ORDINANCE NO. 119-K
IN THE MATTER OF AN AMENDMENT TO ORDINANCE NO. 119, WELD COUNTY BUILDING CODE
ORDINANCE, AS CURRENTLY AMENDED, REVISING CERTAIN PROCEDURES, TERMS, AND
REQUIREMENTS, AND INCORPORATING BY REFERENCE CERTAIN PORTIONS OF THE UNIFORM
BUILDING CODE, 1988 EDITION
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY, COLORADO:
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has the power and authority
under the Weld County Home Rule Charter and State statute, including Article 28
of Title 30, CRS, to adopt building codes for the unincorporated areas of the
County of Weld, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, has
adopted Ordinance No. 119, Weld County Building Code Ordinance, establishing a
comprehensive revision of the building code requirements for unincorporated areas
of the County of Weld, and has adopted amendments in Ordinance No. 119-A through
119-J, and
WHEREAS, said Ordinance No. 119, as amended, is in need of revision and
clarification with regard to procedures, terms, and requirements therein.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Weld
County, Colorado, that certain existing sections of said Ordinance No. 119, as
amended, are amended by the addition and revision of various sections, which
shall read as follows:
Amend Section 20. 1.2 to read:
Section 1210(a) shall be amended to read the same as Section 1210(a) in
the 1988 Edition of the Uniform Building Code.
Renumber existing Section 20. 1.2 to 20.1.3
Renumber existing Section 20.1.3 to 20. 1.4
If any section, subsection, paragraph, sentence, clause or phrase of
this Ordinance is for any reason held or decided to be invalid or
unconstitutional, such decision shall not affect the validity of the
remaining portion. The Board of County Commissioners hereby
declares that it would have passed the Ordinance, and each phrase
thereof irrespective of the fact that any one or more sections,
subsections, paragraphs, sentences, clauses, or phrases might be
declared to be unconstitutional and invalid.

A public hearing was conducted on December 9, 1992, at 10:00 A.M. , with

The following business was transacted:
I hereby certify that pursuant to a notice dated November 9, 1992, and
duly published November 19, 1992, in the Windsor Beacon, a public hearing
was conducted to consider amending the Weld County Building Code Ordinance
by revising certain procedures, terms, and requirements, and incorporating
by reference certain portions of the Uniform Building Code, 1988 Edition.
Lee Morrison, Assistant County Attorney, made this a matter of record.
Chuck Cunliffe, Planning Department representative, entered the favorable
recommendations of the Planning Commission and the Building Trades
Advisory Commission into the record. Mr. Cunliffe noted the Board
previously had a work session on this matter. There was no public
testimony offered concerning this matter. In response to a question from
Commissioner Lacy, Mr. Cunliffe and Ed Stoner, Building Inspection,
explained the requirements for hardwired smoke alarms. Mr. Cunliffe said
the City of Greeley is also maintaining the 1988 Edition requirements.
Mr. Morrison read Ordinance No. 119-K into the record. Commissioner
Harbert moved to approve Ordinance No. 119-K on first reading. The motion
was seconded by Commissioner Webster, and it carried unanimously.
This Certification was approved on the 14th day of December, 1992.

The Board of County Commissioners of Weld County, Colorado, will conduct a public
hearing at 10:00 A.M. , on Wednesday, December 9, 1992, in the Chambers of the
Board of County Commissioners of Weld County, Colorado, Weld County Centennial
Center, 915 10th Street, First Floor, Greeley, Colorado, for the purpose of
considering amendments to the Weld County Building Code Ordinance as summarized
below:
Amending Section 20.1.2 to read:
Section 1210(a) shall be amended to read the same as Section 1210(a)
in the 1988 Edition of the Uniform Building Code.
Renumbering existing Section 20.1.2 to 20.1.3
Renumbering existing Section 20.1.3 to 20. 1.4
All persons in any manner interested in the proposed amendments to the Weld
County Building Code Ordinance are requested to attend and be heard.

RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS
Moved by Brian Boos that the following resolution be introduced for passage by
the Weld County Building Trades Advisory Committee. Be it resolved by the Weld
County Building Trades Advisory Committee:
That Section 1210 of the 1991 edition of the Uniform Building Code be repealed
and Section 1210 of the 1988 edition of the Uniform Building Code concerning the
requirements for smoke detectors be adopted by Weld County.
Motion was seconded by Donald New.

Conditions of Approval and Development Standards, be forwarded to the Board of
County Commissioners with the Planning Commission' s recommendation for approval.
Tom Rulon seconded the motion.
The Chairperson asked the secretary to poll the members of the Planning
Commission for their decision. Tom Rulon - yes ; Judy Yamaguchi - yes; Juliette
Kroekel - yes; Shirley Camenisch - yes; Bud Clemons - yes. Motion carried
unanimously.
The second item of business is to consider proposed amendments to Section 20 of
the Weld County Building Code Ordinance concerning smoke detectors.
Chuck Cunliffe, explained that staff has prepared a recommendation for approval
and asks that the amendments be approved by the Planning Commission and forwarded
to the Board of County Commissioners. This particular set of amendments were
reviewed by the Weld County Building Trades Advisory Committee and approved
earlier this year. There has been one work session with the County Commissioners
and some of the homebuilders and they were also receptive to the changes. Chuck
Cunliffe introduced Ed Stoner with the Weld County Building Inspection Department
who was available to answer technical questions about the code.
Judy Yamaguchi asked if this change would affect smoke detectors already in
existence. Chuck Cunliffe said no.
The Chairperson asked if there was anyone in the audience who wished to speak for
or against this application. No one wished to speak.
Bud Clemons moved proposed amendments to Section 20 of the Weld County Building
Code Ordinance be forwarded to the Board of County Commissioners with the
Planning Commission' s recommendation for approval. Shirley Camenisch seconded
the motion.
The Chairperson asked the secretary to poll the members of the Planning

Smoke Detectors and Sprinkler Systems
Sec. 1210. (a) Smoke Detectors. 1. General.Dwelling units, congregate resi-
dences and hotel or lodging house guest rooms that are used for sleeping purposes
shall be provided with smoke detectors.Detectors shall be installed in accordance
with the approved manufacturer's instructions.
2.Additions,alterations or repairs to Group R Occupancies.When the valu-
ation of an addition, alteration or repair to a Group R Occupancy exceeds 51,000
and a permit is required,or when one or more sleeping rooms are added or created
in existing Group R Occupancies,smoke detectors shall be installed in accordance
with Subsections 3, 4 and 5 of this section.
3. Power source. In new construction, required smoke detectors shall receive
their primary power from the building wiring when such wiring is served from a
commercial source and shall be equipped with a battery backup.The detector shall i
emit a signal when the batteries are low.Wiring shall be permanent and without a <`
disconnecting switch other than those required for overcurrent protection. Smoke !3
detectors may be solely battery operated when installed in existing buildings:or in 1
buildings without commercial power; or in buildings which undergo alterations,
repairs or additions regulated by Subsection 2 of this section.
4. Location within dwelling units. In dwelling units, a detector shall be in-
stalled in each sleeping room and at a point centrally located in the corridor or area
giving access to each separate sleeping area.When the dwelling unit has more than
one story and in dwellings with basements, a detector shall be installed on each
story and in the basement. In dwelling units where a story or basement is split into
two or more levels,the smoke detector shall be installed on the upper level.except
that when the lower level contains a sleeping area. a detector shall be installed on
each level. When sleeping rooms are on an upper level,the detector shall be placed
at the ceiling of the upper level in close proximity to the stairway.In dwelling units
where the ceiling height of a room open to the hallway serving the bedrooms ex-
ceeds that of the hallway by 24 inches or more.smoke detectors shall be installed in
the hallway and in the adjacent room. Detectors shall sound an alarm audible in ail
sleeping areas of the dwelling unit in which they are located.
5.Location in efficiency dwelling units,congregate residences and hotels.In
efficiency dwelling units,hotel suites and in hotel and congregate residence sleep-
ing rooms,detectors shall be located on the ceiling or wall of the main room or each
sleeping room. When sleeping rooms within an efficiency dwelling unit or hotel
suite are on an upper level,the detector shall be placed at the ceiling of the upper
level in close proximity to the stairway.When actuated,the detector shall sound an
alarm audible within the sleeping area of the dwelling unit,hotel suite or sleeping
room in which it is located.
