Dear Mr. Duckworth:
The Environmental Protection Division of the Weld County Health Department has
completed an initial review of the Status Report, dated October 21, 1993,
submitted by Groundwater Technology on behalf of the Weld County Waste Disposal,
Inc. facility, Weld County.
As you are aware, volatile organic compounds have been detected in monitoring
wells located on the facility. The presence of these compounds in the
groundwater indicate a environmental impact from this facility. Additionally,
the detected concentrations of benzene exceed the groundwater organic chemical
standard as defined in "the Basic Standards For Groundwater", 3.11.0 (5 CCR 1002-
8) .
The Division requests that the facility develop a characterization and
remediation plan detailing the extent of migration of the contamination and
measures being considered to alleviate the impact.
The facility shall submit this material, both to this Division and the Solid
Waste Division of the Colorado Department of Health in a comprehensive document
within thirty (30) days of receipt of this letter.

Dear Mr. Martin:
The Hazardous Materials and Waste Management Division of the Colorado Department
of Health(the Division)has received information from Ms.Jane Godby concerning removal
of contaminated soils from your property. The Division is not yet in receipt of a written
remediation and sampling plan for this waste, as requested by the Division in its letter of
July 6, 1993. Prior to receiving such submittals, the Division cannot approve any
remediation.
Furthermore,without confirmatory sampling after waste removal, the Division will have no
proof that all waste has been removed, and must assume that some portion of the
referenced waste is still in place. As such, the illegal disposal cited in the Division's
July 6 letter will not be fully remediated, and the criminal and civil penalties mentioned in
that same letter will still apply.
If an adequate plan for remediation and sampling of the referenced waste, including
confirmatory sampling, is not received in this office within ten (10) days, the Division will
recommend that Weld County actively pursue criminal and civil penalties against all
responsible parties.

This letter is in response to your letter to Mr. Duckworth dated July 27, 1993. *',
1) Mr. Duckworth has never received any laboratory analysis that shows the facility
impacting the ground water. If you have such analysis he would like a copy for his own
determination.
•
2) There is once again no report to W.C.W.D. that any hazardous waste has been
accepted. The only waters accepted at this facility were approved by the Department of
Health; with approved laboratory analysis.
3) Removal of any waste is not encouraged by W.C.W.D. If this number is referring to
the sludge sold to Mr. Martin, it is being retrieved and properly disposed on a plastic liner
on the clay soil on the west side of pond A. t
4) This soil was tested and submitted to your office. It is being stored on a soil clay liner
until a determination can be made for disposal. W.C.W.D. would like to use some of this
dirt to cover the bentonite in the pond that it originally came from. The rest they would
like to store on site on the plastic liner. Please inform us if this procedure will be •
acceptable.
5) Minor spills are expected to be cleaned up as soon as possible. The big area of stain
that you are referring to east of the tank battery is the remains of a certified pond that is no
longer in use.
6) Freeboard levels at W.C.W.D. are read by placing a level across the 3'bench marker.
This marker is a concrete block that was shot in by Alpha T.ngineering. I have requested
that they send you the procedure in which they determined this as the 3'marker.
Mr. Duckwoth has informed me that he has requested Alpha Engineering to make a second
determination of these parameters. It will be done in two weeks. I will send the results to
your office.

Dear Mr. Duckworth:
On June 28, 1993, a representative of the Environmental Protection Division (the
Division) of the Weld County Health Department inspected Weld County Waste
Disposal, located at Weld County Road 35, Fort Lupton, in Weld County, Colorado.
The purpose of the inspection was to inspect and assess the facilities compliance
with the "Regulations Pertaining to Solid Waste Disposal Sites and Facilities"
as promulgated by the Solid Waste Disposal Sites and Facilities Act, Title 30,
Article 20, Part 1, C.R.S. , as amended, and the Development Standards as set
forth in SUP-454:80:44.
On the date of June 28, 1993, field inspection, and subsequent records review the
following observations were made:
1) Evidence of potential for (serious) groundwater pollution. Submitted
laboratory analysis indicates that this facility is impacting ground
water. This data is currently being reviewed by our Division and the
Colorado Department of Health to determine further action.

hazardous waste at this facility would not be permitted under any approved
design and operation plan.
3) Non-compliance with approved design and operation. The facility has
removed waste which has been accepted for disposal and disposed of it on
property not associated with the facility.
4) The facility intends to remove potentially contaminated soils from Pond A
without adequately characterizing to determine the proper mode for
disposal.

5) Evidence of minor spills around the disposal area. Observation of the
facility revealed that stained and potentially contaminated soils exist
extensively across the site, particularly around the disposal area and
east of the tank battery.
6) Pond freeboard level exceeded. Visual observation of freeboard levels
indicate that freeboard has been exceeded on both ponds at the facility.
7) The facility has accepted unapproved waste without the written approval of
the Weld County Health Department.
Items #1 and #2 referenced above are currently under review, you will be notified
of any determination and necessary requirements in the near future.
This facility has removed skimmed oil materials and possibly sludges from the
ponds and associated equipment and disposed of these wastes on property located
to the south of the facility owned by James Martin and his family. This method
of disposal is illegal and must cease immediately as provided in the Solid Wastes
Disposal Sites and Facilities Act, Title 30, Article 20, Part 1, as amended.
The facility intends to remove potentially contaminated soils from Pond A in
order to prepare the pond for eventual use. You have been notified of this issue
in Certified letter P 186 978 548, dated July 22, 1993.
Visual observation of the facility revealed that stained and potentially
contaminated soils exist across the site, particularly near the disposal area and
the area east of the tank battery. The facility must remediate these soils and
shall provide documentation to this Division as to the proposed method of
remediation. Further, the facility must determine which activity(s) are
responsible for these contaminated soils and make necessary procedural
modifications to insure no further soil contamination. These modifications must
also be provided to the Division for review.
Visual observation of freeboard levels on both ponds indicate that these levels
have been exceeded. A review of records on file at this Division has revealed
that an accurate depth gauge may not exist on the facility. The facility must
provide adetp. tp documentation to the Division which indicates the accuracy of
the depth gauges on site.
According to information (attached) provided to the Division by the Colorado
Department of Health the facility has accepted waste without written approval
from the Division. Accepting waste without prior written approval is a violation
of Development Standard #1, SUP-454:80:44 and the Solid Waste Disposal Sites and
Facilities Act, as amended. If the facility has adequate documentation on file
which indicate the approval for the disposal of these materials, please provide
the Division with copies of all pertinent documents.

On June 8, 1993, in response to a complaint, a representative of the
Environmental Protection Division of the Weld County Health Department observed
a portion of your property, located at the following legal description: SE 1/4,
Section 12, Township 01 N, Range 66 W. The complainant alleged that oil wastes
from the Weld County Disposal had been disposed at this location.
On this date, observations and samples collected at this location confirm that
an oil product was disposed. Subsequent investigations confirmed that this waste
was in fact generated at the Weld County Disposal. This disposal of solid waste
is considered illegal, pursuant to the Solid Wastes Disposal Site and Facilities
Act, Title 30, Article 20, Part 1, specifically, paragraphs 113 and 114 which
provide for civil and criminal penalties for those who illegally dispose of solid
waste. :
The Division requests that you submit a comprehensive remediation plan for this
illegal disposal on your property. Specific information regarding the areal
extent of waste placement, the approximate volume of waste and/or waste
contaminated soils, and the proposed remediation method (i.e. excavation and
disposal at an approved facility).
Please respond to the above issues in a detailed comprehensive written document
within twenty (20) days of the receipt of this letter. If you have any

Dear Mr. Duckworth:
On Friday, July 16, 1993, a representative of the Environmental Protection
Division of the Weld County Health Department observed the operation of the Weld
County Waste Disposal. On this date, it was observed that the facility was in
the process of constructing an additional pond. Please be advised that the
design, construction, and operation of this pond and any associated equipment
must be reviewed and approved by the Weld County Department of Planning, Weld
County Department of Health, and the Colorado Department of Health prior to
operation.
Further, on this date, it was observed that the facility had excavated
contaminated soils from the above mentioned pond which had previously been stored
at this location and transported them to an unknown destination, possibly
disposing them on property located south of the facility. From analysis provided
to the Division by Northern Colorado Consulting Firm, the Division has determined
that this contaminated soil is a solid waste and must be disposed of
appropriately. The present disposal of this waste is considered a violation of

The Division requires that you submit a comprehensive remediation plan for this

Dear Mr. Jiricek:
Weld County Waste Disposal Inc. is currently preparing Pond A for relining. The soils
were tested by Tech Labs out of Fort Collins. My contact person is Mr Bill Betters at 490-
1414. The analysis is enclosed.
Chen and Associates were contacted to be the engineers for this project. Also, Ground
Water Technology will be working on this project, as Mr. Cope is short of working time
available. Chen& Assoc. will be running an analysis on the clay on site to determine how
much bentonite will be required to line the pond. After this is determined the proper
amount will be added to the clay on site and properly applied to the pond. Chen&. Assoc.
will also do the compaction testing and follow with the nuclear densomitor to assure the
proper compaction for the permeability. The design and operation plan will be submitted
to your office before any additional work is done on "Pond A". If you have any questions
please contact Mr. Reese at 744-7105, or myself at the number below.

RE: Weld County Waste Disposal, Inc.
Dear Mr. Pickle:
As you may know, the Colorado Department of Health, Hazardous
Materials and Waste Management Division (the "Department") has been
investigating Weld County Waste Disposal, Inc. ("WCWD") located on
Weld County Road 35, near Fort Lupton, Colorado. In the course of
our investigation, we have noted the following, which may be in
violation of WCWD's special use permit or other agreements between
WCWD and the County:
1. WCWD may be accepting loads of contaminated water (non-
brine) without the written approval of the Weld County
Health Department.
For example, in a June 5, 1991 letter to Ms. Judy Schmidt
of the Weld County Health Department, Ms. Jane Godby of
WCWD requested the County's approval to accept 500
gallons of contaminated ground water from the Southland
Corporation for disposal at WCWD. In a June 10, 1991
letter, Ms. Schmidt and Mr. Wes Potter of the Weld County
Health Department approved WCWD's disposal of the 500
gallons of material. However, on or about June 26, 1991,
the Southland Corporation ultimately disposed of 3, 000
gallons of the contaminated groundwater at WCWD. Also,
on or about September 25, 1991 the Southland Corporation
disposed of another 3 , 000 gallons of the contaminated
groundwater at WCWD. From the information available to
us, it appears that the volume increase during the June
shipment and the additional 3000 gallon shipment in
September 1991 were not approved in writing by the Weld
County Health Department.
2 . In a November 8 , 1991 letter to Ms. Schmidt of the Weld
County Health Department, Ms. Godby of WCWD requested the
County's approval to accept 500 gallons of "waste water"
from the Southland Corporation for disposal at WCWD. In

a November 14 , 1991 letter, Mr. Potter of the Weld County
Health Department approved WCWD's disposal of the
material. However, on or about May 26, 1992 , the
Southland Corporation disposed of an additional shipment
of 400 gallons of the contaminated groundwater at WCWD.
From the information available to us, it appears that the
May 1992 shipment was not approved in writing by the Weld
County Health Department.
3. On about four different occasions (that we know of) ,
Approved Oil Service Inc, brought loads of contaminated
water to WCWD without obtaining WCWD's signature on the
accompanying paperwork. Some of the paperwork notes that
there was "no one to sign". This suggests that there was
no WCWD personnel supervising the acceptance of these
loads.

Dear Ms. Godby.
The Southland Corporation Is seeking your approval to dispose of approximately 500 gallons of
groundwater at the Weld County Waste Disposal facility. The groundwater, which contains dissolved
concentrations of leaded and unleaded gasoline product, will be pumped from monitoring wells located
at our 7-Eleven Store No. 15754, at 4770 West Colfax Avenue in Denver, and from a recovery well at our
7-Eleven Store No.23603, located at 105 Knox Court in Denver.
The groundwater at both sites was contaminated as a result of a leak from underground storage tank
systems. The Southland Corporation intends to pump groundwater from the aforementioned wells as
part of remediation efforts at these sites. We will be using the services of Flint Engineering Company to
transport the groundwater. The analytical results you require for review(benzene,toluene, ethylbenzene,
total xyienes,total petroleum hydrocarbons as gasoline,total lead, corrosivity. reactivity, and Ignitability)
are attached.
The Southland Corporation has also contacted Weld County Health Department seeking similar approval.

This letter is to confirm our conversation of 26 June 1991 concerning the disposal of groundwater
containing dissolved gasoline product from the 7-Eleven Store No. 19754 at_4770 WesLCColfax Avenue in
Denver, Colorado. We had originally arranged to dispose at your facility 500 gallons of water removed
from monitoring wells located in the underground storage tank pit. However,we were able to remove
approximately 3000 gallons of water from these wells. No new source was used to produce this
additional water, all the water was removed from the same wells from which we collected our sample for
waste characterization. It is our understanding that this additional water will be accepted by your facility,
as we discussed during our 26 June telephone conversation.

Dear Mr. Duckworth:
The Weld County Health Department has requested that the Hazardous Materials and
Waste Management Division of the Colorado Department of Health (the Division) review
ground water data from Weld County Waste Disposal to determine if ground water is being
impaired by this facility. All information and data was reviewed under the authority of the
Solid Wastes Disposal Site and Facilities Act,Title 30,Article 20, Part 1, C.R.S.as amended
and with the regulations promulgated thereunder 6 CCR 1007-2 (the Regulations).
Based on the review of the ground water data and facility files the Division has the following
comments:
1. Ground water data clearly shows several wells have a significate increase in
many parameters when compared to other wells at the site. Information from
the facility files suggest an off-site well was impacted by this facility in the
early 1980s. Based on ground water data and information contained within
the files it appears that this site is causing impairment of the ground water.
Section 6.1.4 of the Regulations states "sites and facilities in operation prior
to adoption of these regulations may be required to come into compliance
with these regulations upon a determination that such sites and facilities are
causing impairment to existing or future use of surface water or
groundwater." The Division requests that a detailed geologic and hydrologic
characterization of the site be prepared, and a comprehensive document
which addresses these issues be sent to this Division for review.
2. Please provide an accurate,and readable site map. This map should include
at a minimum; the location off all ponds both active and inactive, facility
structures and roads, location of all surface water features and location of all
ground water monitoring points (both abandoned and active).

3. Many of the ground water wells have been renumbered. Please indicate
which wells were renumbered and when this occurred.
4. Were are wells #15 and #17 located?
5. Analytical data is missing from monitoring wells 2,3,4,6,7,1Q,and 11 for the
1991 and 1992 sampling events. Please clarify.
6. Please provide the following information on all monitoring wells; total depth
of the well, depth to ground water, screened interval of each well, and
position of the well in relationship to ground water flow direction (ie.
upgradient, downgradient or crossgradient).
7. Please provide information on the Speer canal. Information should include;
water use, age of canal, depth of canal, construction details of the canal.
8. There is no record of a leak test on any impoundment at this facility. Section
6.8.8 of the Regulations requires clay or soil liner material to be tested for
permeability at intervals of not more than five (5) years. If such a test has
been completed, please provide this documentation to the Division. If leak
tests have not been performed at this facility,please provide a schedule when
these tests will be completed.
9. Please provide a map which shows all ground water wells within a one mile
radius of this facility. The following information on these wells shall be
included: year the well was drilled, drillers log, total depth, depth to ground
water, well yield, well use, screened interval, aquifer in which the well is
completed, and all geologic units encountered during drilling.

10. The Division's files for this facility indicate a private ground water well
(owned by Mr. Tim Trostel) to the east of the site may have been impaired
by this facility. Records show that ground water contaminated with petroleum
compounds from leaking underground storage tanks has been accepted at this
facility. In addition, numerous other waste streams not approved by this
Division nor included as part of the Special Waste Permit, issued by Weld
County,have been disposed at this facility. Several of these waste streams are
allegedly hazardous and are being investigated by the Division's Monitoring
and Enforcement Section of the Hazardous Waste Control Program.
11. Based on the issues detailed in item 10 the Division requests that volatile
organic compounds (VOCs) be included in ground water sample analyses.
VOCs shall be monitored for four(4) consecutive quarters starting with next
ground water sampling event.
These conclude the Division's comments concerning Weld County Waste Disposal. Please
respond to the issues detailed above in a comprehensive document with thirty (30) days of

Dear Mr. Duckworth:
On January 28, 1993, a representative of the Environmental Protection Division
of the Weld County Health Department inspected Weld County Waste Disposal,
located at Weld County Road 35, Fort Lupton, in Weld County, Colorado. The
purpose of the inspection was to inspect and assess the facilities compliance
with the "Regulations Pertaining to Solid Waste Disposal Sites and Facilities"
as promulgated by the Solid Waste Disposal Sites and Facilities Act, Title 30,
Article 20, Part 1, C.R.S. , as amended, and the Development Standards as set
forth in SUP-454:80:44.
On the date of January 28, 1993, field inspection, the following observations
were made:
1) Evidence of potential for (serious) groundwater pollution. Submitted
laboratory analysis indicates that this facility is impacting ground
water. This data is being reviewed by our Division and the Colorado
Department of Health to determine further action.
2) Non-compliance with approved design and operation. This facility is
currently being investigated for accepting hazardous waste. Disposal of
hazardous waste would not be permitted under any approved design and
operation plan.
3) Records. This item was not marked as a violation on the inspection form
on this date. The written comments were merely recommendations to provide
this information on site.
4) Section II Minimum Standards, "Pond A contains brine." File reviews
completed subsequent to the inspection of January 28, 1993, do not reveal
an approval from this Division nor Colorado Department of Health for
approval to store brine water in Pond A. If a line break did occur, and
brinewater was in fact released into Pond A, all water in Pond A should

have immediately been transferred into an approved pond and this incident
reported to the appropriate agencies. If Pond A was previously approved
to contain brine water, please provide this Division with documentation.
This facility is required to provide documentation as indicated, regarding item
#4 within ten (10) days of receipt of this letter. In regard to the other items
referenced above, you will be notified of any determination and necessary
requirements in the near future.

This letter is in response to your letter of February 1, 1993, to the
Environmental Protection Division of the Weld County Health Department (WCHD) .
Two issues were raised which require response.
Item #1 states:
"Weld County Waste Disposal, Inc. never accepted any material that was not
first approved by Weld County Department of Health and Weld County
Planning Department. Proper Procedure was followed on every proposal that
came through my office. The protocol developed by the governing offices
is enclosed."
WCHD response:
This facility is currently being investigated for accepting hazardous
waste and unapproved waste by the Hazardous Materials and Waste Management
Division (HMWMD) of the Colorado Department of Health (CDH) . Please note,
this facility has not been cited for a violation. If in fact, any such
violation is cited the facility will be notified by the appropriate
agency.
Item #2 states:
"There has been no evidence what so ever that any impairment has occurred
to the groundwater at this location. The quarterly water reports show an
improvement by indicating lower TDS than previously tested throughout the
years. Also, at no point has Weld County Waste Disposal, Inc. received
any data from the Colorado Department of Health stating that they are
being investigated for impairment of groundwater." u

WCHD response:
The Environmental Protection Division of the Weld County Health Department
has never indicated that groundwater has been impaired. In a letter dated
January 6, 1992, Mr. Howard Duckworth was informed that "data submitted in
regard to the monitoring wells at the Disposal indicates that
contamination of groundwater at that facility may have occurred" and that
"this situation is currently under review by the Hazardous Materials and
Waste Management Division of the Colorado Department of Health." The
Colorado Department of Health is reviewing monitoring data at the request
of Weld County, due to what appear to be increased sodium and chloride
levels in what are suspected to be the downgradient monitoring wells at
the facility. Weld County has never indicated that groundwater
contamination has occurred at this facility nor is this facility in
violation for contaminating groundwater, rather, the monitoring data may
indicate a potential problem and is being reviewed by Colorado Department
of Health.

On December 2, 1992, a representative of the Environmental Protection Division
of the Weld County Health Department inspected Weld County Disposal, located at
Weld County Road 35, Ft Lupton, in Weld County, Colorado. The purpose of the
inspection was to inspect and assess the facilities compliance with the
"Regulations Pertaining to Solid Waste Disposal Sites and Facilities" as

A review of groundwater monitoring data and recent correspondence revealed the
following:
1. This facility is currently under investigation by the Hazardous Materials
and Waste Management Division (HMWMD) of the Colorado Department of Health
for allegedly accepting hazardous materials.
2. Data submitted on groundwater monitoring reveals that this facility may be
impairing groundwater at this location.

The spillage observed near the disposal area has the potential to contaminate
groundwater at this location and is not an appropriate disposal practice.
According to Subsection 2.1.4, states in part, "facility. . . .shall provide means
of finally disposing of solid wastes on land in a manner to minimize nuisance
conditions" and that "nuisance conditions are those which may result
from. . . .water pollution. . . ."
This facility is currently being investigated by the HMWMD for allegedly
accepting and disposing hazardous materials. In addition, submitted analysis on
gre. ,+iwater monitoring indicate that this facility may be impacting groundwater
at :::is location, this is also currently being investigated by the HMWMD. This
facility will be notified of any determination and necessary requirements in
