H WHEREAS, said Ordinance No. 89, as amended, is in need of revision and
in r clarification with regard to procedures, terms, and requirements therein.

NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Weld
County, Colorado, that certain existing sections of said Ordinance No. 89, as
amended, are repealed and re-enacted, with amendments, and the various sections
are added or revised to read as follows:
Amend the ANIMAL UNIT, CHILD CARE CENTER, and LIVESTOCK definitions in Section
10 to read:
ANIMAL UNIT: A term and number used to establish an equivalency for
various species of LIVESTOCK. The number of LIVESTOCK allowed by right is
dependent upon bulk requirements of the Agricultural, Estate, or R-1 (Low-
Density Residential) Zone Districts. LIVESTOCK in excess of the bulk
requirements for the Agricultural Zone District shall require a Use by
Special Review Permit for a LIVESTOCK CONFINEMENT OPERATION. All
LIVESTOCK shall have the following ANIMAL UNIT equivalents and bulk
requirements:

O CHILD CARE CENTER: A facility, by whatever name known, which is
maintained for the whole or part of a day for the care of five or more
children under the age of sixteen years and not related to the owner,

without compensation for such care and with or without stated educational
purposes. The term includes facilities commonly known as day care
o centers, day nurseries, nursery schools, kindergartens, preschools, play
ro a groups, day camps, summer camps, and center for developmentally disabled
rn o children and those facilities which give twenty-four-hour care for
dependent and neglected children and includes those facilities for

existing text.
Amend Sections 21.6. 1.2 and 22.4.1.2 by changing "thirty (30)" to "fourteen (14)"
in the last sentence of the existing text.
Amend Section 24.1.5 to read:
24. 1.5 If the Use by Special Review has not commenced from the date
of approval or is discontinued for a period of three (3)
consecutive years it shall be presumed inactive. Weld County
shall initiate an administrative hearing to consider whether
to grant an extension of time to commence the use or revoke
the Use by Special Review. If the Use by Special Review is
revoked, it shall be necessary to follow the procedures and
requirements of this Section in order to re-establish any Use
by Special Review.

A public hearing was conducted on September 16, 1992, at 10:00 A.M. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated August 10, 1992, and duly
published August 13, 1992, in the Windsor Beacon, a public hearing was
conducted to consider amending certain sections of the Weld County Zoning
Ordinance. Chairman Kennedy explained that said Ordinance may be heard in
the ante room by tape. Lee Morrison, Assistant County Attorney, made this
a matter of record.
Let the record reflect that the Board proceeded with two land use hearings
at this time.
Chuck Cunliffe, Planning Department representative, entered the favorable
recommendation of the Planning Commission into the record. Mr. Cunliffe
recommended that a new Section 36.3.5 be added under bulk requirements for
E (Estate) District, with subsequent sections to be renumbered through
Section 36.3.11. He read the addition into the record and explained that
this will provide more protection to the Estate District. Upon the
request of Chairman Kennedy, Mr. Cunliffe read Sections 36.3.5 through
36.3.11 into the record. There was no public testimony offered concerning
this matter. Commissioner Harbert moved to approve Ordinance No. 89-W on
first reading with the recommended changes and the amendment to 36.3.5.
The motion was seconded by Commissioner Webster, and it carried
unanimously.
This Certification was approved on the 21st day of September, 1992.

Section 10

animal units for the proposed Estate Zone District.

The proposed amendments are summarized below:
Section 10
Amends the animal unit definition to include bison, mules, burros, llamas, and
ostriches as livestock in the Agricultural zone district. Adds llamas, mules,
and burros in the R-1 (Low Density Residential) zone district. Establishes
animal units for the proposed Estate zone district.
Amends the child care center definition to be consistent with Colorado Revised
Statutes.
Amends the livestock definition to include llamas and ostriches as livestock.
Section 21.6.1.1
Reduces the amount of time to schedule a public hearing for change of zone
applications.
Sections 21.6.1.2 and 22.4.1.1
Reduces the amount of time for publication of legal notices for change of zone
applications and text amendments of the Zoning Ordinance. This reflects recent
changes in Colorado Revised Statutes.
Section 24.1.5
Clarifies status of inactive Special Review permits. Establishes administrative
hearing to consider inactive Special Review permits.
Section 31.5.1
Reduces the minimum lot size for dry land in the Agricultural zone district from
160 acres to 80 acres.
Section 32.2.3.6
Deletes noncommercial junkyards as an accessory use from the Residential zone
districts. Renumbers existing Section 32.2.3.7 to new Section 32.2.3.6.

Section 36
Establishes a new Estate zone district for single family dwellings. Identifies
the intent of the district, uses allowed by right, accessory uses, uses by
special review, and bulk requirements.
Sections 42.2.3.6 and 42.3.2.5
Establishes minimum spacing of 500 feet between off-site directional signs in the
Agricultural, Commercial, and Industrial zone districts.
PROPOSED AMENDMENTS TO THE WELD COUNTY ZONING ORDINANCE
Amend the ANIMAL UNIT, CHILD CARE CENTER, and LIVESTOCK definitions in Section
10 to read:
ANIMAL UNIT: A term and number used to establish an equivalency for various
species of LIVESTOCK. The number of LIVESTOCK allowed by right is dependent upon
bulk requirements of the Agricultural, Estate, or R-1 (Low-Density Residential)
Zone Districts. LIVESTOCK in excess of the bulk requirements for the
Agricultural Zone District shall require a Use by Special Review Permit for a
LIVESTOCK CONFINEMENT OPERATION. All LIVESTOCK shall have the following ANIMAL
UNIT equivalents and bulk requirements:

(Low Density Residential) Zone District.
Amend the CHILD CARE CENTER definition to read:
A facility, by whatever name known, which is maintained for the whole or part of
a day for the care of five or more children under the age of sixteen years and
not related to the owner, operator, or manager thereof, whether such facility is
operated with or without compensation for such care and with or without stated
educational purposes. The term includes facilities commonly known as day care
centers, day nurseries, nursery schools, kindergartens, preschools, play groups,
day camps, summer camps, and center for developmentally disabled children and
those facilities which give twenty-four-hour care for dependent and neglected
children and includes those facilities for children under the age of six years
with stated educational purposes operated in conjunction with a public, private,
or parochial college or a private or parochial school; except that the term shall
not apply to any kindergarten maintained in connection with a public, private,
or parochial elementary school system of at least six grades or to any preschool
established pursuant to the provisions of Article 28 of Title 22, C.R.S. , which
is maintained in connection with a public school system of at least six grades
so long as the school system is not also providing extended day services. The
terms shall not include any facility licensed as a family care home under the
provisions of this article.

LIVESTOCK: Cattle, bison, mules, burros, llamas, ostriches, horses, swine,
sheep, goats, poultry, rabbits.
Amend Section 21.6.1.1 by changing "thirty (30) days and not more than sixty (60)
days" to "fifteen (15) days and not more than forty-five (45) days" in the
existing text.
Amend Sections 21.6.1.2 and 22.4.1.1 by changing "thirty (30)" to "fourteen (14)"
in the last sentence of the existing text.
Amend Section 24.1.5 to read:
24.1.5 If the use by Special Review has not commenced from the date of
approval or is discontinued for a period of three (3) consecutive
years it shall be presumed inactive. Weld County shall initiate
an administrative hearing to consider whether to grant an
extension of time to commence the use or revoke the Use by Special
Review. If the Use by Special Review is revoked, it shall be
necessary to follow the procedures and requirements of this
Section in order to re-establish any Use by Special Review.
Amend Section 31.5.1 to read:
31.5.1 Minimum lot size: 80 acres
Delete Section 32.2.3.6
Renumber Section 32.2.3.7 to 32.2.3.6
Amend Section 32.7.8 by adding the following to the end of the existing text.
ANIMAL UNITS are not permitted in the R-2, R-3,
R-4, and R-5 zone districts.

Add a new section 36 to read:
36 E (Estate) District
36.1 Intent of the E (Estate) District. The E
(Estate) District is intended to provide the
present and future residents of Weld County
with areas in which to locate and establish
residential land USES and land USES that are
compatible with residential areas. The Estate
District is intended to be located, designed,
and developed in a manner that is compatible
with the Weld County Comprehensive Plan and the
adopted MASTER PLANS of affected
municipalities.
36.2 Uses Allowed by Right in the E (Estate) District
36.2.1 No BUILDING, STRUCTURE or land shall be USED,
and no BUILDING or STRUCTURE shall hereafter be
erected, structurally altered, enlarged, or
maintained in the E (Estate) District except
for one or more of the following USES. Land in
the E (Estate) District must be USED in
compliance with the Bulk Requirements contained
in Section 36.3. USES within the E (Estate)
District are subject to the additional
requirements contained in Section 40,
Supplementary District Regulations and Section
50, Overlay Districts.
36.2.1.1 One (1) SINGLE FAMILY DWELLING per LEGAL LOT.
The SINGLE FAMILY DWELLING shall be connected
to and served by a PUBLIC WATER system and an
adequate sewage disposal system. The sewage
disposal system shall comply with the Weld
County Individual Sewage Disposal Regulations.
Evidence that PUBLIC WATER and an adequate
sewage disposal system are available to the
LEGAL LOT shall be provided prior to the
issuance of a building permit.

36.2.1.2 One (1) MANUFACTURED HOME per LEGAL LOT. The
MANUFACTURED HOME shall be connected to and
served by a PUBLIC WATER system and an adequate
sewage disposal system. The sewage disposal
system shall comply with the Weld County
Individual Sewage Disposal Regulations.
Evidence that PUBLIC WATER and an adequate
sewage disposal system are available to the
LEGAL LOT shall be provided prior to the
issuance of a building permit.
36.2.1.3 FARMING, RANCHING, and GARDENING.
36.2.1.4 PUBLIC parks and PUBLIC recreation areas.
36.2.1.5 PUBLIC SCHOOLS, and PUBLIC SCHOOL extension
classes.
36.2.1.6 Police and fire stations or facilities.
36.2.1.7 UTILITY SERVICE FACILITIES.
36.2. 2 Accessory Uses in the E (Estate) District. The
following BUILDINGS, STRUCTURES, and USES shall
be allowed in the E (Estate) District so long
as they are clearly incidental and ACCESSORY to
the Uses Allowed by Right in the E (Estate)
District. Such BUILDINGS, STRUCTURES, and USES
must be designed, constructed, and operated in
conformance with the Bulk Requirements
contained in Section 36.3. ACCESSORY USES
within the E (Estate) District are also subject
to the additional requirements contained in
Section 40, Supplementary District Regulations
and Section 50, Overlay Districts.
36.2.2.1 Garages, carports, and parking areas;
36.2.2.2 Swimming pools, tennis courts and similar
recreational facilities;
36.2.2.3 SIGNS, in accordance with the provisions of
Section 42;

36.2.2.4 HOME OCCUPATIONS;
36.2.2.5 Service BUILDINGS and facilities; and
36.2.2.6 Any other STRUCTURE or USE clearly incidental

E (Estate) District.
36.2.3 Uses by Special Review in the E (Estate)
District. The following BUILDINGS, STRUCTURES,
and USES may be constructed, occupied,
operated, and maintained in the E (Estate)
District upon approval of a permit in
accordance with the requirements and procedures
set forth in Section 24, Uses by Special
Review.
36.2.3.1 HOSPITAL, nursing home, and rehabilitation
center;
36.2.3.2 Private school;
36.2.3.3 Church;
36.2.3.4 PRIVATE RECREATIONAL FACILITY;
36.2.3.5 KENNEL, subject to the additional requirements
of Section 45.6;
36.2. 3.6 CHILD CARE CENTER;
36.2.3.7 Keeping, raising, boarding of EXOTIC ANIMALS;
36.2.3.8 HOME BUSINESS; and
36.2.3.9 USES similar to the USES listed above as Uses
by Special Review as long as the USE complies
with the general intent of the E (Estate)
District.
