Dear Cle' :
This letter will serve to specify and elaborate on the Division's interpretation;
of the liquid waste stream that Roggen Disposal, Inc. may be authorized to
receive regarding underground storage tanks.
The basis for the waste is specifically water that has been contaminated with
gasoline or diesel fuel. This could include waste water from:
A. Groundwater tables adjacent to and contaminated by leaking storm
tanks.
B. Water removed from fuel storage tanks which held gasoline or diesel .
C. Water from fuel lines, transport truck tanks, pumps or other fuel
related equipment.
D. Water recovered from the surface of the ground which is contaminated
with gasoline or diesel fuel.
E. Water that has been used to flush and/or clean gasoline or diesel
fuel tanks , lines or equipment.
The amount of petroleum contamination is not a limiting factor because these
products are compatible with the existing waste stream. The level of lead can
be a limiting factor if it is too high. Any liquid waste containing toxic
substances or hazardous waste cannot be considered.
I think that this adequately defines the waste that is being considered for the
facility. This authority has not been approved as of this date.

LETTER OF AGREEMENT
VOLUNTARY CLOSURE PROCEDURES
ROGGEN DISPOSAL, INC.
The owner/operator of the Roggen Disposal, Inc. , Northern Colorado Brine agree
to the following Voluntary Closure Procedures.
At any time that the Weld County Health Department staff finds that conditions
warrant closure, the staff will verbally notify the on-site, operator of the
problem and formally request closure. Within 24 Hours of the verbal
notification, the Weld County Health Officer will confirm the action by formally
requesting closure in written form.
Within 5 days of the verbal notification (confirmed by written notification) ,
the operator of the facility will close the facility and cease operations
receiving waste until the facility is in compliance with the Development
Standards of the Use by Special Review Permit and Certificate of Designation.

Receive Waste
The staff has reviewed the proposal from Roggen Disposal, Inc. to receive for
disposal, contaminated water recovered from leaking underground storage clean-
up sites. The waste is compatible with the existing waste stream and the request
is not considered to be a substantial change from the Certificate of Designation
approved for the facility.
The Division recommends for approval with the following conditions:
1. The waste from each clean-up site shall be evaluated, reviewed and
approved by the Weld County Health Department on a case by case
basis. No disposal of waste shall occur without a Letter of Approval
from the Weld County Health Department.
2. The approved waste will be restricted to only water recovered from
sites contaminated by leaking underground storage tanks. The
approval shall limit the waste to only those sites contaminated by
diesel fuel, leaded and unleaded gasoline.
3. The liquid waste shall be tested in an approved laboratory for the
following:
A. Total Petroleum Hydrocarbons
B. Oil and Grease Chemical
C. Benzene
D. Toluene
E. Xylene
F. Ethylbenzene
G. Lead

MATERIALS STORAGE AND HANDLING, MINING AND
ASSOCIATED ACTIVITIES
The Colorado Air Quality Control Commission' s Regulation No. 1 requires
that a fugitive emissions control plan be submitted by applicants whose
source/activity results in fugitive particulate emissions. The control plan
must enable the source to minimize fugitive emissions to a level that is
technologically feasible and economically reasonable. If the control plan is
not adequate in minimizing emissions a revised control plan will be required
unless it is determined that no technologically feasible and economically
reasonable abatement measures exist. The control plan (if acceptable to the
Division) will be used for enforcement purposes on the source(s) .
Please check the control measures which you propose for your activity. A
separate sheet may be attached explaining your specific control measures or
activities if they differ from those listed in this form or if more space is
needed. The Division will contact you if it feels that additional control
measures are needed. The control measures you and the Division agree to be
applied will be enforced.

Dear Mrs. Symons:
Thank you for your letter of July 31. The Department of Planning Services'
staff and the Health Department's staff have reviewed your request to accept
contaminated water recovered from leaking underground storage tanks. The
planning staff has determined that the disposal of the materials would not
be a material deviation from approved Special Review permit #481. This
approval, however, is conditional upon the following requirements:
1. The waste from each clean up site shall be evaluated,
reviewed, and approved by the Weld County Health Department
on a case-by-case basis. No disposal of waste shall occur
without a letter of approval from the Weld County Health
Department.
2. The approved waste will be restricted to only water recovered
from sites contaminated by leaking underground storage tanks.
The approval shall limit the waste to only those sites
contaminated by diesel fuel and leaded and unleaded gasoline.
3. The liquid waste shall be tested in a laboratory approved by

Roggen Disposal: Illegal Dumping

Today, at approximately 10:30 a.m. , I received a report that Roggen Disposal
was receiving waste water at their brine water disposal facility without
county authorization. I called Clay Simmons (830-7156) and inquired on the
matter. She confirmed that they were receiving bulk waste water from Limon.
She said it was from an elevator that blew over in the tornadoes that they
had recently. She said that the analysis showed the following:
Acetone 24 ppb
Butanane 34 ppb
Tolulene 48 ppb
I informed her that this was in violation of her certificate of designation
issued under the auspices of a county special use permit. I advised her that
they are required to hive approval from the county before varying from their
permit. She said that she wasn't aware of that. She was trying to contact
the facility to hault the dumping but feared that the dumping may already
have been completed. I told her that she is required in such matters as this
to submit the lab analysis with a letter requesting authorization along with .
a copy of the state approval letter to this department.
I closed the conversation with a request that she contact us as soon as
possible to inform us as to what the status of the waste water was. If the
dumping is completed I asked her to report the amount that was received.

Please find enclosed the analysis of the water currently in
frac tanks that is intended for disposal at the Roggen
Disposal.
The information came to us from Flint Engineering, the
hauler, and was provided to them by Riedel Environmental ,
the entity doing the dumping. They received verbal approval
from Nancy Jackson at the Colorado Health Department to dump
the material.

Wastewater Disposal from Limon

Dear Mr. Potter:
EPA recently conducted an Emergency cleanup action in Limon,
Colorado. The recent tornados had destroyed a facility that had
stored farm chemicals. During the cleanup, EPA collected a
wastestream of approximately 32, 000 gallons of water. It was
subsequently determined that the wastewater was not hazardous.
Rather than dumping the water on the ground, it gas determined
that disposal through a treatment facility would be desirable due
to odor and possible H2S problems.
Roggings was selected because we were informed that they
were both in compliance and could accept this wastestream.

Pursuant to our discussion of today, I am writing on behalf of Mr. Howard
C. Duckworth, owner of Weld County Disposal to describe the operations at the
brine disposal site and the possible sources of odor in the area.
As I indicated when we talked, the brine water received at the disposal
site has approximately 2% crude oil associated with it. This brine water is
discharged from the trucks into a concrete sump where the oil is skimmed from
•
the surface of the brine water and collected in closed tanks for sale. The
brine water is pumped from the bottom of the sump through a series of three
oil water separator tanks, to a seven acre clay-lined evaporation pond.
Associated with the brine water are paraffins originally contained in the
crude oil. These paraffins are waxy substances that have a low vapor
pressure. Occasionally, during the summer months, these paraffins will float
on the surface of the evaporation pond and will be accumulated behind a
floating containment device located at the west end of the pond.
Periodically, these paraffins are skimmed from the surface of the evaporation i
pond by a vacuum truck and are removed from the site. I

I have visited the site on numerous occasions and can recall only one f
instance during the stir months, when wind speeds were low, that an oily
odor was noticeable at the site. This odor was not especially objectionable
but was much like the odor found in a service station. I do recall several
times, however, during the summer months -when odors from the turkey farm
located approximately 1/2 mile to the west of the disposal site have boon
quite strong and objectionable.

I do not know what the nature of the complaints about odors in the area
have been but I hope that this information is useful to you in issuing the air
emissions permit for the site. If you have any questions do not hesitate to

BRINE WATER DISPOSAL CONSTITUENTS
1) Organics.approximately 2% total volume
a. Comprised of condensates (boiling points above 30°C)
such as gasoline and light napthas with a carbon
content of C5 - C10.
b. Kerosene and fuel oils, carbon content C10 -- C20
(boiling range 150-300°) •
c. Lubricating oils, C10 and up (boiling range above 300°) .
2) . Inorganics
a. Neutral aqueous solution with a total dissolved solids
concentration from 1-3% salt.
b. Major .cations: sodium 0.5-1%; potassium 0.1-.5%;
calcium 500-2000 mg/L.
c. Major anion chloride 0.5-2%.
d. Sulfides produce largest odor problem at a disposal
site. These are mainly as an iron sulfide with an
iron concentration of up to 50 mg/L.
