RE: PRELIMINARY HEARING TO CONSIDER CREATING LOCAL IMPROVEMENT DISTRICT -
WELD COUNTY ROAD 34
A public hearing was conducted on April 22, 1992, at 10:00 A.M. , with the
following present:
Commissioner George Kennedy, Chairman
Commissioner Constance L. Harbert, Pro-Tem
Commissioner C. W. Kirby
Commissioner Gordon E. Lacy
Commissioner W. H. Webster
Also present:

Assistant County Attorney, Lee Morrison
Director of Engineering Department, Drew Scheltinga
The following business was transacted:
I hereby certify that a public hearing was conducted to consider creation
of a local improvement district along Weld County Road 34. Lee Morrison,
Assistant County Attorney, made this a matter of record. Mr. Morrison
said the Board should consider accepting the draft resolution declaring
the intent to create a local improvement district. Drew Scheltinga,
Director of Engineering Department, said this district is directly one
mile north of the proposed local improvement district on Weld County Road
32. He said there are 25 parcels, and 20 property owners signed the
petition to be assessed $1000 each. He said Raterink Subdivision, which
is located within the proposed district, is within the Town of Mead, and
no portion of Weld County Road 34 is annexed to Mead. Said road would be
paved from Interstate 25 to Weld County Road 13, a distance of 2 miles.
The lanes would be 12' wide with 2' to 4' shoulders and a 6" aggregate
base course, with 2s" of asphalt. Mr. Scheltinga said there may be a
possible decrease in the cost estimate since this project will be bid
along with the project for Weld County Road 32. He said the paving and
shouldering is estimated at $103,400. The preparation work is estimated
at $102,000, and administration fees are estimated at $15,000, with a
total being estimated at $220,400. The district's share is estimated to
be $25, 000, with the exception of Lots 7-11 of Raterink Subdivision at
$1,000, and Weld County at $195,400. In response to a question from
Commissioner Lacy, Mr. Scheltinga said the Raterink Subdivision presently
has only one access. He said that Mr. Raterink is willing to enter into
an agreement with the Board stating no further accesses will be allowed.
Mr. Morrison suggested requiring a covenant restricting the use of the
parcels, as well as the agreement, in case Mr. Raterink would sell in the
future. He said the Town of Mead would need to ratify the creation of
this district. In response to a question from Commissioner Harbert, Mr.
Scheltinga said an emergency access exists off the I-25 frontage road. He
said all of Raterink Subdivision is in Mead, in response to a question
from Mr. Morrison. There was no public testimony offered concerning this
matter. Commissioner Lacy moved to approve the draft resolution to form
the local improvement district, with Commissioner Kirby seconding the
motion. It carried unanimously. Commissioner Lacy moved to set the
creation hearing on Monday, June 1, 1992, at 9:00 a.m. The motion was
seconded by Commissioner Kirby and carried unanimously.
