The parcel of land under consideration is proposed to be 4.36 acres in size, more or less. Elmore Road, a paved county local road, provides access to the property. The parcel is located within the Urban Growth Boundary of the Town of Mead. This proposal is compatible with Mead's comprehensive plan for this area. - The submitted application materials are in compliance with the application requirements of Section 8.4 of the Weld County Subdivision Ordinance. The majority of lots within Seemore Heights Subdivision are approximately one acre in size. The approval of this resubdivision request will correct an illegal lot split and result in a parcel which exceeds the average lot size in the subdivision. Existing utilities, located along Elmore Road, are able to serve the proposed residence. The applicants are requesting a vacation of the recorded 12.5 foot-wide utility easement on the property because they wish to construct a residence in the same vicinity. The Weld County Utility Advisory Committee reviewed and conditionally approved the utility easement vacation request on December 8, 1994. The Department of Planning Services' staff recommends approval of this application. Approval of the resubdivision will not adversely influence the adopted rules, regulations, and ordinances currently enforced upon and affecting this subdivision. Approval of this request will not adversely influence surrounding property owners, and conforms with the Weld County Comprehensive Plan. Seemore Heights Subdivision was platted in 1963 and zoned R-I (Low Density Residential) in 1962. The parcel as proposed exceeds R-1 lot size standards, as stated in Section 32.7.1 of the Weld County Zoning Ordinance. Due to the above-stated reasons, it is 950378 the opinion of staff that the resubdivision application should be granted. Respectfully sbmitted, to is Dunn �rrent Planner 950379 ADDITIONAL COMMENTS Tom Paxton & Charles Bill Schovanec S-366 Lot 6, Block 3 of Seemore Heights Subdivision was divided into two parcels described as the N2 and S2 by a deed recorded with Weld County in 1964. The subject site, known as the N2 of Lot 6 is approximately .82 acre in size and is considered a legal parcel. A strip of ground (147.35 by 1.035.5 feet) lying adjacent to and west of the N2 of Lot 6 was illegally conveyed to and became a part of the N2 of Lot 6 in 1974. The approval of this resubdivision request will legally join this land and the existing N2 of Lot 6, resulting in a 4.36 acre parcel, more or less. Vacation of the utility easement on the N2 of Lot 6 will allow the applicants to build a residence in that area of the property. 950378 CONDITIONS OF APPROVAL S-366 Tom Paxton & Charles Bill Schovanec Within 30 days from the date of approval by the Board of County Commissioners, the applicants shall submit a mylar plat prepared in accordance with Section 7.2.6 of the Weld County Subdivision Ordinance. The plat shall show a 15-foot utility easement around the perimeter of the property, as approved by the Weld County Utility Advisory Committee. Dear Mr. Paxton and Mr. Schovanec: Your application and related materials for the request described above are complete and in order at the present time. The Clerk to the Board of County Commisioners will be scheduling a meeting to consider this proposal. This meeting will take place in the County Commissioners' Hearing Room, first floor, Weld County Centennial Center, 915 10th Street, Greeley, Colorado. I have also scheduled a meeting with the Weld County Utilities Advisory Committee for Thursday, December 8, 1994, at 10:00 a.m. This meeting will take place in the Weld County Planning Department conference room at 1400 N. 17th Avenue, Greeley, Colorado. It is the policy of Weld County to refer an application of this nature to any town or municipality lying within three miles of the property in question or if the property under consideration is located within the comprehensive planning area of a town or municipality. Therefore, our office has forwarded a copy of the submitted materials to the Town of Mead for its review and comments. Please call Judy Hegwood at (303) 962-2521 for further details regarding the date, time, and place of this meeting. It is recommended that you and/or a representative be in attendance at the Planning Commission meeting to answer any questions the Commission members may have with respect to your application. 950378 Sometime prior to 10 days before the hearing, a representative from the Department of Planning Services will be out to the property to post a sign adjacent to and visible from a publicly maintained road right-of-way which identifies the hearing time, date, and location. In the event the property under consideration is not adjacent to a publicly maintained road right-of-way, one sign will be posted in the most prominent place on the property and post a second sign at the point at which the driveway (access drive) intersects a publicly maintained road right-of-way. The Department of Planning Services' staff will make a recommendation concerning this application to the Weld County Planning Commission. This recommendation will be available twenty-four (24) hours before the scheduled hearing. It is the responsibility of the applicant to call the Department of Planning Services' office before the Planning Commission hearing to make arrangements to obtain the recommendation.
