APPROVED WITH CONDITIONS
The Department of Planning Services has determined through the review that
the standards of Section 9-2 E. (1) (a) through (m) of the Weld County
Subdivision Regulations have been met. This Recorded Exemption is approved
with the following conditions in accordance with information submitted in
the application and the policies of the County.
A Weld County septic permit is required for the proposed home and its
septic system shall be installed according to the Weld County Individual
Sewage Disposal System (ISDS) regulations.
An ISDS evaluation by the Weld County Health Department on all existing
septic systems will be necessary prior to issuing the required septic
permits on the existing systems.
The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be prepared in accordance with the requirements
of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within sixty (60) days from the date of approval by the
Department of Planning Services. The applicant shall be responsible for
paying the recording fees.
Prior to recording the Recorded Exemption plat, the mobile home on the
property shall be properly permitted or removed. The noncommercial
junkyard on the property shall be screened from adjacent properties and
rights-of-way, enclosed in a building, or removed from the property.

As we discussed today, Lot A of Recorded Exemption 1404 has two dwelling units
currently on it. The home that is considered the principal dwelling on the lot
is considered a use by right and may be enlarged. The home that is the second
dwelling on the property is considered a non-conforming use and may not be
enlarged or expanded and only ordinary repairs the value of which do not exceed
fifty percent (50%) of the replacement cost of the structure may be permitted.

Your recorded exemption application is complete and in order and will be processed
on or before April 13, 1992. If it is determined that the application meets the
approval criteria of Section 9-2 E. (1) (a) through (m) of the Weld County
Subdivision Regulations, you will be notified that the recorded exemption is
approved. If the staff determines that the application does not meet the approval
criteria, you will be notified and asked to appear before the Board of County
Commissioners at a public hearing. You will be informed of the hearing date prior
to the hearing. The Board of County Commissioners will then consider your
application and make a final decision on the recorded exemption.

Requirement No. 4 :
The reason for dividing this parcel into two lots is the owner is
installing a center pivot irrigation system which will dry up the
corner and in trying to run a more efficient farming operation, the
buildings will no longer be needed to operate this farm.
Requirement No. 5 :
This proposal is consistent with the policies of the Weld County
Comprehensive Plan due to the following factors: (1) No lost has
been created by a Recorded Exemption within the past five (5)
years, (2) It is in an agricultural district and the contiguous
ownership is more than twice the minimum lot size, and (3) The
lot created by this Recorded Exemption shall have access from Weld
County Road #80 which is a county road right of way.
Requirement No. 6:
This proposal is consistent with the intent of the Zone District
which is agricultural .
Requirement No. 7 & 8 :
The intended use of the property will be rural residence. The
existing dwelling has been on the property since approximately
1930, with remodeling and other improvements added in the interim.
Requirement No. 9 :
This proposal is not inconsistent with efficient and orderly
development since the buildings and improvements already exist and
there is no further planned development.
Requirement No. 10:
There is an existing North Weld Water tap serving the property as
well as an existing septic system.
Requirement No. 11:
To my knowledge this property is not located in a flood plain or
in the Weld County Airport Overlay District. To my knowledge, the
proposed lot created by this exemption has never flooded and is not
affected by any other geologic hazard.
