don't believe that we are bound with rules in this kind of Court. If you want to admit hearsay for what it is worth NCR. A 'fl R AEU: Will it be alright with you, Mr. Miller, if we hear the hearsay and weigh it for what it is worth? MR. MILLER: Mr. Houtchens is absolutely right. The Commissioner can do as he ple-ses. but this is a r.«ular Court practice. It is easy to say somebody said so an so. It has been advertised twice and they had a perfect opportunity to come and object. If it is worthwhile enough to object, it is worthwhile enouh to be here. MR. ANDERSEN: I think we will receive it and weigh it for what it is rorth. MISS HORN: Than I can continue with what I started to say? MR. ANDERSE : Yes. Thank you, sir. There are names on this petition, of course I haven't seen the petition and I wasn't ask to sign it --- there are names on this petition that are there, that surprise me. I have asked them why and they said they were riven the impression that the 3.2 place would he closed if the package liquor store was opened. Also we are sixty miles from adequate law. 4e have had a law problem in our corn-uni ti.,s and we have asked or help many, many times awl have not received it, and we are sixty, if not sixty-one miles, I do not know the exact mileage --- sixty miles from adequate law --- that is the Greeley law, and we are not equipped to handle anymore than we are, because we are not handling what we have now. I would also like to ask --- do I say the Court, or the people --- how anyone out of - 12 - 56-0 149--0 Wyoming really has an interest in the community to sign a petition to bring some- thing into Colorado that will harm Colorado people. I don't understand that. MR. ANDERSEN: I think that I can answer that. I may be wrong, but I think that they have a perfect right to sign it, and I think the Board of Commis- sioners weigh the signatures for what we judge they are worth, Miss Horn. Don't you think that is the correct answer, Bob? MR. HOTITCT I E≥NS: I think so. When a postal employee or a banker cannot sign it, I am not --- I do not under- stand how an out-of-state person --- we might --- we are close to the Nebraska line, and a Nebraska person could have sif•ned it, and they have no interest in helping supply the taxes to help take care of the law problem. MR. ANDERSEN: Well, as I saici a moment ago, we will have to --- we cannot keep people from signing the petition, Miss Horn, but we do in our ;judgment --- we probably will consider all of the signatures. We will weigh them, balance them. I again say, I have taken my position because I am i_n'erested in young peoplE . They are my interest. I have worked with them. I have seen them ;7row up. 1 have seen some of them make dire mistakes, and I do not wish this issue --- this license, to be issued in order to cause any more hardship in our community thrc drinking. And so it is my position as a minister and a citizen. I wool taken this same position if I had just been a citizen rather than a minister. ask you to weigh it and weigh U. well. 1<".'i. A'IDERSEN: Do you care to question her, Mr. Miller? DIRECT EXA1ft' ATIC"I BY MR. MILLER: Q. Miss Horn, or Rev. Horn, you say there are beer cans there now: A. I wouldn't say this morning when I left. I saic' after any actvity, the next morning. Q. This is prior to rrantinp of the license, you understand? A. Prior to granting what license? - 13 - 56-P . What manner would the license increase it's present use? A. If we cannot handle our drinking among minors, I am not accusing Mr. Zitek or Mr. Anderson, the men who dispense our 3.2 beer, I haven't accused them of selling it, but unscrupulous people are selling it to teenaers and they are drinking it and of course as I said, we are not handling that when a minor can find the beer that he wants. And we have dozens and dozens of cans in front of the school after a dance or some activitity of that kind. I do not feel when it takes perhaps --- it takes four beers to make a boy --- I don't know how many it takes, hut, i sakes a lot less hard liquor to make a boy drunk or a !rirl and I do not 'eel we can handle it because we are not prepared by law. Q. You are opposed by your religion? Opposed to drinking, are you not? A. Certainly. Q. That is your veneral posit; :n? n? A. No. I made a statement here a minute aro and that was I would come ', rr= oxaot1v as now if I had only been a citizen. Q. My question is whether or not you are opposed to drinking? A. Yes. Q. Absolutely opposed to it. Is that ri -ht? A. I feel that it brings no rood. :0 You are opposed to it on religious grounds, is that right? A. I am opposed to --- I wouldn't say so on religious grounds. I, in ray own inner self, have a conviction that it does nothing for us as a people. Q. Now you state that you have not seen the petition. A. No. I haven't. Q. Will you state the names of the people who said to you that they were told '-tint the 3.2 beer would be stopped? A. Do you want me to state them publicly? Q. Yes. A. Mr. Robertson is one of them. Q. And who else? - 14 - 56-Q-- A. And Mrs. Robertson. I don't know as she signed it. As I said, I haven't seen the petition. I did not talk to Slayton alder, but I happen to know that Clayton signed it and it was his opinion --- he told his family that Now if you didn't talk to him, how did you know that was his opinion? I talked with Glen Cowley. He did not sign it. He told me that he didn't. As I told you, I haven't seen your petition. • Now, who else told you this? A. I did not talk directly to Mr. Burnett, but Mr. Burnett Q. Then you don't know what Mr. Burnett said? A. No. I did not talk to him. • Who else are you talking about? A. MILLER: I haven't objected to it. 3he hasn't ask for it. MISS HORN: You know, I didn't know that I had the privilege. MR. ANDERSEN: Yes, you have. A. Max Robertson. Some of these I can't read. Herbert Croissaint. Arthur Boardman signed this. He is a postal man. Ray Byers told me that he did not. But he did. Leslie Lambert's wife, I called at his home, Mr. Lambert was not there, hut she told me that she was very sure that he didn't sign it, but he did, he signed it. My testimony as a parent --- girls, and I don't like to be involved in anymore drinking than we n -,n-1 + ^r — 17 - 56- Y e aqq - 7" was one statement that I would like to bring out that my sons made one night after being at the pool hall in Hereford. They said that they had been up there longer than they had planned, but that it was to be kept open anyway because the Grover High School Basketball team would be in when they got home after the ball game. MR. ANDERSEN: Would be in where? In the beer parlor after the basketball game. That was the remark made by my two sons --- they were the only two up there that evening. That was the only reason it was being kept open. And I also don't believe that we have roads that are adequate any more than we have law that is adequate. That is all that I have to say. MR. Well, I just would like to protest this on the grounds that I think that it is a very poor thing for the young people and the things that are done after these school functions that should warrant some criticism there. We all know what takes place and I think it has been said, the older ones know enough better, but I don't think that they carry that out, so I am thinking of more of the interest of the young people when I make my protest. MR. 4OUTCHENS: Mr. Wilson, is this your position that this is a law enforcement problem? A. To a great extent, not entirely. MR. MILLER: How far do you live from Hereford? A. I live at Grover. Q. Tell me how far from Hereford? A. Nine miles. LfR. A" PERSE'1: Step down, Mr. Wilson, and if there further testimony? MRS. ?RED WERNER being first fully sworn, testifies as follows: - 18 - 56-U 149- U I'm Mrs. Fred Werner from Rri gsdale and my children go to Gro:per to school. The only thing that I have to say, is that I have two sons and one daughter, and I want to say that my husband said the other day, if he ever finds out who is selling liquor to those boys, that the Court won't be too lenient. And I am not saying that either one of you do, and I don't say that Anderson's do, I don't know. Rut it isn't the package liquor or just beer, but I know that they are: strong with liquor coming into that school, and where it is coming from, it should be stopped. And it is minors not older people that are drinking it. All the basketball boys --- we used to think that we had a wonderful place out there for our children, that they weren' t drinking, and we could uphold them to the other schools, but we can' t do that now, and where the liquor is coming from, I don' t know. Tt's beyond me. I just can't say who has been selling it to them, but I do know that it is coming in, and it' a problem that just has --- just as I say --- it is a law problem, and we ^an'+ get law out here. I would like to ask the Commissioners and the Court, n;,, made the statement the other night that --- he said in the State law, it was told him several years ago, unless there was a jail and a policeman in the `own, t had no right to have a liquor store --- that is a package liquor store r- kind of liquor. Now, I don't know if that is true or not, ;nut they told aim Loat was in the state law, and I would like to ask that. MR. AT EA3EN: From my meager knowledge of the law, I would have to dis- agree with your husband. There is nothing in the law, Mrs. -lerner, that says that there can't be a package store if there is not a policeman. Now, I want you to understand that as a Board of County Commissioners, we have no jurisdiction where there is an incorporated town and policed. We can only issue licenses in rural and unincorporated areas. If it were an incorporated town, we would have nothing to do with it. It would be up to the town board. A. I was just wondering. Now, I don' t know who told him that, hut I was just wondering to that fact. M . A'J,r?SF"J: I would like to ha •e the County Attorney verify that. MR. MISS HORN: I would also like to ask the question if out-o;'-state people would have an impact. I was told that they wouldn't. MR. I will give these to Mr. Houtchens. (Thereupon the case of Buddy Lloyd's More A. vs The "'ity Coun •el of Aurora, is given. ) T think that the entire case here is made on the basis of law enforcement which i3 a problem that we all have. It is probably easier to say to someone else, you take care of your child than it is for me to take care of my own. Rut the charge here is a general one that this is a lack of law enforcement. Time is not specified as to whether it is the present or preceeding. It is obvious that there are plenty or people in the community that could bring pressure to bear if such a condition existed. Rut that condition is not related to the issuance of a license. It is a law enforcement problem that these people admit that they have at the present time. Whether it will be solved by ref"•sing the issuance of a license or whether or not the law enforcement problem will be greater after the issuance of a license, is a matter - 24 - 56 AA 149 -AA of conjecture.
